Late payment penalty by developer

Hi all, loan letter of offer and SPA signed more than 6 months ago but loan still not executed, is this normal?

Two possible reasons i am aware of -
1. Developer office/ land office or whatever office is closed during mco
2. Incorrect documents prepared by banker (need to sign additional rectification document), causing delay to the process

Downpayment and legal fees all settled from my end.

Developer is charging late payment penalty now. Can this be waived? Who should be responsible for this situation?
