Robbery victim will have tough time suing Uber, lawyers say

KUALA LUMPUR, May 31 ― Exclusion clauses and Uber’s unique relationship with its drivers could make it difficult for a woman to successfully sue the firm over her robbery on one of its rides, lawyers suggested. Wong Mei Yan, 26, was allegedly robbed last week by an Uber driver and an accomplice, and later suffered a miscarriage of her month-old pregnancy. She announced plans to sue the ride-hailing firm for emotional distress and loss on Saturday.

Speaking to Malay Mail Online, corporate and technology lawyer Edwin Lee noted that the terms and conditions of Uber’s service included a boilerplate clause disavowing all responsibility for any damages resulting from the use of any of its services. “Contractually speaking, Uber will not be liable if something unfortunate happens to their passengers,” Lee said. While acknowledging that transport operators have been found indirectly liable for their employees’ activities before, Lee noted that Uber’s relationship with its drivers was not as clearcut.

He said Uber maintained that drivers in its network were “independent contractors”, although he added that some foreign jurisdictions have rejected this and concluded that Uber is an employer. “In Malaysia, this has not been tested. So, if this lady were to bring the suit, it is going to be an opportunity for our courts to rule on this,” he added. According to civil litigation lawyer Ong Yu Jian, Wong would also need to show that Uber was negligent in recruiting the driver.

The driver from the incident last week has been arrested, but police did not disclose if he has previous criminal records. “Unless she finds evidence that the driver has prior criminal background and Uber did not conduct the necessary background checks on the suspect,’ Ong said.

KL Bar committee member Alex Anton Netto argued, however, that Uber should be responsible for the actions of the drivers despite the existence of the exclusion clause. He further suggested a review of such disclaimers, saying there must not be situations where employers could absolve themselves entirely of liability for actions committed by their hirelings on duty.

“Because what kind of precedent are they setting? Everyone who books rides now would be very worried,” he told Malay Mail Online when contacted.

Despite citing Uber’s disclaimer, Lee said it could be negated by the Consumer Protection Act 1999 if negligence is detected.

Lawyer Fahri Azzat went further to say that exclusion clauses could be nullified by the Act even without negligence.

“I would attack the clause as being void under the Consumer Protection Act 1999. Specifically, Section 24C (for being procedurally unfair) and 24D (for being substantively unfair).

Section 24C states that a contract is procedurally unfair if it results in an unjust advantage to the supplier or the consumer while Section 24D holds that a contractual term is unfair if it is harsh, oppressive, unconscionable, and excludes or restricts liability for negligence without adequate justification. Uber must also prove that it performed due diligence in vetting the driver in question, Fahri said. Wong’s lawsuit, if she proceeds with it, would be the first of its kind in Malaysia, but not in the world.

In 2015, Reuters reported that a woman from New Delhi, India, who alleged she was raped and beaten by a Uber driver, had filed a lawsuit against the ride-hailing company. In her lawsuit, she claimed that Uber failed to maintain basic safety principles. The court filing did not disclose any details on how the case was settled.

Uber declined comment when contacted by Malay Mail Online.

Adam Rosly may face disciplinary action if found guilty: Nurul Izzah

KUALA TERENGGANU: Ampang PKR Youth chief Datuk Adam Rosly may face disciplinary action from his party if convicted on corruption-related charges made against him, two days ago. PKR vice-president Nurul Izzah Anwar in a statement said the party leadership would not compromise on issues involving corruption as the party held strongly to its principles of integrity, transparency and accountability. "The PKR disciplinary committee will take action against any party member found guilty of breaking the law, especially corruption. "Of course, we want those charged (in court) to be given fair treatment. However, if found guilty, the party will respect it (court decision) because integrity, transparency and accountability make up the key to the party.

"Anyone found guilty of violating the laws of Malaysia, including in corruption cases would be tried by the party''s disciplinary committee," she told reporters after the Keadilan Terengganu Convention 2017 here, today. Terengganu PKR chairman Azan Ismail was also present at the convention.

Nurul Izzah, who is also Lembah Pantai MP said this when asked to comment on the case against the 30-year-old Adam, who is also a businessman. Adam was charged at the Sessions Court in Kuala Lumpur two days ago, on six counts of giving false statements and forging documents during the Malaysian Anti-Corruption Commission''s investigation over the former's purchase of a luxury bungalow in Ampang. Commenting on Adam's position as Ampang PKR Youth chief, Nurul Izzah said the matter had been discussed at the Youth wing-level, and it would be discussed at the central leadership soon. - BERNAMA

This is the first time he is directly addressing the matter, having previously declined comment about the emergence of another set of photographs and a video of the two dancing. “No, it’s not me. Australia toughens foreign worker visas, says Australian jobs for Australians

SYDNEY (Reuters) - Australia will abolish a temporary work visa popular with foreigners and replace it with a new programme requiring better English-language and job skills, Prime Minister Malcolm Turnbull said on Tuesday. Turnbull, struggling with poor voter approval ratings, rejected suggestions the visa policy change was in response to far-right wing political parties, such as One Nation demanding more nationalistic policies. But in a Facebook announcement Turnbull said: "Our reforms will have a simple focus: Australian jobs and Australian values."

Turnbull said the visa change would attract better skilled workers and see Australians employed over cheap foreign workers brought in under the old 457 visa programme. "We are an immigration nation, but the fact remains- Australian workers must have priority for Australian jobs," he said. "We'll no longer allow 457 visas to be passports to jobs that could and should go to Australians." The 457 visa was introduced in the 1990s to expedite the entry of business professionals and highly skilled migrants but over time it was opened up to include a broad suite of workers.

The programme has become mired in controversy with allegations the visa was being misused by employers to import workers on the cheap, not to fill genuine skill shortage. "We are bringing the 457 visa class to an end. It's lost its credibility," Turnbull said at a press conference in Canberra. Anyone now in Australia on a 457 visa will not be affected by the new arrangements.

The 457 visa, now used by about 95,000 foreign workers, will be replaced by a new temporary visa and the list of occupations that qualify for a visa will be reduced from more than 200. The new visa will be limited to a two-year period and a second four-year visa will require a higher standard of English language. From 1901 to around 1973, Australia restricted non-white immigration under a White Australia policy which required an English language test.

The Australian Industry Group (Ai Group), which represents more than 60,000 business, said the changes would improve the integrity of Australia's visa programme. "The temporary skilled visa programme should now be considered as settled without the need for further reviews and disruptive policy change," said Ai Group Chief Executive Innes Willox.

Some experts said the government should focus on boosting education and training systems to address Australia's skills needs.

The opposition was not impressed though. Labor leader Bill Shorten tweeted "the only job Malcolm Turnbull cares about saving is his own."

Boeing to lay off hundreds more engineers - source

NEW YORK (Reuters) - Boeing Co warned employees on Monday it planned another round of involuntary layoffs that would affect hundreds of engineers at its commercial airplanes unit, according to a source and a memo seen by Reuters. The latest job cuts followed a prior involuntary reduction of 245 workers set for May 19 as the company responded to increasing competition and slowing aircraft sales. The additional layoffs are due to start June 23, according to the memo from John Hamilton, vice president of engineering at Boeing Commercial Airplanes.

"We are moving forward with a second phase of involuntary layoffs for some select skills in Washington state and other enterprise locations," the memo said. "We anticipate this will impact hundreds of engineering employees. Additional reductions in engineering later this year will be driven by our business environment and the amount of voluntary attrition." Boeing's airplane unit eliminated several hundred engineers through voluntary redundancies announced in January and March.

In a statement, the aerospace and defence company said the extra job cuts would include managers and executives and be achieved through a combination of attrition, voluntary layoffs and in some cases involuntary layoffs. "In an ongoing effort to increase overall competitiveness and invest in our future, we are reducing costs and matching employment levels to business and market requirements," the statement said. It was not immediately clear whether workers at Boeing's Dreamliner factory in South Carolina would be affected.

The first lady is followed by more than 500,000 followers on Instagram, Facebook and Telegram. Last weekend an Instagram account under her name was used to respond to President Donald Trump's air strikes against a Syrian air base, which came in response to a chemical weapons attack by her husband's regime. The post said: "The presidency of the Syrian Arab Republic affirms that what America has done is an irresponsible act that only reflects a short-sightedness, a narrow horizon, a political and military blindness to reality and a naive pursuit of a frenzied false propaganda campaign."

Her husband has also accused the US of fabricating the chemical attack to justify a military strike, even as British investigators confirmed the use of toxic sarin gas. Assad was born to Syrian parents in London and educated at Queens College, a private girls school, and Kings College London, where she graduated with a degree in computer science in 1996.

She is subject to European Union sanctions that make it illegal to render her economic assistance and ban her from travelling in the European Union with the exception of the UK, because she holds British nationality. Removing her UK citizenship is unlikely to be rejected as illegal, because she is understood to be British- Syrian dual national.

Osprey vice president for product line and marketing Rob BonDurant confirmed this with Malay Mail Online. He said his firm has reviewed the clip and found Yee’s behaviour to be “reprehensible”. “In response to the incident, we are engaged in the process of terminating our relationship with this distributor completely. "We made this decision because as a brand, we absolutely oppose any act of inhumane violence or neglect against animals,” he said in an email.

BonDurant said Osprey will appoint a new local distributor soon.

In a clip uploaded online, Yee is seen attacking the dog after it rushed at him while he was cycling and caused him to fall. He was recorded punching the animal before hitting it repeatedly with a motorcycle helmet and later, kicking it. The case is under investigation by the Serdang police and the Department of Veterinary Services. Yee came under intense public criticism after his personal information was exposed together with the video and his business is now the subject of boycotts.

The Singaporean has publicly admitted to being the person shown in the video captured on April 2 and to attacking the dog.

KUALA LUMPUR, Malaysia (AP) — Malaysian property developer Tiah Joo Kim got way more than he bargained for when he signed a licensing deal to use the Trump brand on the Trump International Hotel and Tower that is opening Tuesday in the Canadian city of Vancouver.

Prices for condominiums in the sleek 69-story building designed by one of Canada's top architects have set records. But police are expecting protests by many who object to having a major Trump-branded property as a city landmark when the president's two oldest sons officially open the tower on Tuesday.

Joo Kim's Holborn Development struck the licensing deal before Trump's political ascent. He says he's now "locked" into his licensing agreement, with no legal grounds to back out of the deal, whose terms have not been released.

"There would be severe legal implications," he told The Associated Press in a recent interview.

Joo Kim, 37, is the son of tycoon Tony Tiah Thee Kian, one of Malaysia's richest men and a staunch Christian who built his fortune in stockbroking in the 1990s before expanding into real estate. Groomed to inherit the family business, last year Joo Kim was appointed CEO of its property arm TA Global. He also runs the Canadian-based Holborn Group.

Raised in the Malaysian capital Kuala Lumpur, he studied at Oral Roberts University in Tulsa, Oklahoma, and earned a master's degree in international business at Macquarie University in Sydney, Australia. When he set the deal with Trump in 2013, Joo Kim was banking on the staying power and cachet of his brand. "I wanted a brand that would get me a lot of attention so that the public would, in turn, be impressed with me knowing I am responsible for the product," Joo Kim told the Malaysian newspaper The Star in an interview last year.

He has a picture on Instagram of himself at Trump's Jan. 20 inauguration, along with a picture of his ticket for the Liberty Ball, one of three balls the president attended. Joo Kim has profited from the partnership: TA Global reported it earned $10.4 million from the Vancouver Trump project in 2015, representing 57 percent of its total profit. But in his recent interview with the AP, Joo Kim says he found Trump's statements about Muslims, Mexicans and women "extremely stressful." "I did a lot of soul searching because people were attacking me for it," said Joo Kim.

The Tiah family has endured setbacks and criticism before.In 1999, Joo Kim's father, who is now 70, was charged with abetting a businessman to defraud another brokerage, Omega Securities. In 2002, he was convicted on a reduced charge of providing a false report to the Kuala Lumpur stock exchange. He resigned as head of his financial firm, TA Enterprise. The elder Tiah made a comeback in 2009 with the listing of his property arm, TA Global. The family are devout Christians in a majority Muslim country: Joo Kim's father often preaches at Christian events.

Joo Kim says he chose the Trump brand in part because he felt a bond with Trump's son Donald Jr. "We're both the oldest son and our fathers were really dominant and difficult at times," he said. "We may be OK financially but we didn't get the attention of our parents because our parents were always busy working. But at the same time there's a big expectation to be perfect."

I heard last time from a poster name Wobbles in K, he claim he very rich and got a lot of biz (juicer biz). His wife not working and he not want to have children. So every month he give his mother in law 5k per month and even bought her a big house. But then after some years, wobbles did not know that his mother in law has actually secretly been funding his sister-in-law gambling habits with her allowances wobbles provide every month. Jail, fine for lawyer who abused ex-girlfriend

A corporate lawyer who physically abused her 19-year-old former girlfriend was sentenced to six months and three weeks in jail and fined $1,000. Lydiawaty Abdul Rahman, 32, pleaded guilty on 6 January this year after a 12-day trial. She was found guilty of five charges. According to a Straits Times report, Lydiawaty cut the victim’s forearm with a knife. She also forced her to strip and threatened her to either live in her flat or leave in a “body bag”.

The pair started a relationship after getting to know each other through Craigslist some time in May 2012, but the teenager wanted to end things after Lydiawaty became abusive. On 10 February 2014, the victim went to Lydiawaty’s apartment at Jalan Novena Barat after the latter claimed she was in distress. When the victim arrived, Lydiawaty locked the gate. A heated argument ensued, and Lydiawaty punched the victim, dragged her into the bedroom and forced her to remove her clothes, which she cut up with a pair of scissors. The victim managed to force Lydiawaty out of the room, but was cut on the arm as she tried to close the door of the bedroom. She escaped by climbing out of the window and jumping down to the second floor to seek help at a neighbour’s home.

Lydiawaty will be appealing the sentence, and is currently out on bail.

A Pacific Southwest Airlines jet collides in mid-air with a small Cessna over San Diego, killing 153 people on this day in 1978. The wreckage of the planes fell into a populous neighborhood and did extensive damage on the ground.

David Lee Boswell and his instructor, Martin Kazy, were in the process of a flying lesson in a single-engine Cessna 1732 on the morning of September 25, practicing approaches at San Diego’s Lindbergh Field airport. At the same time, Pacific Southwest Flight 182 was approaching San Diego. The jet, a Boeing 727, was carrying 144 passengers and crew members from Sacramento, after a stopover in Los Angeles. Though air-traffic controllers at Lindbergh had told Boswell to keep the Cessna below 3,500 feet altitude as it flew northeast, the Cessna did not comply and changed course without informing the controllers.

The pilots of Flight 182 could see the Cessna clearly at 9 a.m., but soon lost sight of it and failed to inform the controllers. Meanwhile, the conflict-alert warning system began to flash at the air-traffic control center. However, because the alert system went off so frequently with false alarms, it was ignored. The controllers believed that the pilots of the 727 had the Cessna in view. Within a minute, the planes collided.

Hence TCAS was born to prevent air collision.

Uberlingen mid air collision cause by TCAS & air traffic controller misunderstanding

On 1 July 2002, Bashkirian Airlines Flight 2937, a Tupolev Tu-154 passenger jet; and DHL Flight 611, a Boeing 757 cargo jet; collided in mid-air over the southern German town of Überlingen at local time 21:35 CET. All 69 passengers and crew aboard the Tu-154 and the two crew members aboard the Boeing 757 were killed.

Swiss airspace control company Skyguide has only one air traffic controller handling the airspace, Peter Nielsen, was working two workstations at the same time. He did not realize the problem in time and thus failed to keep the aircraft at a safe distance from each other. Only less than a minute before the accident did he realize the danger and contacted Flight 2937, instructing the pilot to descend by a thousand feet to avoid collision with crossing traffic (Flight 611). Seconds after the Russian crew initiated the descent, however, their traffic collision avoidance system (TCAS) instructed them to climb, while at about the same time the TCAS on Flight 611 instructed the pilots of that aircraft to descend.Had both aircraft followed those automated instructions, the collision would not have occurred.

Devastated by the loss of his wife and two children aboard flight 2937, Vitaly Kaloyev, a Russian architect, held Peter Nielsen responsible for their deaths. He tracked down and stabbed Nielsen to death at his home in Kloten, near Zürich, on 24 February 2004.[18][24] The Swiss police arrested Kaloyev at a local motel shortly after, and he was sentenced to prison for the murder in 2005. He was released in November 2007 because his mental condition was not sufficiently considered in the initial sentence. After his release, Kaloyev was dubbed a hero in North Ossetia. In January 2008, he was appointed deputy construction minister of North Ossetia.

KUALA LUMPUR, Jan 23 ― The trend of ethnic Chinese emigration from Malaysia will result in a smaller private sector, less tax monies for the government and a reduced professional workforce, political analysts said. They also expressed concern over whether demographic changes would be manipulated to reinforce racial and political dominance as well as possible hazards to minority rights if the country’s ethnic composition shifts towards any single community. “The Chinese community is known to be very enterprising and economically vibrant,” independent analyst Khoo Kay Peng told Malay Mail Online.
“The community has been important to the nation’s development. It is a worrying trend for the country,” he added.
Khoo was remarking on the Asian Strategy and Leadership Institute’s (Asli) reported prediction that the ethnic Chinese will drop to about 19.6 per cent of the Malaysian population by 2030 if their emigration trend and low birth rates continue.

The Department of Statistics, however, projected that the Chinese proportion would drop to 20 per cent of the population by 2040 from 24.5 per cent in 2010. The ethnic Indian proportion was expected to reduce by 0.9 percentage points to 6.4 per cent of the population by 2040. The Bumiputra population, however, was expected to grow by 4.8 percentage points to 72.1 per cent by 2040 from 67.3 per cent in 2010. Oh Ei Sun, adjunct senior fellow at Singapore's Nanyang Technological University's S. Rajaratnam School of International Studies, said the trend of implementation of Islamic law and practices in “all aspects of social life” would likely continue in tandem with the decreased non-Muslim population and worldwide Islamist revivalist sentiments. “Besides likely decline in their political rights, the professional human resources of the whole country would similarly be decimated,” Oh told Malay Mail Online. Centre for Policy Initiatives director Lim Teck Ghee said the higher fertility rates of Malay-Muslims and of Muslim foreign workers affected Malay interests, noting that impoverished and large families could strain the community and country. “Proper family planning and birth control will help ensure a higher quality of population and fewer socio-economic problems,” Lim told Malay Mail Online. “In my opinion, a large part of the benefits of the NEP and other Malay-centric policies in the past 30 years has been negated by the much higher Malay rate of population increase,” he added, referring to the pro-Bumiputera New Economic Policy (NEP).

According to the Department of Statistics, the Bumiputra recorded the highest crude birth rate of 20.5 per 1,000 population in 2014, followed by the Indians (11.7), the Chinese (10.9) and others including foreigners (9.6). Merdeka Center director Ibrahim Suffian said minorities ultimately needed to figure out how to work with the Muslim-majority population. “Muslims in Malaysia are not monolithic; they ascribe to many different political ideas,” Ibrahim told Malay Mail Online. “Non-Muslims probably need to accept that Muslims in Malaysia have become more deeply involved in discovering their identity (and all the forms it comes) and that they are not the Malays one reminisces as per the P. Ramlee movies of the past. “Muslims need to realise that non-Muslims are their fellow countrymen with whom they have a shared stake in the country’s continued peace and prosperity,” he added. Universiti Putra Malaysia professor of politics and government Jayum Jawan said Sarawak Dayaks and Sabah’s indigenous people would provide the balance to ensure a multi-ethnic Malaysian society.

“The Dayaks and indigenous may be small in population, but have the legislative strength to ensure this,” he told Malay Mail Online.

Minister: Don’t panic, cops will watch returning

PUTRAJAYA, Jan 20 — Malaysians can rest assured that police will keep a close eye on convicted serial rapist Selva Kumar Subbiah if and when he returns from Canada, Datuk Seri Rohani Abdul Karim said today.

The women, family and community development minister sought to allay concerns following Canadian news reports citing a warning attributed to prison personnel that the 56-year-old Malaysian is a high risk to reoffend or even kill.

“The police have a registry for these kind of offenders. They would definitely monitor,” Rohani told reporters after attending her ministry’s monthly gathering here.

“We should not have a panic in the society [over this matter],” she added.

Chiropractor Causes Complete Paralysis: 46-Y/O

Canadian Sandy Nette recently made a miraculous if lengthy recovery from a complete paralysis brought on by a botched chiropractic adjustment. The Daily Mail reports that the 46-year-old woman suffered from locked-in syndrome after a chiropractor manipulating her neck ripped two vertebral arteries, causing several strokes and leaving her unable to communicate. The incident took place nearly six years ago, in September 2007, when Nette made an appointment to adjust a tense shoulder. Her husband, David, knew the routine visit had gone wrong when his wife called him from the road. “She called saying she'd parked on the roadside but I couldn't really understand what she was saying,” he remembers. “She was always very articulate but her sentences were really weird and she kept saying ‘David, I'm so scared.'

“She said she felt dizzy and her vision had become strange. She would talk and then the line would suddenly go silent.”

When she returned home with a blank, expressionless face, David rushed her to emergency room at the Royal Alexander Hospital, where her condition would continue to deteriorate. Within minutes of arriving, Nette began gagging and convulsing, and her husband was forced to watch in horror as her body started to shut down.

She was locked-in.

“They told me they thought she was going to die and that if she survived, she would be on a ventilator for the foreseeable future,” her husband said. “The doctor asked if a chiropractor had been involved and I said she'd just been to see one. Apparently he had seen a similar case before.”

A Long Road To Recovery

For the first six months, Nette remained completely paralyzed, and was unable to communicate in any way. However, signs of recovery began to appear slowly but surely: three months in, she moved her toe; and after five months, physicians were finally able to remove the suction device in her trachea. Free of life-preserving equipment, Nette was finally ready to begin her long rehabilitation process at the Glenrose Rehabilitation Center. “If they asked Sandy to do five of anything, she would do ten,” said David. “Sandy would push herself to exhaustion. They had to be careful what they asked of her.” “She tried to focus on everything else, though — she just wanted to regain some privacy and independence.” In February 2009, she gradually began to regain her speech. However, the disability severely restricts her ability to communicate like she once did, and she can only walk a few steps without assistance. Although a long road lies ahead, Nette maintains the positive outlook that got her this far. “I like the place where I am today,” she said. “I am not satisfied with where I am physically; but I am enjoying a peace within that defies all logic.” Nette’s chiropractor later admitted under oath to forging her signature on the documents required for the risky manual therapy he performed. He also admitted to perjury and fraud, and was given a three-month suspension. In addition, the Canadian Chiropractic Protection Association will no longer insure him.
