            <description>&lt;b&gt;Robbery victim will have tough time suing Uber, lawyers say&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;KUALA LUMPUR, May 31 ― Exclusion clauses and Uber’s unique relationship with its drivers could make it difficult for a woman to successfully sue the firm over her robbery on one of its rides, lawyers suggested. Wong Mei Yan, 26, was allegedly robbed last week by an Uber driver and an accomplice, and later suffered a miscarriage of her month-old pregnancy. She announced plans to sue the ride-hailing firm for emotional distress and loss on Saturday.&lt;br /&gt;&lt;br /&gt;Speaking to Malay Mail Online, corporate and technology lawyer Edwin Lee noted that the terms and conditions of Uber’s service included a boilerplate clause disavowing all responsibility for any damages resulting from the use of any of its services. “Contractually speaking, Uber will not be liable if something unfortunate happens to their passengers,” Lee said. While acknowledging that transport operators have been found indirectly liable for their employees’ activities before, Lee noted that Uber’s relationship with its drivers was not as clearcut.&lt;br /&gt;&lt;br /&gt;He said Uber maintained that drivers in its network were “independent contractors”, although he added that some foreign jurisdictions have rejected this and concluded that Uber is an employer. “In Malaysia, this has not been tested. So, if this lady were to bring the suit, it is going to be an opportunity for our courts to rule on this,” he added. According to civil litigation lawyer Ong Yu Jian, Wong would also need to show that Uber was negligent in recruiting the driver.&lt;br /&gt;&lt;br /&gt;The driver from the incident last week has been arrested, but police did not disclose if he has previous criminal records. “Unless she finds evidence that the driver has prior criminal background and Uber did not conduct the necessary background checks on the suspect,’ Ong said.&lt;br /&gt;&lt;br /&gt;KL Bar committee member Alex Anton Netto argued, however, that Uber should be responsible for the actions of the drivers despite the existence of the exclusion clause. He further suggested a review of such disclaimers, saying there must not be situations where employers could absolve themselves entirely of liability for actions committed by their hirelings on duty.&lt;br /&gt;&lt;br /&gt;“Because what kind of precedent are they setting? Everyone who books rides now would be very worried,” he told Malay Mail Online when contacted. &lt;br /&gt;&lt;br /&gt;Despite citing Uber’s disclaimer, Lee said it could be negated by the Consumer Protection Act 1999 if negligence is detected.&lt;br /&gt;&lt;br /&gt;Lawyer Fahri Azzat went further to say that exclusion clauses could be nullified by the Act even without negligence.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;“I would attack the clause as being void under the Consumer Protection Act 1999. Specifically, Section 24C (for being procedurally unfair) and 24D (for being substantively unfair).&lt;br /&gt;&lt;br /&gt;Section 24C states that a contract is procedurally unfair if it results in an unjust advantage to the supplier or the consumer while Section 24D holds that a contractual term is unfair if it is harsh, oppressive, unconscionable, and excludes or restricts liability for negligence without adequate justification. Uber must also prove that it performed due diligence in vetting the driver in question, Fahri said. Wong’s lawsuit, if she proceeds with it, would be the first of its kind in Malaysia, but not in the world.&lt;br /&gt;&lt;br /&gt;In 2015, Reuters reported that a woman from New Delhi, India, who alleged she was raped and beaten by a Uber driver, had filed a lawsuit against the ride-hailing company. In her lawsuit, she claimed that Uber failed to maintain basic safety principles. The court filing did not disclose any details on how the case was settled.&lt;br /&gt;&lt;br /&gt;Uber declined comment when contacted by Malay Mail Online.&lt;br /&gt;</description>

Turnbull, struggling with poor voter approval ratings, rejected suggestions the visa policy change was in response to far-right wing political parties, such as One Nation demanding more nationalistic policies. But in a Facebook announcement Turnbull said: &amp;quot;Our reforms will have a simple focus: Australian jobs and Australian values.&amp;quot;&lt;br /&gt;&lt;br /&gt;Turnbull said the visa change would attract better skilled workers and see Australians employed over cheap foreign workers brought in under the old 457 visa programme. &amp;quot;We are an immigration nation, but the fact remains- Australian workers must have priority for Australian jobs,&amp;quot; he said. &amp;quot;We&amp;#39;ll no longer allow 457 visas to be passports to jobs that could and should go to Australians.&amp;quot; The 457 visa was introduced in the 1990s to expedite the entry of business professionals and highly skilled migrants but over time it was opened up to include a broad suite of workers.&lt;br /&gt;&lt;br /&gt;The programme has become mired in controversy with allegations the visa was being misused by employers to import workers on the cheap, not to fill genuine skill shortage. &amp;quot;We are bringing the 457 visa class to an end. It&amp;#39;s lost its credibility,&amp;quot; Turnbull said at a press conference in Canberra. Anyone now in Australia on a 457 visa will not be affected by the new arrangements.&lt;br /&gt;&lt;br /&gt;The 457 visa, now used by about 95,000 foreign workers, will be replaced by a new temporary visa and the list of occupations that qualify for a visa will be reduced from more than 200. The new visa will be limited to a two-year period and a second four-year visa will require a higher standard of English language. From 1901 to around 1973, Australia restricted non-white immigration under a White Australia policy which required an English language test.&lt;br /&gt;&lt;br /&gt;The Australian Industry Group (Ai Group), which represents more than 60,000 business, said the changes would improve the integrity of Australia&amp;#39;s visa programme. &amp;quot;The temporary skilled visa programme should now be considered as settled without the need for further reviews and disruptive policy change,&amp;quot; said Ai Group Chief Executive Innes Willox.&lt;br /&gt;&lt;br /&gt;Some experts said the government should focus on boosting education and training systems to address Australia&amp;#39;s skills needs.&lt;br /&gt;&lt;br /&gt;The opposition was not impressed though. The additional layoffs are due to start June 23, according to the memo from John Hamilton, vice president of engineering at Boeing Commercial Airplanes.&lt;br /&gt;&lt;br /&gt;&amp;quot;We are moving forward with a second phase of involuntary layoffs for some select skills in Washington state and other enterprise locations,&amp;quot; the memo said. &amp;quot;We anticipate this will impact hundreds of engineering employees. Additional reductions in engineering later this year will be driven by our business environment and the amount of voluntary attrition.&amp;quot; Boeing&amp;#39;s airplane unit eliminated several hundred engineers through voluntary redundancies announced in January and March.&lt;br /&gt;&lt;br /&gt;In a statement, the aerospace and defence company said the extra job cuts would include managers and executives and be achieved through a combination of attrition, voluntary layoffs and in some cases involuntary layoffs. &amp;quot;In an ongoing effort to increase overall competitiveness and invest in our future, we are reducing costs and matching employment levels to business and market requirements,&amp;quot; the statement said. On 10 February 2014, the victim went to Lydiawaty’s apartment at Jalan Novena Barat after the latter claimed she was in distress. When the victim arrived, Lydiawaty locked the gate. A heated argument ensued, and Lydiawaty punched the victim, dragged her into the bedroom and forced her to remove her clothes, which she cut up with a pair of scissors. The victim managed to force Lydiawaty out of the room, but was cut on the arm as she tried to close the door of the bedroom. The wreckage of the planes fell into a populous neighborhood and did extensive damage on the ground.&lt;br /&gt;&lt;br /&gt;David Lee Boswell and his instructor, Martin Kazy, were in the process of a flying lesson in a single-engine Cessna 1732 on the morning of September 25, practicing approaches at San Diego’s Lindbergh Field airport. At the same time, Pacific Southwest Flight 182 was approaching San Diego. The jet, a Boeing 727, was carrying 144 passengers and crew members from Sacramento, after a stopover in Los Angeles. Though air-traffic controllers at Lindbergh had told Boswell to keep the Cessna below 3,500 feet altitude as it flew northeast, the Cessna did not comply and changed course without informing the controllers. &lt;br /&gt;&lt;br /&gt;The pilots of Flight 182 could see the Cessna clearly at 9 a.m., but soon lost sight of it and failed to inform the controllers. Meanwhile, the conflict-alert warning system began to flash at the air-traffic control center. However, because the alert system went off so frequently with false alarms, it was ignored. The controllers believed that the pilots of the 727 had the Cessna in view. Within a minute, the planes collided.&lt;br /&gt;&lt;br /&gt;Hence TCAS was born to prevent air collision.&lt;br /&gt;&lt;br /&gt;&lt;u&gt;Uberlingen mid air collision cause by TCAS &amp;amp; air traffic controller misunderstanding&lt;/u&gt;&lt;br /&gt;&lt;br /&gt;On 1 July 2002, Bashkirian Airlines Flight 2937, a Tupolev Tu-154 passenger jet; and DHL Flight 611, a Boeing 757 cargo jet; collided in mid-air over the southern German town of Überlingen at local time 21:35 CET. All 69 passengers and crew aboard the Tu-154 and the two crew members aboard the Boeing 757 were killed.&lt;br /&gt;&lt;br /&gt;Swiss airspace control company Skyguide has only one air traffic controller handling the airspace, Peter Nielsen, was working two workstations at the same time. He did not realize the problem in time and thus failed to keep the aircraft at a safe distance from each other. Only less than a minute before the accident did he realize the danger and contacted Flight 2937, instructing the pilot to descend by a thousand feet to avoid collision with crossing traffic (Flight 611). Seconds after the Russian crew initiated the descent, however, their traffic collision avoidance system (TCAS) instructed them to climb, while at about the same time the TCAS on Flight 611 instructed the pilots of that aircraft to descend.Had both aircraft followed those automated instructions, the collision would not have occurred.&lt;br /&gt;&lt;br /&gt;&lt;u&gt;&lt;b&gt;Aftermath result in murder of air traffic controller&lt;/b&gt;&lt;/u&gt;&lt;br /&gt;Devastated by the loss of his wife and two children aboard flight 2937, Vitaly Kaloyev, a Russian architect, held Peter Nielsen responsible for their deaths. He tracked down and stabbed Nielsen to death at his home in Kloten, near Zürich, on 24 February 2004.[18][24] The Swiss police arrested Kaloyev at a local motel shortly after, and he was sentenced to prison for the murder in 2005. He was released in November 2007 because his mental condition was not sufficiently considered in the initial sentence. After his release, Kaloyev was dubbed a hero in North Ossetia. They also expressed concern over whether demographic changes would be manipulated to reinforce racial and political dominance as well as possible hazards to minority rights if the country’s ethnic composition shifts towards any single community. “The Chinese community is known to be very enterprising and economically vibrant,” independent analyst Khoo Kay Peng told Malay Mail Online. &lt;br /&gt;“The community has been important to the nation’s development. It is a worrying trend for the country,” he added. &lt;br /&gt;Khoo was remarking on the Asian Strategy and Leadership Institute’s (Asli) reported prediction that the ethnic Chinese will drop to about 19.6 per cent of the Malaysian population by 2030 if their emigration trend and low birth rates continue.&lt;br /&gt;&lt;br /&gt;The Department of Statistics, however, projected that the Chinese proportion would drop to 20 per cent of the population by 2040 from 24.5 per cent in 2010. The ethnic Indian proportion was expected to reduce by 0.9 percentage points to 6.4 per cent of the population by 2040. The Bumiputra population, however, was expected to grow by 4.8 percentage points to 72.1 per cent by 2040 from 67.3 per cent in 2010. Oh Ei Sun, adjunct senior fellow at Singapore&amp;#39;s Nanyang Technological University&amp;#39;s S. Rajaratnam School of International Studies, said the trend of implementation of Islamic law and practices in “all aspects of social life” would likely continue in tandem with the decreased non-Muslim population and worldwide Islamist revivalist sentiments. “Besides likely decline in their political rights, the professional human resources of the whole country would similarly be decimated,” Oh told Malay Mail Online.             <description>Canadian Sandy Nette recently made a miraculous if lengthy recovery from a complete paralysis brought on by a botched chiropractic adjustment. The Daily Mail reports that the 46-year-old woman suffered from locked-in syndrome after a chiropractor manipulating her neck ripped two vertebral arteries, causing several strokes and leaving her unable to communicate. The incident took place nearly six years ago, in September 2007, when Nette made an appointment to adjust a tense shoulder. Her husband, David, knew the routine visit had gone wrong when his wife called him from the road. “She called saying she&amp;#39;d parked on the roadside but I couldn&amp;#39;t really understand what she was saying,” he remembers. “She was always very articulate but her sentences were really weird and she kept saying ‘David, I&amp;#39;m so scared.&amp;#39;&lt;br /&gt;&lt;br /&gt;“She said she felt dizzy and her vision had become strange. She would talk and then the line would suddenly go silent.”&lt;br /&gt;&lt;br /&gt;When she returned home with a blank, expressionless face, David rushed her to emergency room at the Royal Alexander Hospital, where her condition would continue to deteriorate. Within minutes of arriving, Nette began gagging and convulsing, and her husband was forced to watch in horror as her body started to shut down. &lt;br /&gt;&lt;br /&gt;She was locked-in. &lt;br /&gt;&lt;br /&gt;“They told me they thought she was going to die and that if she survived, she would be on a ventilator for the foreseeable future,” her husband said. “The doctor asked if a chiropractor had been involved and I said she&amp;#39;d just been to see one. Apparently he had seen a similar case before.”&lt;br /&gt;&lt;br /&gt;A Long Road To Recovery&lt;br /&gt;&lt;br /&gt;For the first six months, Nette remained completely paralyzed, and was unable to communicate in any way. However, signs of recovery began to appear slowly but surely: three months in, she moved her toe; and after five months, physicians were finally able to remove the suction device in her trachea. Free of life-preserving equipment, Nette was finally ready to begin her long rehabilitation process at the Glenrose Rehabilitation Center. “If they asked Sandy to do five of anything, she would do ten,” said David. “Sandy would push herself to exhaustion. They had to be careful what they asked of her.” “She tried to focus on everything else, though — she just wanted to regain some privacy and independence.” In February 2009, she gradually began to regain her speech. However, the disability severely restricts her ability to communicate like she once did, and she can only walk a few steps without assistance. Although a long road lies ahead, Nette maintains the positive outlook that got her this far. “I like the place where I am today,” she said. “I am not satisfied with where I am physically; but I am enjoying a peace within that defies all logic.” Nette’s chiropractor later admitted under oath to forging her signature on the documents required for the risky manual therapy he performed. He also admitted to perjury and fraud, and was given a three-month suspension. In addition, the Canadian Chiropractic Protection Association will no longer insure him.&lt;br /&gt;</description>
