Bekas ketua hakim dakwa istana bertindak tidak selari Perlembagaan

Bekas ketua hakim negara berkata Yang di-Pertuan Agong bertindak di luar kerangka Perlembagaan dalam beberapa peristiwa sepanjang setahun lalu sehingga ke tarikh peletakan jawatan oleh Muyhiddin Yassin, di samping turut menambah beberapa siri tindakan istana boleh ditafsirkan sebagai campur tangan politik.

Bekas ketua hakim Abdul Hamid Mohamad juga turut mempersoalkan apakah keperluan Sultan Abdullah Sultan Ahmad Shah memanggil Raja-Raja Melayu yang lain untuk mempertimbangkan perkara seperti cadangan kerajaan bagi pengisytiharan darurat virus tahun lalu, selain pelantikan Ismail Sabri Yaakob sebagai perdana menteri bulan lalu.

“Perlembagaan tidak memberi Raja-Raja Melayu apa-apa peranan dalam pelantikan Perdana Menteri. Paling kurang, bolehlah dikatakan mesyuarat itu tidak perlu. Sebaliknya, dengan mengadakan mesyuarat itu, ia memberi gambaran seolah-olah Yang di-Pertuan Agong tidak boleh membuat keputusan sendiri,” kata Hamid, yang bersara sebagai ketua hakim pada 2008 setelah lebih 50 tahun berkhidmat dalam badan kehakiman negara dalam analisis 11 halaman yang ditulisnya mengenai krisis politik sejak setahun lalu.

Hamid berkata, peristiwa 2020 dan 2021 yang menyaksikan istana menentang nasihat kerajaan pada masa itu boleh menjadikan urusan undang-undang yang mudah menjadi rumit.

“Keadaan menjadi lebih buruk apabila Raja-Raja, bukan sahaja tidak mengikut nasihat, di mana Perlembagaan memperuntukkan mereka kena berbuat demikian, tetapi melakukan sesuatu di luar Perlembagaan dan menitahkan sesuatu yang bercanggah, apatah lagi sesuatu yang bersifat politik, yang digunakan oleh pembangkang untuk mencapai kehendak mereka.

“Maka, betul atau tidak, nampaklah seolah-olah Raja berada di satu pihak dan Kerajaan di satu pihak lagi,” katanya.

Beliau memetik beberapa kenyataan media yang dikeluarkan oleh Istana Negara, mengatakan ia memberikan gambaran wujud campur tangan istana dalam politik.

Hal ini, katanya, turut termasuk gesaan awal Agong bulan lalu agar usul undi percaya dibentangkan bagi mengesahkan sokongan kepada orang yang sudah dinamakan beliau sebagai perdana menteri.

Ex-1MDB CEO confirms Jho Low was actual CEO, claims PM Najib put up ‘drama’ despite knowing funds disappeared

KUALA LUMPUR, Aug 17 — A former CEO of 1Malaysia Development Berhad (1MDB) today confirmed to the High Court that he was effectively “led by the nose” as he took instructions from businessman Low Taek Jho who was virtually the real CEO of the government-owned company.

Former 1MDB CEO Mohd Hazem Abd Rahman however explained his belief that instructions from Low — better known as Jho Low — were actually the same as instructions from Datuk Seri Najib Razak who was the prime minister then.

Mohd Hazem also told the court today that this was proven through events such as Low’s presence at a meeting with the prime minister on 1MDB affairs. This was despite Low not having any official 1MDB positions.

Mohd Hazem went on to assert his belief that Najib as the prime minister was part of Low’s “scheme” for 1MDB, also claiming that Najib had allegedly known that 1MDB’s funds had gone missing but that the then prime minister was purportedly putting on a “drama” by allegedly pretending to enquire about the funds’ status.

Malaysian satellite to fall from space after mystery incident, says report

A Malaysian communications satellite launched into space some 15 years ago will be de-orbited after suffering an unexplained issue in June which left it out of commission.

Space.com reported that Measat-3 was put under ground control on June 24 after an unknown incident three days earlier which left it “playing dead”.

Space tracking company ExoAnalytic Solutions meanwhile estimated in the report that the satellite had been “tumbling in its orbit since at least July 1”.

“Further testing and recovery efforts found that the satellite could not re-enter service,” the report quoted Measat as saying in an update from the company.

Measat-3 was launched on Dec 11, 2006 from the Baikonur Cosmodrome in Kazakhstan. It was ordered by Measat Satellite Systems Sdn Bhd in March 2003.

An investigation into the cause of its inoperability is underway by Measat and Boeing, with ExoAnalytic Solutions noting no evidence of an in-space collision or near-term collision risk with other objects in space.

KOTA KINABALU: A PAS member has been appointed to the Sabah assembly despite strong objections from Gabungan Rakyat Sabah (GRS) leaders.

Perikatan Nasional (PN) deputy president and Parti Solidariti Tanah Airku (Star) president Datuk Jeffrey Kitingan had also previously claimed that such an appointment was merely fake news.

Parti Bersatu Sabah (PBS), which is part of GRS, had previously objected to having a PAS member in the assembly due to local sentiments and because the party had not taken part in the 16th state election.

Sabah PAS secretary Dr Aliaakbar Gulasan, who is also a senior lecturer at Universiti Malaysia Sabah, has since been listed among six appointed assemblymen.

MRT: No reason to worry, gap in concrete guideway is part of the design

The concrete parapet piece at the MRT Kajang Line near the Kota Damansara station is properly and securely fixed and the gap which can be seen is part of the design.

In a joint statement Friday (Sept 25), MRT Corp and Rapid Rail Sdn Bhd – the operator of the MRT Kajang Line – confirmed that it was safe based on an inspection of the section of the elevated guideway.

MRT Corp said that the gap that can be seen between the parapet pieces are designed as such and placed at an angle to each other to cater to the widened guideway near the station.

They assured the public that there was no cause for concern as there is no risk of the parapet piece being dislodged.

WASHINGTON (AP) — The Justice Department has charged five Chinese citizens with hacks targeting more than 100 companies and institutions in the United States and abroad, including social media and video game companies as well as universities and telecommunications providers, officials said Wednesday.

The five defendants remain fugitives, but prosecutors say two Malaysian businessmen charged with conspiring with the alleged hackers to profit off the attacks on the billion-dollar video game industry were arrested in Malaysia this week and now face extradition proceedings.

The indictments are part of a broader effort by the Trump administration to call out cybercrimes by China. In July, prosecutors accused hackers of working with the Chinese government to target companies developing vaccines for the coronavirus and of stealing hundreds of millions of dollars worth of intellectual property and trade secrets from companies across the world.

After retesting samples, French hospital discovers COVID-19 case from December

PARIS (Reuters) - A French hospital which has retested old samples from pneumonia patients discovered that it treated a man who had COVID-19 as early as Dec. 27, nearly a month before the French government confirmed its first cases.

Yves Cohen, head of resuscitation at the Avicenne and Jean Verdier hospitals in the northern suburbs of Paris, told BFM TV that scientists had retested samples from 24 patients treated in December and January who tested negative for the flu. "Of the 24, we had one who was positive for COVID-19 on Dec. 27," he told the news channel on Sunday.

The samples had all initially been collected to detect flu using PCR tests, the same genetic screening process that can also be used to detect the presence of the novel coronavirus in patients infected at the time the sample is collected.

Each sample was retested several times to ensure there were no errors, he added. Neither Cohen nor his team were immediately available for comment on Monday. France, which has seen almost 25,000 people die from the virus since March 1, confirmed its first three COVID-19 cases on Jan. 24, including two patients in Paris and another in the southwestern city of Bordeaux.

Cohen said it was too early to know if the patient whose Dec. 27 test was COVID-19 positive is France's "patient zero". Knowing who was the first is critical to understanding how the virus spread. Cohen said the patient had survived and that a first investigation to trace the first contamination has been carried out. "He was sick for 15 days and infected his two children, but not his wife, who works in a supermarket.

"He was amazed, he didn't understand how he had been infected. We put the puzzle together and he had not made any trips. The only contact that he had was with his wife." The man's wife worked alongside a Sushi stand, close to colleagues of Chinese origin, Cohen said. It was not clear whether those colleagues had travelled to China, and the local health authority should investigate, he said.

"We're wondering whether she was asymptomatic," he said. "He may be the 'patient zero', but perhaps there are others in other regions. All the negative PCRs for pneumonia must be tested again. The virus was probably circulating (then)," he said.

Covid-19: Patient 26's higher infection rate could be due to virus mutation

PETALING JAYA: A more aggressive mutation of the Covid-19 virus is believed to be the cause for the higher infection rate of cases linked to Patient 26, say the Health Ministry.
Health director-general Datuk Dr Noor Hisham Abdullah said the Institute for Medical Research (IMR) had found a mutation that might have caused the virus to become more aggressive in the case of Patient 26.

“At IMR, we carried out virus isolation and also cultured the virus.
"For instance, in the case of Patient 26, we have studied the virus and found that there was a mutation.
“It may be that this mutation has made the virus more aggressive, and it has spread and infected about 120 people, ” he said in a daily press briefing on Wednesday (April 29).
Patient 26 is UDA Holdings Bhd chairman Datuk Hisham Hamdan who was Shanghai in the middle of January, though he denied he contracted the virus there.

He started to develop symptoms on Feb 27, tested positive for Covid-19 on Feb 29 and was immediately warded at the Sungai Buloh Hospital.
Dr Hisham added that the IMR’s role was not only to conduct tests for Covid-19 but to also focus on researching the virus and its different strains.
“We see that for the first wave of infections and the initial stages of the second wave, the virus in our cases were of strain B, which come from Wuhan.
“This is different from strain A, which is linked to most cases in the United States, and for Europe it is strain C, ” he said.

Singapore civil servant arrested for leaking info on Covid-19 cases

SINGAPORE (The Straits Times/ANN): A civil servant has been arrested after she allegedly shared the number of new Covid-19 cases in Singapore with members in a private group who were not authorised to see the information.

In a statement on Thursday (April 23), the police said that they have arrested the 35-year-old Singaporean woman under the Official Secrets Act and Computer Misuse Act.

The police received a report on the incident on April 16 at 7.43pm, from a member of the public that the number of daily confirmed cases of Covid-19 in Singapore for that day had been leaked on an Instagram story post, even though the Ministry of Health (MOH) had not officially released the figure.

Preliminary investigations found that the woman had shared the number of new Covid-19 cases for April 16 – which was 728 – with members in an online private WeChat group who were not authorised to receive the classified information.

The members of the group then disseminated the information before MOH officially released the announcement in its daily update.

Further investigations found that the woman had shared the daily Covid-19 case figures with the WeChat group on several other occasions.

The civil servant also accessed a Government Covid-19 database without authorisation, to retrieve confidential records of a patient who tested positive for the virus, and gave the information to her friend.

ANGKA kematian akibat pandemik COVID-19 di United Kingdom (UK) dilaporkan tidak memberi refleksi sebenar kepada jumlah korban negara itu kerana ia tidak mengambil kira kesemua kematian di pusat jagaan warga emas.

Pejabat Statistik Kebangsaan negara itu menyatakan bahawa jumlah kematian sebenar adalah sekurang-kurangnya 10 peratus lebih tinggi berbanding angka yang dilaporkan, iaitu 12,107 setakat Selasa.
Lebih 2,000 pusat jagaan warga emas, iaitu 13 peratus daripada jumlah keseluruhan negara itu, telah merekodkan kes positif COVID-19, menurut Dr Chris Witty, ketua penasihat perubatan kerajaan.

Menurut Care England, sebuah badan kebajikan, dianggarkan hampir 1,000 kematian akibat COVID-19 di pusat jagaan warga emas.

A conspiracy theory linking 5G technology to the outbreak of the coronavirus is quickly gaining momentum, with celebrities including actor Woody Harrelson promoting the idea. But the theory is also getting a boost from what some researchers say is a coordinated disinformation campaign.

Marc Owen Jones, a researcher at Hamad bin Khalifa University in Qatar, who specialises in online disinformation networks, analysed 22,000 recent interactions on Twitter mentioning "5G” and “corona”, and said he found a large number of accounts displaying what he termed “inauthentic activity”. He said the effort bears some hallmarks of a state-backed campaign.

Jones said the campaign uses a strategy similar to Russia’s Internet Research Agency, which was behind a disinformation campaign during the 2016 US presidential campaign. But he said he hasn’t yet concluded that Russia, or any other government or organisation, is behind the effort.

Mobile towers torched due to claims that 5G spreads COVID-19

The problem with the COVID-19 outbreak is not just the disease but also misinformation that’s circulated online. In the UK, it is reported that two mobile towers were set on fire due to conspiracy theories that 5G has “accelerated” the spread of the coronavirus.

According to the BBC, a tower in Sparkhill, Birmingham was set on fire on Thursday and another tower in Melling, Merseyside was torched on Friday. It isn’t clear if both towers were actually providing 5G coverage but Mobile UK, a body that represents telcos have shared that false rumours and theories were “concerning”.

KOTA KINABALU: Students needing to stay in quarantine centres provided by the state government after coming back from overseas are concerned and not willing to do so after seeing the less than conducive state of the centres.

This was voiced by a recent group of students who returned from London and were shown the quarantine centres.

However, after discussions with the authorities, they were allowed to check into selected hotels as long as they paid for the rooms themselves.

One of the student’s parents, Sheilla Chong, said that her daughter and friends were asked to head straight to one of the quarantine centers upon arrival but they refused to stay there as the place was dirty and cramped.

Covid-19: Malaysia’s response can be a lesson to US, says American assoc prof

PETALING JAYA: Malaysia's nationwide response can be a model for other countries to help flatten the curve of the Covid-19 pandemic, says an American academic, Jason Hassenstab.

Hassenstab, an associate professor of neurology at Washington University, Missouri, acknowledged that his was a poorly-timed trip to Malaysia, but praised the nation’s response to the virus and suggested that the United States could emulate these measures.

“I noticed some stark contrasts between Malaysia and the US. In Malaysia, we went to four cities – Kuala Lumpur, Kota Kinabalu, Lahad Datu and Sandakan.

“The enforcement was evident everywhere, even in the remote rainforest where we were staying.

“Mobile carriers send a message about social distancing every day. The carrier ID at the top of my phone that normally says Sprint said 'Stay Home' instead,” he said in a series of posts on Twitter.

Hassenstab gave a few other examples, noting the scenes at the Kuala Lumpur International Airport (KLIA) with security guards enforcing social distancing.

KOTA KINABALU: Twelve Sabahans who were in Sulawesi, Indonesia for a tabligh gathering, were taken straight to quarantine and tested for Covid-19 when they arrived home.

The 12 men were believed to have arrived in Tawau on Saturday (March 21) evening.

According to sources, security forces including marine police and Malaysia Maritime Enforcement Agency, among others, escorted them back to Tawau via sea routes.

The source said they had received information that the group was planning to come back after reaching Sg Pancang Pulau Sebatik, Indonesia from Sulawesi at about 9.50am the same day.

"Our forces went to the island to check on the information and brought them back," the source said.

PETALING JAYA: Three members of the Damansara Utama Methodist Church (DUMC) have been tested positive for Covid-19.

The three are Datin Doris Ho, the wife of Pastor Datuk Dr Daniel Ho, and two other members of a Bible study group.

According to a circular sent to members, the church had contacted all members of the group in Bangsar, Kuala Lumpur who were now monitoring themselves in self-quarantine and had also sent samples for testing.

It said the church, one of the largest in the country, is assisting the Health Ministry to trace those who might have come into contact with the trio recently.

Daniel said he and his wife were tested on Friday (March 20).
