Hi all,

Previously I lodged a court case under IR which I was unfairly dismissal during probation.
The first court date is set, which will be done online.

Im not sure whether it is a proper court case but in the email it says " Dimaklumkan bahawa penetapan sebutan kes ini akan diadakan secara dalam talian (e-Sebutan) pada...."

I guess this is just giving explanation before escalating to proper Judge?
Anything I need to be careful?

Not allowed to serve notice period & 0 compensatio

I have a 1 year contract with a company.

After working for 3 months, out of sudden got told terminated verbally with immediate effect.

By the contract signed, there is a notice period of 1 month/or salary. Now cant serve notice period and no compensation in lieu thereof.

Can I lodge a case at IR?

TLDR Version:
Salary over RM2k. No offer letter signed as chinaman boss said "dont worry just work first" (I have copies of their standard offer letter). Probation 2 months. Worked 5 weeks. Fired on 24hours notice. Yesterday, chinaman boss walked in say, "blablabla, you are fired, pack your things, unpaid salary will pay later after 25th cut off". No termination letter. Reason given verbally is personal culture clash with company's.

How strong is my case?

I come from a small town from West Malaysia. Weeks ago, I saw internal posting about this job, the pay is okay-ish. I enquired and interviewed on Zoom. Got hired and I packed my things and come to KL.

First day, chinaman boss showed me the offer letter, it is totally what not they promised basically with element of deferred salary and I smell some grey area. I told the boss "I come all the way to KL to your office and I expect to receive the salary which is advertised and promised by the HR cum Operation Head cum Boss's assistant". Chinaman boss said "since you already come here well just work first". I say I will need to think but I will start working tomorrow. Boss agreed. Roughly 2 weeks later, I felt like without offer letter signed its quite dangerous to me in legal sense. I asked the HR cum Operation Head cum Boss's assistant I want the offer letter signed, she said "Boss is not here, he has a lot business blablabla, dont worry you just work we will pay you the salary"

Between some time later, I argued with the boss on phone about their salary payment which he said "I dont scare you I dare put there it must be legal, lets go to court if not". I knew after that, I not gonna continue after probationary...

And the rest is history....

Boss said, " after a month of evaluation, I think you are not suitable for the job, ..."
I said, "What is the exact thing the exact problem about myself you have?"
Boss: "I think your personal culture, upbringing lead you not suitable for this job. Didnt even point out where the faults only talk about generality"
I: "Okay now I know where the problems are and we are here to solve problems aren't we. So after today thanks to your advice I will improve and do A,B,C to show myself I can improve since I still have some weeks left for the probation period."
Boss: "short pain is better than long pain"
I:"So you are not giving me any chance to improve and none of you guys told me where was my problem before and expect me to do everything that is according to your expectation and the so called policy which is never put down in words?"
Boss: "Yes anyway you are fired, unpaid salary will be given when the company clear it, you can ask my assistant she will assist you"
I: " I think this is not quite legal in a way, that I saw from internet, unless the reason is like sexual harassment, performing too badly, retrenchment, you cant fired people just like that"
Boss: "if you think they are not legal, fine just go to sue me, I wait you"
...

Update:
A lot hours wasted today. Wait more than an hour for the printing shop to open. Wait an hour ended up queued in wrong floor (wrong claim), lunch time...

First time, the officer not interested in your story or whatever they just want to see your offer letter and then termination letter, give you a paper you go fill up, and go Lobby and print it. Thats all.

So now I have to wait for the next stage.

What cards I can play is:
- Terminate verbal without black and white
- Unlawful dismissal
- No EPF/SOSCO Contribution

My disadvantage:
- No proper signed offer letter (but has evidence proof I worked)
- Still in probationary period

I guess I can only wait until next session where I can tell the story. Because the first officer today he said he cant hear 1-sided story so not interested to hear too much. So I cannot find out how strong is my case etc

Just received schedule for conciliation meeting. 2 weeks later
Monday filed, Wednesday scheduled.

I asked for 3 months compensation, they turned down and insist at paying nothing and no reinstatement. Its going to escalate to second stage
