            <title>MALAYSIA SHOULD EMBRACE COMPLIANCE ON ITS OVERLAPP</title>

            <description>MALAYSIA SHOULD EMBRACE COMPLIANCE ON ITS OVERLAPPING CONTINENTAL SHELF CLAIM&lt;br /&gt;&lt;br /&gt;Recently, international observers have been puzzled to see Malaysia undertaking oil and gas operations in the overlapping extended continental shelf area defined by its 2009 joint submission with Vietnam to the Commission on the Limits of the Continental Shelf (CLCS). As reported by AMTI, the West Capella, a drillship contracted by Malaysian national oil and gas company Petronas, entered and began operations within the “Joint Defined Area” on December 21, 2019. This move has provoked a three-way standoff between Malaysia, China, and Vietnam involving warships, coastguard, militia, and civilian vessels. Why would Malaysia choose to ignore its 2009 joint submission with Vietnam and undermine ASEAN solidarity?&lt;br /&gt;&lt;br /&gt;Whatever its motivations, Malaysia should err on the side of caution. Instead of venturing into undertakings in the Joint Defined Area which may not be lawful, Malaysia should consider doing what is certain to be consistent with international law.&lt;br /&gt;&lt;br /&gt;Unilateral Exploration May Be Unlawful&lt;br /&gt;&lt;br /&gt;Under the United Nations Convention on the Law of the Sea (UNCLOS), the Joint Defined Area between Malaysia and Vietnam should be considered as having “pending status” on two fronts. First, it is a continental shelf pending delimitation between states with opposite or adjacent coasts. And second, it is an extended continental shelf claim beyond 200 nautical miles which is still awaiting recommendations from the CLCS.&lt;br /&gt;&lt;br /&gt;Concerning the first category, UNCLOS requires relevant states not to jeopardize or hamper the reaching of a final agreement on delimitation. International tribunals have recognized this as an obligation to avoid unilateral invasive activities in undelimited areas. In the Guyana/Suriname case in 2007, the arbitral tribunal stated that unilateral exploratory drilling in an undelimited or disputed area which causes physical change to the marine environment may jeopardize or hamper the reaching of a final agreement on delimitation. The arbitral tribunal found that less invasive exploratory activity in a disputed area, such as seismic surveying, could be permissible.&lt;br /&gt;&lt;br /&gt;In the more recent Ghana/Côte d’Ivoire case, the International Tribunal for the Law of the Sea (ITLOS) allowed preexisting unilateral operations to continue in disputed areas pending the judgement of the tribunal, but prohibited new drilling. The tribunal found in its 2017 judgement that drilling undertaken by Ghana had not prejudiced Côte d’Ivoire’s sovereign rights, but only because the area in question was ultimately attributed to Ghana, which had acted in good faith on that assumption. If the tribunal had delimited the maritime boundary in favor of Côte d’Ivoire, then Ghana’s unilateral operations would have indeed prejudiced Côte d’Ivoire’s sovereign rights.&lt;br /&gt;&lt;br /&gt;Given that the West Capella is a drillship, it can be assumed that Malaysia is engaged in unilateral drilling, not just less invasive surveys. Malaysia might be assuming in good faith that the part of the Joint Defined Area in question would be awarded to it in any eventual delimitation. But it also recognized that the area is disputed when it made the joint submission to the CLCS in 2009, so undertaking new drilling in the area now falls short of the precedent set by Ghana/Côte d’Ivoire.&lt;br /&gt;&lt;br /&gt;Regarding extended continental shelf areas beyond 200 nautical miles, UNCLOS remains silent on what rights and obligations coastal states have while their claims are still pending recommendations from the CLCS. International tribunals have so far only provided very general guidance on that subject, finding that activities should not prejudice the rights of third parties or the international community. Given that the Joint Defined Area lies in disputed waters and has not received a recommendation from the CLCS, would unilateral exploration be considered an activity that prejudices those rights? The answer may again depend on whether the operation causes physical change to the marine environment. In the case of drilling, the answer would certainly be yes.&lt;br /&gt;&lt;br /&gt;Delimitation: The Safer Course&lt;br /&gt;&lt;br /&gt;A closer look at judgments and awards from international tribunals relating to extended continental shelf claims that are awaiting recommendations from the CLCS shows that one activity that is surely consistent with international law is the delimitation of this area between the states involved. Various tribunals have stated that delimitation does not prejudice the rights and interests of third-party states or the international community. Nor can it be seen as encroaching on the function of the CLCS because the commission’s role in delineating the outer limits of the continental shelf is distinct from delimiting its lateral limits between two states. ITLOS was clear on the matter in its judgement in Bangladesh/Myanmar: “There is nothing in the Convention [i.e. UNCLOS] or in the Rules of Procedure of the Commission [i.e. CLCS] or in its practice to indicate that delimitation of the continental shelf constitutes an impediment to the performance by the Commission of its functions.”&lt;br /&gt;&lt;br /&gt;From this perspective, Malaysia could begin discussions with Vietnam about delimiting the Joint Defined Area. The two countries could choose to do it by way of negotiations or adjudication. While the greater degree of control over the process offered by negotiation seems to make it the preferred practice for maritime delimitation for South China Sea states, adjudication has some important advantages for Malaysia in this case. First, it could be faster. Boundary negotiations can last for decades without agreement whereas ITLOS or an ad hoc arbitral tribunal would take about three years to reach a decision. Second, Malaysia has significant experience in settling maritime disputes using third party mechanisms, having initiated four different proceedings, one of which involved both ITLOS and arbitration under Annex VII of UNCLOS (i.e. the case concerning Land Reclamation in and around the Straits of Johor). Last but not least, a decision from an international tribunal could help reinforce the validity of the joint submission made by Malaysia and Vietnam. In cases such as Bangladesh/Myanmar and Ghana/Côte d’Ivoire, ITLOS went so far as to examine relevant parties’ submissions to the CLCS itself to conclude that they had entitlements to an extended continental shelf beyond 200 nautical miles even when the CLCS had not yet issued a recommendation.&lt;br /&gt;&lt;br /&gt;Delimitation may be a slower and less eye-catching way for Malaysia to affirm its sovereign rights and jurisdiction in the Joint Defined Area than simply undertaking unilateral drilling. But it is the only way forward that is guaranteed to be lawful. Even more importantly, it can help avoid confrontations like the current three-way standoff, which carries a risk of instigating a larger conflict and undermines ASEAN unity.&lt;br /&gt;&lt;br /&gt;&lt;a href='https://amti.csis.org/malaysia-should-embrace-compliance-on-its-overlapping-continental-shelf-claim/' target='_blank'&gt;https://amti.csis.org/malaysia-should-embra...al-shelf-claim/&lt;/a&gt;</description>

            <description>**Terbukti Lakukan Illegal Logging, 5 Warga Malaysia Ditangkap**&lt;br /&gt;&lt;br /&gt;PONTIANAK- tniad.mil.id – Satgas Pamtas Yonif 320/Badak Putih yang bertugas melaksanakan operasi pengamanan Perbatasan RI – Malaysia di sektor timur antara wilayah Kalimantan Barat – Sarawak, telah menangkap lima warga Malaysia pada 11 Desember lalu karena melakukan kegiatan illegal logging tepatnya di sekitar Patok G.648 yang merupakan wilayah tanggung jawab pengawasan Pos Pamtas Enteli.&lt;br /&gt;Hal tersebut dikatakan oleh Kepala Penerangan Kodam (Kapendam) XII/Tanjungpura Kolonel Inf Aulia Fahmi Dalimunthe, S.Sos., kepada awak media di Media Center Kodam XII/Tpr, Jalan Teuku Umar, Kota Pontianak, Minggu (23/12/2018) .&lt;br /&gt;“Berdasarkan laporan dari Komandan Satgas (Dansatgas) Pamtas RI-Mly Yonif 320/BP, Letnan Kolonel Inf Imam Wicaksana bahwa penangkapan lima Warga Negara Malaysia tersebut dilakukan saat mereka sedang memuat balok-balok kayu jenis tekam hasil illegal logging ke atas kendaraan.&lt;br /&gt;Ini merupakan tindak lanjut dari pelaksanaan patroli yang dilakukan beberapa hari sebelumnya oleh personel Pos Enteli yang menemukan sisa-sisa balok kayu, jerigen BBM dan botol aqua berisi pelumas serta tonggak kayu yang telah ditebang di wilayah Indonesia yang berada sekitar Patok G.647 – G.648,” jelas Kapendam.&lt;br /&gt;Selanjutnya kelima Warga Negara Malaysia yang ditangkap tersebut dibawa ke Pos Enteli beserta kendaraan Toyota Hilux SC Noreg QAA 1282 T dan sekitar 1 m³ balok kayu sebagai barang bukti guna diadakan pemeriksaan lebih lanjut.&lt;br /&gt;Kapendam XII/Tpr juga menjelaskan, saat dilakukan pemeriksaan kepada lima warga Malaysia tersebut, mereka mengakui telah melakukan illegal logging di wilayah Indonesia.&lt;br /&gt;Terkait terjadinya penangkapan tersebut, Kolakopsrem 121/Abw, pada tanggal 12/12/2018 melakukan koordinasi dengan Brigade 3 TDM dan selanjutnya dilaksanakan pengecekan bersama di lapangan antara kedua Pos Pamtas dari kedua negara.&lt;br /&gt;Dalam pengecekan yang dilaksanakan di kawasan sekitar Patok G.647, G.648 dan G.649, hadir dari pihak TDM antara lain Mej Frankie Ak Jika (Pegawai 2 Gerak MK 3 Briged TDM) dan Mej Amirul Nazimi bin Jarani (Pegawai Gerak 10 RRD) beserta 15 orang anggota TDM lainnya bersama-sama personel Pos Enteli satgas Yonif 320/BP.&lt;br /&gt;“Saat dilakukan pengecekan dilokasi penebangan kayu ditemukan bukti-bukti berupa sisa-sisa balok kayu, serbuk gergaji dan tunggul kayu bekas penebangan pohon serta ditemukan adanya jalan masuk mobil menuju Patok G648 yang sebelumnya merupakan jalur yang tidak dapat dilalui kendaraan roda empat,” terang Kapendam XII/Tpr.&lt;br /&gt;Lebih lanjut dijelaskan oleh Kapendam XII/Tpr, setelah dilakukan pengecekan patok dan lokasi bekas penebangan pohon, dilakukan penyerahan empat warga Malaysia yang ditahan di Pos Pamtas Enteli Satgas Pamtas Yonif 320/BP oleh Danpos Enteli Serka Ricki Hardadi kepada Danpos Balaring TDM Letnan Faiz yang disertai bukti penyerahan tahanan atas nama Leoni (15), Roby (30), Willy (17) dan Langgong (50).&lt;br /&gt;Saat dilakukan penyerahan tahanan, kondisi para.pelaku dalam keadaan sehat. Satu hari sebelumnya, atas dasar rasa kemanusiaan telah dilepaskan satu warga Malaysia atas nama Sanjan (65) Wakil Kepala Dusun Malikin, dengan maksud untuk menyampaikan berita penangkapan kepada pihak keluarganya .&lt;br /&gt;Menindaklanjuti kejadian tersebut pada tanggal 16/12//2018, Wadan Satgas Pamtas Yonif 320/BP, Mayor Inf Widhitama Dwi Chandra mengikutsertakan personel Pos Pamtas Enteli didampingi Ketua ILO TNI Kuching, Letkol Inf Doddy Darmawan beserta personel TDM yang dipimpin langsung Ketua Staf MK Brigade 3 Letkol Ilyas bin Hanafi beserta beberapa personel staf dan jajarannya antara lain Letkol Anuar (Pegawai Memerintah 10 RRD), Mej Amirul Nazimi bin Jarani (Pegawai Gerak 10 RRD), Mej Frankie Ak Jika (Pegawai 2 Gerak MK 3 Briged), Lt Faiz (Danpos Balai Ringin TDM) dan 11 anggota TDM lainnya.&lt;br /&gt;“Dalam kesempatan pengecekan bersama tersebut disepakati penyelesaian secara kekeluargaan atas kasus illegal logging yang terjadi dan tidak ada tuntutan apapun dari kedua pihak di kemudian hari,” tutur Kapendam XII/Tpr.&lt;br /&gt;Menanggapi adanya pemberitaan yang disiarkan melalui media Malaysia terkait penangkapan lima orang warga negara Malaysia tersebut, lebih lanjut Kapendam XII/Tpr menyanggah keras pemberitaan tersebut.&lt;br /&gt;“Adanya tuduhan bahwa personel Pos Enteli Satgas Yonif 320/BP telah melakukan penculikan terhadap lima orang warga Negara Malaysia dan meminta sejumlah uang sebagai tebusan sama sekali tidak benar. Bahkan berdasarkan penuturan Danpos Enteli Serka Ricky Hardadi kepada Dansatgas Yonif 320/BP, beberapa jam setelah dilakukan penangkapan terhadap pelaku illegal logging datang seorang warga Malaysia atas nama Isyak ke Pos Enteli dan menyampaikan bahwa aktivitas pengambilan kayu di wilayah tersebut sebenarnya sudah sejak lama dilakukan warga Negara Malaysia dan tidak pernah ditangkap,” terangnya.&lt;br /&gt;Pada kesempatan tersebut Isyak sempat menawarkan sejumlah uang ringgit untuk melepas lima orang yang ditangkap, namun tidak ditanggapi oleh Danpos Enteli.&lt;br /&gt;Isyak lebih lanjut meminta salah satu pelaku yang ditangkap untuk dilepaskan. Permintaan ini akhirnya diluluskan oleh Danpos atas pertimbangan kemanusiaan dan dengan harapan dapat memberitahukan kepada keluarganya atas penangkapan yang telah dilakukan.&lt;br /&gt;Sesungguhnya telah sejak lama terjalin hubungan kerjasama dan koordinasi yang baik dan harmonis antara kedua pihak yang melaksanakan tugas pengamanan perbatasan kedua negara, khususnya antara Korem 121/Abw selaku Kolakops Pamtas RI-Malaysia dan jajarannya dengan pihak 3 Briged TDM maupun antara Kodam XII/Tpr selaku Koops Pamtas RI-Malaysia dengan 1 Divisyen TDM. Bahkan beberapa hari sebelum peristiwa penangkapan telah dilaksanakan kegiatan Unit Commander’s Meeting Seri-2/2018 antara Delegasi Kolakopsrem 121/Abw dengan Delegasi Brigade 3 TDM di Pontianak – Kalimantan Barat.&lt;br /&gt;Dalam kegiatan yang rutin dilaksanakan tersebut disepakati sejumlah kerjasama bilateral dalam pelaksanaan pengamanan perbatasan negara yang diselenggarakan kedua pihak.&lt;br /&gt;“Jadi berita yang disiarkan sejumlah media Malaysia sama sekali tidak benar.             <description>***Asean forms patrol vs IS***&lt;br /&gt;&lt;br /&gt;By Chito Lozada - June 10, 2018&lt;br /&gt;&lt;br /&gt;Asean foot soldiers will be deployed in Mindanao in an unprecedented move to strengthen Association of Southeast Asian Nations (Asean) cooperation to stem the growth of Islamic State (IS) sympathizers in the region, regional defense officials said in a recent anti-terror summit.&lt;br /&gt;Under the agreement, Indonesia will deploy soldiers to hunt down pro-IS militants for the first time in a joint ground patrol with Malaysia and the Philippines, Indonesian Defense Minister Ryamizard Ryacudu said.&lt;br /&gt;Reports in Indonesia said Ryamizard first divulged the joint ground patrol aimed at curbing the spread of IS in the region during a speech at the recent Shangri-La Dialogue, a meeting in Singapore attended by Southeast Asian and other world leaders.&lt;br /&gt;The three key Asean members had established trilateral air and maritime patrols in the Sulu Sea and cooperation through the joint operation of land forces that will start “two months from now.”&lt;br /&gt;“The aim of this joint operation is to locate ISIS in the southern Philippines and stop it from spreading,” he said, using the other acronym for IS.&lt;br /&gt;Defense Secretary Delfin Lorenzana said during the forum “challenges do not end when the military declared victory” on October 23 last year in the Marawi City siege of pro-IS forces.&lt;br /&gt;“While pro-Daesh [another term for IS] groups failed to establish a strong foothold in southern Philippines and in Southeast Asia, their initial accomplishments provide a viable blueprint for terrorism operations in the region,” Lorenzana said.&lt;br /&gt;Lorenzana also revealed government plans to boost the country’s technological capabilities as part of counterterrorism efforts.&lt;br /&gt;“We are looking at facial-recognition software so that we can easily track down the bad guys,” Lorenzana added.&lt;br /&gt;The Armed Forces of the Philippines (AFP) bought ScanEagle drones from the US for use in low-altitude surveillance.&lt;br /&gt;US forces stationed in Mindanao also use small drones with powerful signaling capabilities, he said.&lt;br /&gt;“When our order for bigger drones arrives, it will improve our intelligence capabilities,” he said.&lt;br /&gt;Lorenzana said pro-IS militants also use sophisticated technologies to spread propaganda and gain an advantage in clashes with government forces.&lt;br /&gt;Lorenzana said during the five-month battle in Marawi, militants had used drones, which were shot down by Philippine troops.&lt;br /&gt;Terrorists were using technology for recruitment, to plan their movements and to send money, he added.&lt;br /&gt;“During the Marawi siege, my people recommended that we shut down the Internet there because the Mautes inside were sending pictures and messages outside,” he said.&lt;br /&gt;Lorenzana agreed that intelligence capabilities “are only as good as the people who manage them and who interpret the data.&lt;br /&gt;“We still need human intelligence, people who go down and see things on the ground with their own eyes and feel what’s happening on the ground so they can report to headquarters,” he said.&lt;br /&gt;International security consultant Stephen Cutler praised the Department of National Defense’s (DND) plan to upgrade its technological capabilities.&lt;br /&gt;Facial-recognition systems were being used in other countries and were highly effective, he said.&lt;br /&gt;Ryamizard said the expansion of the existing trilateral patrol mechanism would take place with Malaysia and the Philippines giving their agreement.&lt;br /&gt;“I planned it. The implementation is after Eid,” he told Indonesian reporters after a ceremony at the Defense Ministry in Jakarta.&lt;br /&gt;At a bilateral meeting with his Malaysian counterpart Mohamad Sabu last June 9 in Singapore, Ryamizard said the training exercise “at a company level” would focus on “anti-guerrilla warfare, urban warfare and how to tackle snipers.”&lt;br /&gt;Ryamizard told Mohamad the militants in southern Philippines were skilled marksmen and it was necessary for the three countries to equip their forces with better rifles.&lt;br /&gt;The battle for Marawi City emboldened other Southeast Asian terror cells aligned with the Syria- and Iraq-based IS, according to analysts.&lt;br /&gt;Among the 31,500 foreign fighters who had joined IS in Syria, about 800 came from Asia, including 400 from Indonesia, the largest Muslim-majority country, Ryamizard said.&lt;br /&gt;“Maritime patrols have been already implemented, the air patrols too, even though mostly through drones, but it is the same. But not the land patrols yet, even though the combined land forces exercise is very important,” Ryamizard said.&lt;br /&gt;Indonesia’s Defense Ministry spokesman, Brig. Gen.             <description>Palace hints Sabah claim will be retained in proposed charter&lt;br /&gt;&lt;br /&gt;[attachmentid=9571289]&lt;br /&gt;&lt;br /&gt;MANILA, Philippines — The Duterte administration would not give up any part of Philippine territory under a new charter, Malacañang said, after former Senate President Aquilino Pimentel Jr. proposed the inclusion of Sabah in the proposed federal government. &lt;br /&gt; &lt;br /&gt;Presidential spokesman Harry Roque said the administration does not intend to amend constitutional provisions on the Philippine territory. &lt;br /&gt; &lt;br /&gt;&amp;quot;The Palace has not made any pronouncement that the charter should be redrafted in a manner that would give up any Philippine territory,&amp;quot; Roque said in a press briefing Monday. &lt;br /&gt; &lt;br /&gt;&amp;quot;The language of the Constitution be it ‘35, ‘73 and ‘87 provides for definition of national territory, that’s not one of the parts of the Constitution that the Palace seeks to amend or revise,&amp;quot; he added. &lt;br /&gt; &lt;br /&gt;When asked to react to Malaysia&amp;#39;s statement that it would not recognize any claim by any party on Sabah, Roque replied: &amp;quot;There’s a definition of Philippine territory in all our Constitutions, it includes territory by reason of historic title.&amp;quot;&lt;br /&gt; &lt;br /&gt;Earlier, Pimentel said he would seek the inclusion of Sabah in the Philippines&amp;#39; territory under the new form of government. &lt;br /&gt; &lt;br /&gt;Pimentel, a member of a consultative committee created by Duterte to review the 1987 constitution, said the Sabah claim should be acceptable under international law. &lt;br /&gt; &lt;br /&gt;He said Sabah could be the 13th federal state of the Philippines.&lt;br /&gt; &lt;br /&gt;Other federal states in Pimentel&amp;#39;s proposal are Metro Manila, Northern Luzon, Central Luzon, Southern Luzon, Bicol, Eastern Visayas, Central Visayas, Western Visayas, Minparom, Northern Mindanao, Southern Mindanao, and Bangsamoro.&lt;br /&gt; &lt;br /&gt;Before assuming office in 2016, Duterte vowed to pursue the Philippines’ claim to Sabah.&lt;br /&gt; &lt;br /&gt;The Sultanate of Sulu used to rule over some parts of southern Philippines and Sabah. In 1963, the British government transferred Sabah to the Federation of Malaysia.&lt;br /&gt; &lt;br /&gt;The Philippines claims that Sabah was not ceded but only leased to the British North Borneo Co. The heirs of the Sulu sultan still get lease payments for Sabah.&lt;br /&gt; &lt;br /&gt;But Malaysia claims that the international community has been recognizing Sabah as part of its territory since the federation was formed in 1963. &lt;br /&gt; &lt;br /&gt;In 2013, followers of the late Sulu Sultan Jamalul Kiram entered Lahad Datu in Sabah to assert their rights over the area.
