Stubborn upstairs neighbour

Hi,
My MIL lives in a condominium. Her unit is a corner unit which means they can installe a grille door and have a long front door porch . Her upstairs neighbour took this opportunity and planted whole bunch of plants directly on the front porch floor .. which in long term cause the roots to eat into the floor and water seeps down to my MIL ceiling ... it's been many years my MIL have complain to management and they don't seems to have much power and the neighbour above refuse to come out even when called at doorsteps.What are my MIL options availeble? Go tribunal court? its getting very worst regarding the ceiling seepage issue.
