cheating sellar forfeit my down payment

we was looking to buy a 2nd hand house.my lawyer ask us not to pay the sellar downpayment till we get our loan frist and the owner also din't no ask for downpayment frist time we meet. after we in the mid of applying loan the owner ask for downpayment so we put our 4k to our lawyer for safe keeping and show our good will to by but not as a downpayment.then thing started to happen the owner lawyer started ask to pay 4k for a 175k house 20 x 55 two story terracs so i go to meet with the owner and let him know we do not agree 4k as downpayment and i agree only to give 1k only then he agree.but after few day his lawyer call my lawyer that there is no agreement on 4k downpayment so i call the owner agin to get thing right he say ok ok. then his lawyer issue letter for 1k and forfeit 3k if we do not buy in 21day.i feel very cheated!
note: we have no any agreement on paper also!

1 can he sue me if we don't wan to buy anymore?

2 do i have the right do not buy and not pay him anything?

3 will we win if we go to court?

hi i like to know anyone try to overclock the gpu notebook?
i got very hi 3dmark06 score 4954 when overclock my 8600gt form 450mhz core bus to 650mhz and memory bus of 400mhz to 550mhz.

notebbook spec dell vostro 1500,
1440 x 900 screen
intel T7500
2gb ram
8600gt gpu,driver 169.28

i have test to overclock my notebook 8600gt gpu
1. for 475mhz core bus and 400mhz memory bus to 600mhz core bus and 550mhz meory bus is it ok to do so?
2.around 68 C max for the gpu temperatures?
3.can i overclock to cpu also? i have't try it yet.

i go 4819 scored for 3dmark06 defaults setting.
my spec dell vostro 1500 t7500,2gb memory and 8600gt.

how many xbox 360 defacts are out there? many say 360 have defacts 1rod,2rod,3rod,4rod or any thing pls post. if your xbox are ok pls post how you taking care your xbox.

my have 1rod HDD error 67 HDD every time i start to play game but after restart ok.

note my xbox is make on july 06

need help my 360 HDD have error 67 when i stop the console for more then 30min but it work after i restart it. anyone know how to fix it?or have to buy new harddisk?
