KUANTAN: Pusat tahfiz di mana seorang kanak-kanak dicucuh api dan diugut akan dipotong kemaluannya menggunakan gunting rumput disahkan beroperasi tanpa lesen daripada Jabatan Agama Islam Pahang (JAIP).

Pengerusi Jawatankuasa Kebudayaan, Perpaduan, Kebajikan Masyarakat, Pembangunan Wanita dan Keluarga Pahang, Datuk Seri Shahaniza Shamsuddin berkata pusat tahfiz itu sekadar berdaftar dengan Majlis Perbandaran Kuantan (MPK).

“Pusat itu berdaftar dengan MPK sebagai pusat asuhan dan beroperasi sejak 4 tahun lalu, diuruskan secara persendirian, termasuk dalam soal silibus pembelajaran serta tidak menerima bantuan kewangan daripada mana-mana pihak.

“Setakat ini, terdapat 9 pelajar berusia antara 8 hingga 17 tahun di sini yang dikenakan bayaran RM250 sebulan, meliputi bayaran makan dan tempat tinggal,” katanya selepas mengunjungi pusat tahfiz itu, hari ini.

Shahaniza berkata, beliau dimaklumkan JAIP sedang menyiasat kelayakan tenaga pengajar pusat tahfiz di Jalan Tengku Muhammad, di sini, memandangkan semua pelajarnya tidak ke sekolah harian.

Mengulas pertemuannya dengan mangsa berusia 8 tahun, Shahaniza berkata, kanak-kanak itu tidak menunjukkan tanda trauma, sebaliknya menganggap ia adalah hukuman terhadapnya.

“Kanak-kanak itu mengatakan dia tidak lagi kencing merata-rata atau di atas tilam kerana hukuman itu menjadikannya lebih berdisiplin. Bapa kanak-kanak itu juga mengakui dia tahu mengenai kejadian itu.

“Katanya, dia telah ditunjukkan video itu terlebih dahulu sebelum menjadi viral. Malah, bapa kanak-kanak itu masih menghantar anaknya tinggal di sini, walaupun dinasihatkan mengambil anaknya pulang.”

Ahad lalu, media melaporkan penahanan pentadbir pusat tahfiz itu yang dipanggil “ummi” dan “walid” bagi membantu siasatan mendera mangsa, selepas tersebar video itu di laman sosial.

Shahaniza menasihatkan semua pusat tahfiz di Pahang mendaftar dengan pihak berkuasa bagi menjamin keselamatan dan kebajikan kanak-kanak, selain memastikan mereka mendapat pendidikan sempurna.

“Walaupun pembelajaran yang utama adalah bidang agama, pusat tahfiz juga perlu memastikan pelajar tidak ketinggalan dari segi akademik demi masa depan kanak-kanak ini.”

Why doctor is not making big money

I HAVE just retired from general practice. Allow me to put the GP charges into proper perspective. I am not even talking about cost of living, inflation, cost of a medical education or the doctor’s worth.

Generally, GPs would be doing reasonably well if they see 20 to 30 patients a day. Based on a consultation fee of RM30 per patient, with no money being made on drugs and working 26 days a month, the clinic’s income would be between RM15,600 and RM23,400 monthly. If we factor in the wages of two nurses in the clinic working for a minimum pay of RM1,000 per month each, plus their EPF, Socso and EIS, overheads of water, telephone and electricity (no air conditioning in the waiting area) and maintenance costs, rental (depends on location), annual assessment and local licence fees, indemnity insurance (now RM3,200 annually), disposables (syringes, needles, speculum and etc.), waste disposal services and others, the monthly expenditure would be about RM10,000 (if the rental is only RM2,000 per month).

So, in a slow month, the doctor’s income would be RM5,600 and RM13,400 in a good one. This does not take into account the cost of replacing equipment and payments for the doctor’s car/house/PTPTN loans (if any).

Consider that in some places, rental can be as high as RM10,000 and the salary for a nurse could be more than RM2,000 a month. Bear in mind too that the recommended charges are standardised all over Malaysia, be it in Kuala Lumpur or Parit Buntar in Perak.

Rightly or wrongly, GPs have been charging a consultation fee of between RM10 and RM15 while “making money” from the cost of medicine. The total cost of a visit to a doctor would actually be similar to a consult fee of RM30 plus the cost of medicine, which means GPs are not overcharging their patients.

I have been charging my patients a consultation fee of RM30 for many years and when they ask, I explain to them the rationale behind the charges. Cost of medicines is an open secret and they can buy these from the pharmacy if they so wish. I would readily write the prescriptions for them.

The consultation fee is for the history taking, examination, management and advice to the patient. This requires the doctor’s knowledge, expertise and experience. If patients think they only need to pay for the cost of medicines when they go directly to the pharmacy, then it is their choice. But they should remember that when they come to see the doctor at an advanced stage of their disease, they are solely responsible and cannot beg ignorance.

Even doctors are advised not to treat themselves because we cannot be objective in our self appraisal. If you think the doctor you are seeing does not deserve his consultation fee, then look for another one.

PUTRAJAYA: A senior citizen was jailed 12 years by a Sessions Court here for inserting his finger into an 11-month-old baby girl's private part last month.

Judge Mohamad Kamil Nizam also ordered the 68-year-old former lorry driver Hashim Karim to be whipped twice, and instructed the sentence to run from Aug 22, the day Hashim was nabbed.

Judge Mohamad Kamil meted out the sentence after Hashim admitted to the charge yesterday.

Hashim was accused of committing the offence at a house in Shah Alam at about 4pm on Aug 20 and was charged under Section 377CA of the Penal Code for sexual connection by object.

Earlier, in mitigation, Hashim who was clad in olive green shirt and white short pants, said he was unemployed and had to take care of his school-going child.

Meanwhile, Deputy Public Prosecutor Aimi Syazwani Sarmin urged the court to mete out a deterrent sentence to serve as a lesson to the accused as the crime involved an infant.

"The victim is like a granddaughter to the accused, and he should have taken a good care of the baby instead for causing injury to her.

"Although he is 68 years old, he is not spared from being whipped as he is a sexual offender. This is allowed under the law," she said.

Aimi also applied to the court to restrain the media from publishing identities and information related to the victim under Section 14 of the Evidence of Child Witness Act 2007.

Based on the statement of facts, the baby's parents sent her to babysitter's house every day, except weekends.

On Aug 20, they sent their baby to the babysitter's house as usual. At 4pm, the babysitter asked the accused, her father-in-law, to look after the baby as she needed to renew her road tax and car insurance.

When the babysitter returned, she found the infant crying continuously in the cradle and saw that there was blood on the baby's pants. Later, when she bathed the child, she again detected blood.

The parents subsequently took their child to the hospital after discovering blood on the child's diaper.

An obstetrician and gynecologist specialist who examined the child said the injury sustained by the infant could have been caused by a huge blunt object which was forced into her private part.

According to police investigation, the accused told his son he had inserted his finger into the victim's private parts, and what he said was heard by a third person.

KUALA LUMPUR: The Attorney General has no hand in the decision to withdraw the corruption charges against Finance Minister Lim Guan Eng and a businesswoman, resulting in the two being acquitted from the charges on Monday (Sept 3).

In a statement Tuesday (Sept 4), DPP Datuk Mohamad Hanafiah Zakaria said AG Tommy Thomas had recused himself in all deliberations regarding the case.

"The AG had no hand in the decision to enter nolle prosequi (where Public Prosecutor does not propose further to prosecute the accused) on the charges against Lim and Phang Li Koon," he said.
Mohamad Hanafiah is the head of the appellate & trial division at the Attorney General's Chambers.

He said he decided on the representations from Lim and Phang and the withdrawal was due to the evidence in the case having been substantially weakened.

"I have perused the evidence that has been investigated by the Malaysian Anti-Corruption Commission (MACC) and the evidence that have adduced and tested under cross examination thus far, I concluded that as a result of the cross-examination of the prosecution witnesses who has testified so far, the evidence supporting the first charge under Section 23 of the MACC Act and under Section 165 of the Penal Code has been substantially weakened.

"This conclusion was arrived in light of fresh evidence that have arisen during the cross-examination of prosecution witnesses," he added.

On Monday (Sept 3), the Penang High Court acquitted both Lim and Phang of the corruption charges over the purchase of the bungalow at below market value.

The prosecution had dropped the charges and sought an order for both accused to be discharged not amounting to an acquittal.

The joint trial of Lim, who is former Penang chief minister, and Phang, was in connection to the conversion of land from agriculture to residential status, and the purchase of a plot of land and a bungalow at below market value.

He was charged with using his position as chief minister to gain gratification for himself and his wife Betty Chew by approving the application for conversion of agricultural land to a public housing zone in Balik Pulau to Magnificent Emblem Sdn Bhd.

Spy queen to sue MACC for not letting her lawyer

KUALA LUMPUR: Former Malaysian External Intelligence Organisation (MEIO) director-general Datuk Hasanah Abdul Hamid is suing the Malaysian Anti-Corruption Commission (MACC) for not allowing her to consult with her lawyer while she was remanded on allegations of abuse of power and misuse of GE14 funds.

Hasanah filed the originating summons through Messrs Azam Aziz Shaharudinali & Co on Aug 30.

She named the MACC and the government as the first and second respondents respectively.

Lawyer Datuk Shaharudin Ali, who represented Hasanah, said Tuesday (Sept 4) was fixed for case management in the chambers of High Court judge Justice Azizah Nawawi, who later scheduled Sept 24 for hearing of the originating summons.

In her suit, Hasanah is seeking a declaration that the notice issued by the MACC under Section 28A(8) and (9) of the Criminal Procedure Code, which barred her from consulting her lawyer throughout her remand period, is ultra vires to Article 5(3) and Article 8 of the Federal Constitution.

The applicant claims that Section 28A is unlawful, null and void, and cannot be enforced against her.

In her supporting affidavit, she said Article 5(3) of the Constitution allowed a person who was arrested the basic right of consulting with a lawyer and the right of representation.

Hasanah was remanded for six days from Aug 29 to assist in the investigation into power abuse and misuse of GE14 funds.

She was released on Monday (Sept 3) on MACC bail.

7. It ought to be emphasised that the decision in respect of initiating prosecution or discontinuing it is a matter within the prerogative and powers of the Public Prosecutor. In this case, I kept confidential my decision until the very last minute and did not consult the investigative agency fearing it might leak and cause unnecessary alarm. In fact, my decision was so confidential that I only informed the AG personally at 9.44am yesterday.

8. I wish to stress that I have decided the representations without any influence from any quarters. In fact, there was a letter from a legal firm representing the complainant in the above-said case objecting to any idea of withdrawing the charges against Lim Guan Eng and Phang Li Koon. I have responded to the letter that I will decide the case based on available evidence and governing law, which I did, without fear or favour.

9. My utmost priority is justice.

KUALA LUMPUR: Prime Minister Dr Mahathir Mohamad today vowed that the Pakatan Harapan (PH) government would return the country to its glory days with the Malaysia Incorporated (Malaysia Inc) concept under which the country is seen as one large corporation.

“(Under this concept) the home country is regarded as one big operation and the government and private sector work together to make profits for this national corporation.

“From here, we will have the money to support industries to support the people and provide good governance,” he said at the launch of the 9th International Rubber Glove Conference and Exhibition 2018 titled “Transforming Technology, Driving Innovation” at the Kuala Lumpur Convention Centre here.

The Malaysia Inc concept was first introduced in 1983 as an industrial strategy to forge a symbiotic relationship and partnership between the public and private sectors.

It is modelled after a Japanese model of economic development to forge mutual public-private partnerships and to target state investment.

Mahathir said the government encouraged business and believed in the concept of Malaysia Inc.

“We believe in the government and the private sector working closely together,” he said, adding however that it was not altruistic of the government to help the private sector.

“If we help you to make more money, it is because 26% of the money you make belongs to the government for it to provide services.”

He also praised Malaysia for its leading role in the rubber industry, saying the country was now synonymous with rubber.

“It is not the rubber that is important but the application,” he said, giving the example of surgical gloves and the structure of buildings in earthquake-prone areas.

He also drew laughter by remarking that rubber is an important component of birth control.

“Imagine the world without condoms. If the population is now at seven billion, (without condoms) it could be 10 billion.

“Again, rubber has performed a great duty for humanity,” he quipped.

PETALING JAYA: Umno has decried the Penang High Court’s decision to acquit Finance Minister Lim Guan Eng of corruption.

The party’s secretary-general, Annuar Musa, took to Twitter to pour scorn on Pakatan Harapan (PH) over its oft-repeated claim that it respects and upholds the rule of law.

“Goodbye, rule of law,” he said. “In Malaysia, you do no wrong once you are in power. Courts are only meant for the opposition.”

He disclosed that many reporters had asked him to comment on the attorney-general’s (AG) decision to withdraw the charge against Lim and the court’s decision to free him.

“My comment is this: let the people judge,” he said.

Judge Hadhariah Syed Ismail yesterday decided to discharge and acquit Lim and businesswoman Phang Li Koon of related corruption charges although the prosecution had asked her to consider only a discharge not amounting to acquittal.

Hadhariah agreed with defence counsel that it would not be right to leave a cloud hanging over their heads.

Lim was charged on June 30, 2016, with using his public office to obtain gratification for himself and his wife by approving an application by Magnificent Emblem to convert agricultural land for residential purposes during a state exco meeting in July 2014.

He was also charged with using his position to obtain gratification by purchasing a bungalow from Phang at RM2.8 million, which was said to have a market value of RM4.7 million.

Phang was charged with abetting him.

Another Umno personage, Rembau MP Khairy Jamaluddin, criticised the AG’s office for what he called its “selective non-prosecution”.

“Shame on the Attorney-General’s Chambers (AGC),” he said. “This decision stinks to high heaven and undermines the chambers’ commitment to the rule of law.”

Pengerang MP Azalina Othman Said, who heads Umno’s legal unit, accused AG Tommy Thomas of giving preferential treatment to PH leaders.

“The decision to acquit and discharge Guan Eng puts a damper on the credibility of the AG’s office,” she said in a press statement.

“The AG must explain the matter clearly as this could give rise to a negative perception which can be a threat to the doctrine of separation of powers in the country and result in the people losing trust in the country’s administrative system.”

She noted that deputy public prosecutor Abdul Rashid Daud, in his opening statement at the start of the corruption proceedings, had said the prosecution would prove Lim had bought a house from Phang at a price known to be below market rate and that he had, at the time the purchase was made, allowed an application by Phang’s company to change the status of agriculture land to one meant for housing.

“So this begs the question of how the AGC can say there is no case against the two of them and withdraw the charges. This does not make sense at all.

“It shows the AG appointed by the PH government has already begun abusing his discretionary powers provided under the law and is giving preferential treatment and favouritism to PH leaders.”

She urged the Malaysian Bar Council to convene an emergency meeting and state its stand on the matter.

47% youths in steep credit card debt

KUALA LUMPUR: Some 47% of Malaysian youths have high credit card debts while 38% have taken personal loans, according to Bank Negara Malaysia (BNM).

BNM assistant governor Nazrul Hisyam Mohd Noh said last year, more than 3,400 people between the ages of 20 and 30 sought counselling and help from the Debt Management and Counselling Agency.

He was speaking at the finale of a presentation contest organised by the Malaysia Life Insurance Association (LIAM).

“I challenge all of you to break the myth that the young generation are not financially savvy and do not contribute to these statistics,” he said in his speech.

Can i sue LGE for my rm3.5million tax refund?

KOTA KINABALU: A businessman today asked Finance Minister Lim Guan Eng if he could charge back the government for about RM3.5 million in refunds of the goods and services tax (GST) owed to his company to pay for his income tax.

At a sales and service tax (SST) briefing attended by Lim and Customs director general T Subromaniam, the businessman said the amount was accumulated since 2016 and should have been paid to his company under the previous GST system.

“Of course we don’t know where that money is because it is still under investigation.

“I need the money to pay for my income tax… can I contra the RM3.5 million to the government? If not, can I sue the government?” he asked, drawing laughter from the floor.

In his response, Lim said the problem faced by the businessman was due to a system inherited from the previous government.

“The government now is trying to resolve this but unfortunately you are not able to do this (contra) because they are two different systems.

“No need to sue the government lah but it is definitely within your rights,” Lim added.

Lim said this was not the first someone had asked him such a question.

LGE like CKT so no SST for prawn crab lobster

PUTRAJAYA: Prawns, lobsters and shrimps will no longer be subject to the 10% sales and services tax (SST), Finance Minister Lim Guan Eng said today, adding that there had been an oversight by his ministry in the list of taxable seafood.

Lim said the items were ingredients in popular meals such as Char Kuey Teow and could have a chain effect on food prices.

“I must confess I like Char Kuey Teow,” Lim told a press conference today.

He said many of these items were used in curries and dishes sold at Nasi Kandar shops and would now be more expensive.

“Some have questioned why raw ingredients like prawns, crabs and shells have been hit with the 10% SST.

“The 10% tax was imposed on them because they were lumped together with luxury items,” Lim added.

Among the “luxury items” are Rock Lobster, Norway Lobster, cold water shrimps and prawns, oysters and abalone mushrooms.

Lim said he did not realise taxing regular seafood and other produce would affect the prices of meals at restaurants.

The SST came into force on Sept 1, more than three months after the government effectively abolished the goods and services tax (GST) by zero-rating it.

Lim said the 10% tax was being removed now to help traders and consumers who were confused by the SST implementation.

“Those from the middle and low income groups can now enjoy this without paying the 10% SST,”

GEORGE TOWN: The High Court here has acquitted Finance Minister Lim Guan Eng and businesswoman Phang Li Koon over the alleged conversion of land status and purchase of a bungalow below market value.

High Court judge Justice Hadhariah Syed Ismail acquitted both the accused and decided the charges be dropped despite the prosecution only proposing a discharge not amounting to an acquittal (DNAA).

Hadhariah however said both the accused will be released immediately and would not be called again for the case in future, as they are discharged amounting to acquittal.

He was charged with using his position as chief minister to gain gratification for himself and his wife Betty Chew by approving the application for conversion of agricultural land to a public housing zone in Balik Pulau to Magnificent Emblem Sdn Bhd.

He faced a second charge of using his position to obtain a plot of land and bungalow at No 25, Jalan Pinhorn, on July 28, 2015, from Phang for RM2.8mil, at below market value.
