Sungai Penchala 1.5 Story Terrace

Hi all,

TLDR: I wanna buy this property, but donno if this is legit or not.

So heres how the story goes.

Recently I saw in an fb group there was a guy asking whether if people would be interested if there was a house project in sungai penchala for a 1.5 story house. He also provided a google docs link to register your contact details as sign on being interested in the project. I was intrigued and I signed up.

A few weeks(or months) later, I received a whatsapp message from an unknown number contacting me on the 1.5 housing project in sungai penchala and asked whether i was still interested. It was a 1.5 storey house with 3 rooms, 2 baths and 3 carpacks. Pricing was from 425k to 525k. Build area was 1200sf, land area was from 1550sf, 1930sf, 2100sf. He also mentioned that the booking forms are ready and requires a 2k booking cheque and asked when can we meet up.

I asked for more details on the project such as project layout examples. He provided me with some 3d rendered house design showing the ground and first floor. I continued to ask where was the location, he provided me with a google maps location and more details on the project.

I then asked whether this unit was a townhouse ? He said it is a 1.5 storey terrace. I then checked whether he was available on monday and was he able to meet with me on monday, he said yes. I then asked what is the name of the project and who is the developer, he said that the project doesnt have a name yet, and the developer subsidary of Radiant Concorde.

I thanked him for the info and tried to do some research on Radiant Concorde. The first link was this : https://hartabumi.com/agents/radiant-concord-sdn-bhd/

It show that radiant concord has a listing for Angkasa Residence Kuala Lumpur. The Angkasa Residence project is also in sungai penchala, I booked one of the units back in 2016 but until now it has no progress and I've asked for a refund and have gotten my refund.

The next day I whatsapp the agent again and asked what is the price of the 2100sf unit and how many was there as I was interested in that one. He said the price is 515k, has 2 units but both fully booked. I was like shit I wanted that one, then I asked for the smaller unit at 1930sf, but also fully booked. I asked so whats available, he said the 1550sf unit for 425k. I was like ok lets go with that one.

I asked him whether he can help to lock the unit for me first. He then sent me 2 documents, 1 was the project proposal and one more is the master layout. I noticed in the master layout it said it was a 20X70 double storey unit, but the proposal said it was 1.5 storey unit. He then send me a form and asked that i provided the data in that form to him as he will help to fill out. On the form there was "Wellness Industries Sdn Bhd" written on the side. I googled that name but all I could fine was information for a company named "Natural Wellness" which seemed odd to me because I couldnt find information on that company.

The agent then mentioned that this project has not received Development Order (DO) and Advertising Permit and Developer license (APDL). He also mentioned that the project has not been approved yet and it may not be approved or the plans need to be changed. I had no idea what that meant so I contacted my friends who knew better. Basically they said to proceed with a project that does not have an adpl is very risky. I then asked the agent whether they will have projects like this in the future in the same area. He said for now no as they need to find lands that they can do the housing projects on first.

I then asked if the project is not approved then how ? will i get my booking back ? and is this project freehold or leasehold and can the unit be renovated ? He answered that the project is free hold malay reserve, can renovate with dbkl's approval and yes deposit will be returned if project not approved.

So i was like alright lets proceed. I gave him my info and asked him to lock one of the units available for me first but i didnt provide the deposit fee yet.

Then one day i got a whatsapp message from the agent, saying that he has submitted all the documents to the developers lawyers, and then mentioned that the lawyers will propare all neccessary documents for the purchaser to sign including the Perjanjian Jualbeli and Surat Akuan Penerimaan Deposit. He continued saying that the lawyer will call for a meeting to sign the documents and those who still have not paid the RM 2,000 deposit can bring it together during the signing day. Estimated within this week or next.

I then asked current status of the hda and approval from the gov and is there any legal documents, he said not yet, saying submission will be by end of month and if everything goes well, can start applying loan by early next year after the APDL is completed. Then i told him that I will issue a bankers cheque for the deposit and asked who is the beneficiary. He gave me a lawyers business card and said the bankers cheque can wait and the lawyer will contact on the day of signing and asked i bring the cheque during that day as well.

I did some research on the agent, he seemed to be from a well known properties company and most of the agents listing are in ttdi/sungai penchala area.

Finally, is this legit and should i proceed ? (I am a first house buyer / noob)
