Need advise on how to manage kids school session

Hi. Need help from any of working parents out there.

Me and my wife are both working. Next year our kids going to be standard 5 and standard 1.
My mother is the one who take care of them now, but she is tired and want to rest. I respect her decision.
So starting next year we have no relatives to help.

The problem that we going to have is the logistic part of sending and picking them up from school.
The school at our place have 2 sessions, standard 4, 5, 6 morning and standard 1, 2, 3 afternoon.

We could arrange a transport to pick both of them up but since no one would be home my standard 5 kid could not go home and my standard 1 kid wont have anyone to prep him for school.

We've been cracking our heads on this but could not find a good solution. Transit homes are an option that is not very favorable to us.
We know this problem is not unique to all working parents so hoping anyone who have experienced this before could provide some guidance.

Myvilla Development/Mah Sing sort of scam

I want to share my experience buying a condo from Myvilla Development a subsidiary of Mahsing.

They are the developer for Garden Plaza condo in Cyberjaya, next to Garden Residence.

1. The promotion that they offered was, down payment only RM 500, if loan not successful, RM 500 burn only.
2. But for you to be eligible for this offer and some other rebates, you need to sign SPA on the spot.
3. Since it is on the spot signing, you don't really have time to read the SPA.
4. But even if you got time to read the SPA cover to cover, and found something that is not to your liking, still you cannot do anything. They will not change the SPA for you. Take it or leave it.

So what I did is, I paid RM 500 and signed the SPA. Couple of weeks after that my loan application not successful. (don't tell me I should do the financial check first, I already did, and the HSBC banker told me I'm eligible). Shit happens. So I thought only my RM 500 is forfeited. I thought wrong.

After sending an official letter to cancel the purchase, 2 weeks after that Myvilla sent me a letter requesting me to pay 1% of the total property value on the basis of cancelling the purchase.
This is on the SPA that I signed. I don't even have the copy of the SPA. Luckily I know the SPA has not been stamped, SPA without stamp cannot be use in court by the way, but it is still an valid legal document.

I called the salesperson and she apologized to me, she said this shouldn't happen. The SPA lawyer said the same thing, it is the standard SPA that they use regardless of any promotion.
She told me just to ignore the letter because Mahsing wont even bother to pursue this case because it is a waste of time and money.

I simply cannot trust her any more, not after she tricked me with the RM 500 down payment promotion crap. I can't blame her though, how are you going to sell any units if you tell you customer, if your loan not approved, you need to pay us 1% out of the total property value, which is probably around 4,000 to 5,000.

So I deal directly with those who issued me the letter. After weeks of calling and emailing, they still won't cancel the request. Typical answer from a desk executive, you should read the SPA before signing.

So what did I do?

I contacted Kementerian Perumahan dan Kerajaan Tempatan (KPKT) http://www.kpkt.gov.my/kpkt/

I was recommended to contact this government agency by a lawyer friend.
I always have a bad perception towards government agency. In my views they are always slow and inefficient. I thought wrong again.

Within a week after filing a complaint through KPKT, an officer by the name of Loke called me and instructed me to do few things.
After I did all of the things on the list, he contacted Myvilla Development directly. A day after that, Myvilla Development called me and informing that they will issue a cancellation for the 1% request.

They took about a week to issue that letter and here it is.

So ladies and gents, learn from my mistakes. These property developer will try their best to look for your mistakes and make profit from it. They most likely thought most of us won't do anything and just succumb to their request.

If you have any issues with your property whether it is buying or selling or managing, please go to KPKT. They are a very good and cooperative government agency.

Tune hotel Danga Bay, JB

I would like to share my experience in dealing with Tune Hotel Danga Bay JB.

This is about booking DATE.

I arrived at Tune Hotel past midnight on 24 Sept 2012, roughly about 12:15 a.m.
I found out walk in rate is higher that online booking price.
Concierge told me I could still get cheaper rate if I book now because there is plenty of room available at that time.
So I sat at the lobby with my iPad to book the hotel.

What I did is:

Book on 24 Sept 2012, since it is 24 Sept at that time.
I paid using credit card.

When i finished booking, I went to him and and said I completed the booking. He ask for my credit card and IC.
Then he told me I BOOKED ON THE WRONG DATE, IT SHOULD BE 23 SEPT 2012.

I ask him if he could change the booking to 23 Sept (which is yesterday) since there are plenty of room available.
He said the system does not allow that.

I ask him again, if the hotel is completely empty, could you still not change my booking? Still no.

He told me it is pretty well known fact that people usually book earlier date for check in after midnight.

"I said I could be a first time hotel guest and I did not know this, and since you're in the hotel industry why don't you tell me since I'm doing the online booking in front of you."

He said "I thought you know."

Then I check again the Terms and Conditions below. If you have time to read, please read it. If you don't have time, Let me summarize, not a single clause on check in date must be one day before for after midnight booking.

What I like to point out here is there is no clause on their term and condition about this particular of check in, past midnight.
Even if there is, a first time hotel guest can easily be confused.
And there is plenty of room available, most hotel are more flexible and they allow you to change, if there is room available.

Extra info, the room that i booked, i did not stay, burned my 90++ ringgit and went to a shop lot hotel just 500 meter away called Kozy hotel.
The price is RM 98. For 90++, Tune hotel room only provide you with room, no air cond (extra charge), just ceiling fan, no tv (extra charge) and no wifi. Pretty much a place to sleep horribly and take a bath.

At Kozy, I got everything, air cond, towels, tv, wifi. Except no window, and and need to climb stairs. Also got security guards.

So guys and girls, learn from my mistakes. If you're looking at budget/economy hotels, don't go to Tune hotels, there are plenty of choices around that offer better value for your money and flexibility for your travel plan.

Tune hotels, same like Airasia, the parent company, designed their business concept to make profit from your mistakes.

Touch N Go card serious flaw

This is my experience about touch n go card. Hope this will be a reminder to everybody that uses touch n go on daily basis.

Last week 10 August 2012 like usual I wake up in the morning take a bath, wear my clothes and get ready for work.
My route to work goes through NKVE. When I arrived at the toll plaza, as usual I enter the smart tag lane, but then the smart tag doesn't work.

Just topped up the balance last night, the battery is full, and I mount the smart tag on the wind shield using the provided mount, instead of just holding the damn thing like most people did.
The display states that "kad tidah sah" or something like that. So I caused quite a small hold up for all the cars that uses smart tag lane, sorry for that guys!

I can't reverse my car because there's already about 5 car piling up at the back, so my only choice is to press the interkom. It take a while for a girl to came to me and give me the transit card.
Already some drivers started to honk, way to start off the morning.

So with the card, she let me through and ask me to check my card at their office.

Straight after that I went to Plus Touch N Go counter to check what the heck is wrong with my card.
The problem is my card has expired. Yes, even with the card expired you could still top up the card.

What I didn't tell you guy yet is the night before, instead of using the usual card I normally use, I found another card my wife bought but didn't use, because she was carpooling with somebody for some time now.
My usual card is the first generation touch n go card. While it worked just fine all these years, I thought it would be a good idea to change to a new card. The card that my wife bought is the Petronas F1 version that is released for last year F1 event in Malaysia.

Most of you probably didn't know this, I know I didn't prior to my episode, if you didn't use your card for 1 year, the card is considered inactive or dormant. This is stated in their website under the quick facts.

What they failed to mention is that the card is completely useless now after 1 year of inactivity. Yes useless piece of plastic that got no value at all even with all the pretty pictures they print on them. There is absolutely no way for you to reactivate the card. While I know this is just a matter of pushing a few buttons on Touch N Go server, they choose not to have this option so that they could sell more card.

How can I reload the card when it is inactive? The answer is ATM reload. If you go to Petrol station or Touch N Go reload centre like the one they have at the highway, they could identify the card status. But for ATM reload, the machine will not be able to know the status of the card, but you could still reload the card as much as you like. Even when you slip the card into the smart tag, you will have no problem in seeing the card balance.

But all is not lost, since I already topped up RM 50 into card I could still have that value to be transferred to another card. But not any card, a new card only. I bring with me the old card that I normally use, and tell them to transfer the value to my old card. The guy at the counter the system will not allow them to do this.

He gave me some options, you could go to Touch N Go office and ask for refund for the card and my money back or just buy a new card and transfer the balance to the new card, for RM 10. If I chose to refund the card, I will only get my money in 1 month time. This is their standard procedure. If you ask me, this is all the can do with all the stupid people running the place.

I called Touch N Go care line and made a complaint. My point to them is that you system is flawed and you intentionally disable the option to transfer balance to an existing card to sell more cards.
From my point of view, I have done nothing wrong, it is your system which still enable user to top up money on a useless card via ATM machine. After 15 minutes of arguing, the supervisors said Touch N Go will refund me RM 10 for the card. The operator took all of my details to transact the money and she said I will be done earliest next week. Up till now, nothing.

Will my rants here do anything? Not really. They are Touch N Go Sdn Bhd a monopoly company. You and I practically got no choice.
Just want to share my story so that you guys won't repeat the same mistake I did.

This is an update:

For those of you who think I should read the terms and condition first, let me present to you the term and condition stated at their website below.
Apart from the normal 'we are not responsible for everything' and 'we will amend this term and condition from time to time', here is what they have stated in regards to the card expiration and inactivity.

There is no mention about reloading an expired card from ATM. No only that, if your card expired and somehow you manage to add some money to it, and the only way you could get back that money is by buying a new card for RM 10, they will also deduct some money from there.

In the end, TNG win, consumer lose.

Want to break company bond/contract

im currently in the midst of leaving my company. the boss could not hold on to almost all the promises he blurted out of his mouth.
But the problem is i have a contract. 3 years contract contract to be exact.

The contract is due to the bonus that i took and the training that i went. the training contract is 1 year and the rest is for the bonus (called performance bond in my company).
I already been in the company for 2 years now, and already pass the 1 year contract for the training. The remaining is still ongoing and would be for the bonus.

Now i said to my boss, i want to make full settlement which means i'm going to pay back the performance bond bonus to the company and nullifies the contract.

But the issues is, my boss said even though i paid in full i could not break the contract and can be sued in court.
The reason he gave me is that the agreement involves 2 party, and each party must agree for the contract to be cancelled. He didn't agree.
He said there must be a penalty that i need to pay to end to contract prematurely. He didn't mention any numbers, but looking at the situation it ain't gonna be in cents.

This is true, if it is written in the agreement letter but the letter is only one page and nothing is written about the penalty.
The boss is trying to make my life difficult with my action.

Therefore i need some legal advice, or any advice on this matter. Thanks.
