Strata owners and tenants of Ampang Park mall lose appeal

PUTRAJAYA: The acquisition of land by the Government for construction of the Klang Valley Mass Rapid Transit (MRT) Ampang Park station can proceed as the legal challenge by the 39 strata owners and tenants of the iconic Ampang Park shopping centre over the issue has ended.

Federal Court three-man panel led by Chief Justice Md Raus Sharif yesterday dismissed the application of the strata owners and tenants to obtain leave to appeal against the dismissal of their judicial review by the High Court and Court of Appeal.

In a unanimous decision, Md Raus held that the legal questions submitted by the appellants’ counsel, Datuk Zainur Zakaria, for determination by the Federal Court did not pass the threshold requirement of Section 96 of the Courts of Judicature Act 1964.

“Even if we allow the questions, there is no chance of success on the questions posed. We dismiss the application,” he said.

He ordered the strata owners and tenants to pay costs of RM20,000 to the first and second respondent – the Federal Territories Land and Mines director and Federal Territories Land administrator, and another RM20,000 to MRT Corp.

Presiding with him were Federal Court judges Abu Samah Nordin and Aziah Ali.

On Jan 8 last year, 39 business owners and tenants of the Ampang Park shopping centre filed legal action to overturn the approval for the mall’s demolition to make way for an underground walkway connecting the new MRT station to the Ampang Park Light Rail Transit station.

On June 30 last year, their application was dismissed by the High Court, which ruled that the acquisition of the land was proper and had been done in accordance with the law, including the Land Acquisition Act 1960.

The strata owners and tenants of the shopping centre lost their appeal at the Court of Appeal on Jan 18 this year, prompting them to file for leave to appeal to the Federal Court.

After the court’s verdict, the appellants’ other lawyer, Jason Ng Kau, said there was no further legal avenue for them to challenge the acquisition of the land and the next stage was for the land enquiry hearing to proceed in respect of compensation. — Bernama

I'm very low Phone & SMS user, i now using surfmore plus 50 packages with 5GB data. so i'm not really need MaxisOne plan with Unlimited Call & SMS and 20GB data.
I hope Maxis can come plan like MaxisOne 75 or 78 with 150 hrs talk time and 200 SMS, 10GB data plan, with 1 share line with RM30 (2GB data)

Soon opening MRT1 only can use Touch & Go card, but for RapidKL card need to wait until next year July, so need to buy TnG card to enjoy cashless fare. i wonder so long MRT project, RapidKL since they operate MRT not plan integrate card early? 。
also is all MRT station can reload TnG card? like rapidkl card can reload using fare machine。

Preliminary investigation showed the consignment was being shipped from Taiwan to Singapore, the Post has learned.
“Hong Kong was not its final destination. It is not known why the consignment was unloaded here,” a government source with knowledge of the matter said.

High Speed Rail: Singapore, Malaysia launch 'market sensing exercise'
Malaysia's Land Public Transport Commission and Singapore's Land Transport Authority have jointly launched a Request for Information exercise on the Kuala Lumpur-Singapore High Speed Rail project.

SINGAPORE: Malaysia's Land Public Transport Commission (SPAD) and Singapore's Land Transport Authority (LTA) have jointly launched a "market sensing exercise" on the Kuala Lumpur-Singapore High Speed Rail (HSR) project.

In a press release issued by LTA on Wednesday (Oct 7), it said that the two parties will launch a Request for Information to "gauge market interest" and "gather industry opinion on selected commercial and technical aspects" of the HSR project.

The Request for Information will mark the next phase of the project and the feedback received will "inform the ongoing bilateral discussions and formal tender process subsequently", LTA said.

This exercise is expected to conclude by the end of this year.

In a joint statement, Malaysian Minister in the Prime Minister’s Department Abdul Wahid Omar and Singapore Coordinating Minister for Infrastructure and Minister for Transport Mr Khaw Boon Wan said: “This market sounding exercise marks a major milestone in our HSR journey. It is important for us to be properly informed of the industry views.

"We want to use this exercise to gauge market interest in the project and solicit views on different models and approaches. The feedback is crucial in helping us refine and validate our options, which will in turn help ensure a successful tender process subsequently”.

In a blog post on Wednesday, Mr Khaw said: "This RFI will help us gather views from the industry, on how we should structure the project commercially. To be sustainable and exemplary, the project must meet the market test."

The Kuala Lumpur-Singapore HSR link was first announced by Malaysian Prime Minister Najib Abdul Razak and Singapore Prime Minister Lee Hsien Loong in February 2013.

Singapore's terminus station will be at Jurong East, while the one in Kuala Lumpur will be in Bandar Malaysia. With the HSR, it will take about 90 minutes to get from one end of the line to the other.

During his Malaysian trip, French Defense Minister Jean-Yves Le Drian will discuss the possibility of delivering to Malaysia the two Mistral-class warships initially built for Russia, the French newspaper Tribune reported.

Earlier, the French media suggested that Egypt and Saudi Arabia were seriously contemplating the purchase of Mistral ships. Other nations believed to be interested in the two Mistrals include Brazil, Canada, China, India and the United States.

Le Drian will arrive to Malaysia on August 30. On the way back, the minister plans to visit India to sign a contract on the delivery of 36 Rafale jets to New Delhi.

According to Tribune, the Indian military is also interested in the purchase of the Mistrals.

2 unit MAS A380 will lease to Turkish Airlines

18 Feb 2015: Turkish Airlines is contemplating testing A380 operations according to Blomberg by wet leasing two A380 from Malaysian Airlines. Turkish did the same when they tested the Boeing 777 before ordering it, then by wet leasing 777 from Jet Airways.

The deal would be good for both Turkish Airlines which could test the A380 to see if there is sufficient demand on their densest routes and for Malaysian Airlines as recent disasters has meant they no longer need the capacity of their six A380.

Probable destinations for Turkish would be London Heathrow and JFK. The two aircraft would be operated by Malaysian Airlines pilots and Malaysian would also furnish half the cabin crew during the first six months, the other half coming from Turkish. After the initial period there would be a dry lease phase where Turkish would continue with own crews. A third backup aircraft should be part of the deal.
