Akberdin told reporters that the defence was asked to attend the case management proceedings today via a letter dated June 29.

"The (relevant) parties turned up today and the court rescheduled the judgment date to Sept 1, at 9 am," he said.

Sg Langat water level reaches ‘dangerous’ level near Kajang

Residents around Kajang are urged to be on alert for possible flooding following two hours of heavy rain in the region.

In a Facebook post, the Irrigation and Drainage Department said its monitoring stations for Sungai Langat at downtown Kajang and Taman West County has recorded “dangerous water levels with rising trend”.

“Residents in low-lying and flood risk areas are advised to be on constant alert and take appropriate action while following instructions from the authorities,” it said in a statement today.

Meanwhile, netizens have posted videos purportedly showing that part of Kajang is already flooded.

Youth and Sports Minister Ahmad Faizal Azumu has admitted to be among cabinet ministers said to be on holiday abroad amid the flood crisis.

Utusan TV quoted Faizal as saying that he had spent less than 12 hours in Dubai last Wednesday with his two sons, who are both studying in the UK, and they have not met since the beginning of the Covid-19 pandemic two years ago.

"Yes, I did apply for leave and once I received approval, I flew to Dubai on Wednesday (Dec 22) to meet my sons.

"However, looking at the country's flood situation, my heart felt uneasy," he was quoted as saying.

"So I decided to purchase a return ticket after only about 12 hours there (in Dubai).

"I managed to sit down for a brief chat with my sons before flying home at 8am, Thursday (Dec 23), before Prime Minister Ismail Sabri Yaakob issued the instruction," he said, according to Utusan TV.

Record amount of rainfall on Dec 17 had triggered massive flooding in several parts of the country and Faizal had, on Dec 19, launched his ministry's post-flood volunteer squad.

He later responded to former premier Najib Abdul Razak who criticised the formal launch set-up, complete with a digital backdrop.

It is not immediately clear whether Faizal had participated in the volunteer squad or when his leave application was approved.

Last Friday, Ismail Sabri cancelled the year-end leave applications from his cabinet members until after the flood situation had passed.

He also ordered those already on leave and abroad to come back immediately.

Yesterday, Ismail Sabri, without mentioning any names, said at least two or three ministers who went abroad have returned home and are under self-quarantine.

Aside from Faizal, Malaysiakini understood that the returning ministers include Environment and Water Minister Tuan Ibrahim Tuan Man, who yesterday revealed that he had been tested positive for Covid-19 along with four other family members.

'A national embarrassment,' Justice Abdul Karim describes, saying there's no good reason to disagree with High Court ruling
9.50am: Justice Abdul Karim says they agree that there is overwhelming evidence that Najib had interest in approving the KWAP loans for SRC.

“This establishes that the appellant had interest beyond his office in SRC. We find no good reason to disagree with the ruling of the High Court judge,” he says.

Justice Abdul Karim adds that Najib was granted special powers in SRC because of his role as the then premier.

He says Najib in his defence said that his actions were for national interest.

However, Justice Abdul Karim points out that the running of SRC was bad management of funds, and Najib did not find out what happened to the SRC funds and obstructed the then second finance minister from seeking the funds.

“This is no national interest as the appellant claimed for SRC. This is a national embarrassment,” Justice Abdul Karim says.

PUTRAJAYA (Dec 7): The Court of Appeal (COA) on Tuesday (Dec 7) denied an application from Former Prime Minister Datuk Seri Najib Abdul Razak to adduce further oral evidence in his appeal against his conviction in the SRC International trial.

The COA bench led by Justice Datuk Abdul Karim Abdul Jalil denied Najib’s application and said that there “were no exceptional circumstances” which merited adducing the new evidence.

He also said that the decision on whether or not to set aside Najib’s conviction and 12-year jail term and RM210 million fine for the SRC offences will go on as planned tomorrow morning (Wednesday, 8 December).

In a unanimous decision by Abdul Karim, Justices Datuk Has Zanah Mehat and Datuk Vazeer Alam Mydin Meera, the bench surmised that Najib’s bid to adduce the evidence by calling Malaysian Anti-Corruption Commission (MACC) chief commissioner Tan Sri Azam Baki and former SRC investigating officer Rosli Hussein to be examined was not necessary as it did not fulfil the criteria as stated in Section 61 of the Courts of Judicature Act (1964)

Relationship between Vaccination and Cases/Death

Daily cases have been on the decline for the past two weeks.

Lets take a look at how vaccination rates relate to deaths and cases when compared between states. Data as of 27 Nov 2021, 11:59 pm pulled from https://covidnow.moh.gov.my/ and presented in the table below, data is sorted according to total population fully vaccinated (Vaccination %). A simple linear regression is plotted with but excludes data from Labuan and Putrajaya due to the their low population (~100k each) which skews the analysis. Data points for Malaysia and Klang Valley is also excluded as the data is a sum of the states.

Linear regression for fully vaccinated against cases per 10k shows that there is no trend observed i.e. there is no relationship between high/low cases and vaccination %. In other words, states with lower vaccination rates can have low cases and other states also with low vaccination rates can have high cases. The same is true for states with high vaccination rates.

While Putrajaya was not included in the analysis, it is placed on the chart to indicate that Putrajaya breaks away from the trend. There is a marked increase of cases in this state, while we can assume that the residents of Putrajaya are not adhering to SOP we should also take note that this can happen in other states if SOPs are not abided.

The relationship between Vaccination and Death (per 1m, 14 day avg) however paints a different picture. There is a negative trend observed i.e. states with lower vaccination rates have higher death rates. 3 states are highlighted as examples. Kelantan follows this trend quite closely (when removing Sabah and T'gganu, r2 of the model increases to 0.63), while Sabah and T'gganu are two different extremes. Sabah has much lower death rates, while having the same vaccination % as Kelantan, while T'gganu has close to twice the death rate while having higher vaccination rates than Kelantan.

One possible explanation for the lower death rates observed in Sabah is potentially due to lower rates of co-morbidities. There are only 48915 registered diabetic patients in Sabah (~1.2% per capita) whilst the national average is ~6%. But this does not explain the high death rates observed in T'gganu as it is close to the national average.

Other possible explanations could be due to high concentration of poor households as described here (https://newnaratif.com/men-dying-younger-kelantan-terengganu/) as men in these two states have the lowest life expectancy. But this doesn't explain why deaths are so much higher in T'gganu given the same conditions.

In summary, nothing that we don't already know. Vaccination doesn't prevent infection but there is strong indication that it reduces the risk of dying due to covid. Not having co-morbidities also improves your chances of surviving.

^valid point to take note of. these analysis are not adjusted for age/co-morbidities and assumes it to be similar to all states. Sabah is an interesting case for example.

Trends in Covid death in the past 24 weeks

Known factors for increase risk in death after covid-19 infection: co-morbidities and old age.

There's a shift in the distribution of death by age group through time. While most of the death caused by covid-19 prior to the surge of second wave was in the >60 age group, this quickly shifted to the younger age groups (>30) towards the peak of the second wave (23k daily positive cases). The trend has now shifted back to senior citizens (>60) making up the bulk of deaths. Nothing out of the ordinary. What is more concerning now is that, even with the decreasing number of overall death, there's a increasing trend in deaths in the 0-4 age groups.

The obvious beneficiaries of vaccines are in the 50-59 age group and 18-49 as a whole saw decrease in % death distribution as more individuals are vaccinated. The 5-11 and 12-17 age group has an interesting trend where deaths increased gradually, and dropped thereafter presumably after a majority of parents was vaccinated, therefore explaining in the lagging trend.

Pipul in the 60-69 age group didn't see any significant change in trend, and fall within a grey area. Folks >70 don't fare too well as the odds are against them. Again, what is concerning to me (as a parent of two kids below 2) when I looked at the data is in the increasing trend of death distribution in the 0-4 group, even when total daily deaths are falling and even when >75% of the population are vaccinated. One explanation is that parents are taking their vaccination status for granted, and although the total number of cases and deaths are decreasing as a whole, are not aware that their kids (0 - 4) are still vulnerable.

The takeaway message (at least for me) is to get vaccinated, abide SOP and reduce your chances of getting infected. You may fair well but this doesn't necessarily extend to the senior citizens and little kids (if you have any at home)

A parody poster warning netizens not to use the hashtag #SiBodohKauDengarSini (Listen here, idiot) has been denounced by the Malaysian Communications and Multimedia Commission (MCMC).

The commission said it had not issued the poster, which uses the MCMC name and logo, and warned that it contained false information.

"The poster which has spread on social media contained fake offences which were made up covering the aspects of punishment and the act which will be used on those who violate the warning.

"The MCMC will proceed with necessary action to curb the spread of false information," it said in a statement today.

The fake poster was created by Bawangmana, a parody news Twitter account.

The poster, which is discernibly a parody, contains graphic designer Fahmi Reza's caricature of Prime Minister Muhyiddin Yassin as a clown.

It also jokingly warns users that using the hashtag #SiBodohKauDengarSini is punishable under "Section 109" of the "Muhyiddin Has No Majority Act 2021" and can be punished by a fine not exceeding RM35 million or up to one year in quarantine, or both.

Section 109 is a reference to how many MPs are left on the Perikatan Nasional Plus side after two Umno lawmakers withdrew support from the government, leaving Muhyiddin without a majority in Parliament.

RM35 million, meanwhile, refers to the controversial allocation to build three community halls in the prime minister's Pagoh constituency.

The hashtag #SiBodohKauDengarSini went viral on Monday and originated from frustration at operating hours for food outlets during the second movement control order.

It has since been a vehicle for netizens to express their displeasure with the government over its handling of the Covid-19 pandemic.

BREAKING: Prasarana mum over report

Prasarana Malaysia Bhd has declined to comment on a report which questioned the leadership and direction of the company since the appointment of Umno leader Tajuddin Abdul Rahman as its chairperson in May.

Malaysiakini also made an attempt to reach out to the three-term Pasir Salak MP for comment, but he has not replied.

This came after The Edge reported that Tajuddin was exerting his authority by seeking significant changes at the rail and bus transport operator. Some of these changes have supposedly raised questions about the leadership and direction of the wholly-owned unit of the Finance Ministry.

Tajuddin has allegedly sought to terminate the contract of RM1.2 billion Latitud 8, a mixed-use commercial development at the Dang Wangi light rail transit (LRT) station to allow Prasarana to play a more prominent role in the project and eventually move its office to the new development.

The Edge cited documents sighting in reporting that the termination of the joint land development agreement (JLDA) may cost Prasarana up to RM80 million.

The documents also allegedly indicated that Finance Ministry has given "tacit approval" for Prasarana to move to the new tower being built in Dang Wangi from Menara UOA in Bangsar.

Reportedly the reason given was that Dang Wangi is the ideal location as it is located in the Golden Triangle area of Kuala Lumpur, which has one of the best values in terms of property and also one of the best commercial addresses in Kuala Lumpur.

The companies involved in the construction of Latitud 8 are Crest Builder Holdings Bhd and its 51 percent unit Intan Sekitar Sdn Bhd. The remaining 49 percent of the company is held by Detik Utuh Sdn Bhd.

Interestingly, Tajuddin's daughter Rahayu sits on the board of Detik Utuh.

Detik Utuh’s shareholders are Tindakan Juara Sdn Bhd (40 percent), Obata-Ambak Holdings Sdn Bhd (35 percent) and Vignesh Naidu Kuppusamy Naidu (25 percent).

Tajuddin's family members own Tindakan Juara. The company is 35 percent owned by his daughter and 35 percent by his wife Rohkiah Abd Samat while the balance of 30 percent is owned by his son Firdaus.

Both Rohkiah and Firdaus were appointed as Tindakan Juara directors in early 2007, about four months after the company was registered. Sri Rahayu was appointed to the board in February 2010.

In March 2012, Crest Builder and Detik Utuh were granted the development project.

Prasarana, which owned the 2.72 acres tract in which the development slated to take place, was to receive RM46.64 million or 21.2 percent of the project’s estimated gross development value of RM220 million.

The Latitud 8 was originally slated to be launched in 2016, but it never happened. However, Crest Builder said in its annual report FY2019 that the project had already commenced the main building works.

The development of Latitud involves a single block of 43 storeys, with 17 storeys of office space and 418 SoHo units on top of the offices, as well as a retail podium, all located above the Dang Wangi LRT station.

However, the construction work was reportedly halted and scheduled for a relaunch of the project in 2020, but again, it failed to take place. The offices of Latitud 8 said the launch will only take place in one or two years due to market sentiment.

Show-cause to CEO

The Edge also cited a copy of a show-cause letter given to Prasarana CEO Muhammad Nizam Alias and linked the disciplinary action to Nizam being insubordinate when he was instructed by the chairperson and the board to investigate MRCB George Kent Sdn Bhd, the joint-venture party tasked with constructing the LRT3.

Nizam is said to have made allegations against Tajuddin on the award of contracts.

Nizam was appointed in July, taking over from Mohamed Hazlan Mohamed Hussain, who had left after being suspended in early 2020.

On Dec 16, financial daily Malaysian Reserve quoted a source alleging that Prasarana was interfering in the appointment of subcontractors for the project by its main contractor MRCB-George Kent Sdn Bhd.

The turnkey contractor has refused to give into Prasarana's demands for "more say" but that this has resulted in MRCB-George Kent being given “a hard time” on its progress payment by Prasarana.

The source said that a high-ranking individual in Prasarana requested that MRCB-George Kent award a work package worth a substantial amount to a particular firm.

This firm, the source claimed, is politically linked to a senior figure in Prasarana, hence raising the issue of conflict of interest for the urban public transport operator.

Prasarana owns and operates the country’s urban rail services, which include three LRT networks and the KL monorail on top of operating the mass rapid transit (MRT) line.

It also owns and operates the stage bus services in Kuala Lumpur, Selangor, Penang, Perak and Pahang; provides management and engineering consultancy services locally and abroad; and undertakes commercial and transit-oriented developments within its assets, as well as key public transport infrastructure projects in the country.

As of December 2019, Prasarana had total assets of RM1.3 billion while its total liabilities stood at RM35.38 billion. It also had accumulated losses of RM42.41 billion.

"As project owner - at least for me, I don't know about past chairpersons who may not care about this - but I care. The participation of bumiputera contractors is important to me. It is a policy which we need to support," he said.

Tajuddin revealed that a "topmost" Prasarana official had opposed to the approach but did not name him.

Earlier, Tajuddin confirmed that Prasarana president and chief executive officer Muhammad Nizam Alias had been suspended for "insubordination".

"We are taking the initiative to be in the know, but there is a topmost officer whose name I don't want to mention - you can guess - who said that since they (MRCB-George Kent) have been appointed as the turnkey contractor, we should not interfere in what they are doing.

"They can do as they wish. For me, that is not right. As the project owner, we need to be in the know. Being in the know is not interference.

"It is not being a busybody, it is our right," he said.

It is with dismay and disappointment that I read of Tengku Razaleigh Hamzah’s statement, “This is Malay land, there is no other place for Malays to go” (Malaysia Chronicle, 18 September 2020).
He was also quoted by Insight Talk as having said “this is Tanah Melayu (Malay land) and there is no other place for the Malays to go”.
My dear Tengku, I’m also in a similar predicament. I have no other place to go to. This is my birth place. This is my country. This is Tanah Aku.
My right to this land cannot be challenged, it cannot be disputed, it cannot be denied. Legally and constitutionally, I belong to this land. My status to this land is clearly spelt out and guaranteed by the Federal Constitution.

MCA introduces 'Member Flash Card Benefits' for party members

PETALING JAYA: MCA members can now enjoy discounted prices at selected outlets.

"As a part of giving back to MCA party members nationwide, MCA is introducing “Member Flash Card Benefits”, so that its members can enjoy discounted prices at various outlets such as restaurants, retail stores, accommodations and other services.

"Under the Covid-19 threat and movement control order (MCO) restrictions, the nation’s economy took a deep dive. We hope that the introduction of this flash card and its benefits will help party members save up and lessen their burdens, as well as encourage spending to stimulate the local economy, killing two birds with one stone," said MCA national organising secretary Ling Tian Soon in a statement on Wednesday (Sept 2).

Among the participating vendors include Ibis Hotel Kuala Lumpur, Mirage Optics and Shu Daxia Hotpot KLCC.
