            <title>Schedules H &amp;amp; G and Subsequent Extension of SPA</title>

            <description>Hi all,&lt;br /&gt;&lt;br /&gt;Wanted to get your feedback, specifically legal feedback if possible, regarding a matter which concerns one development which I have purchased. It may affect all of your rights as house buyers. &lt;br /&gt;&lt;br /&gt;I bought a property from Developer A in December 2011 of which the duration for completion of handover is this coming end of December 2014. The SPA was signed pursuant to Schedule H of the HDA and the stage of claim is at 2(h) being the last stage prior to vacant possession. This claim was made somewhere in October 2014 hence, you would have expected the VP to be made soon.&lt;br /&gt;&lt;br /&gt;Somewhere in end November 2014, I received a letter from the developer stating that the development will be extended for another six (6) months from the stated 3 years under Schedule H. This developer has also attached a letter from the Ministry of Housing that it approves the extension of six months. The MOH Letter was dated somewhere in However, neither the letter did mention the specific reasons for extension.&lt;br /&gt;&lt;br /&gt;I sought opinion from various parties and was informed of 2 things. Firstly, a developer cannot extend the prescribed tenure under Schedule G or H unless it is sought upfront (with specific reasons and rationale i.e. soil conditions which may result in longer piling period or degree of slope which requires longer time for clearing) in order for the development to start. This seemed logical as it allows the buyer to decide whether to purchase the property with such extended time line. &lt;br /&gt;&lt;br /&gt;Secondly, I was also informed by another person in his legal capacity that, subject to specific reasons, such extension from the Ministry can be sought after the DO or APDL is issued. But such extension does not absolve the developer from paying LAD.  &lt;br /&gt;&lt;br /&gt;The reason I am asking this is due to the fact that it seemed like I have been misrepresented from the beginning and/or induced by this developer to purchase their property in the first place. Considering I was not entitled to any DIBS in the beginning, I am paying for interest. Can you imagine if all developers do this to every purchaser and instead of extending it for 6 months, they extend it for 6 years? It might as well be considered an abandoned property development and we, as purchasers, will have to bear interest payments for this? &lt;br /&gt;&lt;br /&gt;I have written to the Tribunal of House Buyers Association and awaiting their reply. However, in light of 2 differing legal views, I would like to know my rights to claim LAD from this developer. One legal person said that extension does not absolve the developer from paying. Another legal person said that developers cannot extend the 36 months for VP under Schedule H (after the development is sold but rather do it up front prior to its commencement) hence in the first place no extension should be given by the MOH.  &lt;br /&gt;&lt;br /&gt;Hence, till now I am still confused. Further, without saying much, the sales representative from Developer A said that since there’s an extension, the LAD begins from the 43rd month onwards after considering the 6 months extension. This was never mentioned in the letter from developer hence, I feel that, yet again, I have been cheated with such non-disclosure.  &lt;br /&gt;&lt;br /&gt;I was wondering if any of you have had similar experience and could shed some light on this matter. &lt;br /&gt;Thank you. &lt;br /&gt;</description>

These metal items are such as cabinet doors which are made of metal mesh, shelving made out of piping etc. &lt;br /&gt;&lt;br /&gt;I am unable to find a suitable person (either a general contractor or metal works person) to fabricate such items for me. Also, should I be looking at those companies doing gates to do such things for me? I am unsure. &lt;br /&gt;&lt;br /&gt;Hence, if any of you have any clues or recommendations as to contractors who are doing metal works, appreciate the contact. &lt;br /&gt;&lt;br /&gt;The property is in Selangor hence any from KL or Selangor would do the trick.&lt;br /&gt;&lt;br /&gt;Thanks in advance.</description>
