directd - add new terms to receipt during RMA

Forumer you are complaining against: directd

Item being sold/bought: Samsung Galaxy Note used (2nd hand)

Original thread link: http://forum.lowyat.net/index.php?showtopic=2233494&hl=

Date of transaction:
3/12/2011 - original receipt issued
13/2/2012 - bought the set used
21/2/2012 - initiated RMA

Details of the complaint :
i received a PM from directd on 22/3/2012 4.12PM denoting the following:

QUOTE

our management has decided to take legal action against u, just give u the head up..

i’ll refrain from making further comment, but will make available all available proves/transaction/communication for the purpose of the processing of this complain:

this post is a customer feedback towards directd / Extrovest Communications Sdn. Bhd./Brandstar.
the original posts along with tracking data of the whole incident were deleted by mod.

during a recent RMA attempt, directd confiscated my original receipt and replaced with a re-printed official receipt, with additional terms attached.
The new clause now include warranty void disclaimer on LCD screen as well, on top of “rooting”.
directd claimed he informed the first-hand owner of my set about “rooting voids warranty”, but i highly doubt if he informed the first-hand owner against the LCD screen warranty disclaimer, which weren’t printed on the original receipt.
the phone came back without any directd warranty seal, pealed off and unsealed.

i am sending my phone to Samsung service center for repair, and have them capturing prove if there’s any unnecessary alteration done to internal component of the set.

i acknowledge the fact that the device was rooted before thus RMA is rejected, i’m thus absorbing the repairing cost on my own.

i condemn the business practice of directd to alter the official receipt and terms of a Closed Deal.

Prove, quoted from directd’s now deleted thread dated Mar 20 2012, 12:54AM:

history of the deleted posts, with chronological data of the incident, and full disclosure of SMS & PM conversation:

» Click to show Spoiler - click again to hide... «

BUYERS BEWARE!! THIS SELLER DOES NOT ENTERTAIN RMA of ROOTED / CUSTOM ROM,
PRACTICES ALTERING SALES TERMS IN OFFICIAL RECEIPT AFTER DEAL CLOSED WHENEVER AND HOWEVER THEY LIKE.
If you intend to flash/root your phone, this is something you should know.

My recent Galaxy Note RMA attempt from directd was rejected with the reason “warranty is void due to rooting”.
the service response was fairly fast and appear nice until a problem really hits you, when you needed their service the most.

instead of offering a viable solution to customer, they choose to drag and delay the RMA -- until they got their “Samsung flash count checker (whatever they like to call it)”, find out that there’s rooting attempted done before, and rejecting the RMA only when I call to check for status update. all the empty promise of “will provide a solution to you” is not a penny worth.

i do understand the risk of rooting, and the fact that it could void warranty going by any official warranty claim in the field.
what i DO NOT like, it’s the delay and drag, non-responsiveness and empty promises.
Instead of helping customer to solve their problem, they helped themselves by dragging the case for a few weeks, buy time to get the tool and to prove that “your problem is YOURS to solve”.

the RMA incident in chronological order:
20/2/12 - SGN SOD, could not power on again even with USB Jig.
23/2/12- sent for RMA,
24/2/12 - PM’ed in LYN for status check, no response.
25/2/12 - directd called asking for failure symptom. (boy i thought, how nice the service..)
28/2/12 - PM’ed again for fix status in LYN. responded if issue their “tech dept” will contact, promised to “provide a satisfactory solution” to problem.
6/3/12 - PM’ed again for fix status in LYN, no response.
9/3/12 - PM’ed again to ask for “tech dept” contact to check for progress, No response. Called Directd, was - after long wait, called for another status check, asked to “give another 3, 4 days, will provide satisfactory answer”.
13/3/12 - called directd, was told “warranty void due to rooting”, RMA declined.
14/3/12 - sms'd "tech ppl" to get the tracking number but receive NO response. PM'd directd and he said will check for me & "tech ppl" will contact me
15/3/12 - still did not receive any call/sms from "tech ppl"; PM'd directd and he said "tech ppl" is waiting for parts; asking what parts that they are waiting and how are they going to fix my phone and here is his reply "sorry i have no idea-once is ready my tech ppl will sent the goods out"
15/3/12 - Did not get respond, SMS'd "tech ppl" by myself and they only ship it afterward
16/3/12 - received the phone finally
19/3/12 - rechecking the package before sending SAMSUNG for repair *at my own expense*, the returned package comes with an re-printed “official receipt”, which i deem as dishonest business practice, cause the RMA can only be processed with official receipt shipped back to seller. in this case one can alter the business terms as one like.

note the date circled in red, and the terms.
i hereby urge that the seller “directd”/tech/you-know-who-you-are to present the ORIGINAL RECEIPT, to prove your “innocence”.
-------------------------
20/3/19 - directd uploaded picture of original vs. re-print receipt with the additional clause.

apparently if your LCD gone wrong, it's not their problem too.
the negotiation didn't work out, i've decided to absorb the repairing cost by myself and instead update this thread to make sure forumers are aware of what they are buying into.
attached below is the PM and SMS conversation full disclosure, showcase the seller's attitude and their way of (not) handling your problem.
http://www.filedropper.com/directdrmareject
or,
http://imgur.com/a/OutHx#2

buy ahead if this is the shopping experience you look for, with your thousand-ringgit worth gadget.
BUYERS BEWARE!! THIS SELLER DOES NOT ENTERTAIN RMA of ROOTED / CUSTOM ROM,
PRACTICES ALTERING SALES TERMS IN OFFICIAL RECEIPT DURING RMA, WHENEVER AND HOWEVER THEY LIKE.

» Click to show Spoiler - click again to hide... «

BUSINESS INTEGRITY is all about honoring the deal that is closed.

you can change the terms to all your FUTURE deals but NOT to deals that is already CLOSED.
while you are denying the fact that you are "changing terms to avoid honoring warranty claim", you are doing exactly THAT in my case.
your re-print still bears the same first owner name, but of different date, and ADDITIONAL TERMS.
you are not trying to help, the re-print merely trying to "justify" (which is no just in the first place) the refusal to RMA, after dragged the case for close to a month.
the "increase" in duration of warranty is ironic if not irrelevant. for the record, the set was sent back for RMA on 23 Feb, which is well within the warranty period.

there's no specific terms denoting "warranty is not transferrable" and "rooting void warranty" in your original receipt.
i've seen cases where rooted devices RMA was successful. i don't mind quoting from LYN forums for this.

if there's specific clauses and terms in the original receipt, that "warranty is not transferrable" and "rooting will void warranty" i would NOT have purchase the used set in the first place, as that means the set's warranty has lapsed following the transferring of ownership.
in such, me being first owner or 2nd or 3rd, has nothing to do with this RMA incident.

you can add any terms you like to your future deals, but a closed deal is a closed deal, you need to honor your warranty claim.
with warranty in place, to provide a working set is the shop's responsibility, it is NOT "best effort basis" -- you need to REPLACE a set if you fail to repair it.

with that, i stress that you and your company to HONOR THE ORIGINAL DEAL AND RMA claim.

QUOTE(directd @ Mar 20 2012, 12:54 AM)

(Note: the deletion was due to forum rule:

QUOTE

Refrain from jeopardizing sales unnecessarily. However, you are encouraged to raise an alarm if you strongly believe a potential fraud is about to take place. Alternatively, report the post.
)

===========================
update 19 sep 2012:
Here's the update you guys craving for.

Despite the lack of follow up action, here is NCCC's verdict, CC'ed letter we received on April'12.

neither NCCC nor the seller took follow up action to this letter, despite we sent in several enquiries to NCCC urging for actions to be taken.

my wife, the bearer of this LYN ID, i.e. the name the seller threathened to sue had a miscarriage on 31 Mar 2012 of ~2 months pregnancy.
This dispute happened during and through her pregnancy and miscarriage. (Yeah, they bullied a pregnant lady!!)
Having presented all the evidence and transactional records, i stop updating after seeing that there's no action taken by NCCC and LYN, that the seller is pretty much active and selling, and for the fact that the wife is now having another pregnancy of our 2nd child.

The moderator has made it clear that even if i won this dispute, there's nothing much the forum could do.
if this forum doesn't care / can't take action to help its forumers, why should i trouble myself, my wife and my kid's well being to try to help?

I'll let Karma do its deed.
