What is in the TPP?

I've briefly read through the sections on IP (Intellectual Property: Patents, Trademarks, and Copyrights) and GLCs (referred to as State-controlled Enterprises). I'll give a summary here. It's still a wall of text but hopefully the commentary is easier to digest.

On IP: Chapter 18
Read it in full:
http://www.mfat.govt.nz/downloads/trade-ag...y%20Chapter.pdf

1. Article 18.46 asks that countries extend patents for the length of patent application process. What this means is if a patent application was pending with the patent office for 3 years, the patent should be extended 3 years. The Malaysian Patent Office hasn't been giving these extensions so this would be a change in Malaysia. This may result in longer patents if the patent office do not process patents quickly.

2. Article 18.47 asks that countries do no allow a third party to make use of information that is disclosed for the purpose of marketing approval for agricultural chemical products. For e.g., if Company A submits a new compound X to authorities for marketing approval, the authorities should disallow Company B from using this new information to exploit compound X for at least 10 years. As far as I know, there is no such protection currently in Malaysia so this would be a change.

3. Article 18.48 is about the same thing as point 1 but now asks the patent office to extend the patent to account for delays in the marketing approval process of pharmaceuticals. E.g. if the Ministry approval to sell the drug ate 1 year into the patent, the patent should be extended by 1 year.

4. Article 18.50 is about the same thing as point 2, except that it is now directed to pharmaceuticals. The gist of it is that third parties should not be allowed to exploit information submitted on the new pharmaceutical for at least 5 years.

5. Article 18.52 talks about biologics (genetically-engineered proteins) and confers to them the protections already discussed above.

6. Article 18.63 effectively extends copyrights to life of author + 70 years after author's death. Malaysian copyright is currently is life of author + 50 years after death.

7. Article 18.69 asks countries to provide legal remedies to protect RMI (Rights Management Information). Any person without authority who willfully remove RMI should be liable to legal liability (read: you can be sued if you remove RMI without authorization from the legal owner). The article gives that RMI means "information that identifies a work... the author... owner of any right in the work..." and "information about the terms and conditions of the use of the work..."

8. Article 18.81 asks that countries legally require internet service providers remove or disable access to material "upon obtaining actual knowledge of copyright infringement". In layman, the ISP must remove pirated materials if given sufficient information. This is analogous to the DMCA.

9. The same article also says that you cannot sue the ISP if they remove those materials wrongly but "in good faith" (meaning: they followed the procedures).

10. The same article does not require that ISPs actively monitor for copyright infringement.

11. The same article requires countries to require their ISPs to provide information on the alleged infringer (the person possessing the copyrighted materials) to the copyright owner for the purpose of enforcing that copyright.

12. Annex 18-C, says that Malaysia may require that pharmaceuticals and biologics be first approved in any country prior to marketing approval in Malaysia. I imagine they left it here because we don't have the expertise to approve/unapprove pharmaceuticals and biologics.

Advisory/non-audit consulting

Quite fresh myself. Only 2 years since I graduated with a science degree. I'm thinking of career changing to something more demanding than what I'm doing now (which you probably guess is too relaxed since I'm writing this in the morning). Long hours is okay.

Went through PWC's brochure for graduates and want to have an idea before I invest the time to put together an application. I'm really looking for any kind of advice at all, including those which tell me not to waste my time.

We're not talking about audit by the way.

Does these kinds of jobs take people at my entry-level? What about non-business grads? What kind of people are they looking for? When do firms most actively hire?

Feel free to add in anything.
Photo on resume

Is a photo standard/expected in a resume in Malaysia?

I ask this because at least in the US, attaching a photo to a resume or job application is considered very unprofessional.

Seems like a lot of job adverts here are asking for a photo.

Are photos expected even when they are not explicitly asked?

Bonus questions: Do Malaysian employers even want or read cover letters? Is it common for prospective Malaysian employees to write a cover letter for an online application?

Thanks for your responses.

American complains about Malaysian jail/police

http://www.reddit.com/r/IAmA/comments/1doe...t_1_month_in_a/

QUOTE

The Malaysian police arrested me because my business partner in Malaysia didn't want to pay me, so she paid them less money to arrest me. Also, Malaysia has the most messed up legal system on earth.

QUOTE

The conditions... Oh man! Were they f***ed up... When there are people from Nigeria and Pakistan complaining about human rights abuses, you know it's bad.
50 people per cell, just 1 blanket, crackers for breakfast, with porridge, and tea on occasion, or hot water. sardines and rice for lunch and dinner, with some greens, and a bread roll, a piece of chicken to replace the sardines if you are lucky.. There is no "yard." you are locked down in your cell - always.
Also, don't get sick in there. There is no medicine.

QUOTE

It's not what I was charged with, it's how they do it there that's more f***ed up than anything...
See.. In Malaysia, the police can arrest you for any reason they see fit, and hold you up to 14 days in the jail (which they call lockup.) without charging you with anything, while they "investigate." But, if they can't find anything during their "investigation," which mostly involves going around and trying to extort everyone that you know, they can still charge you with any crime and send it to the magistrate (judge) So, after they charge you on the 14th day, they send you to the judge, where they read you the charges against you, after that, the judge ask if there is anyone there to pay your bail, and if there is not, depending on the seriousness of the charges, they will send you the the prison for 2 weeks or more to await your trial.
Also, they give you no phone calls... It's like being thrown into a pit. So I had no idea what was going on...
Anyway, I was charged for taking the equipment that I bought out of the gym, as she said it was her stuff... And it is not like I fenced it.. I just had it in my apartment.

QUOTE

Being caught with 1 kilo of drugs including marijuana in Malaysia is an automatic death sentence and if you have less than that on yourself you don't get much better than a hanging... It ranges from 10, 20, 30 years, and life.
With that being said... ALL of the guards were selling drugs to the inmates.

QUOTE

The guards loved to beat the crap out of inmates though. Wouldn't touch me though, as they are afraid of western embassies. Actually, the only thing that the American Embassy cares about is if you are being beaten or not, otherwise it could give two shits what happens to you.
Once in awhile though, one of the prisoners, usually Malaysian Indian, will fight the guards back, and they usually win... But they throw you in the hole for 6 months and only give you milk and a dinner role to eat 3 times a day. The rest is just black.
2 guys got into a small scuffle during the lunch handout outside of their cell one day though - they were quickly broken up though - Then thrown in the hole for 2 months each..
In general though. NO ONE WANTS TO f***IN FIGHT IN THERE.
No fear from other inmates, as in Malaysian Prison if you keep to yourself, they may try to steal some of your stuff if you are not looking, but no one bothers you like that. The intimidation game doesn't really exist like it does in the US... Because the guards would just beat the shit out of you if they saw you get out of hand or if other inmates complained.
But what was scary is that you have no idea what is happening outside.. You get to talk to no one and you are cut off from all communication. You just get to talk to the embassy once at the police station, one time in the first week.

Liquids in carry-on luggage for domestic flights

Hey people,

So I got paranoid and called MAS on it.

MAS customer service just told me that the 100ml rule for liquids apply to domestic flights

But is it not only applicable to international flights? The website itself says it is only for international flights.

Can an experienced domestic flier clarify? I intend to bring some liquids that may potentially be embarrassing if airport security whips it out. It is not contraband and not illegal however.

Also, what do you think about the Tesla Model S?

» Click to show Spoiler - click again to hide... «

edit: fixed pics

Survey: Most Israeli Jews would support apartheid

http://www.haaretz.com/news/national/surve...remium-1.471644

Most of the Jewish public in Israel supports the establishment of an apartheid regime in Israel if it formally annexes the West Bank.

A majority also explicitly favors discrimination against the state's Arab citizens, a survey shows.

The survey, conducted by Dialog on the eve of Rosh Hashanah, exposes anti-Arab, ultra-nationalist views espoused by a majority of Israeli Jews. The survey was commissioned by the New Israel Fund's Yisraela Goldblum Fund and is based on a sample of 503 interviewees.

The questions were written by a group of academia-based peace and civil rights activists. Dialog is headed by Tel Aviv University Prof. Camil Fuchs.

The majority of the Jewish public, 59 percent, wants preference for Jews over Arabs in admission to jobs in government ministries. Almost half the Jews, 49 percent, want the state to treat Jewish citizens better than Arab ones; 42 percent don't want to live in the same building with Arabs and 42 percent don't want their children in the same class with Arab children.

A third of the Jewish public wants a law barring Israeli Arabs from voting for the Knesset and a large majority of 69 percent objects to giving 2.5 million Palestinians the right to vote if Israel annexes the West Bank.

A sweeping 74 percent majority is in favor of separate roads for Israelis and Palestinians in the West Bank. A quarter - 24 percent - believe separate roads are "a good situation" and 50 percent believe they are "a necessary situation."

Almost half - 47 percent - want part of Israel's Arab population to be transferred to the Palestinian Authority and 36 percent support transferring some of the Arab towns from Israel to the PA, in exchange for keeping some of the West Bank settlements.

Although the territories have not been annexed, most of the Jewish public (58 percent ) already believes Israel practices apartheid against Arabs. Only 31 percent think such a system is not in force here. Over a third (38 percent ) of the Jewish public wants Israel to annex the territories with settlements on them, while 48 percent object.

The survey distinguishes among the various communities in Israeli society - secular, observant, religious, ultra-Orthodox and former Soviet immigrants. The ultra-Orthodox, in contrast to those who described themselves as religious or observant, hold the most extreme positions against the Palestinians. An overwhelming majority (83 percent ) of Haredim are in favor of segregated roads and 71 percent are in favor of transfer.
The ultra-Orthodox are also the most anti-Arab group - 70 percent of them support legally barring Israeli Arabs from voting, 82 percent support preferential treatment from the state toward Jews, and 95 percent are in favor of discrimination against Arabs in admission to workplaces.

The group classifying itself as religious is the second most anti-Arab. New immigrants from former Soviet states are closer in their views of the Palestinians to secular Israelis, and are far less radical than the religious and Haredi groups. However, the number of people who answered "don't know" in the "Russian" community was higher than in any other.

The Russians register the highest rate of satisfaction with life in Israel (77 percent ) and the secular Israelis the lowest - only 63 percent. On average, 69 percent of Israelis are satisfied with life in Israel.

Secular Israelis appear to be the least racist - 68 percent of them would not mind having Arab neighbors in their apartment building, 73 percent would not mind Arab students in their children's class and 50 percent believe Arabs should not be discriminated against in admission to workplaces.

The survey indicates that a third to half of Jewish Israelis want to live in a state that practices formal, open discrimination against its Arab citizens. An even larger majority wants to live in an apartheid state if Israel annexes the territories.

The survey conductors say perhaps the term "apartheid" was not clear enough to some interviewees. However, the interviewees did not object strongly to describing Israel's character as "apartheid" already today, without annexing the territories. Only 31 percent objected to calling Israel an "apartheid state" and said "there's no apartheid at all."

In contrast, 39 percent believe apartheid is practiced "in a few fields"; 19 percent believe "there's apartheid in many fields" and 11 percent do not know.

The "Russians," as the survey calls them, display the most objection to classifying their new country as an apartheid state. A third of them - 35 percent - believe Israel practices no apartheid at all, compared to 28 percent of the secular and ultra-Orthodox communities, 27 percent of the religious and 30 percent of the observant Jews who hold that view. Altogether, 58 percent of all the groups believe Israel practices apartheid "in a few fields" or "in many fields," while 11 percent don't know.

Finally, the interviewees were asked whether "a famous American author [who] is boycotting Israel, claiming it practices apartheid" should be boycotted or invited to Israel. About half (48 percent ) said she should be invited to Israel, 28 percent suggest no response and only 15 percent call to boycott her.

» Click to show Spoiler - click again to hide... «

Hi guys,

I knocked a Wira's door today and it now has a dented door with some scratches. The door is still okay and there's no need for a replacement. Just knocking and repainting. How much should I offer to compensate the owner?

Thanks a lot

Index Funds

Hey people.

I'm currently looking for an an index fund trading on equities and which complies to its own index without any fund-managing. Something like the S&P500 in the US.

AFAIK, Public Mutual's Equity Index Fund is managed and AmBank's is trading on bonds (how a fund can trade bonds and still be an index fund confounds me).

So far I've found none. Do these even exist in Malaysia?

I have serious doubts when it comes to investing in mutual funds - I basically don't believe those fund managers can outwit the market (or myself) sufficiently to warrant high fees. Plus the bulk of economic literature points to how most managed funds sub-perform relative to the market. I do plan however to check them out, especially their returns after discounting for fees.

Currently have a geared prot warrior (Nemyst) with decent dps gear (at least ilvl200s).

I've been raiding (and currently still is) with an Aussie guild, missing a lot of their raids due to time zone conflicts.

Thinking of pulling together a new guild for Ulduar. We'll start off with Ulduar10, with an intention to make it for 25s as well in a reasonably quick timeframe.

I'm looking at a guild that is committed to progressing through content in 12 to 16-hour raiding week. If you're interested or have a different idea, please do drop me a PM or a reply to this thread.

Thanks

Emergency leave

Hi guys, I need advice.

I'm still under probation and therefore not entitled to any kind of paid leave. Is it still possible for me to call for an emergency leave in less than 24 hours notice (unpaid of course)?

Best thing is I'm currently serving my 2 weeks notice of termination. I've never taken a single day off since I've started with this company. What's the norm by the way?

Fax over network

Hi, I'm posting here because the networks subforum is so filled with streamyx/broadband issues to make this out of place. But mods can feel free to move this there.

My network consists of a telephone line plugged to a router which links up the rest of the network. I have a separate fax line which is plugged to a currently dead fax machine.

If I want the network (with the router plugged into the telephone line) to be able to send and receive faxes, what do I need to do to it? The thing is, I want my networked computers to be able to send/receive faxes. I know that modems are required to translate faxes but the thing is my networked computers are cabled to the LAN and not plugged through the wall jack through modems. DSL is supposed to be compatible with fax/voice aren't they?

I wonder in a network, which PC will answer the fax? It makes no sense for a fax to be delivered through a router.

In short, is it possible to fax over a local network and if so how should I set up my hardware? I'm not talking about fax over IP btw.

Any advice that offers a solution is much appreciated.
