hi,

i need advise on bank procedure for 2nd hand car.

Need help need help,

i'm selling my 2012 c200 to my own brother.. Since this is our first time buying/selling second hand car, we got quite confuse with the calculation and such, including the topup/downpayment.

1) basically, does the calculation below correct?

My Current Loan with Bank :- RM175,000

Market Value:- RM185,000 @ 90% approved

Loan Approved:- RM166,500

Topup/Downpayment:

RM175,000 - RM 166,500 = RM8,500 <---- this is the amount my brother needs to pay in order for the loan to be settled in before transfer to him right?

OR

my brother needs to pay 10% of the RM185,000 which is RM18,500?

2) Second thing is if my current hire purchase account is with CIMB and we going to use different bank for my brother's loan, what is the standard process?

it's not like buying/selling house whereby the buyer's bank will pay the current owner's bank and settled everything at the back end?

2 Names Property Sold

Hi,
appreciate your guys advise on this matter, especially on legal point of view and if you have any experience.

basically,
i'm divorced about 2 years ago and now having dispute with my ex regarding our property since it's under 2 names.

all process of selling the property done.

NOW the Balance Purchase Price (almost half a million) is in lawyer's hand.

However since my ex and me didn't come to any agreement on how to divide the BPP, what happened now are:-

1. Laywer decided to write the cheque under both of our names. Meaning WE NEED TO have joint account to bank in the cheque, possible to happen.[U]
2. Lawyer then decide they will put the BPP under their deposit account and advise us to go settle all our issue at court and bring to them the court order. Then they will release the payment according to the court order.

Question:
1. Lawyer do have rights to hold the BPP and keep them under their own deposit account? I'm afraid if anything happened to us, those money could go to the lawyer itself.
2. Can just the lawyer divide the payment into 50/50 and any legal claims,dispute thereafter we will settle it by our own (my ex and me)
3. What will you do if you are in my situation?
