Penang Chief Minister Lim Guan Eng and his bungalow have been hitting the news for the last week.

How did it start, what do we know and what don't we know?

Malaysiakini sifts through the noise and puts together a brief guide on the Jalan Pinhorn bungalow row.

The allegation

Tasek Gelugor MP Shahbudin Yahaya of Umno last Thursday dropped a bombshell in Parliament, insinuating that Lim was involved in corruption.

Shahbudin accused Lim of purchasing a bungalow from Phang Li Koon at below the market price. Which isn't all that serious, nor a crime.But what made the allegation serious was that Shahbudin linked it to the state's government sale of land in Taman Manggis to a private company in 2012, which BN also claimed was sold at below the market price.

If a chief minister indeed gets a bungalow at a cheap price, in exchange for selling state land at a cheap price, then there likely is a case for the Malaysian Anti-Corruption Commission (MACC) to investigate.

But, are there any merits to allegation in Lim's case? Malaysiakini will explore this shortly.

Let's look at the Taman Manggis land first, because the bungalow in isolation is not an issue.

What is the Taman Manggis land?

The 0.4-hectare plot was sold for RM11 million to Kuala Lumpur International Dental Centre Sdn Bhd (KLIDC) in 2012.

Prior to the sale, Lim had offered Gerakan to purchase the land for RM22 million, after the BN member party claimed that the land was worth double the price.

However, Gerakan failed to come up with the money to complete the transaction.

The Penang Island Dental College is expected to take up residence on nthe site, which will include a 200-chair dental hospital, resource centre, hostel and recreational facilities.

Why is BN linking bungalow to Taman Manggis land sale?

The original bungalow owner, Phang, does not have any interest in KLIDC, which purchased Taman Manggis land, so why is BN trying to link them together?

While there is no direct link, Umno blogs have suggested an indirect link to Phang's business partner as the majority stakeholder in KLIDC.

According to documents from the Companies Commission, Phang is the co-director of Windbond Management & Consultant Sdn Bhd, holding a 20 percent stake.

Her partner in the company is Tang Yong Chew, who controls the remaining 80 percent of the company.

Tang also the majority shareholder of KLIDC, which bought the Taman Manggis land, holding a 60 percent stake in the dental company.

Is this a smoking gun? Not quite. Lim pointed out that the Taman Manggis land was sold based on open tender.

Furthermore, Lim was not part of the tender committee, which was chaired by the state secretary, which awarded the bid.

So, while there is an indirect link between Phang and KLIDC, there is no evidence to show that Lim had used his position to sell state land cheaply, or was even involved in the deal.

The bungalow - sold at below market price?

Back to the much talked about bungalow at 25, Jalan Pinhorn in Green Lane.

Lim bought the 10,161.13sq-ft property on July 28 last year for RM2.8 million, at or RM275.56 per square feet.

The previous owner, Phang bought it at RM2.5 million, or RM246psf, on Sept 27, 2008.

She had renovated the property and later rented it to Lim for six years at RM5,000 a month.

Umno blogs have compared Lim's purchase to a another newly-renovated property on Jalan Pinhorn, which has a plot size of 4,983.690sq-ft and was sold for RM3.6 million or RM 722.36psf in 2014, to claim Lim's purchase was way below market.

If the 2014 transaction is to be a benchmark, Lim's property should be worth more than RM7 million.

However, that is likely an exaggerated figure as the bungalows on Jalan Pinhorn vary starkly, from the rundown to the posh ones, thus the price can also vary widely.

However, Penang Umno Youth chief Rafizal Abdul Rahim submitted a document to the MACC on Monday, in which he claimed showed Lim's unit to have been valued at RM4.27 million.

Rafizal claimed the document was a copy of the property transfer assessment declaration from the Inland Revenue Board.

If the document is authentic, then the property Lim bought was indeed a good deal.

However, the transaction alone, without any quid-pro-quo, does not constitute an offence.

Phang, in a statutory declaration yesterday, stressed that she had no interest in the government and no part in the management of KLIDC.

She also praised Lim as Penang chief minister and said she had no regrets selling the property to Lim.

Amongst the shocking items of evidence understood to have been passed by the MACC’s 1MDB corruption enquiry to the Attorney General were credit card bills run up by the PM for his personal shopping on the public company SRC International’s named company credit cards!

AG Mohamed Apandi, who replaced sacked Gani Patail in August after Najib heard charges were about to be brought on the matter, is clearly playing for time, having yesterday returning the entire dossier to the MACC (Malaysian Anti-Corruption Commission) for ‘further clarifications’.

Apandi, of course, comes up for retirement in just 3 weeks time on February 11th, when he will hit 65. Najib’s uber-loyal prosecutor Shafee Abdullah is already sworn in to replace him, which ought now to enable Apandi to escape this hot potato (he hopes) and to pass it on to Malaysia’s most famous legal thug.

Najib must in turn be hoping that Shafee will simply thrust the whole dossier in the bin and continue to act as his one man legal attack unit against anyone who threatens the ‘Big Boss’.

One month, two credit cards and over three million ringgit!

However, Shafee will be landed with an uncomfortable cover-up to deal with, simply because so many people now have the details from the dossier and are willing to leak them – to outfits such as Sarawak Report.

Last year we already reported that Najib and his wife splashed huge sums of money during August 2014 on credit cards for their European holiday. We are now able to furnish further details of the expenditure, information which we are reliably informed is included in the MACC dossier, which Apandi has decided to sidestep.

The two cards involved were a Visa card issued by CIMB (no: 4585 8180 0000 5496) on which RM449,000 was spent and a Master Card issued by Maybank (no: 5289 4380 0003 8961) on which RM2.8 million was spent in the course of the month of August in 2014.

Items funded included hotels, meals, jewellery purchases and other personal luxury expenditures in the South of Europe, including Italy and Monaco.

Rosmah - the mystery over who funds her big jewellery is starting to unravel as more and more public money has shown up in Najib's spending patterns.

The devastating detail, which makes this expenditure so toxic for a Prime Minister who has spent the last year trying to explain the source of his ostentatious wealth, is that both cards were in name of the company SRC International, which began as a subsidiary of 1MDB before it was taken over by the Finance Ministry directly (Najib is also Finance Minister).

Toxic company

SRC International was famously launched with a RM4 billion loan from the public pension fund KWAP and has from the very beginning been embroiled in controversy over its opaque operations and lack of accountability. The Chief Executive of SRC was none other than Nik Faisal Arif Kamil, who is currently a fugitive in Indonesia and at the centre of the scandal relating to the missing monies from 1MDB and tycoon Jho Low’s sale of UBG.

After public demands for greater accountability over SRC in the 1MDB accounts, Najib in his dual capacity as Minister of Finance took the company directly under the Ministry of Finance and opposition parties have consistently campaigned for proper accountability over whatever has happened to the mission RM4 billion pension fund ‘investment’.

The crisis of confidence deepened after Sarawak Report and the Wall Street Journal reported in detail how RM42 million was funnelled in late 2014 early 2015 by Nik Kamil from SRC into Najib’s personal accounts in KL – an allegation that the Prime Minister has signally failed to refute.

This new information that Najib was also using SRC International’s company credit cards to fund his private jet-setting the previous August helps to further explain how it is that the establishment in KL is buzzing with the news that a slew of suggested criminal charges have now been brought against Najib by the MACC, which was the task force responsible for examining the SRC angle of the 1MDB corruption probe.

Opposition DAP MP Tony Pua has constantly repeated his complaint that virtually none of the RM4 billion borrowed from KWAP has been properly accounted for by SRC. His concerns were not allayed by a Prime Ministerial statement last year, which referred to an investment in a Mongolian coal mine as the major venture in which SRC was involved. After all, Sarawak Report was able to expose that investment as a relatively minor expenditure, worth at the most US85 million.

Sarawak Report has also pointed out that the Prime Minister’s proxy, the businessman Jho Low, has been further identified as the owner of the similarly named SRC Global, which was involved in a private business venture to buy out Canada’s Coastal Energy together with the sacked former Abu Dhabi Aabar fund manager Khadem Al Qubaisi, who had extensive dealings with 1MDB.

It is just one of a series of dealings involving Low where confusion of ownership appears to have been deliberately sown the the use of names similar to companies owned by 1MDB or other major concerns.

Investigations show that the same circle of contacts Najib Razak and his family, Jho Low and Khadem Al Qubaisi have appeared time and again in a series of business dealings both public and private, but all funded by Malaysia’s public money raised by the Prime Minister.

Yesterday’s boomeranging of the MACC dossier makes plain that Apandi is set on sitting out this particular dilemma and passing on the entire toxic mess to his eager successor, Shafee Abdullah. It offers Shafee the choice of becoming identified as wholly complicit in a cover up if he then closes the case or of turning on his key client for the past decade.

Certainly, this would not be the first time that Shafee will have been called on as a fixer of scandals involving the present Prime Minister. In fact, Shafee has been on hand for just about every other major reputational danger that has enveloped Najib in the past.

It was Shafee who waded in to help during the Altantuya murder case and organised for top suspect Najib’s proxy Razak Baginda to be removed as a defendent; Shafee who was found to have together with Najib interviewed the accuser of Anwar Ibrahim the day before that young man reported a sodomy allegation and then he again who prosecuted the case against the opposition leader, despite complaints over the conflict of interest and Shafee who appeared in the hospital, apparently representing no one, on the day of the assassination of the AmBank founder Hussein Najadi, in order to inform the family that the body would be given a Muslim burial the very next day – before they could reach KL.

This time, however, Najib’s master fixer may find the evidence less amendable to disappearance as he steps into his new job at the centre of an unprecedented political scandal in Malaysia, not least because the SRC investigation itself pales into insignificance compared to the vast sums that also reached Najib’s private accounts from a series of BVI companies – guaranteed by a Sheikh, who turned out not to actually exist.

According to a report by Taiwanese site ETToday, the 22 year old victim is due to leave abroad to study, and had planned a farewell party in a local karaoke with his best mates. Like most farewell parties he had quite a few drinks and got himself totally knocked out when the party ended, but unfortunately for him, one of his friend had other plans in mind when he brought him home.

According to the victim’s police report, he planned a farewell party in early January with a group of his friends, and within 3 hours the group had consumed 3 bottles of whiskey. After finding the victim unconscious at the toilet, his friend Zheng guided his drunk friend to rest, and proceeded to hug and kiss the victim while no one was watching. He even took his pants down and touched his penis, and the whole ordeal was captured on CCTV.

Zheng then proceeded to ‘take his friend home’, and that’s when the victim’s nightmare began. He reported to have felt a pain in his anus after Zheng allegedly inserted his fingers, but was too intoxicated to fight back. He woke up the next morning with discomfort in his anal parts, and had found his lower body wet and slimy – he proceeded to file a police report immediately.

Zheng came out later in court and admitted that he had sexual intercourse with his friend, but denied any wrongdoing. In his defense he claimed that the victim, while drunk had been very touchy with him during the party, even to the extent of them touching each other’s privates – which he assumed was flirting, and an invitation for sexual intercourse, which he ‘lovingly’ accepted.

The court was not convinced however, and considered that he not only had taken advantaged of the victim’s intoxication, also misused the trust by his friend, causing the victim physical and mental harm. He was sentenced to 10 months in jail for rape. The victim is currently recovering in a local hospital.

(CNN)Russian President Vladimir Putin has told a German newspaper he did not mean to scare Chancellor Angela Merkel when he brought his pet Labrador in to meet her during an infamous press conference nine years ago.

Merkel, reportedly fearful of dogs since one attacked her in 1995, was photographed looking distinctly uncomfortable when Putin brought his large black Labrador Koni into a meeting at his summer residence in Sochi, Russia, in January 2007.

The Russian leader appeared to smirk as he watched his pet approach his uneasy VIP guest.

Now, years on, Putin has told German newspaper Bild he had no intention of intimidating Merkel.

"I wanted to do something nice for her," he told the newspaper, in an interview published Monday.

"When I found out that she doesn't like dogs, of course I apologized."

Putin's treatment of Merkel, in office for less than two years at the time, reportedly rankled the German press corps.

"I never said that. I value her as very professional and open," he said.

Putin said that, despite tensions with the West, both sides had a shared interest in fighting Islamic terrorism.

"We should stand together much more globally in the fight against terror, which is a big challenge," he said. "Even though we don't agree every time and on every subject, no one should take that as an excuse to declare us enemies."
