Insolvency: Can a Bankrupt be Charged Interest?

Dear LYN,

Over here in my Condo's Management Corporation, we have owners who are bankrupt and owe us big sum of unpaid maintenence fees. The debtor claimed that as a bankrupt, they cannot be charged interest (Under the MC's by-law, the MC has the right to charge interest on outstanding dues) by the MC on the unpaid dues starting from the date of the declaration of bankruptcy by the court. My questions:

1. Under which clause of the insolvency act says that interest cannot be charged?
2. Does it apply to Non-Financial Institution? (Like a Condo Management Corporation)
3. Despite being a bankrupt for more than 3 years, the said parcel of the owner is still not foreclosed yet by the creditors. Is this common? Why did Insolvency/Creditors not take over the parcel?

Thanks for your insights!

Celebrity Fitness: Locker broken into

the locker that I used was broken into while I was working out. I lost my wallet and mobile phone in this incident. The Management assured me that a thorough investigation will be carried out and they will keep me posted. It has been 2 working days and I have not heard from them. This happened a week into my 2 weeks trial with Celebrity Fitness, what a good start. One thing for sure I would not sign-up any offers from Celebrity Fitness and would encourage other potential gym goers to do the same. The poor security level in your gym is shocking.

Now my question is, any remedy that I can seek? They told me straight, dont expect compensation from them which fired me up even more to explore if there are any remedy. Consumer Tribunal?

One point to note, the hotel got the Innkeepers Act to protect them from any liability on damages/losses of their guests. For a Gym, what do they have? I have not signed anything, just a 2 weeks trial. There are no disclaimers, notice board informing their customers that they are not liable as we often seen in most of car parks and other establishments.

Opinion please.

Sunway Bhd Rights Issue

Dear Investors,

Sunway Berhad recently announced a rights issue, for every 3 units will get to exercise the option to get get 1 unit at RM1.70.

Have few lots at RM2.58.

Wondering if I should exercise the option. If I do, I am worried it will take 1-2 years before it will regain its EPS, not forgetting other investors would dump it once the exercise is completed, further eroding its value.

What do you think? Exercise the option or sell now? I stand to gain 16% ROI if I sell now at RM2.95.

[WTA]Bank failed to release progress payment

Dear all, advice would be appreciated.

Financier failed to release progress payment on time. Developer charged me late payment interest. But the Financier already posted the said progress payment in my loan account and I am servicing the interest due. According to Financier they already issued the payment but they can't prove it. They are still investigating.

Question:

1. In this case, the onus is on who to make sure all payment to developer is in order?

2. Who is suppose to pay for the penalty? Clearly this is something that is beyond my control. No way I am paying it.
