Malaysia Tycoon Tony Fernandes' Indian Roots

Malaysian airline tycoon Tony Fernandes, chief executive of budget carrier AirAsia Bhd, said he’s applied for a version of Indian citizenship, a status that may allow him to fully own his local unit and skirt some aviation rules that restrict foreigners.

“There will be a big party when I get my approval,” he told reporters in the southern Indian city of Hyderabad on Wednesday, where he was attending an air show. “I will be the same as everyone else.”

If India grants the special citizenship to Fernandes, 51, he may be able to fend off rivals who say AirAsia is violating foreign ownership rules by fully controlling the local unit even though it’s allowed to hold only up to 49 percent. Becoming an overseas citizen of India may clear the path for the British-educated chief executive officer to acquire, in his personal capacity, 100 percent of the venture he now shares with the Tata Group and a private investor.

“This whole foreign thing is bizarre for me,” Fernandes, whose parents are from India, told reporters. “What’s important? Is it creating jobs, is it creating investments, increasing tourism?”

The Malaysia-listed carrier started its India operations in June 2014, intensifying competition in an air travel market where operators racked up $10 billion in losses in the past seven years. AirAsia (India) Pvt. is a joint venture between AirAsia, Tata Sons Ltd. and Telestra Tradeplace Pvt.

Malaysian Bar takes AG’s decision on RM2.6b

KUALA LUMPUR, March 15 — The Malaysian Bar has filed a judicial review at the High Court against the Attorney-General’s decision to close investigations on the transfers of RM2.6 billion and funds from SRC International to the prime minister’s accounts.

Malaysian Bar president Steven Thiru said the legal body was seeking to set aside Attorney-General Tan Sri Mohamed Apandi Ali’s decisions on January 26, 2016, that cleared Prime Minister Datuk Seri Najib Razak of wrongdoing in both cases and that ordered the Malaysian Anti-Corruption Commission (MACC) to close the investigation papers.

“There should be no usurpation of the judicial powers of the courts, as it is for the courts — and not the Attorney General — to decide on the innocence or guilt of a suspect in respect of any alleged crime,” Steven said in a statement today.

“The Malaysian Bar is of the view that the discretionary prosecutorial powers conferred on the Attorney General by Article 145(3) of the Federal Constitution are not absolute or unfettered, and the exercise of these powers can be challenged in a judicial review action.

“The scope and ambit of the discretionary prosecutorial powers, and whether these powers were exercised in accordance to law on the facts of any given case, should be determined by the courts,” added the head of the peninsular professional legal body.

According to Steven, the Malaysian Bar’s judicial review application also sought to disqualify the AG from making any further decisions on the matters covered by the MACC’s investigation papers, noting that Apandi had reportedly given Najib legal advice on those issues.

The Malaysian Bar also sought court orders to enable the Solicitor-General to act as the interim AG, upon Apandi’s disqualification, in relation to the MACC’s request for mutual legal assistance in order to complete its investigations on the RM2.6 billion transfer.

A court order was also sought to enable the Solicitor-General to reconsider MACC’s recommendations in its three investigation papers in deciding whether to initiate prosecutions.

Steven said the Malaysian Bar also wanted a court order to enable the MACC to continue investigations in those cases without interference.

Malay Mail Online reported earlier today that the Malaysian Bar is set to debate at its annual general meeting (AGM) Saturday a motion that calls on Apandi to quit as AG, in light of the controversies surrounding state investment firm 1Malaysia Development Berhad (1MDB), former 1MDB unit SRC International, and the RM2.6 billion transfer into Najib’s personal accounts.

Apandi told a press conference last January 26 that he found the prime minister did not commit any criminal offence in relation to the SRC International and RM2.6 billion cases, claiming that the RM2.6 billion was a donation from the Saudi royal family and that Najib was not aware that money had been transferred into his personal accounts from SRC International.

Alibaba Group Holding Ltd.’s delivery affiliate attracted investments from Malaysia and Singapore, including Temasek Holdings Pte, in its first round of external fundraising since its creation in 2013.

Zhejiang Cainiao Supply Chain Management Co. also gained funding from GIC Pte. and Khazanah Nasional Bhd to bankroll its expansion, according to an e-mailed statement on Monday. The company didn’t specify the amount raised or its valuation.

Cainiao, which has grown as Alibaba developed a dominant position in Chinese e-commerce, handles more than 70 percent of the nation’s express packages with its network set to span 2,800 county districts inside the country and 224 countries and regions globally by March. The company is angling toward a public offering to bankroll its expansion, as its Chief Executive Officer Tong Wenhong envisions the ability to support daily package deliveries of 200 million.

“If e-commerce was the focus of China’s economy in the past 10 years, logistics will be the focus for the next 10,” Tong said in the statement.
The delivery network is valued at about 50 billion yuan ($7.7 billion) in this funding round, Caixin reported citing people familiar with the matter. Alibaba declined to comment in an e-mailed statement.

Cainiao has previously said its network expansion could reach the U.S., Russia, Brazil and Spain to complement existing bases in seven countries, including Amazon.com Inc.’s home turf.

Alibaba created Cainiao with department store chain Intime Retail Group Co. and industrial conglomerate Fosun International Ltd. Alibaba owned 48 percent of Cainiao at the time.

Cainiao had 700 employees as of June last year. The company runs its own warehouses while also operating as a network overseer, using software to marshal trucking, shipping and delivery firms to get packages from seller to buyer.

KUALA LUMPUR, March 14 — Controversial blogger Papagomo will have his house seized by the court and put for sale following his failure to pay RM800,000 damages to PKR de facto leader Datuk Anwar Ibrahim in a libel suit in which he lost.

Court bailiffs and Anwar’s lawyers today posted a notice of seizure and sale for an apartment property in Kuala Lumpur under Papagomo’s real name, Wan Muhammad Azri Wan Deris.

No individuals were in the house when the bailiff along with lawyers Latheefa Koya and Raul Lee came to serve the execution order for seizure and sale issued by the Kuala Lumpur High Court.

“We will now go back to the court and obtain a new order for another date,” Latheefa told reporters here.

The new court order will be issued if the current notice is not heeded, and will include permission for court officials to enter by force to seize the property at the walk up apartment complex in Setapak, which is Papagomo’s official registered address.

The High Court found him guilty of libel against Anwar, who was then opposition leader, in February 2014 following a series of blog posts he wrote about Anwar.

The Court of Appeal in December last year upheld the decision after Papagomo’s appeal and ordered damages amounting to RM800,000, which the blogger is yet to pay.

IKEA confirms Penang outlet will open in 2018

Work at its 24-acre Batu Kawan site has started

GEORGE TOWN: The first IKEA store in the northern region will open in Penang by the third quarter of 2018.

Ikano Pte Ltd, the owner of the IKEA franchise holder in Singapore, Malaysia and Thailand, said work at the Batu Kawan site had started and plans were now underway to prepare a 24-acre plot for the development.

“We confirmed today our plan to open a store in Penang during the third quarter of 2018,” managing director Christian Rojkjaer said in a statement.

Ikano had teamed up with Aspen Group in September 2014 to purchase 245 acres of land from Penang Development Corp to develop the Aspen Vision City (AVC), where the IKEA store would be located.

Ikano will hold a 20% stake in AVC while Aspen the remaining 80%. The planned IKEA store will be wholly owned by Ikano.

“We want to transform the vast swath of land in Batu Kawan into a new metropolis where people can live, work and play. A shopping centre anchored by IKEA is a key component of the development plan for AVC.

“The IKEA vision is to create a better everyday life for the people,” Rojkjaer said.

The IKEA store will bring affordable range of functional home furnishings to the northern region, along with hundreds of job and economic spin-off opportunities for the local community.

The long-term development plan for AVC includes condominiums, office towers, an international school, a Columbia Asia Hospital and a 24-acre park, according to Rojkjaer.

“Piling works are in full swing for the first phase – a gated and guarded commercial precinct called Vervéa. Plans for a high-rise condo called Vertu Resort received a warm response when it was recently introduced to the public.

“With a gross development value of RM8bil, the entire AVC development is slated for completion in 10 years,” he said.

THE Strata Management Act 2013 (Act 757) that came into force in June last year unifies all previous laws governing the management and maintenance of common properties in stratified – condos and high-rise – buildings, explains Wong Kok Soo.

Wong is an adviser to the Association of Valuers, Property Managers, Estate Agents and Property Consultants in the Private Sector of Malaysia and consultant to the National House Buyers Association.

He explains that service or maintenance fees, known as “charges”, must now be kept in a “maintenance account” for the general maintenance, management and administration of the common property and building. Contributions to a separate “sinking fund” account are used only for capital expenditure, he explains.

He highlights the Act’s new measures to address the perennial problem of collecting these monies:

> Failure to pay within 14 days from date of service of billing incurs interest not exceeding 10% a year on daily rest until payment is made.

> Any restriction or action against a defaulter shall include his family or any chargee, assignee, successor-in-title, lessee, tenant or occupier of his unit.

> A defaulters’ list showing the amounts owed can be displayed on notice boards.

> A managing body can deactivate the defaulter’s electromagnetic access device without prior notice. The defaulter can be asked to sign a register upon every entry/exit. A fee not exceeding RM50 can be charged for reactivation of the device upon settlement of arrears.

> Use of common facilities/services, including car park bays, can be suspended.

> A managing body can demand payment of arrears by issuing the prescribed regulation Form 11 (used by developers and joint management bodies) or Form 20 (used by management corporations).

> A defaulter who fails to comply with such a notice of demand commits a criminal offence, and upon conviction, without reasonable excuse, can be fined up to RM5,000 or jailed for not more than three years, or both.

> The defaulter can be further fined up to RM50 for every day the offence continues after conviction.

> If the debt due is not settled within the stated 14-day period in the notice of demand, the managing body can file a claim in the Strata Management Tribunal to recover the sum. Failure to comply with an award made by the tribunal is a criminal offence and, upon conviction, the defaulter can be fined up to RM250,000 or jailed for not more than three years, or both. The defaulter can also be further fined up to RM5,000 for every day the offence continues after conviction.

BSI Singapore Banker Involved in 1MDB leaves

Yak Yew Chee, a BSI Bank Singapore executive whose financial accounts were frozen as part of a probe related to a Malaysian government fund, left the bank last month, according to the firm.

Yak, 58, had been a relationship manager for 1MDB Global Investments Ltd., a unit of 1Malaysia Development Bhd., whose advisory board is headed by Malaysian Prime Minister Najib Razak. 1MDB has been the subject of investigations stretching from the U.S. to Singapore amid allegations of financial irregularities.

The banker’s accounts were frozen by Singapore authorities in September and he’s been questioned as part of the city-state’s 1MDB inquiry. Yak was placed on leave from May to September while BSI conducted investigations, according to court papers. He hasn’t been charged.

“He is no longer employed by BSI,” Valeria Montesoro, a spokeswoman at the Lugano, Switzerland-based bank said in an e-mailed response to queries. “We fully cooperate with all authorities and regulators if and whenever necessary.” Yak’s lawyer Roderick Martin declined to comment.

Yak said in a declaration to BSI on April 27, and reproduced in court papers, that he didn’t get unlawful benefits from managing the 1MDB account.

Yak last month asked the Singapore High Court for permission to transfer funds from overseas bank accounts and unfreeze his funds in the city. A senior vice president at BSI, he was until recently paid a monthly salary of about S$82,000, ($59,000).

Both Najib and 1MDB have consistently denied any wrongdoing. Singapore’s authorities have seized “a large number” of bank accounts in connection with possible money-laundering in the country.

BSI said on Wednesday Hanspeter Brunner, its Singapore-based head of Asia operations who will turn 64 in April, is to retire in the coming weeks. His replacement will be Raj Sriram who will be appointed in the interim, pending the Singapore regulator’s approval, Montesoro said.

KUALA LUMPUR: The International Monetary Fund (IMF) has recommended Malaysia’s implementation of the goods and services tax (GST) as a case study to Middle Eastern countries which are looking to adopt a consumption tax regime, said Customs deputy director-general Datuk Subromaniam Tholasy.

“The United Arab Emirates will implement GST — or value added tax — in 2018. There are already inquiries on Malaysia’s model and the success of the country’s implementation. Malaysia is a pioneer in this implementation, especially when it comes to Islamic-related products,” he said.

Like Malaysia, many Middle Eastern governments are faced with shrivelling revenues because of the sharp fall in the price of crude oil over the past one year plus, as they rely heavily on black gold to fatten their coffers.

Subromaniam said a consumption tax is better able to endure economic shock, because of its broad base. While this tax ought to be good for the government, he said consumers too will benefit in the long run.

In Malaysia’s case, he noted the increase in prices of goods has tapered off, nearly one year into the implementation.

“Most of the prices went up before the implementation date, because it’s easier to hide under the old tax system and profiteer,” Subromaniam said, while adding that he cannot comment much on cases of profiteering, because it falls under the Ministry of Domestic Trade, Cooperatives and Consumerism’s supervision.

Nearly a year later since the GST was implemented, it seems there are still a lot of confusion and misunderstanding about the GST, said Grant Thornton partner and head of indirect taxes for Apac, Lorraine Parkin.

“Businesses in Malaysia should focus on managing risks, getting their systems and processes right; understand their supply chains, so that they can actually pay the right amount of tax,” she said.

Subromaniam said the Royal Malaysian Customs Department is dispatching its audit teams to help businesses on filing the proper amount to tax, and what not to.

Vanga allegedly called the election of Barack Obama as well, predicting the 44th president of the United States would be an African American – also making the chilling claim that he would be the ‘last U.S. president’.

The last known Malaysian to be nominated to receive Nobel Prize in Medicine was Dr. Wu Lien-teh since the Nobel Foundation statutes strictly prohibits the name of the nominees and nominators for 50 years from the year of nomination.

The Malaysian who won the award was not even the guy they interviewed for the Prize.

PETALING JAYA - All that Mohd Nasarudin Mohd Yusof wanted to do after moving to The Hague, Netherlands, and joining the Organisation for the Prohibition of Chemical Weapons (OPCW) three years ago, was to make Malaysia proud of his service there.

"I did not win the Nobel prize for individual achievement. I received it with my organisation, for the whole team's work," said the chemical weapons and munition specialist.

The Nobel Peace Prize to the OPCW consisted of a medal, a diploma and a cash prize of about 900,000 euro (S$1.49 million).
Nasarudin said it was difficult initially for him to decide to relocate to the Netherlands.

"Such opportunities only come once in a lifetime though, so I decided to grab it," said the retired lieutenant-colonel.
Malaysia's multicultural society makes it easy for Nasarudin to get acclimatised to the different cultures of the Dutch.
He said he also got help from other Malaysians - of all backgrounds - in The Hague, including a colleague from Malaysia who holds a Permanent Resident status in Britain.

"She had already surrendered her Malaysian citizenship, but I suppose it's true what they say - once a Malaysian always a Malaysian."
His experience abroad had also made him appreciate Malaysia more, said Nasarudin.

To those contemplating leaving Malaysia for work or studies, Nasarudin advises them to just go for it.
"It will not make you any less Malaysian. Good opportunities only come once in your lifetime, so don't waste the chance. That working experience will be valuable in life."
Nasarudin said the Merdeka celebrations this year would be poignant for the Malaysian community in the Netherlands as the Malaysian spirit there had grown stronger after the MH17 tragedy.

He hopes all Malaysians can learn from this tragedy and stay united from wherever they are.

For now, Nasarudin will continue to try and do Malaysia proud from afar.

"I cannot come back yet because there is no work in Malaysia for my specialisation.

"I can contribute more if I stay in The Hague although I really miss the Malaysian weather," he quipped.

Beliau berkata berkata demikian ketika diminta mengulas kenyataan Ketua Penerangan PAS Datuk Mahfuz Omar dalam sebuah portal berita semalam yang menafikan Mohamed Nabi Bux anggota parti itu, sebaliknya mendakwa siasatan menunjukkan beliau anggota Umno Gombak.

Sementara itu berlaku sedikit kekecohan di luar pekarangan Dewan Sri Pinang selepas proses penamaan calon apabila seorang calon Bebas Abu Backer Sidek Mohamad Zan mengeluarkan perkataan ‘p4ria’ ketika mengadakan sidang akhbar di kawasan tersebut.

Tindakan calon Bebas yang menggunakan simbol kuda itu menimbulkan kemarahan beberapa individu berketurunan India yang kebetulan berada di situ dan meminta Abu Backer Sidek memohon maaf secara terbuka.

Bagaimanapun, Abu Backer Sidek yang juga seorang peguam enggan dan mempertahankan kata-katanya itu dengan mendakwa perkataan tersebut merujuk segelintir pihak yang melakukan demontrasi jalanan, bukan kepada kaum India.

Namun alasannya tidak diterima dan berlaku pertengkaran kira-kira 10 minit sebelum seorang wakil media berbangsa India mententeramkan keadaan.

“What happen to the motto ‘lawan tetap lawan’ (we will fight on regardless). I know Umno uses it. What about BN? Why can’t MCA have a similar fighting spirit?,” he questioned.

He said BN should now consider merits of MCA re-joining the cabinet and on whether it had what it takes to take on the opposition.

Rahmad said MCA has to learn from DAP, who had in the last two decades slogged on despite losing in countless elections.
“They (DAP) wanted to prove that they are not quitters,” he quipped.

The by-election was called after Bukit Gelugor incumbent Karpal Singh died in a road accident last month.

DAP has announced that Karpal’s third son Ramkarpal would be its candidate for the seat. Former Gerakan vice-president Huan Cheng Guan, has also declared his intention to join the fray.

Rahmad said BN as the ruling federal coalition had a responsibility to contest in all by-elections to show that it was for all Malaysians regardless of race or religion.

“What kind of message is MCA dishing out? That it is no longer relevant? Voters are scrutinising them and they must respond to the struggle of winning back their core supporters, which are the Chinese,” he added

No matter what MCA cited, voters have come under the impression that the party gave up on them, he added.

The voters in Bukit Gelugor comprises of 14.48% or 11,880 Malay voters, 61,112 or 74.49% Chinese voters, 8,660 or 10.56% Indian voters and 0.48% or 390 other races.

According to the blog, Mohamed Nabi Bux Mohd Nabi Sathar, 63, a businessman who claims to be a PAS ordinary member from Batu Caves, Kuala Lumpur had expressed his intention to contest as an independent candidate.

However, the blog exposed a print-screen shot that proved Mohamed Nabi as an Umno member from the Gombak division.

As reported in the blog, Mohamed Nabi said that he wants to promote Islamic and hudud teachings which he hoped would be implemented in the year 2020.

He urged Muslim voters in Penang to support him.

Penang PAS leader Iszuree Ibrahim was shocked with Mohamed Nabi’s intention to contest as the party will be throwing its full support and campaign efforts for DAP in Bukit Gelugor.

When FMT contacted PAS Information chief Mahfuz Omar to clarify the matter, he confirmed that Mohamed Nabi is an Umno mohamed nabi buxmember and not a PAS member.

The nomination day for Bukit Gelugor is set for Monday and the polls will be on May 25.

Man cuts off his own penis

A Chinese man frustrated at being single cut off his own penis then, in agony, decided to cycle to a hospital for treatment.
When he arrived doctors told him they couldn’t help save his manhood and ordered him to cycle back home to get the penis before he could be treated.
When Yang Hu, 26, eventually arrived back at the hospital with the severed member, doctors told him that it had been without blood for too long, and it was impossible to reattach it.

Yang’s friends said that he had been increasingly depressed about the fact that since moving to the city he could not find a girlfriend.
What was worse, they said, was that he was doing such long hours in a clothing factory in Jiaxing, in Zhejiang province in east China, that he doubted he would ever have a chance to meet a woman.

His depression grew so bad that after returning home after work at 9pm on October 27 to his rented room he had suddenly decided to cut off his member as there was no use for it anyway, and believing it would stop him thinking about getting a girlfriend, as reported in dailymail.

Incredibly he managed to cycle to the hospital, then cycled home again to collect the severed member and then back to the hospital.
His friends criticised doctors saying that had they provided the man with an ambulance he might have managed to get home quicker and his private parts could have been saved.
