            <title>Malaysian Bar takes AG’s decision on RM2.6b</title>

            <description>KUALA LUMPUR, March 15 — &lt;b&gt;The Malaysian Bar has filed a judicial review at the High Court against the Attorney-General’s decision to close investigations on the transfers of RM2.6 billion and funds from SRC International to the prime minister’s accounts.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;&lt;u&gt;Malaysian Bar president Steven Thiru said the legal body was seeking to set aside Attorney-General Tan Sri Mohamed Apandi Ali’s decisions on January 26&lt;/u&gt;, 2016, that cleared Prime Minister Datuk Seri Najib Razak of wrongdoing in both cases and that ordered the Malaysian Anti-Corruption Commission (MACC) to close the investigation papers.&lt;br /&gt;&lt;br /&gt;“There should be no usurpation of the judicial powers of the courts, as it is for the courts — and not the Attorney General — to decide on the innocence or guilt of a suspect in respect of any alleged crime,” Steven said in a statement today.&lt;br /&gt;&lt;br /&gt;“&lt;b&gt;The Malaysian Bar is of the view that the discretionary prosecutorial powers conferred on the Attorney General by Article 145(3) of the Federal Constitution are &lt;u&gt;not absolute or unfettered&lt;/u&gt;, and the exercise of these powers can be challenged in a judicial review action&lt;/b&gt;. &lt;br /&gt;&lt;br /&gt;“The scope and ambit of the discretionary prosecutorial powers, and whether these powers were exercised in accordance to law on the facts of any given case, should be determined by the courts,” added the head of the peninsular professional legal body.&lt;br /&gt;&lt;br /&gt;According to Steven, the Malaysian Bar’s&lt;b&gt; judicial review application also sought to disqualify the AG from making any further decisions on the matters covered by the MACC’s investigation papers&lt;/b&gt;, noting that Apandi had reportedly given Najib legal advice on those issues.&lt;br /&gt;&lt;br /&gt;The Malaysian Bar also &lt;b&gt;sought court orders to enable the Solicitor-General to act as the interim AG,&lt;/b&gt; upon Apandi’s disqualification, in relation to the MACC’s request for mutual legal assistance in order to complete its investigations on the RM2.6 billion transfer.&lt;br /&gt;&lt;br /&gt;A court order was also sought to enable the Solicitor-General to reconsider MACC’s recommendations in its three investigation papers in deciding whether to initiate prosecutions.&lt;br /&gt;&lt;br /&gt;Steven said the Malaysian Bar also&lt;b&gt; wanted a court order to enable the MACC to continue investigations in those cases without interference.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Malay Mail Online reported earlier today that the Malaysian Bar is set to debate at its annual general meeting (AGM) Saturday a motion that calls on Apandi to quit as AG, in light of the controversies surrounding state investment firm 1Malaysia Development Berhad (1MDB), former 1MDB unit SRC International, and the RM2.6 billion transfer into Najib’s personal accounts.&lt;br /&gt;&lt;br /&gt;Apandi told a press conference last January 26 that he found the prime minister did not commit any criminal offence in relation to the SRC International and RM2.6 billion cases, claiming that the RM2.6 billion was a donation from the Saudi royal family and that Najib was not aware that money had been transferred into his personal accounts from SRC International. &lt;br /&gt;&lt;br /&gt;&lt;a href='http://www.themalaymailonline.com/malaysia/article/malaysian-bar-takes-ags-decision-on-rm2.6b-src-international-cases-to-court#sthash.h9pyBwfe.dpuf' target='_blank'&gt;SOURCE&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;TLDR: not for 2&amp;quot;</description>

            <description>&lt;b&gt;Work at its 24-acre Batu Kawan site has started&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;GEORGE TOWN: The first IKEA store in the &lt;b&gt;northern region will open in Penang by the third quarter of 2018.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Ikano Pte Ltd, the owner of the IKEA franchise holder in Singapore, Malaysia and Thailand, said work at the Batu Kawan site had started and plans were now underway to prepare a 24-acre plot for the development.&lt;br /&gt;&lt;br /&gt;“We confirmed today our plan to open a store in Penang during the third quarter of 2018,” managing director Christian Rojkjaer said in a statement.&lt;br /&gt;&lt;br /&gt;Ikano had teamed up with Aspen Group in September 2014 to purchase 245 acres of land from Penang Development Corp to develop the Aspen Vision City (AVC), where the IKEA store would be located.&lt;br /&gt;&lt;br /&gt;Ikano will hold a 20% stake in AVC while Aspen the remaining 80%. The planned IKEA store will be wholly owned by Ikano.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;“We want to transform the vast swath of land in Batu Kawan into a new metropolis where people can live, work and play. A shopping centre anchored by IKEA is a key component of the development plan for AVC.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;“The IKEA vision is to create a better everyday life for the people,” Rojkjaer said.&lt;br /&gt;&lt;br /&gt;The IKEA store will bring affordable range of functional home furnishings to the northern region, along with hundreds of job and economic spin-off opportunities for the local community.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;The long-term development plan for AVC includes condominiums, office towers, an international school, a Columbia Asia Hospital and a 24-acre park, according to Rojkjaer.&lt;br /&gt;&lt;/b&gt;&lt;br /&gt;“Piling works are in full swing for the first phase – a gated and guarded commercial precinct called Vervéa.             <title>Condo/Apartment/Flat/High Rise Building Owners</title>

            <description>&lt;b&gt;THE Strata Management Act 2013 (Act 757) that came into force in June last year unifies all previous laws governing the management and maintenance of common properties in stratified – condos and high-rise – &lt;/b&gt;buildings, explains Wong Kok Soo.&lt;br /&gt;&lt;br /&gt;Wong is an adviser to the Association of Valuers, Property Managers, Estate Agents and Property Consultants in the Private Sector of Malaysia and consultant to the National House Buyers Association.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;He explains that service or maintenance fees, known as “charges”, must now be kept in a “maintenance account” for the general maintenance, management and administration of the common property and building. Contributions to a separate “sinking fund” account are used only for capital expenditure, he explains.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;&lt;span style='font-size:12pt;line-height:100%'&gt;He highlights the Act’s new measures to address the perennial problem of collecting these monies:&lt;br /&gt;&lt;br /&gt;&amp;gt; Failure to pay within 14 days from date of service of billing&lt;u&gt; incurs interest not exceeding 10%&lt;/u&gt; a year on daily rest until payment is made.&lt;br /&gt;&lt;br /&gt;&amp;gt; Any restriction or action against a defaulter shall include his family or any chargee, assignee, successor-in-title, lessee, tenant or occupier of his unit.&lt;br /&gt;&lt;br /&gt;&amp;gt; A defaulters’&lt;u&gt; list showing the amounts owed can be displayed on notice boards.&lt;/u&gt;&lt;br /&gt;&lt;br /&gt;&amp;gt; A &lt;u&gt;managing body can deactivate the defaulter’s electro­magnetic access device without prior notice&lt;/u&gt;. The defaulter can be asked to sign a register upon every entry/exit. A fee not exceeding RM50 can be charged for reactivation of the device upon settlement of arrears.&lt;br /&gt;&lt;br /&gt;&amp;gt; &lt;u&gt;Use of common facilities/services, including car park bays, can be suspended&lt;/u&gt;.&lt;br /&gt;&lt;br /&gt;&amp;gt; A managing body can &lt;u&gt;demand payment of arrears by issuing the prescribed regulation Form 11&lt;/u&gt; (used by developers and joint management bodies) or Form 20 (used by management corporations).&lt;br /&gt;&lt;br /&gt;&amp;gt; A defaulter who fails to comply with such a notice of demand &lt;u&gt;commits a criminal offence&lt;/u&gt;, and upon conviction, without reasonable excuse, can be fined up to RM5,000 or jailed for not more than three years, or both.&lt;br /&gt;&lt;br /&gt;&amp;gt; The defaulter can be further fined up to RM50 for every day the offence continues after conviction.&lt;br /&gt;&lt;br /&gt;&amp;gt; If the debt due is not settled within the stated 14-day period in the notice of demand, &lt;u&gt;the managing body can file a claim in the Strata Management Tribunal to recover the sum&lt;/u&gt;. Failure to comply with an award made by the tribunal is a criminal offence and, upon conviction, the defaulter can be fined up to RM250,000 or jailed for not more than three years, or both. The HBA, he adds, has proposed some 20 amendments to the Act and its ­regulations to “plug the loopholes” and address inconsistencies.&lt;br /&gt;&lt;br /&gt;“We’ve seen the practical application of the Act’s laws. There are teething problems so we’ve made our recommendations to the Urban Wellbeing, Housing and Local Government Ministry,” he says, though he declines to elaborate on those recommendations.&lt;br /&gt;&lt;br /&gt;But no matter how sound the law, it won’t solve anything unless strictly enforced, he stresses.&lt;br /&gt;&lt;br /&gt;Real Estate and Housing Developers’ Association president Datuk Seri F.D. Iskandar agrees.&lt;br /&gt;&lt;br /&gt;“Regardless of the provisions provided in the law, problems will persist without proper monitoring and enforcement,” he says.&lt;br /&gt;&lt;br /&gt;He does feel, though, that the penalties imposed under the Act will go a long way towards encouraging unit owners to pay their fees.&lt;br /&gt;&lt;br /&gt;“The penalties will nudge many to settle their dues and address the ‘why should I pay’ attitude,” he says.&lt;br /&gt;&lt;br /&gt;He adds that the provisions in the new Act have given much needed recourse to developers, joint management bodies and ­management corporations, as they will be able to file claims with the Strata Management Tribunal.&lt;br /&gt;&lt;br /&gt;“With further provisions to recover sums owed, including the option to auction off defaulters’ movable property, it is likely that the long-standing non-payment issue will be reduced.”&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Wong actually thinks the provisions don’t go far enough. Instead of just moveable property, he says the law should provide for the seizure and public auction of the ­actual unit belonging to a defaulter if arrears reach a set limit.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Such a measure will have a strong deterrent effect. Singapore does this and high-rises there are free from the problem of fee defaulters, he says.&lt;br /&gt;&lt;br /&gt;While Building Managers Association of Malaysia (BMAM) deputy president Tan Sri Teo Chiang Kok agrees – “There must be an effective process of recovery. Once the property is auctioned off, the balance can go back to the owner,” he says – the HBA’s Chang does not, saying that giving the tribunal powers of public auction would be “too drastic”.&lt;br /&gt;&lt;br /&gt;Managing director of Yap Burgess Rawson International managing director Wong Kok Soo.&lt;br /&gt;Wong Kok Soo&lt;br /&gt;Doing so, he feels, would be unfair and cause too much hardship, as there would be legal and technical complications that a layperson wouldn’t be able to undertake.&lt;br /&gt;&lt;br /&gt;“Ordering an auction is a complex and serious matter that should only be dealt with by a full-fledged court. If a defaulter only owes RM25,000 and his unit is worth RM500,000, a tribunal would be ill-equipped to deal with related issues like bank collateral vis-à-vis indebtedness and price of sale,” he points out.&lt;br /&gt;&lt;br /&gt;The point of the quasi-legal form of redress offered by the tribunal is to offer easy, cheap and speedy justice while sparing the parties involved from having to go to court, he says.&lt;br /&gt;&lt;br /&gt;“Although it doesn’t have the power to order that the stratified property belonging to defaulters be auctioned off, such a remedy is still possible through the normal legal process.&lt;br /&gt;&lt;br /&gt;“The tribunal’s award can be enforced by applying to the High Court for foreclosure of the property to recover all arrears,” Chang points out.&lt;br /&gt;&lt;br /&gt;Sometimes, taking matters into court can help, says senior lawyer Roger Tan.&lt;br /&gt;&lt;br /&gt;Although the Act defines defaulting on fees payment as a crime, Tan notes that, to date, nobody has ever been charged in court for this offence.&lt;br /&gt;&lt;br /&gt;“Management bodies can pressure their residents to pay by ­deactivating their access devices and so on. There’s something so visceral about such attacks that strike right at the gut.&lt;br /&gt;&lt;br /&gt;To be called a slut or a whore is like being stripped naked in a public square before a crowd hungry to feast on a woman’s shame.&lt;br /&gt;&lt;br /&gt;Since time immemorial, women’s bodies have been subject to constant scrutiny as men seek to control women’s sexuality. Women are told that they have no right over their own bodies. They’re told that their value lies in their virginity, a completely arbitrary concept that only benefits men who want to be the one to “deflower” a woman.&lt;br /&gt;&lt;br /&gt;So when a woman is tarred a slut or a whore, she’s reduced to cheap goods. It doesn’t matter how intelligent or how brave or kindhearted she is. Her opinions and personality cease to matter because her value is placed between her legs.&lt;br /&gt;&lt;br /&gt;Slut-shaming is used to shut women up and to discourage them from entering the public realm, so that they are seen, but not heard. It’s a brutal technique that diverts attention away from a woman’s ideas to her body and to all the “loose” morals that are associated with the flesh.&lt;br /&gt;&lt;br /&gt;It’s not surprising that there are so few women in politics when people use slut-shaming techniques so freely against a woman for merely joining a political party. Melati hasn’t even run for office yet. One can imagine how much worse the attacks would be if she did.&lt;br /&gt;&lt;br /&gt;I can empathise with Melati as I was a victim of sexism and misogyny myself back in 2010 when I reported a senior National Civics Bureau (BTN) official making racist remarks at a closed-door Puteri Umno function.&lt;br /&gt;&lt;br /&gt;The attacks were swift and savage. Pro-Umno bloggers uploaded photographs of me at the function, which were taken without my knowledge, and called me a b**** and a slut. There were vague threats of physical assault too.&lt;br /&gt;&lt;br /&gt;It would be a lie to say that such attacks did not affect me. I was only 24 and I’d been in journalism only six months then. For a while, I was scared because I never expected such vicious abuse.&lt;br /&gt;&lt;br /&gt;My photographs were even uploaded on the Low Yat forum where people talked about how “hot” I was.             <title>Man cuts off his own penis</title>

            <description>A Chinese man frustrated at being single cut off his own penis then, in agony, decided to cycle to a hospital for treatment.&lt;br /&gt;When he arrived doctors told him they couldn’t help save his manhood and ordered him to cycle back home to get the penis before he could be treated.&lt;br /&gt;When Yang Hu, 26, eventually arrived back at the hospital with the severed member, doctors told him that it had been without blood for too long, and it was impossible to reattach it.&lt;br /&gt;&lt;br /&gt;Yang’s friends said that he had been increasingly depressed about the fact that since moving to the city he could not find a girlfriend.&lt;br /&gt;What was worse, they said, was that he was doing such long hours in a clothing factory in Jiaxing, in Zhejiang province in east China, that he doubted he would ever have a chance to meet a woman.&lt;br /&gt;&lt;br /&gt;His depression grew so bad that after returning home after work at 9pm on October 27 to his rented room he had suddenly decided to cut off his member as there was no use for it anyway, and believing it would stop him thinking about getting a girlfriend, as reported in dailymail.&lt;br /&gt;&lt;br /&gt;Incredibly he managed to cycle to the hospital, then cycled home again to collect the severed member and then back to the hospital.&lt;br /&gt;His friends criticised doctors saying that had they provided the man with an ambulance he might have managed to get home quicker and his private parts could have been saved.</description>
