Rental Earnest Deposit

want to ask, i was trying to rent out one of my house.

A husband and wife came and viewed the house. They like it and put down RM500 earnest deposit. 1 week later, the wife called me to say that they are not renting the house anymore as her job transfer has been rejected.

I than proceeded to look for other tenants and eventually found one that is interested. The new tenant put in an earnest deposit to rent and will be moving in in 3 weeks time.

the first tenant called me back to ask if i can return her the earnest deposit or else rent the place to her again. i told her that i cannot cancel the other party and i decided to return her 50% of her earnest deposit.

is it a market's norm to return all, partial or forfeit all?

PETALING JAYA: More than half of Malaysians surveyed want to own a home within the next six months, according to the Real Estate and Housing Developers’ Association Malaysia (Rehda).

However, stringent lending rules continue to be a major deterrent, association president Datuk Seri F D Iskandar said.
In a poll of 1,655 respondents, he said 56% were looking to own a home within the next six months, primarily within the KLCC area and Kuala Lumpur city centre.
“About 38% of them are first-time house buyers, 30% repeat buyers, 23% investors, 6% expatriates and 3% tenants,” he said last week at a media briefing on Rehda’s House Buyers’ Survey 2017.

According to the survey, over a quarter of respondents said they would purchase a property within the next six to 12 months, 12% were unsure and 6% said they would like to own a home immediately.

Iskandar said the respondents’ preference to purchase property within the KLCC area and Kuala Lumpur city centre was “unrealistic.”
“If you want to buy a property in Damansara Heights or even Bangsar ... then you’re going to be prepared to pay for it,” he said.
Apart from KLCC or the city centre, other sought-after locations in the survey in ranking order were Petaling Jaya, Cheras and Bangsar, Puchong and Shah Alam, and finally, Cyberjaya.

Iskandar said the bulk of the respondents were looking for property for self-dwelling purposes. Other reasons to purchase (in ranking order) were for family dwelling, rental yield, upgrading, holiday homes and investment.

The preferred property of choice were apartments/condominiums, followed by terrace/cluster/townhouses. Semi-detached homes, serviced apartments, bungalows/villas and commercial/shoplots ranked third, fourth, fifth and sixth, respectively, in the survey.

In terms of preferred property size, 34% of respondents said they were looking for a home that ranged between 1,000 sq ft and 1,500 sq ft, while 33% preferred units that ranged between 800 sq ft and 1,000 sq ft.

As for pricing preferences, 41% of respondents said they were looking for property that ranged between RM300,000 and RM500,000, while 32% were eyeing homes priced between RM500,000 and RM750,000.

working as enforcement officer sucks!

RECENTLY, a video of a couple harassing a local council officer for issuing them a parking ticket went viral.

The couple were later sentenced to 14 days in jail and fined RM3,000 each.

StarMetro speaks to enforcement officers at several local councils about the complications that arise in their job when dealing with the public.

Shah Alam City Council (MBSA)

MBSA Corporate and Public Communications head Shahrin Ahmad said to his knowledge, last week’s incident was the first of its kind.

“We as civil servants take this as a challenge, it does not diminish our spirit but instead gives us the strength to do our job,” he said.

Subang Jaya Municipal Council (MPSJ)

MPSJ Corporate Communications officer Muhammad Azli Miswan said that during raids, it was common for council enforcement officers to be pushed around by gangsters.

“People are not afraid of us. We are unarmed, unlike the police,” he said.

He said that even though many of the enforcement officers were trained in martial arts, they were told best to not fight back as far as possible.

“When problem arises on site, officers have to follow the standard operating procedure, calm the other party down and try to avoid confrontation.

“If it is verbal abuse or threats, officers are supposed to be patient and face it calmly.

“They can only defend themselves when their lives are at risk.

“If things get physical, we will lodge a police report,” he said.

Azli related an incident where a police report had to be lodged as an officer was punched when issuing parking summons.

“The same officer was pushed when he told a motorist not to park at a non-parking area near the Ramadan bazaar.

“Fortunately, other officers came to his aid and nothing else happened. Both incidents were reported to the police,” he added.

Klang Municipal Council (MPK)

Norfiza Mahfiz related an incident that happened early this year where a commotion broke out during a council operation against illegal hawkers in Bandar Botanic, Klang.

“There was a viral video. After we investigated, it was revealed that it was the hawker that started the fight,” she said.

She advised the public to stay calm and obey the rules.

“It is best to avoid confrontation in the heat of the moment.

“Just come to the council after the incident if you want to appeal the case, we can work things out. In the case of illegal hawkers, we can suggest authorised places for them to relocate to.

Petaling Jaya City Council (MBPJ)

When going door to door to collect assessment tax owed for years, some for a decade or two, it was observed by the media that some houseowners refused to let the officers in. There was also a tug-of-war when officers tried to confiscate items.

Penang Municipal Council

It was reported two years ago (“Attacked in line of duty”, July 20, 2014) that a Penang Municipal Council enforcement officer claimed he was assaulted by two men while carrying out an inspection at the Hill Trace market in Jalan Mount Erskine.

The officer said he was hit at least five times by a man armed with a helmet and shoved repeatedly by another.

Both attackers then fled the scene.

Earlier that week, a female enforcement officer who clamped a woman’s car in Jalan Burmah was allegedly scolded and slapped by the angry motorist.

BEIJING: Against the backdrop of increasing property prices in China, a particular property story made waves on Chinese social media last week.

A user by the name of Proud Qiaoba posted the story on popular Tian Ya Yi Du forum about her friend Xiaoli who had asked each of her 20 current boyfriends to buy her the newly launched iPhone 7, reported the BBC.

Xiaoli (not her real name), who hails from southern Shenzhen, then sold all the 20 iPhones to a mobile phone recycling site called Hui Shou Bao for 115,010 yuan (RM71,190) before using the money to pay for the deposit for a countryside house.

Proud Qiaoba and her friends were all very surprised when Xiaoli showed them her new house and revealed how she had obtained the money, BBC reported.

"Everyone in the office is talking about this now," wrote Proud Qiaoba. "Who knows what her boyfriends think now this news has become public."

Proud Qiaoba also mentioned that Xiaoli "is not from a wealthy family". Her mother is a housewife and her father is a migrant worker, and she is the oldest daughter, it was reported.

"Her parents are getting old and she might be under a lot pressure hoping to buy them a house... But it's still unbelievable that she could use this method!" Proud Qiaoba wrote.

Netizens on China's microblogging website Weibo have expressed their surprise at Xiaoli's enterprise and ability to convince all her 20 lovers to each buy her an iPhone. An impressive feat, considering the phone was only launched on Sept 16.

The hashtag '20 mobiles for a house' (translated from Chinesen) soon began to circulate on Weibo and became China's top trending topic. The hashtag has been used more than 13 million times since.

Some users have expressed admiration for Xiaoli's efforts.

One of them, 'small sand is growing', wrote: "I can't even find one boyfriend. She can actually find 20 boyfriends at the same time and even get them to buy her an iPhone 7. Just want to ask her to teach me such skills."

Others however, like 'Little Bee' commented that Xiaoli was 'the most shameless person'.

Some also suspected that the whole story was a marketing ploy by mobile phone recycling business Hui Shou Bao.

BBC confirmed that the company had purchased 20 iPhones from a female client at the start of October, paying about 5,750 yuan (RM3,557) for each phone.

However, a request by the BBC to interview Xiaoli through the company was rejected.

"Her day-to-day life has been affected (from the local media attention) and she doesn't want the media to continue covering this story," they said, "so she has turned down your interview request." – The Straits Times/Asia News Network.

As per the title above, I think some of us faced the situation before whereby during the interview process, the company asked the applicant to do an assessment whereby the applicant is asked to do a brand plan for one of their products.

the applicant will need to present his/her findings and marketing ideas and strategies. after the assessment, the company asked for the applicant's working file but the applicant is not being hired.

what are your take about this? how do you tell the company to prevent them from taking your file without knowing if you will be hired?

WTA: what is the market practice on rental payment

My tenancy agreement to my tenant stated that the tenant has to pay before every 7th of the month and I'm holding 2 months rental deposit.

1) What is the market practice on the tenant's deadline to pay up?
2) By which date should i ask the tenant to move out if he still haven't pay the rent?
3) Do you all generally allow the tenant to offset the rental?
4) If the tenancy agreement has expired, can i just raise the rent to get the tenant move out?

China to implement “Chinese Card” for overseas born Chinese including those from South East Asia.

South East Asia has the world largest overseas born Chinese. This is going to draw millions Chinese in South East Asia especially those from Indonesia, Malaysia, Myanmar, Philippines, India, Mauritius, Vietnam migrate back to China.

150 to 80 years ago, 1.5 million Hakka Chinese left Songkou River Town going to Shantou en-route to South East Asia.

Plan now is to build an Overseas Chinese Township between Meizhou City and Songkou. Meizhou City is same population to Georgetown but the district of Meizhou is 4 times larger than Singapore, so plenty of space to develop.

It is expected to attract million overseas Chinese migrate to this Overseas Chinese Town.

Private schools and a Malaysia/Singapore/Indonesia Food Street are part of the project in historical Songkou River Town. This Food Street is similar to the one on Sentosa Island of Singapore developed by Genting Berhad.

It is expected that Malaysian Chinese Developers will flock to that area to develop that designated area later. Short winter, low crime rate, low murder rate, low road accident, zero discrimination, least air pollution are attracting overseas born Chinese especially those from South East Asia.

KULIM: There is finally some happy news for a family of five who have been staying in their car for three weeks.

Restaurant operator Loh Aik Foo, 66, has not only offered Winston Khor Sze Yuen, 38, a job, but his family a room to stay here.

Khor now helps out at Loh’s restaurant at night. In the day, he takes care of the three children when his wife M. Kasturi, 24, a factory janitor, is at work.

Kasturi will look after the children – daughter W. Parvineswary, five; son W. Saastha, two; and 10-month-old Stephanie Khor Ewe Lik – when Khor goes to work.

Loh said he had been looking for a helper for his restaurant.

“Since Khor fits the bill, why not? The family deserves a place to stay. The room I offered, though not lavishly furnished, provides them a roof over their heads at least,” said Loh yesterday when met at the family’s new room.

The media had reported about Khor and his family putting up in their car as they could not afford to rent a house.

They had parked their car at a petrol station in Kulim since last month, and did their laundry and showered there.

Padang Serai MCA division chairman Dr Chin Tung Leong, who visited Khor, thanked those who have been helping the family.

“There are many who called me to offer Khor a job. He will continue to get our support.”
