Loan Agreement without Legal Firm/Presence

Hi all..

I really need advices. My brother is renovating his restaurant, and he's applying loan from MARA. but MARA is processing his loan too slow. Thus, he asked me to borrow some money from bank, and he'll repay back in percentage of his NETT PROFIT plus he'll also pays the monthly installment. Sound alluring right?

1) I would like to know, whether an agreement between Lender & Borrower is valid if we construct it ourselves without any legal advices? (we will stamp the agreement, ofcourse)

2) Can I bring the agreement to court if anything happens? my biggest fear is IF the agreement is not valid at all in the court and I can't proceed with legal actions. (I hope this will not happen)

Please advice.
