Abandoned Housing Project

Hi all,

I am in a bit of a sticky situation, and so I would appreciate it if anyone could help me out.

I have a house which I had bought the initial Developer. Thereafter, the initial Developer (supposedly) went bust, and a white knight (WK) was appointed to come in to continue the construction.

So, now the WK refuses to build my unit - because I had refused to pay them additional money to resume construction of my houses.

From my point of view as a purchaser, as I had paid the initial Developer in full, I am no longer owing anymore monies. How can the WK demand for more money from me? After all, the WK is claiming all the balance due to the initial Developer from the Banks of the various purchasers.

That said, can a white knight pick and choose units to complete from a whole project and/or to demand for additional payment?

By right, as the WK was given a substituted power of attorney by the initial Developer to resume construction, shouldn't the WK be duty bound to complete the whole project as if it were in the shoes of the initial Developer?

Doesn't sound quite right to me, and defeats the purpose of rescuing an abandoned project.

Any ideas would be most helpful.

What happens when a lease of a condo ends?

Hi all,

I've been meaning to find out, but no one seems to have an answer given that it probably hasn't happened in Malaysia yet.

But, what happens when a leasehold of a condominium or apartment ends? Unlike a landed property where you can renew your lease, what of if certain units in a condominium do and certain do not?

Then again, I suppose the same problem would occur for a lot of landed properties like terraced and link houses.

Pandemonium to ensue?

Would anyone know if it would be possible to buy a large bottle of champagne online and have it shipped to Malaysia?

Are there any restrictions? I am sure there would be tax - would anyone know what the rate is?

I am looking to buy a jeroboam (3 litres) or methuselah (6 litres) sized champagne for when I go up on stage to offer a toast to the guests at my wedding. Haven't seen those around much in KL.

Any feedback is much appreciated.

Quit Rent & Assessment Rate - Before or after VP?

Hey all,

Just wanted to pick your brains for a bit.

I know that for residential properties, quit rent, assessment rates and all other outgoings are to be borne by the Developer until the handing of vacant possession.

Is it any different for commercial properties?

I was asked by the Developer to pay the quit rent and assessment rates from the date of the S&P Agreement in 2012. The property in question is a shopoffice.

The VP will not be given until June 2015. When asked, the Developer told me that this is the case for commercial properties.
