Road accident & false report

Hi all,

I had an 'accident' last week at turn up into DUKE highway from Jalan Kuching. It was a rainy afternoon around 4pm. I took the curve at quite high speed and the my car skidded then spun almost 180˚ and came to a stand still without hitting anything. Now I am on the left side of the right curve.

Within few second after my car stopped, a Lexus RX350 hit the right side wall while trying to avoid me. Knowing that my current location is not very safe for other drivers I drove my car to where the Lexus is.

I went to check if the lexus driver is ok. It was pouring and I walk to him without umbrella. when I reach the driver's window, a Malay guy in grey shirt was making a call in the car. I stood there for about 1-2 minutes and he is still on the phone. I tried asking him to move the car further down as his current place could cause another accident, he ignored me. I went back to my car to get the 'safety-triangle' but couldn't find it and i use my ikea blue bag filled up with floor mat as a sign to inform on coming traffic (actually by that time it's already bumper to bumper crawl) and I took down the car's details with my phone.

After about 20mins under the rain, there's still no sign of that fella coming down to talk. So i drove my car further down into DUKE highway (about 100M away) and as i walked back to the accident place, the Lexus drove pass. I quickie grab my phone and snap a photo but the photo was quite blur.

Later that night, I went to police station and made a report. Half way through making the report, one of the police officer said my car was not damage and that means the accident does not involve me, and the said forget about the report. so I went home.

On Tuesday, I received a call from KL police and he said I caused an accident and ran away. I didn't explain much on the phone, I went straight to the officer with all my proofs that I'd stop my car and approached the Lexus. When I arrived at the police station, the 1st thing the police ask is 'Macam mana nak sattle?" I was like 'HUH!' then he continued saying my irresponsible driving cause accident so I'm the 1 to blame. he then show me the report by the other party. in the report:

1. The person that made the report is a Chinese 'Txx Sxxx xxx'
2. the report stated that I cut in from the left land and the Lexus hit the wall because he tried to avoid collision -.-"

From the 2 statements above, i knew that the other party had made a false report. I told the officer and he said I can say whatever I want. He also hinted that most people like me always made up story. I showed the picture of the scenic after the accident, he then said that does not show/proof i did not cut into his land. End up, I paid RM300 for the late report and go home. Still waiting for the 'Keputusan'

My questions:
- How can i proof that I had already stop when the Lexus hit the wall? There 's a camera there but not pointing at the accident scene

1. How can I proof that I went to the police station within 24 hrs and the officer suggested I drop the report?

2. What are the chances of me winning this case?

3. Am I wrong at the 1st place?
