Hudud for richman muslim only. Not applicable to non-muslim and poor family.

Ta'zir: violation of the right of an individual.
Qisas: violation of the mixed right of God and of an individual in which the right of the individual is deemed to predominate.
Siyasah: violation of the right of the state.

What are the law that will be implemented?

When we can cut hand of the theft?

1. Mukallaf : Adult and of sound mind .

2. Intentionally stealing.

3. No direct connection with the stolen goods.
Ex: Father stole the goods from sons, they are not subject to hudud .

The stolen goods requirements?

1. Items Stolen is halal in terms of the law.

2. Stolen goods in his possession a decent place.
Ex: Goods are stolen in safe places. Openly stolen goods not subject to hudud.

3. Stolen goods is worth ¼ gold dinar and silver dirham or three (9.36 grams of gold)
Approximately RM1500 and above.

NOT SUBJECT TO HUDUD

Son stealing fathers money.
Desperately stealing foods for family.
Stealing car with the keys inside.
Stealing from bank without security guard.
Chinese or Indian. (Edit: non-muslim only)
Crazy.
Stealing under RM1500.

WHO SUBJECT TO HUDUD

Muslim only.
Stealing above RM1500.
Richman without the needs to support hungry family.
