            <title>Help pls&amp;#33; Happen in a condo in Penang&amp;#33;</title>

            <description>Hi guys, &lt;br /&gt;&lt;br /&gt;Need some advice regarding a situation that is happening in a condo in Penang. &lt;br /&gt;&lt;br /&gt;In this condo, they have 3 floors of carpark (basement, ground and first floor). The entire basement carpark (roughly 200 carparks) were registered under 1 condo unit in the condo and this condo unit was held by the original developer. All the while they did not use the unit nor the carparks. Few years ago, this original developer built a mixed development in front of this condo. The 2 sites are separated by a small little road. After the original developer completed the new mixed development (a few stories of shops downstairs and condo upstairs), they sold all the shops and the condo unit holding 200 carparks to a new owner which is a big corporation. The problem comes in because they did not built enough carparks in their own mixed development site. So they now want to open a tunnel underground to link the 2 sites and allow their customers of the shops to drive into the basement carpark of the condo instead. It seems that they have gotten approval from state to open up the tunnel and proceed. &lt;br /&gt;&lt;br /&gt;Question:&lt;br /&gt;1. Is this legal? Can a unit owner just simply open a separate entrance as he wishes to the condo? &lt;br /&gt;2. What is the definition and purpose of a residence carpark in Strata Act? Can it be used by outsiders i.e. outsiders who are not resident of the condo?&lt;br /&gt;3. Why does the state allow this? &lt;br /&gt;4. Even in the event the state says proceed, it is legal for the condo as a whole to disallow the opening of a new entrance, right? Can convene EGM to approve that the whole community reject this new entrance? &lt;br /&gt;5. Every car in the condo is equipped with a IU sensor device so that they do not need to tap the access card manually to open the gantry before entering car park. So the 200 carparks even if they want to open up to outsiders, they must register all their cars as residents with the condo management and show proof via tenancy agreement that they are residents in 1 unit. The unit owner cannot say he does not want to abide by the condo rules even if he owns 200 carparks correct? &lt;br /&gt;4. Can make police report to investigate? &lt;br /&gt;5. Will the media be interested in this weird happening? &lt;br /&gt;&lt;br /&gt;Above are just some ideas people are coming out with. &lt;br /&gt;&lt;br /&gt;The condo already got lawyer to handle but do you guys think perhaps media and MP got more &amp;quot;weight&amp;quot; to push this? &lt;br /&gt;&lt;br /&gt;Please help by giving any advice/suggestion. Will be very much appreciated. &lt;br /&gt;&lt;br /&gt;Thank you.</description>

            <title>Income Tax Issue</title>

            <description>Hi guys, &lt;br /&gt;&lt;br /&gt;Anyone expert in income tax?  &lt;!--emo&amp;:help:--&gt;&lt;img src='http://static.lowyat.net/style_emoticons/default/icon_question.gif' border='0' style='vertical-align:middle' alt='icon_question.gif' /&gt;&lt;!--endemo--&gt; &lt;br /&gt;&lt;br /&gt;I try to keep my story as short. &lt;br /&gt;&lt;br /&gt;I made a claim under serious illness tax relief (claim up to max &amp;#036;5k) with supporting hospital bill of almost &amp;#036;30k and doctor&amp;#39;s letter. I explained to the tax officer why I thought my illness is serious because I almost died then (I was on life support machine, 1 month hospitalistion etc). He said my hospital bill and doctor&amp;#39;s letter is insufficient. So I asked what other things you need. He did not reply me. Next thing I know, I received a tax notice that my tax relief has been denied and I need to pay additional tax plus PENALTY.  &lt;!--emo&amp;:cry:--&gt;&lt;img src='http://static.lowyat.net/style_emoticons/default/cry.gif' border='0' style='vertical-align:middle' alt='cry.gif' /&gt;&lt;!--endemo--&gt; &lt;br /&gt;&lt;br /&gt;I am fine if they say no we still think your illness is not serious enough (although you almost died). But to slap me with penalty some more. I was not trying to evade tax. Come on... I was really seriously ill. You know tv dramas whereby someone is hooked up onto tubes into his mouth, down the throat and into the lungs to artificially breathe for the person. I was like that for 1 week. Explained all this to him but yet they still think I am not seriously ill. If one can die, not serious ah? Then I am baffled as to what their definition is.  &lt;!--emo&amp;:stars:--&gt;&lt;img src='http://static.lowyat.net/style_emoticons/default/rclxub.gif' border='0' style='vertical-align:middle' alt='rclxub.gif' /&gt;&lt;!--endemo--&gt; &lt;br /&gt;&lt;br /&gt;Anyway, he sent me a pdf file and in there it stated a list of illnesses they termed as &amp;quot;serious illness&amp;quot;. But there was a para that states that even if your illness is not in here, you can make an appeal. So I pointed out to him and asked him what other things you need. He did not reply me. Now kena charge penalty&amp;#33;&amp;#33;&amp;#33;  &lt;!--emo&amp;:x--&gt;&lt;img src='http://static.lowyat.net/style_emoticons/default/doh.gif' border='0' style='vertical-align:middle' alt='doh.gif' /&gt;&lt;!--endemo--&gt; &lt;br /&gt;&lt;br /&gt;Better still.             <title>Agent uses your house photo without permission</title>

            <description>Hi Sifus,&lt;br /&gt;&lt;br /&gt;I have just got an offer for my condo in Penang. However the agent now tells me the buyer is under Malaysia My Second Home. Therefore, they need to apply to government for consent. This will take 6 months and the 10% they place will be held by lawyer. In the event the consent is not approved, I will need to return the 10% to buyer. So I get nothing.&lt;br /&gt;&lt;br /&gt;Has anyone ever sold to MM2H buyers? And if so, what were your terms? Is it like the above?&lt;br /&gt;&lt;br /&gt;Can I request for the 10% to be held by me instead of lawyer after signing S&amp;amp;P? And if consent not approved, I will forfeit the 10%? Can I also charge interest on 4th month onwards say to 7th month with a clause that I have the right to terminate and forfeit the 10% after 7th month because I cannot be waiting indefinitely.&lt;br /&gt;&lt;br /&gt;Appreciate any info you know regarding this.&lt;br /&gt;&lt;br /&gt;Thanks in advance.&lt;br /&gt;&lt;br /&gt;</description>

            <title>Loan Interest</title>

            <description>Hi Gurus,&lt;br /&gt;&lt;br /&gt;I have 2 housing loan. First one was taken 3 years ago while another just newly got. Currently my 1st loan has balance outstanding of about &amp;#036;350k while the new loan is for &amp;#036;450k. I have &amp;#036;350k cash which I put against my 1st flexi loan all along so I do not need to pay interest. Now my question is: Should I leave my cash for my 1st loan or should I transfer to my 2nd flexi loan? Any difference in terms of 1st year interest vs 3rd year interest? I recall someone said first few years, we are paying more interest than principal. So if this is true, should I transfer my cash to my 2nd loan? &lt;br /&gt;&lt;br /&gt;Anyone has any idea?</description>
