The Shit Tablet Apple requested to other company

This image shows Apple lawyers' wet dream for a Samsung tablet. It demonstrates one thing: the Apple lawyers who described it are imbeciles and/or clueless mischievous snakes. Just as much as Samsung's product designers are unimaginative shameless cloning bastards.
Apple demands are these:

• Shapes that are not rectangular with four flat sides or that do not have four rounded corners.
• Front surfaces that are not completely flat or clear and that have substantial adornment.
• Thick frames rather than a thin rim around the front surface.
• Profiles that are not thin relative to [Apple patent D'889] or that have a cluttered appearance.

Apple is right to point out that the design and packaging of Samsung's Galaxy tablet is a clone of the iPad. It's not exactly the same, but it's clearly made to look like the iPad. But Apple's demands are just plain stupid.

Instead, they should have just asked Samsung to design a tablet that nobody could mistake for an iPad in a reasonable way. This could have been really easy. You only have to look at the Playbook or the Kindle Fire or any other tablet out there except for Samsung's. They are well designed and nobody can confuse them. Samsung could have done this:

Full size
Pretty simple. Nobody would mistake that for an iPad but it would retain optimal usability. In fact, using that dark grey—like color professionals use for color proofing—would make this tablet better for color perception and give it its own distinctive look.

Incidentally, except for the change of hue from black to neutral grey, this is actually the tablet that Samsung has made to avoid more legal trouble. Apple is suing them again because they think it's not enough. I bet that if they changed the color no judge in the world would rule against them.

SOS http://gizmodo.com/5866626/the-shit-tablet...hould-have-made

Samsung didn’t “slavishly copy” iPad

Today is a bad day for Apple’s legal sharks. First Motorola Mobility scores a ruling in Germany which has paved the way for a Europe-wide injunction on sales of Apple’s iOS devices and now High Court in Australia denies Apple’s request to appeal against an earlier decision which overturned the ban on Galaxy Tab 10.1 sales in Australia.

Put simply, the country’s highest-level legal instance has ruled that no, Samsung’s tablet does not “slavishly copy” Apple’s iPad, as the Mac maker argues in court documents. The Federal Court honored Apple’s recent request that its injunction against the Samsung tablet remain in effect until today at 4pm in order to allow Apple time to prepare an appeal.

According to the Sydney Morning Herald, Tyler McGee, vice-president of telecommunications for Samsung Australia, said customers in Australia will be able to pick up the Galaxy Tab 10.1 tablet “towards the latter part of next week”. Also…

He said that pre-sales are available today through “certain channels”, adding price points for the Galaxy Tab 10.1 in Australia will match Apple’s iPad: $579 for the 16GB WiFi-only version of the Galaxy Tab 10.1 and $729 for the WiFi+3G model. Apple is also pushing for an injunction on the Galaxy Tab 10.1N in Germany. The 10.1N is a re-engineered version of the original Galaxy Tab 10.1 with an added metal frame around the edges. It’s Samsung’s answer to a Dusseldorf court ruling requiring Samsung to comply with a sales ban. A hearing in that case is scheduled for December 22.

SOS http://9to5mac.com/2011/12/09/samsung-didn...d-in-australia/

Wow, what goes around comes around, bad luck to apple, trolling other, now face what you deserve
Apple crazy demand to samsung

On the smartphone side of things, the following is a list of some of the alternative design options Apple felt Samsung should have looked into further:

Front surface that isn't black.
Overall shape that isn't rectangular, or doesn't have rounded corners.
Display screens that aren't centered on the front face and have substantial lateral borders.
Non-horizontal speaker slots.
Front surfaces with substantial adornment.
No front bezel at all.

As for tablets, Apple identified a similar list of alternative designs available to Samsung:

Overall shape that isn't rectangular, or doesn't have rounded corners.
Thick frames rather than a thin rim around the front surface.
Front surface that isn't entirely flat.
Profiles that aren't thin.
Cluttered appearance.

Man, this paterns war getting ridiculous, such a nonsense demand, how samsung gonna follow what apple want?

Read more here http://www.theverge.com/2011/12/2/2596527/...pad-work-around

BTW, Apple's request to block Samsung Galaxy tablet, phone sales in the US is denied

As the legal drama between Apple and Samsung drags on around the world, US District Court Judge has rejected Apple's request to block the sales of Galaxy devices. Reuters reports the ruling came out late Friday, with the judge deciding "It is not clear that an injunction on Samsung's accused devices would prevent Apple from being irreparably harmed,". This isn't the first rejection for the folks from Cupertino either, after a request to speed up the trial was also denied back in July. The case itself will of course go on, but this means you'll still be able to get your hands on those Galaxy Tabs, Galaxy S IIs, and the like in the meantime.

Update: While Apple has yet to comment on the ruling, Samsung has issued an official statement which you can check out after the break.

Samsung:
Samsung welcomes today's ruling denying Apple's request for a preliminary injunction. This ruling confirms our long-held view that Apple's arguments lack merit. In particular, the court has recognized that Samsung has raised substantial questions about the validity of certain Apple design patents. We are confident that we can demonstrate the distinctiveness of Samsung's mobile devices when the case goes to trial next year. We will continue to assert our intellectual property rights and defend against Apple's claims to ensure our continued ability to provide innovative mobile products to consumers.

read more here http://www.engadget.com/2011/12/03/apples-...one-sales-in-t/
Siri gets lost internationally

The iPhone 4S' Siri integration may be a potential game changer, but she's not quite the world traveler some of us would like her to be. In fact, it seems she's as lost outside of US borders as any unprepared tourist. Looking for a pub in London? Better find a traditional map. Need to know the time of day in Canada? Siri admits she has no idea, go buy a watch. Business search (via Yelp), directions, traffic data, and Wolfram Alpha search all appear to be US-only features for now. The automated assistant's international failings aren't too big of a surprise, however -- Apple's own Siri page outs the service as a beta, noting that some features may vary by area. Stuck with sub-par international support? Sit tight, it's coming: Apple's Siri FAQ states that additional language support (including Japanese, Chinese, Korean, Italian and Spanish), maps and local search content are set to go international in 2012.

Even other Europe country not all supported, don't even dream it in msia...

SOS http://www.engadget.com/2011/10/15/siri-ge.../#disqus_thread

Samsung Stepping Up Attacks on 'Free Riding' Appl

QUOTE

Associated Press reports that Samsung is becoming more vocal about its efforts to go on the offensive against Apple in the patent dispute between the two companies, accusing Apple of "free riding" on Samsung's intellectual property with its products.
"We'll be pursuing our rights for this in a more aggressive way from now on," Lee Younghee, head of global marketing for mobile communications, said Friday in an interview.

Lee, a senior vice president at Samsung, did not say what form the South Korean company's stronger stance would take or if there would be more lawsuits. But her remarks suggest a definite change in tone. She described its previous approach as "passive."
Lee suggests that Samsung has been relatively "passive" in the dispute thus far out of respect for the fact that Apple and Samsung have a close relationship for component supplies, although Apple is reportedly looking to minimize its reliance on Samsung in that regard.
Lee said that Samsung has kept that relationship in mind amid the dispute with the Cupertino, California-based company, and has largely been pulling its punches.

"We've been quite respectful and also passive in a way" in consideration of those links, Lee said during the interview in her office at Samsung's headquarters building in southern Seoul. "However, we shouldn't be ... anymore."
It hasn't taken Samsung long to follow through on its promise to become more aggressive, as Dutch site Webwereld.nl reports [Google translation] that Samsung has filed suit against Apple in The Hague, requesting a ban on sales of Apple's 3G-enabled iOS devices in the Netherlands. The suit explicitly names the iPhone 4, iPhone 3GS, iPad 2, and original iPad, but does not limit its claims to the listed devices.

Apple argues that the patents in question are so basic to wireless telecommunications technology that they should be subject to FRAND (fair, reasonable, and non-discriminatory) conditions that would require Samsung to license them to all competitors under fair and reasonable terms, which Apple does not believe Samsung has been offering in its discussions over the patents. FRAND conditions are applied by standards-setting organizations in certain situations to prevent companies from engaging in anti-competitive behavior by refusing to license patents that are crucial to a given industry.

Earlier this week, sources within Samsung also indicated that the company is planning to target the iPhone 5 with patent lawsuits as soon as it is introduced.

SOS http://www.macrumors.com/2011/09/23/samsun...patent-dispute/

Lol, so apple want samsung to be fair with it pattern? apple now in the big mess, trying to sue big company with a lot of communication pattern, good luck with that, if samsung win this time, radio communication in iphone need to be remove and ban from been sell if not removed.

Iphone 4 fragmentation

QUOTE

By now you've probably seen the latest spectacle to consume the white iPhone 4: it's thicker than the black model. The image above illustrates the point using a piece of lead from a mechanical pencil. So what, you say, in righteous indignation to a device that shipped ten months late. Well, the size difference creates a potential consumer issue since cases (at least the good ones) are manufactured against the tight tolerances supplied by Apple. We've confirmed ourselves, that an Incase slider that fits a black iPhone 4 just fine has to be forced into place on the new white model. Unfortunately, Apple's own spec page doesn't highlight the change in thickness (measured at 9.5mm by TiPb). Instead it still shows a 9.3mm depth with a tiny disclaimer stating, "Actual size and weight vary by configuration and manufacturing process." The result is confusion -- will this case fit or won't it? -- which is never a good thing for consumers.

But why is the white iPhone 4 thicker? Phil Schiller mentioned that his team needed to add extra UV protection and other tweaks, in an attempt to reduce the "unexpected interactions" between the cover's whiteness and the internal components. As such, Apple apparently needed to sacrifice some slimness for a better functioning white phone. In the end, we have what looks to be four different size / button configurations that must be considered when purchasing a shrink-wrapped case for your white iPhone 4, black iPhone 4, white Verizon iPhone 4, or black Verizon iPhone 4. Good luck with that.

SOS http://www.engadget.com/2011/04/29/white-i.../#disqus_thread

Federal Lawsuit Filed Over Apple

Federal Lawsuit Filed Over Apple's Location Tracking in iOS

QUOTE

In what shouldn't be a surprise to anyone, Bloomberg briefly reports that a lawsuit has been filed in U.S. federal court targeting Apple over privacy concerns related to location information being stored on iOS devices and in backups for those devices. The lawsuit is almost certainly the first of many regarding this issue.
Apple Inc. (AAPL) was sued for alleged privacy invasion and computer fraud by two customers who claim the company is secretly recording and storing the location and movement of iPhone and iPad users, according to a federal complaint filed today in Tampa, Florida.

As we noted earlier today, Apple CEO Steve Jobs has reportedly replied to a customer email denying that Apple is tracking its customers and labeling the claims being widely discussed as "false".

Update: Bloomberg has now published an expanded article offering additional detail on the lawsuit.
"We take issue specifically with the notion that Apple is now basically tracking people everywhere they go," Aaron Mayer, an attorney for the plaintiffs, said today in a telephone interview. "If you are a federal marshal you have to have a warrant to do this kind of thing, and Apple is doing it without one."

The two plaintiffs, an iPhone user in Florida and an iPad user in New York, are asking a judge to bar Apple from collecting the location data and requesting refunds for the purchase prices for their devices, claiming that they would not have bought them if they had known about the data collection.

Apple has declined to officially comment on the lawsuit.

SOS http://www.macrumors.com/2011/04/25/federa...racking-in-ios/

first Android Walkman phone, the W8

Sony Ericsson announces its first Android Walkman phone, the W8

Sony Ericsson has just announced its first phone from the Walkman series to run Android (or the other way around). By the looks of it, the W8 is an XPERIA X8, but with a bit of fancy colors and a WALKMAN logo.

Just like its brother, the X8, the Sony Ericsson W8 sports a 3-inch capacitive touchscreen with a resolution of 320 x 480 pixels, a 3.5 mm headphone jack, and a 3.2MP camera. Under the hood there's a 600MHz single-core processor ticking, with 168MB of RAM.
The W8 will run Android 2.1, which is a bit unfortunate, as most Droids on the market are now running Froyo or even Gingerbread. Nevertheless, this is the first Walkman phone to run the Google mobile OS, which will be covered by the Timescape UI.
Being a Walkman, the phone will come with Sony Ericsson's stereo headset, the MH410.

SOS http://www.gsmarena.com/sony_ericsson_anno...8-news-2542.php

iPhone taking pictures without your permission?

QUOTE

Seeing an image of yourself while on video call qualifies as plain creepy in our weird glitches rating, but it seems quite real as this Apple forum thread has generated three pages of users sharing this very complaint: while on Facetime a random picture pops up and it's nothing that you've shot, but rather a photograph the spooky iPhone seems to have captured on his own. The image doesn't appear in the Camera Roll and the issue seems hard to reproduce due to the random occurrence.

Below is a first-hand description of the issue:

“My boyfriend and I have both recently experienced this problem several times - when one of us is calling the other via FaceTime, an old picture freezes on our screen, while the person receiving the call only sees a black screen. It's kind of creepy, because it brought up photos of both of us at work, where I have used FaceTime a few times but he never has. We're just wondering how/why this is happening, and if there is a fix. It's not terribly inconvenient, but it's definitely unsettling, where is seems that even if we haven't taken a picture or used FaceTime, the camera is keeping images.”

As unlikely as it all sounds, the amount of complaints has grown.
Android will rule the smartphones

QUOTE

According to the analysts over at Gartner, Android will be the most popular mobile OS in the next four years reaching almost 50% market share. Meanwhile Windows Phone will catch up and overtake the second place from iOS by 2015 with 20% market share.
This is what the latest Gartner's report predicts. Quite expectedly the Symbian market share is shrinking rapidly, while those of Android's and Windows Phone will go up.

QUOTE

Apple's iOS will have the second place by the end of 2012, but Microsoft will overtake it by 2015. It seems both Android and iOS will lose some users in favor of Windows Phone. It's predicted that when this happens Apple will change its pricing policy in order to maintain its share.

QUOTE

RIM will also have a user withdrawal when its migration from BlackBerry OS to QNX, the OS behind the Playbook, starts in 2012 (we're not sure we've heard of those plans before) .
It seems there will be two major changes in the next four years - Android will be the king of the mobiles (eating the Symbian pie), while the Microsoft-Nokia cooperation will push the Windows Phone up to the second place. It seems logical, but we'll wait and see how things will turn up.

We already saw quite similar predictions in the IDC report a week ago. There are a few minor differences into the distribution of shares (a bit smaller Android share and a bigger Windows Phone one in 2015), but both reach to the same conclusion – Android will be the biggest player in 2015 and Windows Phone will beat iOS for the second place.

Another thing that is worth mentioning is we could expect doubled smartphones sales in 2012 (compared to 2010).
It seems Gartner also didn’t foresee any major players entering the smartphone market. Just like the IDC report, the Gartner’s one also doesn’t see Bada OS as a major player in the next four years. Another think that pops in mind is they think Apple will sit back and stay calm when it’s losing market share. What we are trying to say is there are just too many variables and not all of them were taken in consideration. So these predictions might apply in some version of our world, but can’t be a reliable source in our dynamic life.

Available in orange and a more staid black, this 8.4-pound beast packs a quad-core Sandy Bridge Intel Core i7 processor, Full HD 15.6-inch display, discrete NVIDIA GeForce GTX 460M graphics with 3GB of video memory, up to 16GB of RAM, an 8-cell battery, one USB 3.0 port (along with three USB 2.0 ones), HDMI output, a 2 megapixel webcam, and hard drive space ranging from 500GB to 750GB with speeds of either 5,400RPM or 7,200RPM. Or, you can opt for an SSD as large as 1.25TB. (ASUS likens the speeds to a 10,000 RPM drive.) No word yet on pricing or availability, though we're pretty sure Valentino Balboni won't be ponying up to type on one of these either way.

SOS http://www.engadget.com/2011/04/07/asus-re.../#disqus_thread
