Damage compensation claim against No-SSM Shop

Serious discussion only, Long story ahead.

Here's the story.

My car's a Proton Saga 1.5i 1990, as you know this car is prone to rust on the roof. When the rust gets really bad and even end up penetrating the roof itself causing internal water leaks in my car when it rains. I decided to send in for a respray.

A little back story, about how I found this Respray shop,

This is more onto business relationship term level :
The shop runs by 2 brothers, previously was handled by his elder brother, which he who turned out to be a very reputable shop located in OUG with lots of expensive cars sent to him, so I decided to give it a try by sending few of my cars to touch up damaged parts, turns out the result exceeds expectations, we end up great friends on business scale, his shop has a valid SSM License and he's very careful in dealing with the customer's cars at upmost care.

Until the day he decided to retire and announced he will pass down business ownership to his younger brother to handle,
I did question him about providing a rest assurance on the quality service outcome since he is no longer in charge, he says there will be no issues since both of them worked in this field for a very long time.

Now here's the real problem starts :-
The shop's now operated by a "new owner", he decided to move the shop to an industry area located in OUG, it's quite hidden and only a number of returning customers will be notified where his shop will be located since it's cheaper rent there.

During my send-in, he quoted me based on the "roof skin replacement" due to rust + full body Nippon 2k spray including inner spray on some parts totaling up to RM 5000. As he also told he needs 4 months to complete the job without being rushed to have it looked like new.
I asked him why it needs to be that long? He said because he will be handling the car personally with absolute care without letting his workers do.

I went ahead and accept the quote, the car gets sent in. Once in awhile, I asked for updates, but I rarely able to be notified of any.

The car was sent in since 17th September 2024, ends up completing on the week before Chinese New Year 2025 (It was like 27th January 2025)
Upon collecting the car before I accept the outcome.

The end result ? A fuckin disappointment :
If I had to list a few :
- Fabric seats are stained with black silicone, marks of the welding sparks punctured hole on my seats (They did not cover the seat before starting the job)
- Paint stain found on my fabric seats and Center console
- Misaligned bumper like unfinished job
- More white paint stains on the bumper like a rushed job
- Missing emblems and missing mudflap.
- Broke my passenger auto side mirror but decided to replace with manual mirror cheap replacement, not on my watch.
- Misaligned door gap.
- Pop the hood, found the A/C heat dissipation pipe gets sprayed on, even the battery copper head gets spray on as well.

The entire outcome result sounds like a last minute rushed job although given 4 months of complete time without rushing him even once.

At first I refused to pay him and ask him to compensate on the damage as the interiors are no longer replaceable unless you buy a donor car,
he refused to think about it and ask me to settle the payment first then we can discuss on the compensation part later after Chinese New Year.
He even says if I don't complete the payment now, I'm not allowed to take away my car and my car will be the only one left as he will not be liable if there's any damage or missing parts by storing the car in his yard.

I questioned him further if it was done by his own hands, how come the car was handled this bad?
He then end up saying it was being worked on by one of his foreign worker, but he end up terminating the worker on the spot due to this issue.

I told him "terminating your worker for poor workmanship is your own issue, now my car's damaged. I want to be compensated". This workmanship does not even worth RM 5000.

I walked around his shop, and found no SSM displayed. Just so you know there’s a KKM ambulance in there being sent in for knocking as well.

I end up paying the full amount and took my car away, driving with nothing but disappointment.

Now for the real question :-
- Can you file a consumer tribunal to get refunded / compensated due to poor quality workmanship if the shop found does not have SSM registered. The money was paid to his direct personal account. I have kept the receipts with me.

I thought of taking this step if he refuses to cooperate and compensate the damages.

Advises are welcomed.

Can we sue Gov. hospital or Doctor for negligence?

On 20th November 2023, My father was admitted to UNICU HKL due to lack of oxygen, private hospitals cannot check him in because he is a transplant patient and he has records in Government's HKL

Due to this we are forced to admit him into HKL, 3 days later after admittance, hospital announce that they have detected a CAT5 COVID confirmed within his system, hence moved him into Isolated UNICU for personal nurse to monitor him.
His oxygen levels are improving slowly at around 90-95, as he's still awake and able to do minimal activities.

On the 3rd of December, his COVID was confirmed by doctor to be no more. But he must remain in UNICU (High Dependency ICU) for further monitoring due to post COVID effect still linger around.

5th December, a doctor written a transfer letter to have him transferred from a High Dependency ICU Ward to a Normal Ward in Institut Perubatan Respirasi (IPR) at 6PM, he arrived there by 6:30PM being placed on a normal ward along with other patients.

He was doing well on same day at 11PM we last checked with him, until later at 3:30AM, we received a call from the doctor there that he has breathing difficulties, asking all of us as a family to get there as soonest.

The time we reach there, almost 4AM on the clock, he's already laying there, lifeless.

We asked the doctor why won't they inform us sooner to allow us exchange a few more words before his passing, doctor then informed us his actual passing time is 3:10AM.

Prayers and Post Mortem is under way..

So the question is :

On the scenario above, can we hire a lawyer to sue either the hospital or the doctor in charge who transferred him for negligence.

As we believe that if he remained in UNICU with a personal nurse monitoring him, he would still be alive and well. We are very disappointed where the doctor who transferred him did not remark that this patient requires High Dependency Ward for close monitoring.

The patient was transferred there but only lasted 7 hours due to breathing difficulty and passed away without being monitored closely.

That being said, Please advise, because us as a family are unable to accept this.

International Marriage Questions

I have a girlfriend who's from Romania had brought up to consider about marriage.
We've been together for very long now and she says she's ready to commit fully as a wife.

She decided to move to Malaysia with me and settle down here, which same goes to marriage.
But I have a few questions that concerns me because this is an International marriage.
I looked up to the procedures in the Government website provided steps but there are questions remain unanswered.

Questions as below

1) Are medical prescriptions from overseas can be used in Malaysia Hospitals? Because she had been visiting her psychiatrist / doctors that wrote her prescriptions on the medicine she needs to take, which I need to confirm about this. If not, what are the procedures?

2) Are Single Status Certificate must be translated to English? if yes, what are the rough costs?

It would be a great help for these to be answered, because I need to plan out carefully to insure she can settle down nicely in here.

Hi Sifus,

I would like your opinion regarding my situation as I am puzzled which I should I buy, A desktop or a laptop?

Story Summarize:
- My Desktop's a 3rd GEN Intel IVY bridge powered with a ASUS GTX660 DC2 OC
- The GPU lasted me 10 years in service and actually died on 5th August 2021.
- Current market situation as we know GPU are insanely expensive (or out of MSRP)
- I target mostly ROG brand GPUs due to their reliability, but Malaysia sold out everywhere or just being too insanely expensive
- Currently tight on budget (About 7k or less), as we know a price of 1 GPU can buy you a nice new gaming laptop
- Due to this, my next choice's either a Laptop or buy other GPU brand?

Need your opinions or advise.

GPU Scammers on the wild

We do know now we have GPU Crisis.

Knowing the shortage of GPU is gonna alert the scammers to take advantage of the situation.

It's not a surprise.

And it all started in Facebook,
The one place where people deal via bank transfers instantly.

The only prevention you could do is
1) Check photos - Surely cropped and stolen
2) Check joined date
3) Check "Amount of likes / rates / feedback" - If it's fresh. It's definitely a scam

I've been commenting left and right that those pages have been stealing photos and scam people.
People won't believe, the admin of the page deleted the comment, and blocks you.

Anything that's above RM 100 especially these pandemic times it's highly advisable to COD,
Do not blindly do transactions over it and become the victim as these scams are just too good to be true although you desperately need a GPU for your system.

Although it's pretty obvious those are scam pages, but there's still victims putting their trust into it, blindly transfer and got ghosted.

P/S: I see at least 4 of the pages newly created to scam people by selling single GPU at MSRP

Oh yeah, I reported those pages, but Facebook is not taking them down, and thinks they comply with the T&C.

The photo below highlighted shows how they easily copy and paste, then duplicate into multiple pages.

Proton Saga VVT TRC Control and Handbrake lit up

while cruising on a highway home, these 2 lights (TRC control lights and Handbrake light) just popped up.

I tried to restart the car also the lights still there

Hello sifu,

I wish to discuss regarding a situation whereby I’ve been working in this company for 9 months

But the problem here is that
1) no offer letter
2) no confirmation letter
3) no notice of probation extension
4) I checked with the admins and managers say they will get back but till no avail

Salary , EPF and SOCSO contribution is still given but.
I still can’t utilise my MC and Annual Leave benefit.

So here’s the question,
In this situation, Do I still consider a probation staff or a confirmed staff?

Maxis fibre SELECTED disconnection

Recently have your internet ever went on a "Selective disconnection" issue?

Example :
it'll only have problems connecting to Japan servers or certain websites.
But other sites like Facebook or Instagram works fine.

If yes, how do you resolve this issue? It's hella annoying.

Maxis router has been changed 3 times
TM modem changed once.

P/S : Manual / Auto IP's the same , Manual / Auto DNS still the same issue.

Was it my Gearbox issue or Starter / battery?

Hi car sifu,

I have an unsolved issue on my car which has been going on for days.

Here's how :

The car's completely fine after changed and driven for months after the gearbox's replaced (Since year 2017 December)

Up till today there's an issue popped up :

I wish to ask will a bad starter which I heard it drains battery power or pull too much energy will affect the gearbox shifting?

My car has 3 gears. It shifts from First to Second in "D" gear but refuse to shift to Third gear. ATF fluid also filled in.

The battery was last changed and dated December 2017. "Starter EX" brand. But the my car's starter is a recon.

What I also found out is that when the key was turned to power on the radio. (I turned off everything else except radio running) for mere 10 mins. During start attempt, it cranks slowly or labors to crank when starting.

And I've been questioning myself what actually causes my gearbox refuse to shift to 3rd gear.

P/S : Do not advice me to change to manual, as this is my daily drive car that i used to go on site service.

The topic says all. Recently I had a bad luck ran over a mini spannar causing my rear left tyre to burst instantly (DUNLOP SP TOURING 1) RIP.

Now I need a new replacement tyre to be recommended ..

Can you file a case against insurance company?

Hi all,

The story goes like this

Upon registered for a new credit card, AmAssurance company called in. And explain benefits then offer this AmAssurance insurance which I don’t need. I constantly rejected, refused and order them to cancel, do not bill my credit card

Instead they told that I cannot ask for cancellation or decline before I received and read the black and white copy first. Which resulting in forcing me to accept although I constantly declined till I fucked them up.

Which is about a week now I still did not received any or agreed upon it. But found out of nowhere my credit card bill is charged for 2 months (RM 56 / month)

After I called up Ambank to check on the refund status. That insurance company only refund GST and refused to refund the insurance amount that I did not fully utilize / did not agreed to take up in the first place. Instead, they reason that because “I agreed to enroll in the first place” which is a lie.

May I know if it’s possible to file a consumer court case against this AmAssurance company?

Faulty Dell Vostro 360

Apparently. Here's the issue

iPhone X Crackling / Buzzling noise

Curious to know if anyone else of you out there too got affected by the iPhone X's batch whereby the speakers on the earpiece will produce "Crackling" or "Buzzing" noise when you hit the max volume (Sounds like speaker pecah)

If you compare dual speakers to the Huawei Mate 10 Pro (Which is another Android Flagship phone) The Mate 10 Pro sounds more enclosed and nicer

Any thoughts on this issue?

Or any of you others out there were affected as well. Will there be valid for warranty claim if this affects the users?
