Dear Sir,
SONY MALAYSIA’S FAILURE IN COMPLYING TO CUSTOMER’S RIGHTS
This complaint is written for the a recent RM79 / RM99 PS3 Bundle at Sony Malaysia Online Store (https://store.sony.com.my/); which are claimed as ‘pricing error’ by Sony Malaysia which they would not honour the orders at the price stated when the orders were made. See attachment at http://i.imgur.com/Du5Gawu.jpg
1) In the reply by Sony Malaysia, they stated that “The incorrect pricing is actually that for certain PlayStation® games and not the console” which is totally unacceptable as the product listing in Sony Malaysia Store’s page, the product name is CLEARLY NAMED AS “PlayStation® 3 500GB Ultimate Value Pack – PlayStation® 3 500GB + God of war 3 game + Unchartered 2 Game” along with a CLEAR PICTURE / IMAGE showing the said products of PS3 along with two other games. This clearly indicates that Sony Malaysia is trying to avoid taking responsibilities on their mistakes by not honouring and rejecting all the orders placed on that day. 2) In the reply by Sony Malaysia, they stated that “Our investigation confirmed that this was caused by system error during unscheduled maintenance.” which is totally unacceptable as nothing had been mentioned to customers previously, and it is totally irresponsible for Sony Malaysia to avoid taking any responsibilities for the orders placed by simply declaring it as an “unscheduled maintenance”. Furthermore, the orders that I have placed was between 5.30 PM to 6.00 PM, which is at least 2 to 3 hours prior to the announcement made by Sony Malaysia. This could also be potentially a fraud case of misleading / false advertising. See attachment at http://i.imgur.com/rsU44Np.jpg

3) In the reply by Sony Malaysia, they stated that “Upon discovery of this error, we made the decision to suspend the site to rectify the problem.” which is again false. The announcement was made around 8.58 PM Saturday (16/3/2013) in which Sony Malaysia ‘discovered the error’, but the site are still up until Sunday (17/3/2013) which they decides to take down the entire site of https://store.sony.com.my/.

4) In the reply by Sony Malaysia, they stated that “We are deeply sorry for any inconvenience which this may have caused you. All orders made for the PlayStation® 3 at the incorrect prices on Sony Store Online will not be processed.” this again shows how irresponsible is Sony Malaysia in handling mistakes / errors on their side by refusing to honour the orders which was placed by the consumer. Even if the product(s) listed was displaying incorrect pricings, this is obviously poor-handling and quality-control within Sony Malaysia which by no means a consumer’s error. Consumers will place order or purchase stuff in which they are interested in based on the price offered, which Sony Malaysia should not be avoiding the responsibilities in the problem.

5) On top of all these issues, Sony Malaysia have also already collected our (“consumer”)’s personal & private information which was given to Sony Malaysia with the agreement of placing the order, which was acknowledged and accepted by Sony’s system. Sony Malaysia should not ignore all these facts by simply emailing and informing the customer that “these orders will not be processed” which is very irresponsible. I sincerely hope and seek for actions to be taken in which Sony Malaysia would honour AT LEAST one orders per customer (e.g. limiting one unit per customer to prevent abuse). Thank you.
