I have some questions / comments:<br /><br />1. I believe all SPA has penalty clause in case developer failed to complete and handover the property on time. As the construction has been affected by MCO, is the penalty clause enforceable (by buyers)? If no, on what basis (ie law enacted by government)?<br /><br />2. The mortgage loan continue to accrue interest even though buyers won&#39;t be able to move in or take over the property, and at the same time if developers are protected from paying penalty for the delay, then it is lose-lose situation for buyers. <br /><br />Do share if you have any knowledge or information on this topic.
