GPU WARRANTY

Hi all, what can I do about my situation .

My GPU, an ASUS ROG STRIX 3080ti sent for warranty claim since the fan was making noise.

I sent to the shop I bought from and the shop sent it for the warranty claim. After 3 weeks I ask for updates and they said supplier out of stock and supplier said the can change the brand and provide me with different brand, just have to wait for what the supplier says tomorrow.

In my mind, I'm thinking I only will agree if it's either equivalent or an upgrade.
Has anyone been in the same situation?
