Anti-government protests in the Thai capital turned violent on Saturday and at
least one man was killed and five wounded by gunshots

It was not immediately known who fired the shots or what side the victims were
on. National Police Deputy Spokesman Anucha Romyanant said the dead man was
a 21-year-old male with two bullet wounds.

The shooting occurred after scattered violence during the day involving
government opponents waylaying and beating several people they believed were
going to a rally at a stadium of "Red Shirt" government supporters.

The anti-government demonstrators are seeking to topple Prime Minister
Yingluck Shinawatra's government, which they believe serves the interests of
her brother, former Prime Minister Thaksin Shinawatra who was ousted by a
2006 military coup after being accused of corruption and abuse of power.

Scattered violence had occurred during the day involving government opponents
waylaying and beating several people they believed were going to a rally at
a stadium of "Red Shirt" government supporters.

The protesters have for the past week occupied or besieged government offices
in what they describe as a civil disobedience campaign. They have vowed to
seize the prime minister's offices on Sunday.

During the day, a mob of anti-government protesters had attacked at least two
people they suspected of supporting the current Thai government, smashed the
windows of a moving Bangkok bus and the windshield of a taxi carrying people
wearing red shirts, a sign of government support.

The mob, drawn from more than 1,000 protesters led by university students who
oppose the government, tried to block people from entering a stadium where
Yingluck's supporters were holding a rally.

The national police gave televised reaction immediately, highlighting the
fears of an escalation.

"The situation has almost returned to normal. About 100 police officers are
taking care of the situation," police spokesman Maj. Gen. Piya Uthayo said
before the nighttime clashes.

The week of dramatic protests against Yingluck's government has included
seizing the Finance Ministry, turning off power at police headquarters and
camping at a sprawling government office complex.

Protesters vowed to turn up the pressure Sunday by seizing more government
ministries and key offices, including the Government House, which is the
prime minister's office compound.

Saturday's violence was isolated to the area around the stadium, but it was
bound to increase tension and raise concerns of new political turmoil and
instability in Thailand.

The crowd first attacked two men, one of whom was pulled off the back of a
motorcycle and punched and kicked. Both men were seen being pulled away by
security and treated for head injuries.

The taxi that was attacked managed to move away. Police then moved in, and the
students began to retreat to their nearby university but then spotted a bus
carrying some passengers wearing red shirts and chased after it.

The students threw stones at the bus and then began hitting it on all sides
with sticks, shattering or breaking the buses windows as terrified
passengers inside dropped to the floor. It was not immediately clear if
anyone on the bus was injured before it moved away.

Protest leaders backed by the opposition say they want to uproot the political
machine of former Prime Minister Thaksin Shinawatra, Yingluck's brother, who
was ousted by a military coup in 2006 for alleged corruption and abuse of
power.

The protesters accuse Yingluck of being a puppet of her billionaire brother.

Thaksin, who lives in Dubai to avoid a two-year jail term for a corruption
conviction he says was politically motivated, is a highly polarizing figure
in Thailand. An ill-advised bid by Yingluck's ruling Pheu Thai party to push
an amnesty law through Parliament that would have allowed his return sparked
the latest wave of protests.

KUALA LUMPUR, Oct 27 — Japan's Kenichi Tago came from behind to beat national champion Datuk Lee Chong Wei to advance to the final of the French Open at the Pierre De Coubertin Stadium in Paris.

Najib upholds 7 Wills of the 9 Malay rulers

KUALA LUMPUR: Prime Minister Datuk Seri Najib Razak, who upholds the seven Wills of the nine Malay Rulers, says the Wills are very clear and cannot be disputed.

"The Wills are very clear," said Najib, who is also Umno President, when announcing measures to empower Bumiputeras' economy.

In pursuing Bumiputeras' interests and their unending struggles, Najib quoted the seven Wills governing the independece agreement to establish a federation.

Najib said the Will states the equity and ownership of the Malays and was later expanded to the Bumiputeras with the joining of Sabah and Sarawak when Malaysia was formed 50 years ago.

Najib, who is also the Finance Minister, announced five main strategies to empower Bumiputeras economy, covering human capital, equity ownership, non-finance asset ownership, entrepreneurship and service delivery.

The Bumiputeras, who made up 67.9 per cent of the 27.4 million Malaysia's population, must be the core of the national agenda and cannot be denied by anyone, Najib said.

"Hence, any national initiative that does not take into account or ignore the Malays or Bumiputera agneda is unfair and unjust," he said.

Najib said since independence all planning and conomic policies for the Malays and Bumiputeras by the government were drawn up based on the racial composition of the plural society.

"In principle, this practice has been accepted as a social contract all this while by all Malayians as was agreed to by our founding fathers of this nation.

Trader killed in front of family during prayer ceremony

JOHOR BARU: What was supposed to be a peaceful prayer ceremony at a temple at Taman Nusantara in Gelang Patah turned tragic when businessman K. Jaganathan (pic) was gunned down right in front of his family.

The family was in the midst of performing special prayers at the temple on Friday evening when two men wearing helmets approached and one of them took out a gun from his shoes and started to fire several shots at the 37-year-old victim who is believed to be a member of Gang 21.

The victim’s mother M. Letchumi, 63, wailed while relating the incident when met at the deceased home in Taman Mutiara Rini here yesterday.

“What wrong did he do? Why did they shoot my son mercilessly,” she screamed while other family members tried to calm her down.

Relating the incident, Letchumi said the family was praying inside the temple at around 7.30pm when she saw the gunman firing a shot to his son’s chest.

“He then fell to my legs while screaming “Amma” (Mother). Before I could pick him up, he was shot on the shoulder a second time.

“I was holding him in my arms when the shooter shot him again on his back,” she said, adding that she could still remember her son screaming for help and crying in pain.

“Whoever did this to my son is heartless. We were in a temple with other devotees. And he was killed in front of his three young children,” she cried.

Meanwhile, the victim’s elder brother, who did not want to be named, said that Jaganathan was no longer involved with any gang.

“It was all in the past. He had repented and left the gang after he got married as he had his family to take care of,” he said.

In the recent years, he said, Jaganathan had only attended to his logistics and cow rearing businesses.

Johor police chief Senior Deputy Comm Datuk Mohd Mokhtar Mohd Shariff said police have picked a man in his 30s near the temple about three hours after the incident to assist with the investigations.

He said initial investigations showed that the two suspects entered the temple before firing several shots at the victim.

“The victim had eight past criminal records and was once detained under the Emergency Ordinance,” he said.

JAKARTA (Aug 29, 2013): A Malaysian business manager is facing a possible five-year jail term for suggesting that his and his wife's underwear could be used as a substitute for Indonesia's flag, police said Thursday.

Broderick Chin, a manager at a vegetable oil company in Dumai district in Indonesia's Riau province, will be formally charged by prosecutors, after employees complained to police that he insulted the Indonesian flag by comparing it to his underpants, national police spokesman Agus Rianto said.

Insulting state symbols carry a maximum five years in prison under Indonesian law.

Chin made the alleged remarks when employees complained they could not find a red-and-white Indonesian flag to hoist in the company's premises on Independence Day on August 17, Rianto said.

"In that case, just use my underpants," Chin was reported to have said, according to the Tempo.co online news website.

"I have red underpants and my wife has white ones."
Chin has been detained and banned from travelling out of Indonesia pending the investigation, Rianto said. – DPA

Waytha: Shall we shoot all gangsters to end crime?

Onyourtoes: I think Home Minister Ahmad Zahid Hamidi and Deputy Minister in the PM's Department P Waythamoorthy are both missing the point when discussing police action and gangsterism in Malaysia.

It is not the role and the job of the police to explain why many Indians are involved in violent crimes. It is the role of the government of the day and the society as a whole to address Indian poverty which drove many into crime.

The role and the responsibility of the police is to arrest, neutralise and punish criminals irrespective of who they are. But in doing so, they must abide by procedures and laws.

The fact that they are many Indians involved in crimes does not mean the police cannot kill anyone of them if the situation warrants it.

The reasons why Indians are involved in crimes are different and separate from the reasons why the police need to shoot to kill in certain situations.

Mohamad Abdul Malik: The police's job is to eradicate, or if possible, eliminate crime altogether. And I think that they are on track.

It's the politicians job to find a solution to the social problems created by the past massive displacement of Indians. MIC and a few other Indian-based parties was part and parcel of the government for over 50 years and they were supposed to represent their community.

And for the past 50 years, the Indians has given them their wholehearted support. What were they doing all these years?

The police should not be the punching bag when it was the politicians' failure in the first place that gave rise to these problems among the Indian community.

Anyway I support the current actions of the police. They have a job to do and hopefully we do not have political opportunists derailing the action taken by them. I, too, have the right to a safe environment free of gangsterism.

Angry Citizen: Mohamad Abdul Malik, everyone has the right to safe environment and this being a country upholding the rule of law means those who break the law have to face their day in court, and this means they have to be arrested not just shot dead because the police are lazy to do the work of collecting evidence.

You won't understand this but that is the way of the civilised world which you do not belong to. Just pray you don't one day get shot by the police for being in the wrong place at the wrong time.

Joe Lee: Waytha is absolutely correct on this point: "Shooting these youths is shooting at the most visible portion jutting above the water, but which is only a very small fraction of the problem."

Waytha must take up the gun, and point it at Umno leaders who have totally failed in their duty to look after the interest of all Malaysians. This is blow back - Umno policies are the cause of the gangsterism problem.

Kyrie Eleison: Waythamoorthy, I don't think there is much you can do. Your mission to help the oppressed (Indians) will come to naught because you can't change the system. Unless you can change these Umno leaders, you will not succeed.

Judging from the way they browbeat and belittle you, it appears that you are just a nobody to them. In fact they think you should be indebted to Umno for getting your position in the cabinet (with all the perks and benefits).

If that is what it's all about, you might as well resign and save yourself from further embarrassment. I think you have lost the respect of all Malaysians either way.

Up2U: Malaysians are generally peace-loving and we do have very strict laws to deal with those in possession of firearms - the death penalty. If gangsters are in possession of firearms, then I fully agree that shooting them is the best and safest option for our men-in-blue.

Waytha, did any of these 'wayward youngsters' ever think about the victims they shoot? Irrespective of their racial background or even their nationality, shooting and killing those gangsters in possession of firearms put an end to the story. Period.

Hotsy Totsy: It's very strange those who talk a lot here have not gone to the ground to understand the plight of Indians. No one is protecting the gangsters, but there are laws to apprehend them and give them their just deserts.

Bumiasli: The armed snatch thiefs on motorbikes and sometimes in cars, are mostly Malays. What have the police done about that. Today the snatch thieves are armed with parangs and even kill the victims after robbing them. - edited

I don't see any action taken on them so far. So stop discriminating any race. A criminal is a criminal and same treatment must be given to all.

Rahman Putih: Shoot or reform? The Malay community faces massive issues with drug addicts who commit more than 70 percent of snatch thief and break-ins. The government does a lot to reform and rehabilitate them.

Why can't the government work with Waytha and implement the Hindraf blueprint so that the vicious cycle of gangsterism is wiped out amongst Indian Malaysians.

Azilah, Sirul acquitted of murder

PUTRAJAYA:Two policemen, who were convicted and sentenced to death for murdering Mongolian national Altantuya Shaariibuu in 2006, are now free men after the Court of Appeal overturned the High Court’s decision yesterday.

The three-member bench, led by Datuk Seri Mohamed Apandi Ali, unanimously allowed Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar’s appeal against the conviction and death sentence by the High Court.
Azilah, 37, and Sirul, 42, were accordingly acquitted and discharged. Thecourt yesterdaylaidout eight grounds in acquitting Azilah and Sirul.

In the judgment read by judge Datuk Tengku Maimun Tuan Mat, the court ruled that the trial judge had misdirected himself in convicting the two.

On Azilah’s alibi, the court did not find anywhere in the trial judge’s judgment that he had considered whether the station diary showed or tended to show Azilah’s presence at Bukit Aman at the material time, and that he was unlikely to be at the crime scene.
"The trial judge had misdirected himself by way of non-direction in failing to consider the station diary and in failing to make a finding whether the defence had cast a reasonable doubt on the prosecution's case that Azilah was at the crime scene."
On common intention, the court found that the trial judge had made no findings on whether the prosecution had established that there was a pre-arranged plan by the two to commit the murder.

"The absence of such a finding on the ingredient of common intention amounted to a misdirection by way of non-direction."
In the four-page summary judgment, the court also found that the testimonies of three witnesses from several telecommunication companies had put into issue the reliability and accuracy of the call logs and the coverage prediction.
"It is essential for the trial judge to address his mind to the challenge raised by the defence on the exhibits and to make a finding whether there was an alteration or tampering of the data and whether the authenticity of the data was questionable or otherwise. Regrettably, the judge had failed to do so, which amounts to a serious misdirection, rendering the said exhibits unsafe to be relied upon."
On information leading to the discovery of the crime scene and Altantuya's jewellery, the court found that the trial judge did not direct his mind and did not examine whether the contradictions or inconsistencies in the prosecution witnesses' evidence was material.
She added that the trial judge also did not examine the credibility of the prosecution witnesses and did not address his mind whether the discovery was made as a result of the information supplied by the two, and not from other sources.

The court also ruled that the trial judge should make a further finding to connect the explosives used in the murder with Azilah and Sirul.
"By not making any finding on possession by the appellants of the explosives used in the commission of the murder, the judge had failed to address his mind on this missing link, resulting in yet, another misdirection."

On the issue of a pair of slippers with Altantuya's bloodstains found in Sirul's jeep, the court found no evidence to show any nexus between the slippers and Sirul.

"Similarly, on the spent cartridge recovered from inside Sirul's car, we find that there is a gap in the prosecution's case, which the trial judge had failed to direct his mind to."

On the prosecution's failure to call Deputy Superintendent Musa Safri, Tengku Maimun said Musa's evidence was essential to unfold the narrative upon which the prosecution's case was based on.
During submissions, Sirul's lawyer, Kamarul Hisham Kamaruddin had said there was suppression of evidence when the prosecution failed to call Musa to testify regarding an affidavit affirmed by political analyst Abdul Razak Baginda, the third accused who was acquitted of abetting Azilah and Sirul, without his defence being called.

"Looking at the whole circumstances of the case, it is our judgment that the cumulative effect of the non-directions by the trial judge rendered the conviction of the appellants unsafe," she said.
The Attorney-General's Chambers said it would file an appeal with the Federal Court.
Attorney-General Tan Sri Abdul Gani Patail said while he respect the Court of Appeal, the Chambers, for the prosecution, was dissatisfied with the decision.

"Non-direction or misdirection by the trial court is not the fault of the prosecution. As far as DSP Musa Safri is concerned, we maintained that his testimony had no relevance as the whole narrative of the prosecution's case had been unfolded in the trial below."
Gani said it was non-directions by the trial judge on issues raised by the appellants in his judgment which amounted to misdirections and the non-calling of Musa that formed the main grounds for the setting aside of the conviction and sentence.
Azilah and Sirul, both members of the Special Action Unit, were found guilty in 2009 by the High Court of murdering Altantuya at Mukim Bukit Raja in Shah Alam between 10pm on Oct 19, 2006, and 1am on Oct 20, 2006.
Counsel Datuk Hazman Ahmad appeared for Azilah.

KUALA LUMPUR (April 2, 2013): The MCA has done much to propel the nation forward in many areas, which include education, social issues and the economy, the party's top leadership said today.

In releasing its 1,000-day report card, party president Datuk Seri Dr Chua Soi Lek said the MCA has long contributed to the community through its work, although it is "not good" at publicising what it has done.

"We have facts and figures to present our results, unlike DAP that only does political spinning and gives false hope to the Chinese community," he told a press conference.

The achievements that were highlighted in the report included:

upgrading of Kolej Tunku Abdul Rahman to a university college;
enabling Unified Examination Certificate candidates to apply for National Higher Education Fund (PTPTN);

special allocation of RM415 million from 2009 to Chinese schools;
RM50 million to the 1MCA micro-credit loan scheme for youths to encourage entrepreneurship;

blocking the proposed amendment to the Income Tax Act (which was dropped after objection from MCA); and
setting up of 1MCA Medical Foundation, disbursement of RM10.1 million since 2011.

"So, it is not true that we have done nothing for the Chinese. That is a big lie from DAP," he stressed.

What is more important is that MCA is ready for the election."
He also said that DAP's battle for Johor is all about "spin", and that voting for DAP in Johor will have detrimental effects in the state, without elaborating.
