I am seller and signed SPA on 2018 , stamped and collected 10% Deposit.

Purchaser failed to pay balance untll now.

in the SPA mentioned:

In the event of purchaser failing to pay the balance Sum within time stipulated, Vendor shall be entitled to terminate this agreement following consequences clauses:

a) this agreement shall rendered null and void and the parties hereto shall have no claim or further claim against each other save and except for past breaches.

is the above mean this agreement will be automatically terminated ? or what should i do to terminate this SPA ?

Balance payment of SPA do installment?

SPA signed and stamped, 10% DP paid.

Then now, The buyer asked if can pay the balance 90% to me by installment for 5 years.

I should charge him 5% interest per year.

For example, let say balance is RM 500,000

RM 500,000 x 5% x 5 years = RM 125,000

Total = RM 500,000 + 125,000 = RM 625,000

Then monthly he pay me RM 625,000/12/5 = RM 10,416

Is it ok above? need to do agreement?
The house still under my name, will only transfer the name after he completed all payment in 5 years, is it feasible to just transfer name ??

i sold a house, bank loan last week settled by buyer loan, the balance money hold by lawyer, but lawyer ask me give the key first, he cannot release my balance payment due to documentation havent complete.

he said buyer have paid all, thus i have to give the key first.

Is this a correct way??
