            <description>The Court of Appeal ruled that it is no longer a crime in Malaysia to post “offensive” online remarks intended to “annoy”, declaring part of the Communications and Multimedia Act&amp;#39;s Section 233 as unconstitutional.&lt;br /&gt;&lt;br /&gt;The Court of Appeal said Section 233 gave no objective standard for what is “offensive”, warning it could criminalise speaking the truth and stifle free speech just because someone feels the online remarks are offensive.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The court&amp;#39;s decision today only applies to ongoing and future cases where individuals face charges under Section 233. The Malaysian government can still appeal to the Federal Court, but it is not known yet if it would appeal.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;PUTRAJAYA, Aug 19 — The Court of Appeal today unanimously ruled that it is no longer a crime in Malaysia to make “offensive” online comments with the intention to “annoy”, and struck down parts of the Communications and Multimedia Act 1998’s Section 233 that had criminalised “offensive” and annoying online speech.&lt;br /&gt;&lt;br /&gt;Federal Court judge Datuk Lee Swee Seng, chairing a three-judge panel, said the court found these words “offensive” and “annoy” in Section 233 to be unconstitutional, as they go against the Federal Constitution’s Article 10(2)(a).&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;“We find the impugned words ‘offensive’ and ‘annoy’ in Section 233 constituting an offence to be violative of Article 10(2)(a) of the Federal Constitution read with Article 8. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;“It is not a permissible restriction to freedom of speech under our Federal Constitution,” he said, before striking down or making these two words in Section 233 invalid.&lt;br /&gt;&lt;br /&gt;“We declare this decision to have prospective effect, so as not to resurrect the past,” he added.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The Court of Appeal’s decision’s prospective effect means it will only affect ongoing or future court cases involving the crime of “offensive” online speech intended to “annoy” under Section 233, and will not affect past cases where the court had decided on whether those charged are guilty or not of such crimes.&lt;br /&gt;&lt;br /&gt;In reading the broad grounds of his judgment, judge Lee pointed out that there may be some people who feel offended and annoyed even when what is spoken is the truth, and cautioned against making it a crime to speak the truth.&lt;br /&gt;&lt;br /&gt;“A premium should be given to truth, and the fact that some truths may be unpalatable does not justify criminalising the messenger merely because some masses of the people do not like the message,” the judge said.&lt;br /&gt;&lt;br /&gt;Among other things, the judge said that there is no uniform standard in society on what is “offensive”, and what a person finds offensive may not be offensive to another person in a diverse society.&lt;br /&gt;&lt;br /&gt;The judge said Section 233 does not give any standards on what would be “offensive” or what would be an “intent to annoy”, and said freedom of speech becomes illusory and enforcement becomes arbitrary when all types of speech could potentially be “offensive” if a single person feels it is offensive.&lt;br /&gt;&lt;br /&gt;The judge cautioned that this would result in every speech having to be “sanitised” — whether it is true or not — to avoid committing a crime under Section 233.&lt;br /&gt;&lt;br /&gt;Without an objective standard on what is “offensive”, the judge said regulating online civil discourse would become a “euphemism” for the authorities to police and censor undesirable speeches, which he said would result in a “chilling effect” over the right to freedom of speech and expression which is protected under the Federal Constitution’s Article 10(1)(a).&lt;br /&gt;&lt;br /&gt;The judge pointed out that if online remarks are found to be untrue, a person can still be charged under the CMA’s Section 233(1) for making comments that are false with intent to abuse, threaten or harass another person.&lt;br /&gt;&lt;br /&gt;The two other judges on the panel today are Court of Appeal judges Datuk Hashim Hamzah and Datuk Azman Abdullah.&lt;br /&gt;&lt;br /&gt;When asked by reporters if the Malaysian government will be appealing today’s decision, senior federal counsel Liew Horng Bin said he would be seeking instructions on whether to file an appeal at the Federal Court.&lt;br /&gt;&lt;br /&gt;Earlier, Liew asked for an “interim stay” or to not let today’s decision be immediately enforceable, but the Court of Appeal said he could file a formal application to stay.&lt;br /&gt;&lt;br /&gt;Also appearing for the Malaysian government today were senior federal counsel Farhati Ahmad Tajuddin who is also the Communications Ministry’s legal adviser, and senior federal counsel Nordalina Ali.&lt;br /&gt;&lt;br /&gt;Lawyers Datuk Malik Imtiaz Sarwar, Surendra Ananth, New Sin Yew and Nur Izni Syazwani represented activist Heidy Quah in her successful constitutional challenge today against the words “offensive” and “annoy” in Section 233.&lt;br /&gt;&lt;br /&gt;Quah had in August 2021 filed her constitutional challenge but failed at the High Court in September 2023, and today won her appeal at the Court of Appeal.&lt;br /&gt;&lt;br /&gt;Lawyer Kee Hui Yee held a watching brief for the Malaysian Bar, while lawyers Lim Wei Jiet and Nevyn Vinosh Venudran represented Clooney Foundation for Justice and Suara Rakyat Malaysia in assisting the Court of Appeal as amicus curiae.&lt;br /&gt;&lt;br /&gt;While the Court of Appeal’s decision today has effectively removed the words “offensive” and “annoy” from Section 233, there is now a newer version of Section 233 that uses the words “grossly offensive”.</description>

Developer declare VP dated 4th April 2025, and thereafter claim the full loan disbursement&lt;br /&gt;&lt;br /&gt;2. Bank release payment within 30 days.&lt;br /&gt;&lt;br /&gt;3. Ayam pay all the misc charges and prepayment of maint fee as required.&lt;br /&gt;&lt;br /&gt;4. Developer issue letter of clearance&lt;br /&gt;&lt;br /&gt;5. Now here is the thing get interesting, developer has asked to set appointment for key collection and earliest slot for appointment is 2 months after date i received letter of clearance&lt;br /&gt;&lt;br /&gt;So, under schedule H, clause 27 fully describe how VP should be performed, and I read the whole agreement and nothing say developer can set additional roadblock to key collection after VP&lt;br /&gt;&lt;br /&gt;under clause 27(4), I would be deemed taken the vacant possession after 1 month from date of VP declaration by developer. &lt;br /&gt;&lt;br /&gt;Seek SIFU advise on this matter.</description>

            <title>Tout troubles at DBKL carparks in Sri Petaling</title>

            <description>&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Two Kuala Lumpur City Hall (DBKL) carparks in Sri Petaling are being misused by illegal parking operators, stakeholders say.&lt;br /&gt;&lt;br /&gt;Kuala Lumpur Advisory Board member Andre Lai said a meeting with the relevant DBKL department regarding the management of the sites would be held this month.&lt;br /&gt;&lt;br /&gt;The meeting is to decide whether an operator should be hired to manage each site or if users should continue to pay parking fees via apps.&lt;br /&gt;&lt;br /&gt;“The lots, located at Jalan Radin Bagus 8 and Jalan Radin Anum 4, are DBKL-owned parking areas.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;“They were previously manned by illegal parking touts, who have since reappeared after a clampdown by DBKL.&lt;br /&gt;&lt;br /&gt;“Motorists using these lots are required to pay the standard DBKL parking fee (of RM1 per hour).&lt;br /&gt;&lt;br /&gt;“However, illegal operators have been collecting fees from motorists, charging RM5 per entry,” said Lai.&lt;br /&gt;&lt;br /&gt;On April 19, DBKL carried out an enforcement operation against the illegal parking operators at both the locations in Sri Petaling.&lt;br /&gt;&lt;br /&gt;Authorities dismantled boom gates and makeshift payment counters.&lt;br /&gt;&lt;br /&gt;But the touts returned after a few days, collecting fees at the entrance to the parking lots.&lt;br /&gt;&lt;br /&gt;Lai also brought up the issue of a local pasar malam (night market) using the lot.&lt;br /&gt;&lt;br /&gt;“The carpark at Jalan Radin Bagus 8 has 374 bays.             <description>MALAYSIA&lt;br /&gt;Rafizi: PKR doesn’t have to worry about PM Anwar’s approval ratings, ‘the Opposition is in tatters&amp;#39;&lt;br /&gt;&lt;br /&gt;PUTRAJAYA, Nov 25 — PKR deputy president Rafizi Ramli today dismissed the fall in approval ratings for party president and Prime Minister Datuk Seri Anwar Ibrahim, saying that such an occurrence is normal for any government heading towards the middle of its term.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The Merdeka Center findings do not come from an isolated issue and must be read with the context of approval ratings for previous prime ministers, who had lower approval ratings than Anwar, Rafizi told reporter at the Putrajaya International Convention Centre here where the PKR congress is being held this year.&lt;br /&gt;&lt;br /&gt;“According to my reading, seeing the Merdeka Center findings, actually the approval ratings are quite good compared to the approval ratings of previous prime ministers, the year after he became prime minister.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;“But that wasn’t read by people. Many people only looked at that only and didn’t look at the others,” Rafizi said about Anwar.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Rafizi, who is also economy minister, touted PKR as the most data driven party that has conducted its own surveys, which showed that Anwar’s popularity has been at high levels until May, when the value of the ringgit fell.&lt;br /&gt;&lt;br /&gt;He said that until then, Anwar’s popularity has surged in recent months with the government’s implementation of policies such as the Madani Economy framework and the National Energy Transition Roadmap.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;“Figures from September and October and November have shown an increase again,” Rafizi said.&lt;br /&gt;&lt;br /&gt;He said that the “unity government” under Anwar is currently rock solid with increasing public support and that PKR has nothing to worry about, unlike the federal Opposition coalition Perikatan Nasional (PN) and its component party Bersatu, which is also holding its sixth annual general meeting in Shah Alam, Selangor this weekend.&lt;br /&gt;&lt;br /&gt;“The Opposition is in tatters because I don’t think Perikatan Nasional can maintain the momentum that it had before,” he said.&lt;br /&gt;&lt;br /&gt;He added that PN’s momentum was generated based on projections for the fall of the federal government and not after the August state elections in Selangor, Negeri Sembilan, Penang, Kedah, Kelantan, and Terengganu.&lt;br /&gt;&lt;br /&gt;According to Rafizi, Bersatu has been lucky since it wis a relatively new party and had not been a member of the federal Opposition since its founding.&lt;br /&gt;&lt;br /&gt;“The moment your own party members feel that there is going to be a tough road ahead, some will back off and start pointing fingers at each other ‘why aren’t things like this’.&lt;br /&gt;&lt;br /&gt;“Then you will see a lot of discourse internally about what will happen with the party and then leadership... we’re already seeing it.&lt;br /&gt;&lt;br /&gt;“And whatever happens in Bersatu will also have an effect on PAS because PAS by nature, they will say ‘you are weak then I have to find other partners’,” he said.&lt;br /&gt;&lt;br /&gt;The 2023 PKR Annual National Congress will be held over this weekend with the theme ‘Memaknai Reformasi, Menjulang Madani’.&lt;br /&gt;&lt;br /&gt;The press conference was held after Rafizi’s opening address for the Women’s wing.&lt;br /&gt;&lt;br /&gt;&lt;img src='https://i.kym-cdn.com/photos/images/original/000/972/602/507.png' border='0' alt='user posted image' /&gt;</description>

Being an idealist, even I don’t dream of any idea that can be so far-fetched. For such heavy concepts, there has to be a realistic base, but unfortunately Akhand Bharat has none. This idea isn’t even thought-provoking.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Now tell me one thing, what was the last time when this entity existed? Not in the last 10,000 years&amp;#33;&lt;br /&gt;&lt;br /&gt;This is even less. I see many maps adding newer countries to the mythical Akhand Bharat, such as the ones in southeast Asia. They also add other provinces of China.&lt;br /&gt;&lt;br /&gt;I think the original idea of Akhand Bharat was the reunification of India with Pakistan and Bangladesh, which was indeed a reality 75 years ago. However, that polity was the British India, and not the Akhand Bharat. Even during that time, sheer disunity caused the bloody partition from which both countries are yet to come out. India is not China or US to make such an Akhand Bharat possible.&lt;br /&gt;&lt;br /&gt;Historically, Indian empires occasionally conquered few portions of Afghanistan, Nepal and Sri Lanka. I don’t remember any period when Tibet was a part of any Indian empire. Yes, during the ancient and medieval ages, Indian Hindu and Buddhist culture did spread to these regions but that doesn’t make them a part of India. Indosphere is more of a cultural sphere of Indian influence than socio-political.&lt;br /&gt;&lt;br /&gt;There are dozens of Christian and Muslim nations, are they a single country? Sure, ideas like Ummah and Christendom existed but they did not succeed till now.&lt;br /&gt;&lt;br /&gt;So, a political union is impossible. There are communal riots in India with 21 crore Muslim population, now imagine what would happen with an addition 40 crore Muslim population and adding on other heterogeneous ethnic groups&amp;#33; We want to escape from the Rohingyas, but in Akhand Bharat, they would be completely in the same nation.&lt;br /&gt;&lt;br /&gt;If you talk about forming an EU or ASEAN like intergovernmental organisation, then yes, that can work. It will be beneficial for all the nations in the Indian subcontinent and beyond. But India-Pakistan rivalry is a big hurdle. That is why SAARC couldn’t succeed. And in such organisations, India can and should not play a big brother. In EU and ASEAN, all countries are equal partners. We also cannot agree on open borders due to security issues and demographic threats.</description>

Balamurugan has filed an application for leave to pursue his appeal to the Federal Court in his bid to delist the Liberation Tigers of Tamil Eelam (LTTE) as a terrorist group.&lt;br /&gt;&lt;br /&gt;In his application filed on May 13, Balamurugan had proposed five legal questions for the Federal Court to consider.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;In the notice of motion, Balamurugan said the legal questions concern the scope and limits of the Home Minister’s power in declaring entities under Section 66B(1) of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001.&lt;br /&gt;&lt;br /&gt;Balamurugan’s lawyer Omar Kutty Abdul Aziz, when contacted, confirmed the filing of the leave to appeal application.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The case is fixed for case management on June 17.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;On September 17, 2020, the High Court dismissed Balamurugan’s judicial review to delist LTTE as a terrorist group in the country. He lost his appeal at the Court of Appeal on April 14, this year.&lt;br /&gt;&lt;br /&gt;Balamurugan had filed the judicial review seeking a declaration the LTTE details in the gazette as null and void and the listing of LTTE was unlawful as it was ultra vires to the Federal Constitution.&lt;br /&gt;&lt;br /&gt;He named the Home Minister and the government as respondents.&lt;br /&gt;&lt;br /&gt;He also wanted a certiorari order to quash the listing of LTTE in the gazette, Anti-Money Laundering, Anti-Terrorism Financing, and Proceeds of Unlawful Activities (Declaration of Specific Entities and Reporting Requirements (Amendment) 2014; dated November 12, 2014.&lt;br /&gt;&lt;br /&gt;Balamurugan were among 12 individuals who were charged in late 2019 over alleged support of the LTTE.&lt;br /&gt;&lt;br /&gt;However, in February 2020, the then Attorney-General Tan Sri Tommy Thomas dropped the charges against them. — Bernama&lt;br /&gt;&lt;br /&gt;how lah like this?
