            <title>Developer&amp;#39;s consent to transfer</title>

            <description>Type of property: Leasehold apartment (bought more than 6 years)&lt;br /&gt;Location: Wilayah Persekutuan&lt;br /&gt;Proprietor: DBKL&lt;br /&gt;Strata title: under DBKL&amp;#39;s name but yet to do perfection (i.e. transfer to my name)&lt;br /&gt;Seller&amp;#39;s Loan: none &lt;br /&gt;Purchaser: Cash buyer&lt;br /&gt;&lt;br /&gt;I am selling off my apartment, details as above. Developer agrees to do direct transfer with an administrative fee of RM2.5k and their lawyer&amp;#39;s vetting fee of RM530 - all excluding GST and disbursements.&lt;br /&gt;&lt;br /&gt;May i seek the advice of the sifus here:&lt;br /&gt;&lt;br /&gt;1. Who should bear the above developer&amp;#39;s admin &amp;amp; lawyer&amp;#39;s vetting fee i.e. seller or buyer? &lt;br /&gt;&lt;br /&gt;2. Is there a capped fee / restriction on the amounts to be charged by the developer and their lawyer? Pursuant to the Deed of Mutual Covenants, the developer has the right to charge an admin fee of 1% of the resale price and all legal fee incurred in connection therewith. The developer also has the rights to impose other conditions as it may deem fit.&lt;br /&gt;&lt;br /&gt;3. Who should write to the developer to get the consent i.e. seller or buyer&amp;#39;s lawyer? The seller is using the buyer&amp;#39;s lawyer. Been checking and following-up with the buyer&amp;#39;s lawyer but no response.&lt;br /&gt;&lt;br /&gt;4. In addition to the developer, do i need to get DBKL&amp;#39;s consent too? Pursuant to the Deed of Mutual Covenants, I shall not transfer the property without prior written consent of the developer and proprietor (DBKL).&lt;br /&gt;&lt;br /&gt;Thanks in advance for the input.</description>
