Main Tenant is cheating

Hi all,

The case is like this :

- Me and my friend ( roommate ) is taking over a room - sharing basis in A condo.
- The unit was taken over by an Iranian lady - has been there and renting for 4 - 5 years
- The contract is under this Iranian lady 's name
- She leased back the room to my friend since March 2011 for 700 RM - then later in June 2011, I joined with my friend to share the room ( my share part is more - therefore my deposit is more and my concern with this case is higher too )
- There was no agreement signed between my friend and that main tenant ( Iranian lady )
- It was done verbally
- When my friend paid the deposit (2 months deposit + 1 month rental) - there was a receipt written for her
- In October 2011 we told the main tenant we wanted to move out and will give 2 months notice for this , due to some problem in the house ( hall is always dirty, kitchen is dirty, washing machine does not function properly, out food in the fridge always got thrown away ) - the main tenant told us that we can't do that, no deposit will be given back to us as due to the short time we are staying in the house - "it's not like a hotel"
- And as well she said before the house contract finish / she wants to renew a new one - she will tell us 2 months in advance.
- We overheard her talking to another tenant in the house ( local Chinese girl staying there for 2 years ) that the contract is finishing up soon and if she wants to move out now, she can , or if she wishes to stay and take up the contract ( as the Iranian will go back hometown for good ) then she needs to tell the Iranian lady ( when we confront her, she tried to sooth us up by saying that Chinese girl was trying to make noise to kick my friend out and she stood up for her by asking that girl to move out )
- So we asked her when would the house contract finish so then we can just end our lease right there when contract finishes
- The main tenant acted dumb and said "I don't know" " It can be Dec, can be Jan, I don't know"
- So we requested at that time if we could see the agreement to double check on the lease date
- So her answer at that time was : " I don't know where I keep it, I need to find "
- We have been paying her rental on time, only in October when we actually wanted to move out, and telling her to minus off from our deposit for the house rental and waiting to see what is her answer for that request - then only we paid her late that month
- From November - December - we did pay the house rental and never been late
- Always Always on the 30th of the month end , she already SMS and asking us to bank in the cash whereby it has not even reached the 1st of any month.
- Me and my friend - no one stayed home for these 2 months
- A week ago, my friend called and asked her when would the contract finish up , she said It's December but she is extending to March and she has already showed to the other tenant (the local Chinese)
- I came back to the house on Friday morning, seeing her things are all packed up - with Iranian Address written on it - I texted and asked my friend is she knows about this
- My friend called up the Iranian girl and she said that she was going to go back for holidays for few months 2 to 3 months and will come back
( Because we don't know what is this lady's scheme, if the agreement does end in December, she was rushing us to bank in the rental by 31st Dec, and what's if a week later, the Iranian girl gone , the owner comes in and ask " Eh, who are you guys doing in my house blah blah ")

- We do not know when did the contract end exactly , we only know that it's extended to March.
- So as a tenant, we request to see the agreement and to have the owner contact number as well for emergency case - she refused to give us.
- So last night, things went crazy
- My friend came back to the house, text her - asked to see the agreement
- She asked my friend to come alone to her room to talk
- And we stand outside can hear clearly that main tenant asking my friend " So do you have the last 2 months receipt with you ? " and my friend said " no, you didn't give me receipt " so she told my friend " see, so don't be rude with me, I can just say that you didn't pay the last 2 months and chase you off from here "
- Again, my friend asked to see the agreement , just to see the agreement and that's it. And she refused to show us the Agreement
- Again , my friend said " don't worry, i know it's all business to you, I don't mind about the actual price of the unit shown in the agreement, I just want to see the date, that's it " ( the actual price of the unit is only 1600, while she told us before that its 2000 ++ , our room is 700 , the small room is 600, so her master-room should be very very cheap then )
- She refused to show her
- And she shouted at my friend ( with 5 of us in the house listening ) : " I can just call the police and say you didn't pay the 2 month rental and you will need to leave this house "
- My friend did pay her with cash deposit / bank transfer / or give her cash by hands

- So we decided to bring the police in as this lady is out of hand
- When the police is in the house, the lady changed story and saying we didn't pay her 3 MONTHS and not only 2 months as saying before
- She complained to police that it's November , December and the month before November ( and she can't tell which month it is )
- However, my friend got the November cash-deposit receipt with her.
- When we stressed again " Are you sure that we didn't pay you in November " - she said " Yes "
- Then my friend showed the receipt - she saying " oh this is your problem, you can just go and print it out simply" (Hello! it's a bank receipt =.=" You can't just fake it )
- So the police asked her to showed the record of house monthly rental (since she is the main tenant) she said it's our problem , not her problem, so we needs to produce the proof and not her
- So we asked her we always cash deposit / bank in - should have in her bank transaction - so police demand her to show the bank transaction , she refused and keep on saying " this is not my problem " and trying to turn the story to other stories
- Well, at last, the police ask her to show the house agreement ( Afterall, it comes to this point : show the house agreement so we know what is the lease end date ) - she produced the house agreement , but she stressed " only for police to see, you all cannot see it " WTF , it's just a house agreement. But when the police browse throught it, ok, fine, it shows 1st March 2011 on top of the agreement, there are signs , but there was no chop mark. Not sure if the chop is necessary or not, because all my previous house we do have the legal chop on it)
- Then, come to this points she turns around and ask my friend " DO YOU HAVE THE DEPOSIT RECEIPT WITH YOU ? If you have it now I can give you back the deposit and move out immediately , if you don't have it , don't talk "
- My friend got lightning struck. Why would she mentioned the deposit receipt out of the blue like a certain thing , like it's her ace card
- So my friend went in and check on her expense book . The book is gone . All the receipts in there and record of Utility bills ( which she accused us of never pay as well ) - are gone.
- Her TNB statement proof that last time the Iranian cheated her - as well gone.
- As mentioned above, 2 months we were not at home. and our door is very easy to be opened
- So suddenly talking about deposit receipt now , is like a sudden death for us

- So we went to the police station to make report ( yes it's 1/1/2012 midnite where everywhere have fireworks )
- The Iranian lady after done making report , is making a drama stage in police station that she is so scared going back home and afraid that we and our friend will do something to her and asking the police to do something to us ( like barring us from entering the house )
- The police finally talked her off and she went back
- We stayed back to finished up our report
- at 1.30 am my friend went back home (I went to work) - my friend called me up and saying she changed the padlock and put 2 padlocks now
- She refused to let her go in the house
- She told her to move out immediately
- She called police again
- Police came, talked with the lady, the lady let my friend came in the house at around 3 .30 am
- My friend called me after that , saying when she stepped in the house, the lady saying " I already told you don't mess with me"
- My friend was so scared , just packed some of her clothes and then left the house
- Now she is waiting for me to get off work and we will go back there together

I know it's a long story But I want to know if there was a way for us to reconfirm what that lady say about the 2 month receipt thing and make a record and it could be a good proof against her ... ( at that time we were so stupid to not get a record done )
