Totally not in condition to move around. &lt;br /&gt;&lt;br /&gt;I have police report on the Lost IC case and doctor report on his unavailability to move around.             <description>&lt;b&gt;Najib allowed to withdraw defamation suit against Tony Pua&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Judge says the withdrawal does not prejudice the Damansara MP and orders Najib Razak to pay RM30,000 in costs.&lt;br /&gt;&lt;br /&gt;&lt;img src='http://s3media.freemalaysiatoday.com/wp-content/uploads/2018/07/najib-razak-tony-pua.jpg' border='0' alt='user posted image' /&gt;&lt;br /&gt;&lt;br /&gt;KUALA LUMPUR: The High Court has allowed former prime minister Najib Razak to withdraw his suit against Damansara MP Tony Pua over the tabling of the Syariah Courts (Criminal Jurisdiction) (Amendment) Bill or RUU355.&lt;br /&gt;&lt;br /&gt;Judge Mohd Zaki Abdul Wahab said the withdrawal did not prejudice Pua as Najib had given an undertaking that he would refile a fresh suit later.&lt;br /&gt;&lt;br /&gt;Zaki also ordered Najib to pay Pua RM30,000 in costs within 14 days.&lt;br /&gt;&lt;br /&gt;“The defendant (Pua) and his lawyer have done a lot of work in preparation for the plaintiff’s application to withdraw the suit,” he said.&lt;br /&gt;&lt;br /&gt;Pua’s counsel Tan Cheng Leong said he would obtain instruction from his client on whether to file an appeal.&lt;br /&gt;&lt;br /&gt;Last week, Tan said in his submission that the move would cause prejudice to his client as there was no avenue for him to justify his statement over the bill.&lt;br /&gt;&lt;br /&gt;He said Pua had also obtained leave to appeal from the Federal Court against an interim injunction order granted to Najib.&lt;br /&gt;&lt;br /&gt;“Therefore, it is important for the issue to be decided by the Federal Court. It is unjust to my client if the court allows the discontinuation of the suit before the appeal is heard,” he said.&lt;br /&gt;&lt;br /&gt;Najib’s counsel Mohd Hafarizam Harun however said the application would benefit Pua as his client had appealed to withdraw the suit with no liberty to file a fresh one.&lt;br /&gt;&lt;br /&gt;“The defendant should have looked at this as a way forward, where parties walk over and let bygones be bygones,” he said.&lt;br /&gt;&lt;br /&gt;On April 21 last year, Najib sued Pua in his personal capacity, alleging that Pua had made defamatory statements against him in a video relating to the tabling of a private member’s bill to amend RUU355.&lt;br /&gt;&lt;br /&gt;Najib claimed the two-minute, 21-second video clip uploaded on Pua’s Facebook page entitled “BN Govt abandons all Bills to give precedence to PAS’ RUU355 Private Member’s Bill” could be accessed widely and freely on the internet.&lt;br /&gt;&lt;br /&gt;He also claimed the video contained words referring specifically to him and implying that he had abused his power by giving orders through the Cabinet to the Dewan Rakyat speaker to give way to Marang MP Abdul Hadi Awang to propose the bill.&lt;br /&gt;&lt;br /&gt;In his video, Pua had said that the tabling of the bill was a charade to divert attention from the 1MDB fiasco and the RM2.6 billion found in Najib’s private account.&lt;br /&gt;&lt;br /&gt;On Aug 4, Zaki dismissed Pua’s application for the video to remain on his Facebook page to be viewed by the public pending the outcome of Najib’s defamation suit.&lt;br /&gt;&lt;br /&gt;On Feb 14 this year, the Court of Appeal upheld Zaki’s ruling on the grounds that all investigation agencies and the Attorney-General’s Chambers had cleared him of any criminal wrongdoing.&lt;br /&gt;&lt;br /&gt;Last month, the Federal Court allowed Pua’s leave application to appeal against the interim injunction obtained by Najib.&lt;br /&gt;&lt;br /&gt;A three-man bench led by Court of Appeal president Ahmad Maarof said each case involved questions of legal importance which needed further argument.&lt;br /&gt;&lt;br /&gt;The bench allowed four legal questions framed by Pua which would be argued on a date to be fixed.&lt;br /&gt;&lt;br /&gt;Sos &lt;a href='http://www.freemalaysiatoday.com/category/nation/2018/07/30/najib-allowed-to-withdraw-defamation-suit-against-tony-pua/' target='_blank'&gt;FMT&lt;/a&gt;</description>

They can not be independently verified as access to Rakhine state is heavily controlled.&lt;br /&gt;Advertisement&lt;br /&gt;&lt;br /&gt;Myanmar&amp;#39;s government denies any abuses and instead blames militants for burning down thousands of villages, including many belonging to Rohingya.&lt;br /&gt;But international pressure on Myanmar heightened this week after United Nations rights chief Zeid Ra&amp;#39;ad Al Hussein said the violence seemed to be a &amp;quot;textbook example of ethnic cleansing&amp;quot;.&lt;br /&gt;The US also raised alarm over the violence while the Security Council announced it would meet on Wednesday to discuss the crisis.&lt;br /&gt;Opprobrium has been heaped Aung Sang Suu Kyi, who was once a darling of the rights community but now faces accusations of turning a blind eye to - and even abetting - a humanitarian catastrophe by Western powers who once feted her as well as a slew of fellow Nobel Laureates.&lt;br /&gt;But Beijing offered more encouraging words to her on Tuesday, with foreign ministry spokesman Geng Shuang voicing support for her government&amp;#39;s efforts to &amp;quot;uphold peace and stability&amp;quot; in Rakhine.&lt;br /&gt;&amp;quot;We condemn the violent attacks which happened in Rakhine state in Myanmar,&amp;quot; Geng told a regular news briefing.&lt;br /&gt;&amp;quot;We support Myanmar&amp;#39;s efforts in upholding peace and stability in the Rakhine state. Government should recognize Rohingya as citizenship.&lt;br /&gt;Fact: Bengali government denied its own people. Burmese government accept them and gave them citizenship and equal rights. However, more and more Bengali Rohingya illegally enter to Myanmar every year. They are rude and aggressive. They don’t respect native Rakhine and bullied Rakhine people. Then, they pretend to be like poor and nice guys. Why did Burmese government have to accept these kind of rude hypocrite terrorists? Ramly” product name, lawyers have said.&lt;br /&gt;&lt;br /&gt;Civil liberties lawyer Fahri Azzat said it was “likely” that the Selangor Islamic Religious Department (Jais) and Negri Sembilan Islamic Religious Affairs Department (Jheains) had overstepped their jurisdiction or the legal limits of their powers when they recently investigated Ninja Joe outlets.&lt;br /&gt;&lt;br /&gt;“They have no business over a restaurant that did not apply for halal certification,” he told Malay Mail Online yesterday when contacted, agreeing that the “correct” position is for their powers to be limited to outlets with halal certification or those claiming their products to be halal or permissible for Muslims’ use or consumption.&lt;br /&gt;&lt;br /&gt;Referring specifically to Jheains’s assertion that it has powers under trade description laws to investigate Ninja Joe over an allegedly confusing name for the latter’s pork burger, Fahri disagreed.&lt;br /&gt;&lt;br /&gt;“I think this is incorrect. Jheains has no jurisdiction over trademark or confusion about trade names or items. More so when the entity did not apply for halal certification for those items,” he said.&lt;br /&gt;&lt;br /&gt;In addressing questions on the limits of the powers of Jais and Jheains as bodies created under state laws, civil liberties lawyer Nizam Bashir referred to the position under the Federal Constitution, citing specifically Item 1 of its Ninth Schedule’s List II which deals with matters under state jurisdiction.&lt;br /&gt;&lt;br /&gt;“Constitutionally speaking, Jais or JHEAINS powers do not extend beyond persons professing the religion of Islam,” Nizam told Malay Mail Online when contacted yesterday, adding that Ninja Joe is a chain of restaurants owned by a company.&lt;br /&gt;&lt;br /&gt;“It is trite that a company cannot profess the religion of Islam. Consequently, Jais or Jheains has no power over Ninja Joe Sdn Bhd,” the civil liberties lawyer added.&lt;br /&gt;&lt;br /&gt;But as for the Ministry of Domestic Trade, Cooperatives and Consumerism (KPDNKK), it can investigate Ninja Joe for any offences under the Trade Descriptions Act 2011 if it chooses to do so, Nizam said.&lt;br /&gt;&lt;br /&gt;Authorised officers&lt;br /&gt;&lt;br /&gt;Last week, a senior officer at Jheains’ halal management division had told Malay Mail Online that the Islamic body’s officers have the same enforcement powers as KPDNKK officers, as they are appointed as Assistant Controllers of Trade Descriptions to assist in enforcement duties related to halal matters.&lt;br /&gt;&lt;br /&gt;While acknowledging that officers from Islamic bodies appointed by the KPDNKK may exercise powers within the Trade Descriptions Act, Nizam pointed out that the Ninja Joe incident involves a trade description matter and is not connected with halal concerns.&lt;br /&gt;&lt;br /&gt;“So long as these officers are licenced...if they have been appropriately authorised under the Trade Descriptions Act, they can carry out their powers strictly under the Act.&lt;br /&gt;&lt;br /&gt;“Here I don’t know whether it’s necessary because you have trade ministry officers clearly quite competent to investigate and prosecute, why bring in the religious department, what sort of expertise do they have to bring into the matter? It’s a trade description issue, I don’t see any halal issue about this,” he said.&lt;br /&gt;&lt;br /&gt;Nizam said that the issue of whether there has been misrepresentation of a product’s halal status should be looked at holistically and may not necessarily include factors such as the product’s name, adding that the context where Ninja Joe is a known pork burger outlet and with its poster on “P. Ramly” burger carrying the word “pork” meant that consumers would not be misled into thinking it was halal.&lt;br /&gt;&lt;br /&gt;Enforcement, but to what extent?&lt;br /&gt;&lt;br /&gt;Lawyer Andrew Khoo said both Jais’s and Jheains’s jurisdiction in relation to trade description legislation would be when it comes to the usage of the “halal” certification, or — “even in the absence of any ‘halal’ certification” — to representations that goods and services can be consumed by Muslims.&lt;br /&gt;&lt;br /&gt;Citing Peninsular Malaysia’s situation where people tend to automatically associate names with ethnicity and religion when compared to their “more diverse and accepting” counterparts in Sabah and Sarawak, Khoo said it was possible that some in the peninsular may conclude that a product is safe for consumption from an Islamic perspective merely due to a Malay-sounding trade name.&lt;br /&gt;&lt;br /&gt;“So even though Ninja Joe did not use any halal certification or explicitly represent to the public that its products could safely be consumed by Muslims, for the reasons I have given, it could be seen as confusing by some,” he told Malay Mail Online yesterday when contacted.&lt;br /&gt;&lt;br /&gt;While noting that the Trade Descriptions (Definition of Halal) Order 2011 does give authority to inspectors to investigate situations which can cause confusion, Khoo said it should have been clear for those who read both the burger’s name and its description of the pork ingredient in Ninja Joe’s poster.&lt;br /&gt;&lt;br /&gt;He acknowledged that there may be some who had only read the burger’s name and reacted in a “knee-jerk” manner by associating a particular name with a particular religion, but asked what should be the standard to be imposed.&lt;br /&gt;&lt;br /&gt;“However this is the challenge in this type of legislation or regulation — what level of protection do we afford the consumer?  Do we apply a standard of consumer awareness of the most gullible person in our society?” he asked.&lt;br /&gt;&lt;br /&gt;Khoo added that it would be an “alarming trend” if Islamic bodies are indicating that clearly non-halal products cannot use certain types of names simply due to name-association, noting that it would then result in trade descriptions or name usage being subject to subjective responses based on whether an individual’s sensitivities are affected despite clear product information available.&lt;br /&gt;&lt;br /&gt;Ninja Joe had last week published an apology on its official Facebook page and said that it had not intended to offend, reiterating that it has taken down all posters advertising the “P. The new documents show these purchases were part of at least &amp;#036;6 million spent by Rosmah from 2008 to 2015 on clothes, shoes and jewelry from Harrods in London, Saks Fifth Avenue in New York and elsewhere, the Journal reported. The newspaper also noted she hadn’t held a regular paying job in years and Najib has been a longtime bureaucrat with an annual salary of &amp;#036;100,000.&lt;br /&gt;&lt;br /&gt;Furthermore, a source with direct knowledge of the U.S. investigation into 1MDB’s alleged fraud told the Journal that &lt;b&gt;Rosmah introduced Najib to Jho Low&lt;/b&gt;. According to a lawsuit filed by U.S. officials, Low is at the center of the alleged 1MDB scandal.&lt;br /&gt;&lt;br /&gt;The Journal pointed out that in her 2013 autobiography, Rosmah said she has a habit of saving. “I have bought some jewelry and dresses with my own money. What is wrong with that?” she wrote.&lt;br /&gt;&lt;br /&gt;Some time last year, Najib’s office said his family’s spending was proportionate with his inheritance from his father Abdul Razak Hussein who served as Malaysian prime minister from 1970 to 1976. In February 2015, Najib’s four brothers reportedly said their father did not leave a big estate. Najib, without addressing the inheritance, then said that his father was as thrifty and a man of integrity.&lt;br /&gt;&lt;br /&gt;In the lawsuit filed late last month, the U.S. Justice Department said over &amp;#036;3.5 billion was misappropriated from 1MDB in alleged fraud committed over a four-year period. It further added that it is seeking to seize more than &amp;#036;1 billion of assets linked to the fund.&lt;br /&gt;&lt;br /&gt;Najib set up 1MDB in 2009 to spur economic growth in the Southeast Asian country.
