Box 700&lt;br /&gt;  Toronto, ON M5J 2S1&lt;br /&gt;  Canada&lt;br /&gt;  &lt;br /&gt;&lt;br /&gt;  (hereinafter  called “the Company”)&lt;br /&gt;  &lt;br /&gt;&lt;br /&gt;  and&lt;br /&gt;  &lt;br /&gt;&lt;br /&gt;  Name: MY name&lt;br /&gt;  &lt;br /&gt;   Address  #:  my address   &lt;br /&gt;  &lt;br /&gt;  &lt;br /&gt;   (hereinafter  called “the Employee”)  &lt;br /&gt;   hereby agree  as follows:&lt;br /&gt;  &lt;br /&gt;&lt;br /&gt;  Article 1 –  Employment&lt;br /&gt;  The Company hereby  agrees to employ the Employee as Junior Civil  Engineering&lt;br /&gt;and  the Employee agrees to be employed by the  Company.&lt;br /&gt;  &lt;br /&gt;&lt;br /&gt;  Article 2 – Job  Description&lt;br /&gt;  The Employee shall  perform the duties hereunder diligently and exert best efforts to accomplish  the following duties:  &lt;br /&gt;  &lt;br /&gt;&lt;br /&gt;Junior Civil  Engineering&lt;br /&gt;&lt;br /&gt;  Planning, performing and checking the design and preparation  of drawings, specifications and estimates;&lt;br /&gt;  Ensuring pre-design work is completed including utility locations, existing  site conditions, surveys, topographical work and soils investigations;&lt;br /&gt;  Conducting professional studies and preparing written reports on engineering  related projects under supervision;&lt;br /&gt;  Overseeing the preparation of plans, charts or diagrams;&lt;br /&gt;  Reviewing progress and/or inspects assigned construction projects for  compliance with plans and specifications;&lt;br /&gt;  Making minor field changes and coordinating engineering activities with other  departments;&lt;br /&gt;  Checking tentative and final plans, improvement plans and agreements for  conformance to local rules &amp;amp; regulations, ordinances, resolutions and  established engineering practices;&lt;br /&gt;  Reviewing and updating the database, compiling data and preparing reports;&lt;br /&gt;  Promoting customer service in forging cooperative public relations;&lt;br /&gt;  Keeping abreast of current issues and trends in civil engineering;&lt;br /&gt;  Developing and maintaining positive public relations with emphasis on  customer service;&lt;br /&gt;  Responsible for carrying out the mission of the Company and the department  and adherence to the Company&amp;#39;s and departmental organisational value&lt;br /&gt;  *Perform other  work in connection with Article 2 or other work designated by the  Company from time to time.&lt;br /&gt;&lt;br /&gt;  &lt;br /&gt;&lt;br /&gt;  &lt;br /&gt;&lt;br /&gt;  Article 3 –  Observance of Company Regulations&lt;br /&gt;  1.        The Employee shall observe the instructions of his/her superiors in the  Company, as well as the regulations and rules issued by the Company.&lt;br /&gt;  2.        In the case that any provision of this Agreement is inconsistent or  conflicting with any provision of the regulations or rules of the Company,  the provision of this Agreement shall have priority over the provision of the  regulations or the rules.  &lt;br /&gt;  &lt;br /&gt;Article 4 –Prohibition of Other Business&lt;br /&gt;1.     The Employee shall not execute duties with compensation to any persons notexpressly permitted herein.&lt;br /&gt;2.     The Employee shall not engage, without prior written approval from the Company,in any private commercial transactions or work on behalf of himself/herself orany other individual or company.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 5 – Salary&lt;br /&gt;1.     The Company will pay the Employee a monthly salary in USD in accordance withthe following standard........ The Employee shall not request the Company tomake any payments, including but not limited to wages, allowances, benefits,insurance premiums or disbursements, unless otherwise expressly specifiedherein.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;a)    Wage&lt;br /&gt;(1) Basic Wage: Inconsideration for the designated work as stipulated in Article 9, the Companywill make the following payment to the Employee:  A start off Salary of USD8,125.00&lt;br /&gt;per month (aftertax).The start off Salary is subject to Salary increase  onAnnual Review Basis&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;(2) SpecialAllowance: In consideration for work in excess of the designated work, theCompany will make the following payment to the Employee: USD500.00 permonth.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;2.     Commuting Expenses&lt;br /&gt;The commutingexpenses for the most economical route of public transportation between theEmployee’s work place and his/her residence will be reimbursed to the Employeeon the 25th day of each month for the previous month’s expenses.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 6 – Housing&lt;br /&gt;For the period ofthe contract, the Company will provide housing for the Employee at a companyapartment or a company dormitory or staff complex. The Employee shall only payutility costs for the amount of time spent in the free housing.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 7 – MedicalInsurance and Benefits&lt;br /&gt;1.     For the period of the employee’s stay in Canada, the Employer is responsiblefor obtaining a medical insurance policy or a traveler’s insurance policy withcomprehensive health coverage.  &lt;br /&gt;Our current benefitsprogram includes:&lt;br /&gt;‧ Extended Health Insurance&lt;br /&gt;‧ Dental Care&lt;br /&gt;‧ Group Life Insurance&lt;br /&gt;‧Long Term Disability Insurance&lt;br /&gt;‧ Registered Pension Plan&lt;br /&gt;‧ Maternity Leave&lt;br /&gt;‧ Education Reimbursement Program&lt;br /&gt;‧&lt;br /&gt;Employee are entitled  toreceive a re-location grant upon arrival in Canada free of charge (equivalentto your one month salary as indicated).&lt;br /&gt;The goal is to stripaway everything that gets in our employees way. Employer provide astandard package of fringe benefits starting from:&lt;br /&gt;‧ Health and wellness*  (Medical Insurance, Dental Insurance,Flex Spending Account Plan,EAP,Voluntary Life Insurance, Short Term &amp;amp; LongTerm Disability and Business Travel Accident Insurance.&lt;br /&gt;‧ Retirement and savings*&lt;br /&gt;‧ Time away (Vacation, Holidays, Parental Leave etc)&lt;br /&gt;‧ Benefits...beyond the basics* like Tuition Reimbursement (HigherEducation), Employee Referral Program, Back-Up Child care.&lt;br /&gt;‧ Benefits...way beyond the basics*  like free Lunch andDinner, Shuttle Services, Financial Planning Classes, Free ( 2) Years Housingand Air Ticket -For new employees etc&lt;br /&gt;All the abovebenefits and incentives cover Employees&amp;#39; Dependant/s as may beapplicable)  &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;2.A free RelocationIncentive Grant equivalent to ( 1 ) Month salary is the entitlement of ALLEmployees outside Canada upon arrival in Canada and completing  theEmployees Benefit Form.&lt;br /&gt;*Apart from free accommodation as in  Article 6 and 7 andthe above benefits outlined in article 7,the Employee isalso entitled for a free air ticket (depen&lt;br /&gt;&lt;br /&gt;Article 8 – Expensesfor Business Trips&lt;br /&gt;In the case that theEmployee, with the approval of the Company, takes a business trip in performinghis/her work duties, the Company will pay or reimburse to the Employee theexpenses for the business trip in accordance with the regulations issued by theCompany.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 9 – WorkingHours&lt;br /&gt;&lt;br /&gt;The Company willnotify the Employee of the monthly schedule regarding working hours. Ingeneral, the Employee will not exceed 30 hours per week, Monday through Friday.Weekend and or evening work may be required but not in excess of 8 hours permonth.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 10 –Holidays&lt;br /&gt;&lt;br /&gt;Holidays shall be 15days per year accordance with the provisions of the Holidays Act 2003. TheCompany will notify the Employee of the holidays by the yearly calendar made bythe Company. However, the Company may change the schedule of the holidays forbusiness necessity.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 11 – PaidVacation&lt;br /&gt;&lt;br /&gt;The Employee mayreceive 4 weeks -paid vacation days per year. The Company may change the paidvacation days intended to be used by the Employee for business necessity orother unavoidable circumstances.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 12 – SickDays&lt;br /&gt;The Employee shallreceive a maximum of 10 paid sick days per year in case that the Employeereceives medical treatment from a physician.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 13 –Confidential Information&lt;br /&gt;The Employee shallhold in confidence, and shall not disclose to any third party, any confidentialinformation of the Company and business operations whether he/she learns of itthrough work or other sources, and shall not use such information for thebenefits of the Employee or any third parties in accordance with the CopyrightAct 1994.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 14 –Reputation&lt;br /&gt;The Employee shallnot defame the reputation of the Company and the related companies, or otheremployees or customers of the Company or the related companies.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 15 –Training&lt;br /&gt;The Company willgive the training to the Employee as follows:&lt;br /&gt;1.     Initial Training: Initial training will be given to the Employee to learn andacquire the skills for the position assigned for a period of 45 dayswith full pay and benefits.&lt;br /&gt;2.     Retraining: Retraining will be given to the Employee when necessary to improvethe knowledge and skills required.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 16 – Termand Termination&lt;br /&gt;The employment ofthe Employee under this Agreement shall begin on JULY,2009 and renewableevery 5 years, and the Agreement shall be renewed automatically with theEmployee&amp;#39;s conscent.&lt;br /&gt;Start DateAmendment: This amendment follows  that counting from the date theEmployee receives his/her visa stamped, the Employee is  allowed to arrivein Canada within the period of 30 days ; this in order to allow Employee to putup resignation with present Employer and other relocation arrangements. However,for Employees who do not need pre-resignation notice from present Employer theCompany would be glad to have them in Canada same week the visa is beenstamped.&lt;br /&gt;Also, the Employeeshall have the responsibility, with the Company’s assistance, for obtaining a DesignatedWork Permit Visa from the government of Canada via our accreditedImmigration Solicitor. This Agreement will be valid on the condition that theEmployee has obtained such work permit document and visa and proved theobtainment thereof before the said start date. &lt;br /&gt;&lt;br /&gt;Article 17 – JobLocation&lt;br /&gt;The job locationsare spread across our headquarters in the province of  Toronto - Ontario  inCanada, the Company shall assign the employee to any of ourexpanding store locations where Employee services is most neededsubject to manpower need.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 18 –Termination of Agreement&lt;br /&gt;&lt;br /&gt;1.     The Company may terminate this Agreement in accordance with the followingprovisions at any time for the employment period of this Agreement:&lt;br /&gt;a)   The Company may terminate this Agreement at liberty without any obligation tothe Employee if the Employee breaches any points stipulated in this Agreement,or the rules or regulations, or misdeed or fault any points stipulated therein.&lt;br /&gt;b)    The Company may terminate this Agreement at liberty without any obligations tothe Employee if the Employee’s acts cause damage or loss to the Company orrelated companies.&lt;br /&gt;c)     The Company may terminate this Agreement at liberty without any obligation tothe Employee if the Employee breaches any provision of the laws (including butnot limited to Immigration Control and Recognition of Refugee Status Law) ofCanada, or the Employee is arrested and charged on criminal grounds.&lt;br /&gt;d)    The Company may terminate this Agreement at liberty without any obligation tothe Employee if the Employee performs any act unbecoming the profession.&lt;br /&gt;e)   The Company may terminate this Agreement at liberty without any obligation tothe Employee if the Employee loses the qualification of a Designated WorkVisa.&lt;br /&gt;f)      The Company may terminate this Agreement out of necessity if any unavoidablecircumstances concerning the Company’s business arises.  &lt;br /&gt;2.     During the employment period under this Agreement, the Employee may terminatethis Agreement by giving the Company written notification a minimum of TWO (2)months prior to the termination date.  &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 19 – Loss orChange of Visa Qualification&lt;br /&gt;&lt;br /&gt;In the case that theEmployee loses or changes the qualification of his/her visa, the Employee shallreport it to the Company in writing immediately....&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 20 –Governing Law&lt;br /&gt;The validity,construction and performance of this Agreement shall be governed by andinterpreted in accordance with the laws and customs of Canada.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Article 21 – Arbitration&lt;br /&gt;&lt;br /&gt;The two parties shall consult with each other and mediate anydisputes, which may arise about the contract.
