Item being sold/bought: 1 cracked Moloco tempered glass screen protector for Oneplus One and 2 tudia cases.

Date of transaction: 16th Jan 2015 (paid), 19th Jan 2015 received defect item.

Details of the complaint :

(lowyat username : hamba9551) is a irresponsible seller. I bought OnePlus accessories from this seller on 16th Jan 2015, communicated through whatsapp. My mum received the parcel on 19th Jan 2015 afternoon. When I got back from work, I was so happy to see my parcel on my room table and unpacked those items I purchased from this seller. The 2 tudia casing was great and I like it. Then I unpacked the moloco tempered glass screen protector, inside the box, the sp was still covered by another layer, so I didn't notice anything wrong yet. I removed my current cracked tempered glass screen protector from my Oneplus one and then used the alcohol tissue (included in the package) to clean my OnePlus screen. When it is clean and ready, I took the new screen protector out from its cover, and I discovered it is cracked... seriously cracked, even more serious than my old tpsp... and the argument in whatsapp started.

At first, he told me that it was not his fault, it was poslaju problem, asked me to deal with the carrier, and said he has already packed it into a bubble bag. (Please lah, bubble bag is bend-able, tempered glass screen pro is a flat glass, once bend, it cracked. Some more he put it together with 2 hard casing. this called secure+. ) After he told me this was nothing to do with him, I did a quick search regarding law, the Sales of good Act, and I found that:

The Sale of Goods Act states that the seller is responsible for goods up until they are delivered to the consumer. Any damage or breakage en route is the responsibility of the seller.
If you purchased your goods online you are also covered by the Consumer Contracts Regulations, which make it clear that the seller is responsible for the condition of the goods until the goods are received by the consumer, or by someone else they have nominated to receive them.
So you shouldn't be told to take up your complaint with the delivery company. Nor should you be told that you'll need to claim on the delivery company's insurance.

I sent this to him and then he asked me to go poslaju make a report and then send him a copy, and he will make a refund after that. But then according to the law I found, I shouldn't be told to take up my compliant with the delivery company. Then he keep arguing with me and sent my 2 photo of OTHER sellers policy. It doesn't make sense to use other seller policy to argue with me. Then he started to want me do more complicated job, want me to send the damage item to him, and he will refund to me once he received the parcel and the refund does not include the post fees. It doesn't make sense at all.

At that time, I still thought the receiver can do the report to poslaju, so I did a small search on poslaju official website. I found that the claim for lost and damage item must be made by the sender, NOT the receiver.

Poslaju liabilities for lost or damage item is limited to the sum as follows, subject to the amount whichever is lower;
Maximum of RM100 for document or merchandise weighing less than 2kg for domestic shipment, or;
Maximum of RM300 for document or merchandise weighing 2kg and above for domestic shipment, or;
Maximum of RM100 for item containing document weighing less than 1kg for international shipment, or;
Maximum of RM300 for merchandise with no weight limitation, provided merchandize rates were paid
during posting for international shipment.
Limited to one claim for one posted item only, subject to whichever is higher
but not exceeding the PosLaju maximum liability limit.
2. Posting of Dangerous Goods and Prohibited Item

Posting of any items which are categorized as dangerous goods and items that are prohibited by Poslaju
or by the authority of the country destination are totally prohibited. Poslaju will not be held responsible
to any claim for the posting charges or claim of lost of item, damage or direct loss or indirect loss or whether
or not the said posting has been accepted by PosLaju with purposely.
3. Claim Eligibility

Claim for loss or damages of any Poslaju item must be claimed by the sender or the authorized person
and shall be made only when the following conditions are met:
i. Claim within 30 days from the date of posting.
ii. Poslaju will not entertain any claim that submitted after 30 days from the date of posting.
iii. Submitted by writing together with the proof of posting and a copy of valid self identification
iii. Submitted to nearest Poslaju Branch

I sent him this, and then he just ignored it and said "It's ok, just send me the damage item.. N don't forget to update me the tracking number k.. ". I was like WTF?? The procedure is clearly specified in the term and condition I sent to him. The thing that pissed me off the most is that he said he don't need to waste his time to claim the RM25, wow, he said like my time is not as valuable as his.

I have no choice but to warn other potential buyer here not to buy things from this irresponsible seller (hamba9551). I don't understand, since he is an online seller, for sure will go pos office frequently, why don't just claim the lost and refund to me? WHY did he keep asking me to send the damage item back to him which it is not required by the poslaju from claiming purpose? Coz he know I have no time to post the item back to him (I have told him I will not have offday until CNY, and my working hours is 10am to 10pm everyday) and he do not need to refund if he insist this way.

Anyway, he is not a wise seller, and seems his reputation as a seller is not worth the RM25.
