Heterosexual couple win civil partnership case

Heterosexual couple win civil partnership case

A heterosexual couple have won their legal bid for the right to have a civil partnership instead of a marriage.

The Supreme Court unanimously ruled in favour of Rebecca Steinfeld, 37, and Charles Keidan, 41, from London.

The court said the Civil Partnership Act 2004 - which only applies to same-sex couples - is incompatible with the European Convention on Human Rights.

Ms Steinfeld said she hoped the government does the "right thing" and extends civil partnerships to all.

"We are feeling elated," she told the BBC outside court. "But at the same time we are feeling frustrated the government has wasted taxpayers' money in fighting what the judges' have called a blatant inequality."

The judgement does not oblige government to change the law, although it does make it more likely that the government will now act, the BBC's legal correspondent Clive Coleman explained.

In a civil partnership, a couple is entitled to the same legal treatment in terms of inheritance, tax, pensions and next-of-kin arrangements as marriage.

The couple, who met in 2010 and have two children, said the "legacy of marriage" which "treated women as property for centuries" was not an option for them.

"We want to raise our children as equal partners and feel that a civil partnership - a modern, symmetrical institution - sets the best example for them," they explained.

Since March 2014, same sex-couples can choose whether to enter a civil partnership or to marry. This has not been possible for mixed-sex couples, which led Ms Steinfeld and Mr Keidan to argue that the law was discriminatory.

This ruling overturns a previous judgement made by the Court of Appeal, which rejected the couple's claim, in February of last year.

What does a civil partnership offer?
1. Legal and financial protection for both parties in the event of the relationship ending, like in marriage
2. It is free of the religious connotations of marriage
3. Some object to marriage as an institution and its associations with property and patriarchy

The judges ruled that current UK law was "incompatible" with human rights laws on discrimination and the right to a private and family life.

Announcing the court's decision, Lord Kerr said the government did not seek to justify the difference in treatment between same-sex and different sex couples.

"To the contrary, it accepts that the difference cannot be justified," he said.

LGBT and human rights campaigner Peter Tatchell called the ruling a "victory for love and equality".

"It was never fair that same-sex couples had two options, civil partnerships and civil marriages, whereas opposite-sex partners had only one option, marriage," he said.

It is an irony that the way in which relationship equality for same sex couples came about in the 21st century had the effect of creating inequality between them and different sex couples.

The Civil Partnership Act 2004 created civil partnerships but defined them as a 'relationship between two people of the same sex'.

When the Marriage (Same Sex Couples) Act 2013 legalised same sex marriage, gay couples had two options as to how to formalise their relationship in law - marriage or civil partnership - whereas heterosexual couples could only marry.

The Supreme Court has found that inequality to amount to discrimination and a breach of the right to a family life.

The government accepted the inequality between same sex and different sex couples, but argued that it needed to have time to assemble sufficient information to allow a confident decision to be made about the future of civil partnerships.

Lord Kerr gave that argument short shrift, saying: "What it (the government) seeks is tolerance of the discrimination while it sorts out how to deal with it. That cannot be characterised as a legitimate aim."

The couple will later go to Whitehall to deliver a letter to Equalities Minister Penny Mordaunt.

Martin Loat, chairman of the Equal Civil Partnerships campaign, said: "There is only one possible way forward - giving everyone the right to a civil partnership - and we urge the government to seize this opportunity to announce it will end this injustice now."

More than 130,000 people have signed an online petition in support of civil partnerships for everyone.

The couple's barrister Karon Monaghan QC told the court her clients had "deep-rooted and genuine ideological objections to marriage" and are "not alone" in their views.

There are around 63,000 couples in civil partnerships in the UK and some 3.3 million co-habiting couples.

There's a video in the link here: https://www.bbc.com/news/uk-44627990

---------------------------------------------------------------

so when malaysia gonna introduce civil partnership???

It’s not every day that you find a fine dining establishment run from a chef’s personal kitchen. But then, Pichaya “Pam” Utharntharm is not your everyday chef. At just 28, she has studied gastronomy in both France and New York, and worked for a Michelin three-star chef. But her dream was always to return to her native Thailand and open up her own place. So, she did. Now she’s serving some of Thailand’s most inventive dishes out of Bangkok’s most exclusive joint—her dining room. Welcome to The Table.

[@harryleong] when open your own restaurant??

US green card diversity visa lottery

check your status here: https://www.dvlottery.state.gov/

A one in a million chance at a better life: will the US green card lottery survive?

Getting “randomly selected” by the US state department would usually strike fear in the heart of foreigners. But on Tuesday, more than 100,000 people around the world will be chosen for the state department’s diversity immigrant visa program, also known as the green card lottery.

The prize? A golden ticket to the land of the free, and the possibility of a new life.

The green card lottery is a uniquely American proposition. Every year, 50,000 people win the chance to become permanent residents simply by filling out an online form in the fall. The process is random, and names are simply drawn out of millions of entries.

You don’t need to be sponsored, you don’t need family in the US, you don’t need employment. You do not need to fill out dozens of forms, get a medical exam or be closely vetted to apply (although you will face such requirements if you’re selected). Not everyone is eligible, however: citizens of countries that have had 50,000 green cards awarded in the last five years – including the UK, Mexico, Canada, China, India and Brazil – cannot apply.

» Click to show Spoiler - click again to hide... «

Radovan Serbula, who came from Croatia in 1997 with his wife and young son after winning the green card lottery, says it was not an easy decision. “We didn’t know anybody in the US – no friends, no family,” he said. “We moved over here with no job, no English, nothing. But we decided to go and give it a shot.”

He left a successful career as an international basketball coach behind and, upon arrival in the US, earned $6 an hour working in the stockroom of a toy store in Boston. His first paycheck for a week of full-time work wasn’t enough to cover his rent, so Serbula started working nights as a parking valet, stuffing tips in his pockets.

Two decades on, he owns a personal training studio which employs six workers – the classic tale of an immigrant who chased the American dream.

Stories like Serbula’s, however, might soon become rarer. Two different bills, one in the US Senate and one in the House of Representatives, are attempting to get rid of the diversity lottery. Donald Trump has promised to tighten immigration policies and focus on “hiring American”, making it harder for foreigners to enter the US. Dumping a program that lets 50,000 randomly chosen people come and live here might be an obvious decision in the eyes of his supporters.

https://www.theguardian.com/us-news/2017/ma...on-trump-agenda

-----------------------------------------------------------------------------------------

What You Need to Qualify for the U.S. Green Card Lottery

Today, over 14 million people are finding out if they won the 2018 U.S. green card lottery, also known as the diversity visa lottery. Only about 50,000 people will win a green card, here’s what they needed to qualify for the lottery in the first place.

The lottery is free to enter, but not all countries are eligible, those who want to enter the lottery must check if their country has made the eligible list. Some countries that aren’t eligible for this year’s lottery include mainland China, India, Nigeria, Canada, and Mexico. However, you have two ways to get around your country being ineligible: your spouse was born in an eligible country and you list them on your application and enter the U.S. together or one of your were not residents of an ineligible country at the time of your birth.

In addition to being from a qualifying country, you need one of the following to even enter the lottery:

- A high school degree in a program that is comparable to the United States’ system.
- Two years work experience in the past five years and your work experience must be in a job that the U.S. Department of Labor’s O*NET system categorizes as Zone 4 or 5 and has a Specific Vocational Preparation rating of 7.0 or higher.

Even entering the green card lottery takes a huge amount of effort, so why are people so motivated to go through the trouble? Well, a green card gives you quite a few benefits if you want to legally live and work in the U.S.:

- Live permanently in the United States
- Work legally at most jobs (some are limited to U.S. citizens for security reasons)
- Be protected by federal, state, and local laws

http://lifehacker.com/what-you-need-to-qua...tter-1794844096

Malaysian Recovers Lost Wallet

Malaysian Recovers Lost Wallet Containing RM6,200 In Kyoto, Praises Japanese For Their Honesty

In Malaysia, if you lost your wallet, you might as well forget about it because chances of recovering it is pretty slim close to zero. And even if you thought you found your wallet back, the cash inside is most likely gone. However, that’s not the case in Japan.

On 14 December, Mr. Lim Boon Sun and another 4 of his family members were on a vacation in Kyoto, Japan. Unfortunately, he lost his wallet together with all the cash in it at about 4pm. Subsequently, he lodged a report at 6pm hoping that he could recover his wallet with the aid of the police.

At the police station, the on-duty police officer immediately checked their system to see if anybody had come in with a wallet. Sure enough, someone had found Mr. Lim’s wallet and handed it over to a nearby police station.

“This policeman checked the system and informed me that someone found my wallet and returned it to another police station. We took the subway to that police station to collect my wallet.”

Based on the information given, Mr. Lim hopped onto a train and made his way to the police station. He successfully recovered his wallet by 8.30pm after filling in some forms. Source: Lim Boon Sun’s Facebook Mr. Lim was very grateful towards the Japanese police for their assistance. He even shook the police’s hands before leaving the police station. Terima kasih banyak-banyak!

“The Japanese are very honest and efficient (at their work). The Japanese Yen and American Dollars worth over RM6,200 are still in my wallet!” said Mr. Lim.

Mr. Lim said that the cash would be used to pay for all the expenses of his family in Japan. So imagine his relief when he recovered it! Thank God everything inside is still intact. “I don’t know what will happen if I failed to recover my wallet,” said Mr. Lim. After Mr. Lim’s confession has gone viral on social media, netizens were impressed by the honesty of the Japanese people and praised the efficiency of the Japanese police in helping Mr. Lim finding his wallet. But of course, we all know that the outcome would have been very different if the wallet was lost in Malaysia.

Read more at WOB: http://www.worldofbuzz.com/malaysian-recov...panese-honesty/
