SAYA seorang bekas anggota tentera yang kini sedang berjinak-jinak dengan dunia perniagaan di sekitar Kuala Lumpur.

Saya merasa terpanggil untuk menulis di ruangan ini kerana baru-baru ini saya melawat seorang rakan yang baru bertukar ke sebuah kem di Kuala Lumpur dan beliau telah menceritakan kepada saya satu insiden yang telah menyebabkan beliau akan diadukan di bawah Seksyen 51 Akta Angkatan Tentera 1972, iaitu tidak mematuhi perintah tetap pasukan.

Menurut beliau, semuanya berpunca dari ketidakhadiran isteri beliau dalam aktiviti Badan Amal dan Kebajikan Isteri-isteri Angkatan Tentera (Bakat).

Saya amat terkejut kerana sepanjang saya berkhidmat selama 21 tahun di dalam angkatan tentera dahulu tidak pernah mendengar kes sebegini.

Beliau menyatakan bahawa peraturan di tempat beliau bertugas ialah kehadiran ahli Bakat dalam semua aktiviti adalah wajib. Bagi sesiapa yang isterinya tidak dapat hadir dalam aktiviti Bakat hendaklah menulis surat kepada komandan.

Jika alasan yang diberikan diterima oleh pihak atasan, lepaslah beliau daripada sebarang tindakan. Jika alasan yang diberikan tidak diterima, maka terpaksalah si suami berbaris dengan berpakaian celoreng lengkap dengan pack untuk mendaki bukit di kem itu sebagai `hukuman' ketidakhadiran isteri beliau dalam aktiviti Bakat.

Saya bertanya beliau bagaimana pula dengan anggota yang isterinya bekerja pada hari aktiviti Bakat diadakan. Beliau berkata, isteri yang bekerja hendaklah meminta cuti daripada majikan. Jika isteri tidak dapat cuti suami hendaklah bersiap sedia untuk terima hukuman mendaki bukit.

Beliau berkata bahawa sepanjang 18 tahun beliau berkhidmat dalam Angkatan Tentera Malaysia (ATM), rekodnya masih bersih. Beliau merasa terkilan kerana hasratnya untuk menamatkan perkhidmatan dengan rekod yang bersih lebih kurang tiga tahun lagi tidak akan kesampaian.

Yang beliau lebih terkilan ialah kerana kesalahannya hanyalah berpunca daripada ketidakhadiran isteri beliau dalam aktiviti Bakat.

Beliau menambah lagi bahawa di pasukan lain yang beliau pernah berkhidmat sebelum ini, isteri beliau sangat aktif dalam aktiviti Bakat. Sekali sekala tidak hadir adalah perkara biasa dengan alasan yang munasabah.

Beliau tidak tahu menahu langsung tentang arahan komandan pasukannya yang telah dimasukkan dalam perintah bahagian pertama pasukan. Beliau akui bahawa kesilapan beliau ialah tidak membaca perintah bahagian pertama tersebut.

Saya berpendapat bahawa Seksyen 51 Akta Angkatan Tentera 1972 tidak boleh digunakan sewenang-wenang. Tidak wajar seseorang pegawai pemerintah hendak melaksanakan sesuatu yang mungkin tidak dipersetujui ramai, maka beliau memasukkannya dalam perintah bahagian pertama pasukan. Jika mereka langgar, mereka akan diadukan di bawah Seksyen 51 ini.

Ini adalah kerana seksyen itu berkaitan dengan kesalahan tidak mematuhi perintah tetap pasukan.

Saya menulis mengenai perkara ini kerana saya tidak lagi berkhidmat dalam ATM. Rakan saya itu tidak membenarkan saya mendedahkan perkara ini. Namun saya merasakan perkara ini tidak boleh didiamkan kerana tujuan aktiviti Bakat dulu tidak sama lagi dengan sekarang.

Bakat ditubuhkan pada zaman ancaman komunis. Pada masa itu isteri-isteri anggota tentera kebanyakannya tidak bekerja dan selalu ditinggalkan suami yang pergi operasi berbulan-bulan lamanya.

Untuk mengelakkan kebosanan para isteri ini maka ditubuhkan Bakat agar para isteri dapat melakukan perkara-perkara yang berfaedah.

Keadaan pada zaman sekarang telah berubah kerana ramai isteri anggota tentera yang bekerja. Malah ada yang berpendidikan tinggi hingga ke peringkat universiti dan berjawatan tinggi. Jadi apabila mereka mempunyai komitmen dengan kerja mereka maka mereka tidak dapat hadir aktiviti Bakat.

Di sini saya ingin menyeru semua pihak berkuasa ATM supaya melihat secara serius perkara ini. - BEKAS SARJAN, Kuala Lumpur.

Japanese courts have ruled that a man with an artificial leg is still capable of raping a schoolgirl after all, after having previously quashed his conviction on the grounds that he had only one leg.

The case in question centres on a 27-year-old Fukuoka prefecture man accused of raping a 14-year-old schoolgirl in the back of his car one morning.

He was initially found guilty and given the 3.5 year prison sentence the prosecution requested.

He appealed the verdict, and the court quashed his conviction after having been persuaded by the defence’s arguments that he could not possibly have raped the girl as he had a prosthetic leg.

However, a judge subsequently threw out the ruling, saying they had not “adequately explored the issue of whether the accused was capable of assaulting the girl as she maintained, whilst wearing a prosthesis.”

The court then concluded that he could in fact have managed to assault her as she claimed, and reimposed the initial guilty verdict.

The defendant maintains that he “never raped her, and never got into the car with her.” The whole case is apparently based on the girl’s accusation.
