            <title>New Chevy Cruze found faulty on inspection</title>

            <description>Hi all. Posting on behalf of a friend who just &amp;quot;bought&amp;quot; the new Chevrolet Cruze.&lt;br /&gt;&lt;br /&gt;He inspected the car before taking possession of it, and found some fault with the car:&lt;br /&gt;&lt;br /&gt;1) gap in the front bumper&lt;br /&gt;2) Error Code 67 (related to steering wheel lock)&lt;br /&gt;3) Error Code 91 (unable to detect key)&lt;br /&gt;&lt;br /&gt;He was also less than happy that the car didn&amp;#39;t have the usual plastic covers for the seats. Asked whether that was a showroom car, but the dealer said it was brand new. Some details:&lt;br /&gt;&lt;br /&gt;a) He has NOT signed the &amp;quot;acknowledgement form&amp;quot;, i.e. the usual checklist that you have to sign acknowledging that the car, as delivered to you has been inspected by you and is in good condition;&lt;br /&gt;b) He has paid 30% down payment (foreigner);&lt;br /&gt;c) He has signed the hire purchase agreement with the bank; he has instructed the bank not to disburse any money until this situation has been resolved;&lt;br /&gt;d) The car&amp;#39;s been registered apparently, since got plate number and all that.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The dealer basically said they will repair the faults, but he doesn&amp;#39;t feel that he should be forced to just take what is essentially a faulty car, having paid so much money for it. For instance, if you&amp;#39;re buying a phone, but the software is faulty, you would demand a new one right? A car is expected to be in good, working condition, and you don&amp;#39;t expect that the first thing you do upon getting your new car is to have it fixed. They&amp;#39;re giving so many excuses to avoid replacing the car with a new one perhaps because it would be very very leceh for him. &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Was wondering if any sifu here would be able to suggest what can be done. He&amp;#39;s tried a few things like calling up the dealer, the manager, asking some legal opinion from his lawyer. I said he should just keep calling and demand for a replacement, otherwise he can take it up with the Consumer Tribunal, cuz usually once you get the lawyers in it&amp;#39;s gonna cost more. What are the chances he&amp;#39;d get a replacement car? If he decides to cancel the purchase, what will happen to his 30% down payment (not a deposit)?
