Hi there,

I bought one apartment under construction and signed the SPA (schedule H) 2 1/2 years ago. I was informed by the Developer that they are going to relocate my car park due to the amendments or variations required for the Development as approved by the Appropriate Authorities. They even told me the car park no. is the same but slight change on the car park plan.

I was made understand that I have to sign the Supplemental Agreement and since I've taken up a loan from the bank then I have to sign Supplemental Deed of Assignment.

So, my question is whether these two supplemental agreements are valid agreements and allowed by the Law despite I had signed the SPA in the first place? Is it allowed to amend their plans during construction works?

I don't mind to sign these Supplemental Agreement but I would like to know the legality of these Agreement.

Hi~ My friends and I wanna do some events and BBQ party for 20-30 people. But we dont have any idea where is the suitable place to go.
Please help me by providing suggestion any recreational park or spot that you know. We prefer to do at Klang Valley area..
And if you know any place provide BBQ facilities, do tell me.

hi~

since No Do-My-Homework Threads is not allowed.. but i can ask your opinion regarding my subject which i had difficulty in.. please help me!! i've already made the discussion with my friend and ask senior's advise and opinion etc.. but yet they couldnt help me..

my lecturer gimme the task for my compulsory mooting subject.. and i was chosen as appellant.. it's really neck wrecking!! i dont want to post it here because i really want to try by myself..
despite of having a lot of assignment and case reading .. please help! u can gimme some guidance as it enough for me,, and the rest i can study more about it.

here is the situation of the case..

Pushpalingam was a 16 years old when she was diagnosed as having brain cancer.By March 2007, the doctors treating her announced that the cancer had progressed to stage 4 and there was nothing more they can do. Then could no longer operate on her as the tumor was alredy the size of golf ball and any operation would result in her immedite death. Although she received significant amounts of medication to help her cope with her pain, she was still suffering considerably. All other curative treatments had ceased and she was being nursed at the hospital as doctors tried to alleviate her pain. All this while her devoted father Marimoothoo, would stay with her as her mother had passed away since she was born.

After caring for his daughter for 6 months, Marimoothoo felt that he could no longer take groanong and pleading from his one and only daughter. one night, after pleading repeatedly to her father to end her life< Marimoothoo could no longer take the pressure. He injected a high dose of sleeping pills into her and by dawn quitely passed way. However, upon conducting the post mortem, the doc found the cause of death and immediately alerted the police on the possibility of murder.

Marimothoo was subsequently charged with murder and at his trial in March 2008, he pleaded necessity as a defense to the charge. Jugah J. Held that necessity was not availlable as a defense to murder. He acknowledge that it had been accepted in English case of A (children) (conjoined twins : surgical separation)[2004] 4 All ER 961. however such defense could not be accepted outside the strict factual situation as that which existed in that case. The facts in the case could clearly be distinguished. the case also couldnt bind the court as it was as English case,

On the question on mens rea for murder, he argued that since the death of his daughetr was a foreseeable circumstances, therefore he lacked the Mens rea that was necessary to constitute murder. This argument was also rejected by jugah J.

marimoothoo had also argued that being father of the child gave him the exclusive right to decide how to deal with his child and that what he did was in the best interest of the child. This argument was also rejected as not having any legal basis. he was therefore found guilty of murder..

marimoothoo now appeal..

so, i need to defense Marimoothoo as i was chosen as an appellant.. Now, i need to against the decision of Jugah J..

1) do i need to rise the defense of necessity again??
2) i try to relate the situation with the sec 88 of penal code (about consent).. but it seems not really suitable
3) however such defense could not be accepted outside the strict factual situation as that which existed in that case.
what is that mean??

i'm having trouble because i got the criminal cases.. guhh~ my other friend got the case which we are already taken..
I just started take this subject i.e Criminal this semester.. so, i still learn and not major about this area..
please help me

1) Family Law in Malaysia
2)Criminal Law in Malaysia
3)Malaysia Constitution

i prefer English textbook since i dont really use Malay as my reference..

p/s: if u have any other law books which is not stated above... do tell me... maybe i will use it in a future..
