            <description>&lt;a href='http://www.thestar.com.my/News/Nation/2014/09/05/Teoh-Beng-Hock-open-verdict-incorrect-Court-of-Appeal/' target='_blank'&gt;&lt;span style='color:red'&gt;http://www.thestar.com.my/News/Nation/2014/09/05/Teoh-Beng-Hock-open-verdict-incorrect-Court-of-Appeal/&lt;/span&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;&lt;img src='http://antarapos.com/en/images/news_images_upload/content/Beng%20Hock.jpg' border='0' alt='user posted image' /&gt;&lt;br /&gt;&lt;br /&gt;Published: Friday September 5, 2014 MYT 11:15:00 AM&lt;br /&gt;Updated: Friday September 5, 2014 MYT 11:38:10 AM &lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;PUTRAJAYA: The open verdict by a coroner in the Teoh Beng Hock inquest is incorrect, Court of Appeal judge Justice Mah Weng Kwai said Friday.&lt;br /&gt;&lt;br /&gt;Justice Mah, reading one of the three unanimous judgments on the appeal by Teoh&amp;#39;s family, ruled out that the political aide had committed suicide.&lt;br /&gt;&lt;br /&gt;Court of Appeal judge Justice Mohamad Ariff Md Yusof chaired a three-man panel to decide on the appeal by Teoh&amp;#39;s brother Meng Kee against the Shah Alam High Court&amp;#39;s dismissal of an application on Dec 1, 2011 for a revision in the coroner&amp;#39;s open verdict.&lt;br /&gt;&lt;br /&gt;Coroner Azmil Muntapha Abas had given an open verdict on Jan 5, 2011 that Teoh&amp;#39;s death was not a suicide, nor was it a homicide.&lt;br /&gt;&lt;br /&gt;In his decision, Shah Alam High Court judge Justice Abd Rahim Uda said while there were suspicious grounds that could lead to a conclusion, but based on the law, suspicion alone was not enough.&lt;br /&gt;&lt;br /&gt;Justice Abd Rahim said the court had gone through the documents and found the coroner had evaluated the testimonies and observed the witnesses in the inquest.&lt;br /&gt;&lt;br /&gt;He agreed with the coroner that what was produced before him did not show anything that would implicate a third party&amp;#39;s role in causing the victim&amp;#39;s death, hence ruling out homicide.&lt;br /&gt;&lt;br /&gt;Teoh, 30, the political secretary to Selangor executive councillor Ean Yong Hian Wah, was found dead on July 16, 2009 on the fifth floor corridor of Plaza Masalam in Shah Alam after he had given a statement at the Malaysian Anti-Corruption Commission (MACC)&amp;#39;s Selangor office on the 14th floor of the building.&lt;br /&gt;&lt;br /&gt;Justice Mah said that it was incumbent on the magistrate who handled the inquest to treat Teoh&amp;#39;s &lt;b&gt;&lt;span style='color:red'&gt;&lt;span style='font-size:14pt;line-height:100%'&gt;case as a custodial death. He said this was because Teoh was under the care of MACC officers.&lt;/span&gt;&lt;/span&gt;&lt;/b&gt;</description>

Sessions court judge Jule Lack Abdullah set bail at RM8,000 each in one surety.&lt;br /&gt;&lt;br /&gt;In another sessions court presided by Judge Roslan Hamid, all four were charged with robbing businessman Tan Chin Meng, 46, of several ATM cards, a smartphone, RM1,000 and beating him at the same time and place.&lt;br /&gt;&lt;br /&gt;They claimed trial to the charges of voluntarily causing hurt. Roslan set bail at RM10,000 each in one surety.&lt;br /&gt;&lt;br /&gt;In a separate charge, Azrul Azlan and Fuzairi claimed trial to raping the woman in Sungai Lokan, North Seberang Prai between 3.30am and 7.07am on the same day. Bail was set at RM10,000 each.&lt;br /&gt;&lt;br /&gt;At the Butterworth magistrate&amp;#39;s court, Wan Noorsaipul was also charged with using criminal force with intent to outrage the modesty of the China national at Sungai Lokan between 3.30am and 7.07am on the same day.&lt;br /&gt;&lt;br /&gt;Magistrate Firdaus Abdul Wahab set bail at RM3,000.&lt;br /&gt;&lt;br /&gt;Fizairi was represented by V. Guha while the other three were unrepresented.&lt;br /&gt;&lt;br /&gt;The courts have set Sept 23 for mention of all the cases.&lt;br /&gt;</description>

            <description>&lt;br /&gt;&lt;br /&gt;&lt;a href='http://www.themalaysianinsider.com/malaysia/article/countries-with-hudud-laws-fail-to-reduce-crime-says-former-top-judge' target='_blank'&gt;&lt;span style='color:red'&gt;http://www.themalaysianinsider.com/malaysia/article/countries-with-hudud-laws-fail-to-reduce-crime-says-former-top-judge&lt;/span&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;BY MD IZWAN&lt;br /&gt;February 11, 2014&lt;br /&gt;&lt;br /&gt;Muslim countries which have implemented Islamic capital punishments, or hudud, have not been successful in reducing crime rate, former Chief Justice Tun Abdul Hamid Mohamad said today.&lt;br /&gt;&lt;br /&gt;Speaking at a public talk in Petaling Jaya, Abdul Hamid compared several Muslim countries practising hudud laws, which form part of the Shariah system, with non-Muslim nations, noting that they were far behind in terms of tackling crime and establishing peace and justice despite the existence of hudud laws.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;“So far, countries that have implemented hudud such as Pakistan, Nigeria and Sudan, are still far behind in comparison with countries that did not implement it, like Sweden, Norway, Iceland, Denmark and Japan,” he said in his lecture at the International Institute of Advanced Islamic Studies (IAIS) today.&lt;br /&gt;&lt;/b&gt;&lt;br /&gt;He said the implementation of hudud in the Muslim holy cities of Mecca and Medina should also not be a yardstick to determine the effectiveness of Islamic laws.&lt;br /&gt;&lt;br /&gt;“Those who go there for the Hajj are there once in their lifetime and they have brought sufficient money. These people want to perform an accepted Hajj and are mostly the elderly and repentant,” he said.&lt;br /&gt;&lt;br /&gt;“Clearly they would not commit crimes,” he added.&lt;br /&gt;&lt;br /&gt;State governments in Malaysia have the authority to implement laws governing Muslims,&lt;b&gt; &lt;span style='color:red'&gt;but such laws could be extended to non-Muslims if the case involves abetting a Muslim in committing an offence.&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Hudud was proposed by the current PAS government in Kelantan as well as in Terengganu during the party&amp;#39;s rule, but to date, it has not been enforced.&lt;br /&gt;&lt;br /&gt;Abdul Hamid noted that prior to implementation of any laws, legislators should also be aware of the repercussions and not merely focus on enforcement.&lt;br /&gt;&lt;br /&gt;“The implementation of laws does not end with enforcement,” he said.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;“What is more important is how it was done, what are the effects and as an end result, would it bring about better standards of living, peace and prosperity?             <title>Hudud law: A road of no return</title>

            <description>&lt;br /&gt;&lt;a href='http://www.mysinchew.com/node/97527?tid=10' target='_blank'&gt;&lt;span style='color:red'&gt;http://www.mysinchew.com/node/97527?tid=10&lt;/span&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Translated by DOMINIC LOH&lt;br /&gt;Sin Chew Daily&lt;br /&gt;&lt;br /&gt;Although non-Muslim MPs have mostly expressed their disapproval of the hudud law, it is yet to know whether Muslim MPs will support PAS&amp;#39; private motion to implement the hudud law in Kelantan.&lt;br /&gt;&lt;br /&gt;The PAS administration in Kelantan had several years ago passed the hudud law in the state assembly sitting, but since criminal law is under the jurisdiction of the federal government, PAS is now prepared to table a private motion in the Parliament to seek the approval for enforcement in the state of Kelantan.&lt;br /&gt;&lt;br /&gt;According to those in the legal fraternity, it is highly likely for PAS to seek the approval of the Parliament through either of the following approaches:&lt;br /&gt;&lt;br /&gt;1. To seek constitutional amendment to empower the Kelantan state government to implement the hudud law. This will need the support of two thirds of all the MPs.&lt;br /&gt;&lt;br /&gt;2. To seem amendment to the Penal Code to include the punishments in the hudud law into the country&amp;#39;s Penal Code.This needs only a simple majority to be passed in the Parliament.&lt;br /&gt;&lt;br /&gt;No turning back&lt;br /&gt;&lt;br /&gt;MCA&amp;#39;s head of the Syariah Law and Policy Implementation Gan Peng Sieu pointed out that enforcing the hudud law through either of the above approaches would alter the country&amp;#39;s political system and would put the nation on a road of no return.&lt;br /&gt;&lt;br /&gt;He reminded that while it is possible for a change of federal government, once the country moves towards Islamization, it will be impossible for it to revert to the current administrative approach based on secular values.&lt;br /&gt;&lt;br /&gt;He said during an interview with Sin Chew Daily PAS&amp;#39; tabling of a private motion would be a purely political move, but its influences would be far-fetching. Whether the motion will be eventually passed in the Parliament of not, it will have opened up a gap that will topple the country&amp;#39;s existing system.&lt;br /&gt;&lt;br /&gt;&amp;quot;Once we change the political system, the entire central thinking of the country will be altered and there will be no turning back.&lt;br /&gt;&lt;br /&gt;&amp;quot;PAS is like a small tiger. If this tiger gets bigger, it will attempt to change the existing rules of game, and replace the current political system based on universal values to one that is based on Islamic values.&amp;quot;&lt;br /&gt;&lt;br /&gt;Gan expressed his concerns about PAS&amp;#39; intention to table the private motion in Dewan Rakyat because in the past Umno leaders used to keep mum over the issue, but now some Muslim ministers have openly expressed their support for hudud law.&lt;br /&gt;&lt;br /&gt;&amp;quot;This means that given the political and religious factors, it is very likely for this bill to be passed in the Parliament with the support of majority of Malay MPs.&amp;quot;&lt;br /&gt;&lt;br /&gt;Gan felt that PAS&amp;#39; move was meat at exerting pressure on Malay MPs, in particular Umno MPs, because principally Muslims are not allowed to oppose to the implementation of hudud law. Even if some of the Malay MPs are not supportive, they cannot oppose openly. They can only block the passing of the motion through technical or procedural issues.&lt;br /&gt;&lt;br /&gt;&amp;quot;But, technical issues can be rectified and PAS will not give up tabling it for la second time in order to get the approval of all Muslim MPs, whether they like it or not. It will be a victory for PAS.&amp;quot;&lt;br /&gt;&lt;br /&gt;Setting a precedent&lt;br /&gt;&lt;br /&gt;Gan said there are two ways to implementation: through constitutional amendment, or through the amendment of the Penal Code.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;&lt;span style='color:red'&gt;&amp;quot;Once Kelantan is permitted to enforce hudud law through constitutional amendment, other states will also follow suit. Any state with majority of Muslims will seek to implement hudud law.&amp;quot;&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;However, he said it wouldn&amp;#39;t be easy to get two thirds of MPs to support the motion, but to amend the Penal Code is much easier, as it will only need a simple majority.&lt;br /&gt;&lt;br /&gt;It should be noted that if PAS seeks to amend the Penal Code to include the hudud law, then it will not be enforced only in Kelantan, but all of the country, including non-Muslims, and the courts will need to pass down their sentences in accordance with the hudud law.&lt;br /&gt;&lt;br /&gt;Although many think it is impossible for PAS to achieve this end through constitutional amendment, Gan said nothing is impossible if the country&amp;#39;s political system is changed into one based on Islamic teachings due to political considerations.&lt;br /&gt;&lt;br /&gt;The toughest challenge in any Islamic state is the implementation of hudud law. This explains why not all Islamic states implement hudud law.&lt;br /&gt;&lt;br /&gt;Gan said if even hudud law can be allowed to be enforced in this country, it will not be hard to implement other laws pertaining to Islam, and it is just a matter of time that all other realms in our day-to-day living will eventually be restricted by the Islamic teachings, including the way we behave and freedom of entertainment.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;&lt;span style='color:red'&gt;Currently the syariah court only handles family, estate and religious affairs, but once the hudud law is passed in the Parliament, the syariah court will be accorded even more extensive powers, and could even override our existing civil law.&lt;/span&gt;&lt;br /&gt;&lt;/b&gt;</description>

            <title>&amp;#39;Cinami&amp;#39; against BN, not Malays</title>

Many of my friends are quite aged i.e. 55 years old and above.&lt;br /&gt;&lt;br /&gt;Not by choice though. You see, most of my peers are not based in Seremban. I shall not name these friends of mine but let me tell you that they are both professionals and semi-retired. These people are working just to kill time.&lt;br /&gt;&lt;br /&gt;One of the gentlemen commented to me that there is a huge gap between the Chinese and Malays now after the GE13. The other gentleman agreed and asked me, &amp;quot;Where do we go from here now?&amp;quot;&lt;br /&gt;&lt;br /&gt;I then asked them what made them feel this way.&lt;br /&gt;&lt;br /&gt;One of them then said that a senior top official of Malay ethnicity told him that the Chinese are ungrateful for accepting all the BRIMs and eating at all the BN-organised dinners and yet voted against the BN.&lt;br /&gt;&lt;br /&gt;I immediately said that BN does not represent the Malays.&lt;br /&gt;&lt;br /&gt;Why are they equating &amp;quot;not supporting BN&amp;quot; with &amp;quot;not supporting the Malays&amp;quot;?&lt;br /&gt;&lt;br /&gt;They went on to say that the Malay top official also said that the Chinese which constitutes 26% (sic) - as Chinese now constitutes 23% according to this latest report of Malaysia&amp;#39;s population - controls 60% of Malaysia&amp;#39;s economy.  &lt;br /&gt;&lt;br /&gt;I then asked for the source of that contention. Whereas I gave them Lim Teck Ghee&amp;#39;s findings (five years ago) that the Malays now control more than 45% of Malaysia&amp;#39;s economy.&lt;br /&gt;&lt;br /&gt;Then they said that if the Chinese stopped doing business then Malaysia&amp;#39;s whole economy would shut down.&lt;br /&gt;&lt;br /&gt;It is just like saying if the Malays stopped doing business then Malaysia&amp;#39;s economy would be shut down as well. It won&amp;#39;t be shut down totally, maybe the people would be inconvenienced.&lt;br /&gt;&lt;br /&gt;Anyway, all this is in my opinion, &lt;b&gt;&lt;span style='color:red'&gt;a smokescreen put up by Umno to create a racial divide in order to divide and rule.&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;We have to outgrow this lest we be shackled by it.&lt;br /&gt;&lt;br /&gt;This so-called Chinese Tsunami or &lt;b&gt;&lt;span style='color:red'&gt;&amp;#39;Cinami&amp;#39;&lt;/span&gt;&lt;/b&gt; is not against the Malays but it is against BN. Umno do not represent the Malays.&lt;br /&gt;&lt;br /&gt;After 2008&amp;#39;s tsunami, there were more Malay members of Parliament than before.&lt;br /&gt;&lt;br /&gt;Pakatan Rakyat&amp;#39;s component parties consist of PKR, PAS and DAP. All these parties are open to all races. In fact, the Malays are the majority in both PKR and PAS.&lt;br /&gt;&lt;br /&gt;Using simple mathematics, one would realise that with the 51% popular votes garnered by Pakatan Rakyat, the majority of the votes were from the Malays.&lt;br /&gt;&lt;br /&gt;The Malays who are ABU (Anything but Umno), the Malays who are against the BN, the Malays who can think, the Malays who are progressive, the Malays who love Malaysia, the Malays who are Malaysians first and most importantly, the Malays who are our future&amp;#33;&lt;br /&gt;&lt;br /&gt;To those so called top officials (who are Umno cronies anyway), don&amp;#39;t tell us that Umno represents the Malays. Don&amp;#39;t try to create racial tension.&lt;br /&gt;&lt;br /&gt;Don&amp;#39;t even try to create hatred in the Malays against the Chinese. &lt;b&gt;&lt;span style='color:red'&gt;The Cinami is not against the Malays. The Cinami is against BN, period.&lt;/span&gt;&lt;/b&gt;</description>

            <description>&lt;a href='http://www.themalaysianinsider.com/malaysia/article/chinatown-traders-mulling-judicial-review-to-halt-land-acquisition/' target='_blank'&gt;&lt;span style='color:red'&gt;http://www.themalaysianinsider.com/malaysia/article/chinatown-traders-mulling-judicial-review-to-halt-land-acquisition/&lt;/span&gt;&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;&lt;img src='http://www.themalaysianinsider.com/images/uploads/2011/september/01/mca-chinatown02-sept1.jpg' border='0' alt='user posted image' /&gt;&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;By Yow Hong Chieh&lt;br /&gt;September 01, 2011&lt;br /&gt;&lt;br /&gt;KUALA LUMPUR, Sept 1 — Jalan Sultan traders, whose properties will likely be torn down to make way for the Klang Valley Mass Rapid Transit (KVMRT), are considering filing for judicial review to halt compulsory acquisition of their land by the government.&lt;br /&gt;&lt;br /&gt;Jalan Sultan committee spokesman Judy Tan told The Malaysian Insider a decision on whether to go ahead with the legal challenge could be made known as early as next Friday, if not “within these (next) few days”.&lt;br /&gt;&lt;br /&gt;“It has to be agreed among all of us because it will be stronger if we come in as a group,” she said, adding that not all the 31 landowners who were served notices last month have given their reply.&lt;br /&gt;&lt;br /&gt;The Land Public Transport Commission (SPAD) had reportedly told traders whose land would be acquired for the underground KVMRT line between the proposed Pasar Seni and Merdeka stations they could hold on to their property at an August 23 meeting brokered by MCA president Datuk Seri Dr Chua Soi Lek.&lt;br /&gt;&lt;br /&gt;The commission had earlier insisted it would have to demolish buildings within the corridor of the planned Petaling Street station and tunnel prior to construction to ensure public safety given their age and uncertain soil conditions.&lt;br /&gt;&lt;br /&gt;“The government will proceed with acquisition but also strengthen the buildings that are affected for safety of the household,” Dr Chua had told reporters after the meeting, calling it a win-win situation.&lt;br /&gt;&lt;br /&gt;But SPAD chief executive Mohd Nur Ismail Kamal told The Malaysian Insider the next day there was &lt;b&gt;“no guarantee” the 31 Jalan Sultan landowners affected by the acquisition there will be able to return to their property,&lt;/b&gt; while stressing that the regulator was still working on a solution.&lt;br /&gt;&lt;br /&gt;Outgoing KVMRT project owner Syarikat Prasarana Negara Bhd (SPNB) has also said 20 lots in Bukit Bintang, the capital’s main shopping district, will have to be acquired to make way for tunnelling works and an underground station.&lt;br /&gt;&lt;br /&gt;Putrajaya’s powerful efficiency unit admitted, in a letter to Associated Chinese Chambers of Commerce and Industry Malaysia (ACCCIM) president Tan Sri William Cheng, that Putrajaya needs to acquire and develop land along the MRT route as it cannot afford the multi-billion ringgit project otherwise.&lt;br /&gt;&lt;br /&gt;In a letter obtained by The Malaysian Insider, Performance Management and Delivery Unit (Pemandu) chief Datuk Seri Idris Jala told Cheng that the government was pursuing a “rail-and-property” model as it would &lt;b&gt;not be able to recover the full cost of the first line between Sungai Buloh and Kajang through fares alone.&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;Disgruntled landowners and critics, including Cheng, &lt;b&gt;&lt;span style='color:red'&gt;have accused the government of abusing the Land Acquisition Act 1960 to acquire prime land for commercial purposes.&lt;/span&gt;&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;But Pemandu has denied the allegation, stressing that private land acquired will only be used for stations, car parks and other infrastructure necessary for the KVMRT.</description>
