Sales & Purchase Agreement

Hi,

As I was reading through the Sign & Purchase Agreement, I noticed that all freebies promised (kitchen cabinet, washing machine, etc) are not stated in the SPA. Also, it is stated that purchaser will pay for the legal fees, although the developer is supposed to pay for the legal fees for S&P and loan document.

I talked to the panel lawyer, she claims that developer is obligated to use the standard S&P under Schedule H - Housing Development Act 1966, which explicitly stated that purchaser will pay for the S&P legal fees and maintenance fees.

Also, all other freebies are agreement between developer and purchaser. They are not allowed to put it into the S&P. In this case, if anything goes wrong, what can the buyers do? All the freebies are stated in the Offer-To-Purchase, but it is only signed by the buyers, not the developer.

Last time YTL promised Dale and Meadow @ lakefield to be gated & guarded, but at the end buyers have to apply for it themselves after VP =(
