KUALA LUMPUR: The Industrial Court has ruled that American Express (Malaysia) Sdn Bhd wrongfully dismissed an employee who endured years of workplace bullying, harassment and intimidation by his superior.

In a 45-page award, chairman Augustine Anthony said the evidence revealed a hostile work environment where R. Kuhendran was repeatedly targeted, humiliated and eventually dismissed in a retaliatory act.

The court ordered the company to pay Kuhendran, a former senior credit specialist, RM153,200 in back wages and compensation in lieu of reinstatement.

Kuhendran, who joined the company in 2014, said he endured years of bullying and harassment by his immediate superior, Vijay K. Jayadevan Nair, who was also a company witness in the suit.

The claimant alleged that warning letters issued against him from 2015 onwards were part of a campaign to victimise him after he raised concerns over toxic workplace conduct.

The court heard that despite lodging formal complaints internally, no meaningful action was taken against the superior.

Instead, Kuhendran claimed he became the subject of heightened scrutiny, repeated disciplinary action and constant intimidation.

Matters escalated after he sent a letter of demand to the company's headquarters in New York on March 3, 2022, seeking intervention over the alleged workplace harassment.

Less than three months later, he was issued a show-cause letter accusing him of poor performance and misconduct before he was dismissed on June 23, 2022.

American Express maintained that the dismissal was justified, citing years of poor performance, behavioural issues and repeated breaches of company procedures.

However, the court found the company's allegations vague, exaggerated and unsupported by convincing evidence.

The court said its examination of the evidence revealed the superior had openly used sexually charged, highly derogatory and demeaning words against employees through the office messaging system.

"The evidence clearly shows that the company was nitpicking the claimant's every action to find fault, and in such cases, no employee can work safely in any such work environment," Anthony said.

"It is regrettable that the company did not find it necessary to deal with such office harassment and ridicule of employees strictly and firmly, thereby permitting a hostile work environment.

"Vijay has been proven in this Court to be a superior who has shown his nature of bullying, harassing and intimidating the claimant.

"It was foolhardy for the company to make this very person the coach, guide and leader purportedly guiding and leading the claimant or other employees who experience the same predicament," the court said.

The chairman also found that the company appeared more interested in protecting the superior than addressing the claimant's grievances.

"With clear documented transgression by Vijay, this court wonders why the company, instead of protecting its unfortunate workforce, was seen to be shielding the team leader.

"The issuance of the show cause letter to the claimant was a swift manoeuvre to do damage control after the claimant lodged a complaint/demand to the company's head office in New York, after all his grievances previously raised were not dealt with fairly," the court said.

The chairman further held that the company failed to place the claimant under a proper performance improvement plan before dismissing him, concluding that the dismissal was tainted by bad faith and retaliation.

The court awarded Kuhendran RM114,000 in back wages and RM39,200 as compensation in lieu of reinstatement.

Kuhendran was represented by lawyers Bhavanash Sharma and J. Soarminie, while Trishelea Ann Sandosam, Rachel Tey and Sofia Asyikin Mohd Kamil appeared for the company

KUCHING (May 14): The Magistrates’ Court here today fined a man RM5,000 in default five months’ jail for punching a passenger, spitting on a flight crew member, and causing a disturbance on board an aircraft.

Magistrate Nursyaheeqa Nazwa Radzali meted out the sentence on Mohd Izzan Mohd Hashim, 36, after he pleaded guilty to a charge under Regulation 102 of the Civil Aviation Regulations 2016.

The offence, punishable under Regulation 206(2)(A) of the Civil Aviation Regulations 2016, carries a fine of up to RM25,000 or imprisonment for up to one year, or both, upon conviction.

According to the charge, the man behaved inappropriately towards the flight crew by continuously preventing them from carrying out their duties.

He committed the offence at around 6.25pm while on a flight from Kuala Lumpur to Kuching on April 22.

Based on the facts of the case, an aviation security officer working at Kuching International Airport (KIA) received instructions from the airline’s station manager to be on standby at KIA’s Gate 5.

This followed reports of an aggressive male passenger on board the flight from Kuala Lumpur to Kuching, which was scheduled to arrive at 6.50pm.

Upon arrival, Mohd Izzan was handed over to the police for re-arrest and further action.

Police investigations found witnesses stating that Mohd Izzan acted aggressively while on board the aircraft by punching a passenger in the face, spitting on a flight crew member, and causing a disturbance.

The actions were feared to have endangered the lives of other passengers on the aircraft and affected flight safety.

It is understood that he was under the influence of alcohol during the incident.

Deputy public prosecutor Muhammad Afiq Safly Nor Kazly appeared for the prosecution while the accused did not have legal representation.

KUCHING: Malaysia will execute a complete overhaul of its National Integrated Immigration System (MyNIISe) this September, and roll out an upgraded MyKad security features set for June, in a major push to modernise the country’s identity and immigration systems.

Home Minister Datuk Seri Saifuddin Nasution Ismail said the initiative marks a key milestone for the Home Ministry (KDN) in strengthening identity management and improving the efficiency of public services, especially at border entry points.

He said the new systems and upgraded documents, including passports and identity cards with enhanced security features, are part of an ongoing effort to address evolving security threats and higher travel volumes.

“I believe the National Registration Department and the Immigration Department are ready with Plan A and Plan B,” he said.

He added that he had strong confidence the country would successfully navigate this historic transition.

“At some point, we need to issue new documents with better security features, and we have been working towards this for a long time,” Saifuddin said during a speech at the KDN Assembly recently.

MyNIISe will replace the current Malaysian Immigration System (MyIMMs), which has been in use for more than two decades, as it is no longer adequate for modern security and data integration needs.

The Home Ministry also highlighted that the system upgrade is part of broader efforts to improve border security and prevent cross-border syndicate activities.I

KUCHING (April 30): The Immigration Department has confirmed that the late officer Azman Mazni, who was killed in a road accident on April 25, had an active transfer request under consideration at the time of his death, the New Straits Times (NST) reported.

According to NST, Immigration director-general Datuk Zakaria Shaaban said Azman had submitted his latest application on Aug 10, last year, which was being assessed based on current operational priorities and requirements.

Stationed at the Papar Immigration Depot in Sabah, Azman reportedly travelled more than 700 kilometres each week to be with his family in Miri and Sibu, Sarawak.

It is understood he was less than an hour away from his home in Sibu after a nearly 11-hour journey when the fatal accident occurred, NST reported.

Zakaria said placement and transfer decisions are made based on service requirements, including approved positions, existing vacancies and job grade suitability.
