Buying used car from a private seller

Sharing my experience in buying used car from a private seller.

Been shopping around for a used pickup truck around Malaysia and decided to purchase from a private seller.

#First Attempt - Purchasing from a Private Seller which doesn't have enough fund to clear off bank loan.
#Second Attempt - First attempt was aborted (obviously) and was lucky enough to find another seller with enough fund to clear off bank loan

1. Do your homework, and don't take decision in hurry. Ask for more pictures and videos (aside from those published online), check if seller posted in other online portal.

2. Shortlist and perform On-site Inspections
- Always make an appointment with the seller to view the car in person.
- Check for signs of accidents, modifications (which may void the manufacturer warranty), oil leakage
- Check for signs of kereta potong, water marks / smell that indicate the vehicle was involved in flood.
- We realized that the pictures sent did not cover the left area, upon inspectsion we found out that the side step was damaged accidentally (LESSON learnt!)
- Discovered a bee hive (yes, with bees inside) at the front driver seat as the truck was left unused for soooo long

3. Interview and review the documentations provided by seller
- Ask any questions that you could think of to clarify all your doubts (Why seller decide to sell personally without going through agents, history and usage)

4. Test Drive - If you feel anything is not right, abort immediately.
- Get the seller's permission to perform Lo / High Speed, Suspension, Tranmisssion test.

5. Ask for Warranty and Service booklets
- Bring a copy of the original booklet, or ask the owner to visit any service center to validate that the warranty is still in place (if applicable)
- Check if service is performed as scheduled, history of repair

6. Negotiate on pricing
- Respect and be fair to the seller. The main reason I would shop from a private seller is I tend to get better quality used vehicle (lower mileage, higher chances of getting a vehicle with ORIGINAL mileage - if you've been shopping around you know what I mean, better condition and pricing)
- Used car press the price down, increase it to the market rate
- My old man's advise - take the middleground - lower than the market rate but higher than what a used car dealer would offer
- Win-Win situation mar

7. Confirm and agree on logistics
- Date / Time / Location of JPJ office

8. Here comes the most important part - MONEY MONEY MONEY
- You barely know the other party and vice versa. Would you trust the seller to perform and complete the ownership transfer processs AFTER you've deposited the downpayment / full amount?
- Similarly once the transfer is done, the seller can't do much (Report to PDRM, bring you to court) if you do not complete the payment.
- Banker's cheque seems to be the commonly used method, however the banker's cheque takes time to process and CAN be cancelled even if the original copy is not with you.
- Getting a middleman (such as a used car dealer to be involved seems to be a better choice), but comes with additional cost (if it's buddy then probably can settle la)
- Getting a loan (this is actually quite feasible, getting a loan as the current owner's bank and bank would happily perform the necessary process for you (WARNING: FEES (& interest) is involved and IT's NOT CHEAP).
- But IMHO it's actually the safest method if you're not a risk taker
- My purchase however was done with the assisance of a lawyer, will be explained below

9. Middleman (that won't lari and won't charge a bomb - ta daaaaaaaa, a lawyer)
- Engage a lawyer that both parties are comfortable with (those who decide will need to pay for the legal fee, but it's actually quite reasonable)
- Get an agreement, in my case I drafted one (there are a lot of samples available and I modified and get it reviewed by lawyer)
- The agreement (IMHO) should cover Fee involved, Bank Accounts, Transfer and Refund, indemnification & some standard terms.
- On the actual day, meet up, perform a FINAL check on the vehicle and all accessories, sign and stamp the agreement
- Deposit the amount agreed to the lawyer's client account
- Perform the Ownership transfer (at any JPJ counters - Took less than 5 minutes & make sure you bring all the ORIGINAL documents required)
- Provide the proof of transfer
- Payment released (refund depending on the status of transfer obviously)
- Buyer happily walk away with the car, Seller happily get the $$$

I just completed the transfer and the truck is parked right outside.
