Hi all,

I am asking on behalf of my friend who signed an "Employment Contract" with a clause to says that he is to stay with the company for 2 years. In the event that he resigns, he would have to pay back 2x annual gross salary or new salary, whichever higher. He is almost 1 year into his employment and would like to leave the company because of the toxic work culture and boss. The term of the contract is as follows:

"Notwithstanding any of the foregoing terms, you undertake that you will not resign from the Group for a minimum period of 2 year upon commencement of your contract. Without prejudice to any other legal remedies available to the Group in the event of such breach, you will be required to pay an amount equal to (i) the latest 2x of your gross annual salary that you received from the Group or (ii) the latest gross annual salary that you will receive from the company that you join (whichever shall be the higher), such payment to be made by you immediately upon commencement of your employment with the new employer. You understand, acknowledge and agree that this clause is necessary and reasonable to protect the Company's interest, in view of the position offered to you in the Company."

Notice of termination as follows:

"3 months' notice in writing will be required if you wish to terminate the employment contract. You shall not be entitled to offset unutilized paid annual leave from the notice period.

The Company will provide 1 month's notice period to you in the event the Company wishes to discontinue the employment contract. The Company may at its discretion pay 1 month salary in lieu of such notice. The Company reserves the right, in the event of serious misconduct, to terminate your contract without notice. The full procedure is included in the Disciplinary procedure for your reference and forms part of this contract."

Early release and working for another company

Hi all,

My friend has tendered his resignation. The policy is two months' notice.
However, his company is releasing him early.

His company is willing to pay for the two months.
He has an offer from a competitor company and the company was aware so his manager told him that he cannot start at the competitor's company until the two months is up, saying that he is still under the company's payroll.

Is there a condition like this on the labour law?

What can he do, and what can his current employer do if he decides to just go ahead and work in the competitor company before the two months.

I am just wondering if companies will pay for the phone bills if it includes the phone repayment.

for instance, let's say if I am getting RM150 phone allowance, then will my company pay for my phone bill if part of it includes iphone 7 repayment.

I have not gotten a plan yet and I am thinking how to maximize this alowance.
