PETALING JAYA: The Council of Eminent Persons is set to probe a local company facilitating the processing of entry for Chinese tourists to Malaysia following claims of lopsided terms at the expense of the government, says a source.

Apart from the terms of the contract, the council is also expected to scrutinise the vetting process and identifying weaknesses in the system.

The source told FMT that the council would be looking at the Electronic Travel Registration and Information (eNTRI) facility which allows Chinese nationals to fill in an online application for permission to enter Malaysia.

According to the immigration website, eNTRI is provided by the government to facilitate the entrance of Chinese tourists under the Visa Waiver Programme. An eNTRI note is issued as proof of registration, and must be presented upon arrival in Malaysia.

The source said the online application process would usually take less than five minutes, and applicants only needed to show proof on the length of their stay in Malaysia.

“Why is our online process so simple, unlike for Malaysians wanting to go to China? They make sure no one poses a security risk to them. But why is our system so lenient?” he asked.

The source also said applicants were charged around RM100 for the processing of the visa application.

“The entire amount goes to the company,” he added.

Other than the eNTRI facility, Chinese nationals also have the option of applying for eVISA and the Sticker Visa. These options cost almost RM175 per application, and the government gets about RM50 from each application while the rest of the fee goes to the operators, the source said.

He said applicants preferred the eNTRI facility as it was cheaper and allowed them to submit their applications online.

“However, the vetting process is weak and we do not know how many return to China after their stay period ends,” he said, adding that existing data showed that more than 1.3 million Chinese nationals had entered the country through the eNTRI system.

The source said the council was also looking at the terms of the agreement as it was learnt that the company’s contract might have just been renewed for another five years.

The source said in 2016, the company processed 175,000 eNTRI applications which saw it earning RM18 million.

In 2017, it earned almost RM67 million from 695,434 applications.

The source said the council would likely seek an explanation from the company on the lopsided revenue sharing with the government.

The Immigration Department has yet to respond to FMT’s queries on the vetting system and the terms of payment agreed to with the previous government.

In 2016, former Malaysia Tourism Promotion Board chairman Wee Choo Keong said the visa-free policy for tourists from China to Malaysia had upset the Chinese visitors who were unhappy that they were being charged “excessive” processing fees.

He was also concerned that the high “processing fee” would negate the benefits of the visa-free concession and result in Chinese tourists giving the country a miss.

Wee had urged the government and the Immigration Department to rethink the system.

“The more we (government) examine everything thoroughly, we discover money have used inappropriately, stolen, or sheltered away somewhere.

“Someone told me fishes rot at the head when its dead, I will make sure there is no more rotten fish at the head during our administration,” he said after citing the Finance Ministry’s discovery of dubious payments made in two pipeline projects, with nearly 90 per cent of the contracts worth RM9.4 billion being paid out but only 13 per cent of the work being completed.

Dr Mahathir also reminisced the time when the government and private sector worked as one body under the Malaysia Incorporated Policy introduced in 1981, saying he was determined to treat the business communities as friends and not enemies as he wants to go back to working with the private sector to rebuild the country.

“We want to do things quickly, we want to approve things quickly but we do not want any hanky panky and there will be tenders for every government contracts with fairness.

“Should someone receives a contract from the government, that said person must carry out its obligations and selling it to another person will nullified the contract,” he said.

Folks I just heard some really worrying news. That fellow is going around the country whispering into the ears of the gullible but influential that Najib was a victim of Tun Dr Mahathir’s greed and lust for power. They are listening to him because he is promising them things that Tun Dr Mahathir will not give them.

We faced delays and problems appointing the first few Cabinet Ministers. The same fellow had strongly objected to the appointment of Lim Guan Eng as the Minister of Finance. DAP members please take note.

Then there were delays in the swearing in of Tun Dr Mahathir as Prime Minister.

The Government CANNOT begin fully functioning until a few more things are in place:

1. The rest of the Cabinet must be agreed upon. Then they must be sworn in.

This is also facing delays. Someone wants to see the list of suggested Cabinet Ministers and pick and choose who he wants – which is NOT part of our Constitutional process. He wants to veto names that he does not like.

There are NO provisions in the Federal Constitution for anyone else other than the Prime Minister to choose a Cabinet.

2. Key government appointments must be made like the Attorney General, the Ketua Setiausaha Negara (KSN) and other important Civil Service appointments. The same person also wants to have veto power over these appointments as well. This is really ridiculous. This is purely the prerogative of the Prime Minister.

3. The Parliament must begin its session soon so that we can pass Bills and new Laws, abolish old Laws and get on with the management of the country. No Parliament no country folks. The new Parliament must begin its first session.

Ok folks, here is today’s shocker.

There seems to be some serious issue developing between the Government and another party over the appointment of the Attorney General.

There is a very strong rumour (which I heard from very strong people) that our Prime Minister Tun Dr Mahathir Mohamed has already shortlisted ONE candidate as the new Attorney General.

The candidate is said to be a non Muslim, male Indian.

He is said to be an expert on the Federal Constitution.No it is not Sri Ram.

However the appointment is being objected to on exactly the same grounds – that the candidate is a non Malay and non Muslim. The candidate for AG is a Christian.

There is nothing in the Federal Constitution which says that non Malays and non Muslims cannot be appointed as the Attorney General.

More importantly it is accepted convention that the Prime Minister runs the affairs of the nation. The appointment of the Cabinet and the major Civil Service appointments are at the sole discretion of the Prime Minister. No one else.

1. There is also talk that the role of the AG will be restructured. This is part of the institutional reforms that need to be done. One suggestion is that the AG be confirmed by Parliament via confirmation hearings. Meaning the AG is actually appointed by Parliament and the AG will also be required to report publicly to Parliament on a periodic basis (say twice a year).

2. The AG’s role may also be redefined in that the AG does not prosecute cases anymore. There will be a separate and independent position of Public Prosecutor, who will actually prosecute cases in Court. The AG will focus on other administrative and legal issues.

But ALL THESE REFORMS can only be undertaken AFTER a new AG has been appointed.

It is also rumoured that the new AG (the non Muslim, male Indian lawyer) will be on a strict TWO YEAR contract.

Over the TWO YEARS his job is to focus on achieving 1 and 2 above, ie the institutional reform of the Attorney General’s Chambers.

Some people are afraid that if these institutional reforms are undertaken it will erode their power to play hanky panky with the AG’s Chambers – exactly like what happened with Super Moron and the moronic AG that he appointed as his pet monkey.

Folks, akhir kalam, the Prime Minister is an elected representative of the people. The Prime Minister represents the will of the rakyat. Any attempt to delay or frustrate the PM from carrying out his responsibilities and obligations towards the rakyat will have serious consequences.

Usually the will of the rakyat always wins. Those who go against the will of the rakyat will lose.

So to the people of Malaysia, the citizens of Malaysia who stood for hours queuing up to cast your vote – please listen up.

We all queued patiently in the sun and rain to vote for change.
That change has happened.

Through a fantastic expression of our will we have overthrown a corrupt and useless bunch of monkeys. Power is now back with us the people.

The people are supreme. And our democratic process makes sure that we the people have legitimate claim to be supreme over our own fate. No one else.

Well, it looks like some people are thinking that they can take our power away from us.

Through ignorance, scheming and disguise they wish to usurp the people’s power.

The slimy back door types are helping them in this process.

If this rumour I heard is true, then over the next few days this “impasse” will most likely come out into the open. There is going to be a crisis.

If such an event comes to pass, let us all stand behind our Prime Minister.

Not just because our Prime Minister happens to be Tun Dr Mahathir Mohamed but more importantly because we must uphold the Federal Constitution and the Rule of Law in this country.

If we do not stand up very firmly for our rights now, then they are going to trample all over us again. And again.

Amid a push from certain groups for a Muslim candidate to “defend” Islam’s status as the religion of the federation, Ambiga countered by asking if race and religion were the determining criteria for “the best” in other professions.

“The concept of race and religion is so alien to choosing a professional one has confidence in. Does it matter when we need the best doctor or accountant?” the president of the National Human Rights Society posted on her Twitter account tonight.

In a series of tweets earlier, Ambiga, who is also a member of the government’s Institutional Reforms Committee pointed out that Thomas has acted as counsel to many different groups on a wide array of cases.

Among the high-profile cases was his legal representation for the PAS-led Kelantan government in its court dispute against the federal government over oil and gas royalties, she said while retweeting the same point posted by fellow lawyer Malik Imtiaz Sarwar.

PAS information chief Nasrudin Hassan had in a statement earlier today asserted that a Muslim AG is necessary to safeguard Islam as the religion of the federation, the interests of Malaysia's majority population, who are Muslims, and to properly advise the King as the religion's defenders.

“Tommy Thomas represents Kelantan in its petroleum dispute against Federal Govt. PAS doesn’t seem to have a problem with that,” Malik posted on Twitter earlier.

Ambiga also retweeted another posted by civil rights lawyer Syahredzan Johan who highlighted that Thomas was not the lawyer who had acted for DAP secretary-general Lim Guan Eng when he was charged with corruption over the purchase of his house in Penang.

“Tommy Thomas is not the lawyer representing LGE in the bungalow trial. Tommy is representing LGE in the contempt proceedings filed by Apandi for comments made by LGE after he was charged,” Syahredzan posted in response to an allegation by another Twitter user.

Tan Sri Mohamed Apandi Ali, referred to in the Twitter dispute, is the incumbent AG who has been put on garden leave for suspected complicity in past investigations on the 1Malaysia Development Berhad scandal.

Prime Minister Tun Dr Mahathir Mohamad has confirmed that Thomas was the government’s sole nominee for the AG post.

He also said the government will not be nominating anyone else for the job, but was quick to add that his administration will work on a solution over the AG impasse with the palace.

Various media had reported the Yang di-Pertuan Agong Sultan Muhammad V rejected Thomas’ candidacy, purportedly because he is non-Malay, non-Muslim and has never been a judge.

The Conference of Rulers is scheduled to meet on Tuesday to discuss the AG appointment.

“As far as I remember, I tried to find the section mentioned by the accused, but I couldn’t find the section, because she kept asking so many times: ‘What section? What section?’

“As far as I remember, my Google wasn’t working well,” Siti Nor Jihan said.

She told the court that the operation by the Federal Territories Islamic Religious Department (JAWI) had only wanted to detain the organiser of the beauty pageant by the name of “Ira Sofia” and the participants, but not Siti.

During examination-in-chief by deputy public prosecutor (DPP) Hafizza Sauni, Siti Nor Jihan said that the raid, which was carried out at the Renaissance Hotel in Kuala Lumpur, was in accordance with Section 9 of the Syariah Criminal Offences (Federal Territories) Act 1997.

“What we were trying to explain was that with regards to the beauty pageant, clearly, there is a fatwa that has been gazetted, and Section 9 refers to the violation of that fatwa. The offence was for violating the fatwa,” she said, adding that it is ‘“forbidden and sinful” for Muslim to take part in beauty pageants.

She said that it is equally sacrilegious for Muslims to organise or contribute to such events.

During the trial today, Siti Norjihan, who was the deputy operations head during the raid, also accused Siti of trying to delay Ira’s detention, by not cooperating with JAWI officials.

“We explained many times to the accused about the offence and asked for cooperation but until the end, when we wanted to detain the people, we were still provoked.

“We tried to entertain the questions posed by the accused, though the fact was clear that we had the power to detain the organiser of the beauty pageant that night,” she added.

Judge Maizatul Munirah Abd Rahman then adjourned the hearing until tomorrow.

Siti is being charged under Section 186 of the Penal Code for allegedly obstructing Siti Nor Jihan, a government officer, from discharging her duty during a religious raid at the Renaissance Hotel on April 3, 2016.

Siti claimed that she had been arrested by the officers despite identifying herself as a lawyer and guest at the private dinner party for trans women.

If found guilty, she can be jailed for up to two years, fined a maximum of RM10,000, or both.

“Later on they also searched my office in Keningau and Kota Kinabalu at about 10.30pm,” he said.

Jeffrey, who denied taking the RM20 million, said that the authorities had taken some RM80,000 of his cash which was stored in a bag, as well as his bank card.

“They also went to the Bingkor assemblyman Robert Tawik’s house in Keningau and took his statement there,” he said.

“I’m glad it is over now. They said this was ok, so hopefully it is over,” he added.

Jeffrey said that he had given his full cooperation to the authorities, who in turn had acted professionally, although he believed the raid was politically motivated.

“I believe they were doing their jobs well, I support such investigations as I have nothing to hide, and it is a waste of time and effort.

“But I believe they should investigate those who created this news. It is not pleasant and it was conducted at ungodly hours,” he said.

He also said that thorough investigations should be carried out on all those who had defected as well during the post election period.

“We have many leaders who are crooks and they should all be investigated,” he said.

Jeffrey, whose party won two state seats and was inadvertently the “kingmaker” in deciding whether it was a BN or a Parti Warisan Sabah-Pakatan Harapan government.

Jeffrey ultimately decided to work with the BN, giving them a 31 seat majority out of 60 seats, amidst rumours that he was paid RM20 million and offered a deputy chief minister post in the BN state government.

Sabah BN chairman Tan Sri Musa Aman was later sworn in as chief minister on May 10, but two days and six defections from BN later, Warisan president Datuk Seri Shafie Apdal was sworn in.

“However, only Anwar and Nurul Izzah met with Sultan Ibrahim and also the Tunku Mahkota Johor Tunku Ismail Ibrahim for about an hour plus where they had a meal together.

“However, there are no details as it is considered a private meeting between the Johor royal family and the PKR leadership,” said the source, who wished to remain anonymous.

Earlier, both Anwar and Nurul Izzah were personally flown in the Johor ruler’s private jet from the Sultan Abdul Aziz Shah Airport in Subang to Senai International Airport in Johor at the behest of the state ruler.

They arrived in Johor Baru at about 10.15pm.

Upon touch-down at Senai International Airport, Nurul Izzah had a briefing with several Johor PKR leaders in the airport’s business lounge area.

Present to welcome the Anwar and Nurul Izzah were Johor PKR chief Hassan Abdul Karim, his deputy chief Jimmy Phua Wee Tse, and also its vice-chief Natrah Ismail. Several other senior state PKR members were also present.

“It was a short briefing session lasting about 15 minutes where Nurul Izzah said the Johor PKR leadership on the urgent need to implement the promises made during the 14th general election manifesto.

“At the same time, she also reminded those present in the need to uphold the PH’s reform agenda,” said the source.

It is unclear as to the purpose of the meeting, but Anwar has stated he will be travelling for a fair bit before actively taking part in politics again.

Anwar, who is designated to be the next prime minister, was given a full royal pardon last Wednesday after serving a jail term for sodomy on what he claimed to be politically motivated charges.

He had earlier escorted his wife Datuk Seri Dr Wan Azizah Wan Ismail, who was sworn in as the country’s first female deputy prime minister, in addition to minister for women’s affairs, in Istana Negara.

KUALA LUMPUR: Sixteen Umno members from five states today filed a challenge questioning the legality of their party, as Umno has not held its elections since 2013.

In a leave application for judicial review filed today, three weeks before the May 9 general election, the 16 claimed the extension given by the Registrar of Societies (RoS) to Umno to hold its elections next year was against their party constitution. They want the order quashed.

“Under our constitution, party elections can be only extended up to 54 months,” they said, adding the last elections were held on October 2013.

They also claimed that the announcement to delay polls by Umno president Najib Razak had denied them their right to pick their leaders.

The 16, led by Umno Seri Merpati Pandan Indah branch leader Salihudin Ahmad Khalid, are seeking a court order compelling the RoS to investigate Umno for allegedly breaching their own constitution and for another order to suspend the party’s operations pending the court case.

They are also seeking an order to dissolve Umno from today as, they claim, the party is now “illegal”.

The 16 people filed the case at the High Court registry here today.

They named the RoS and Umno executive secretary Ab Rauf Yusoh as respondents in the judicial review application.

Previously, in August 2015, former Umno member Anina Saadudin sued Najib over the RM2.6 billion donation issue. She was then sacked from Umno for filing the suit.

In 1987, following an acrimonious fight in Umno, several members went to court and the High Court ruled that Umno was an illegal body due to election irregularities in a branch. The party was reformed as Umno Baru.

In the last Umno election, Najib and the then deputy president Muhyiddin Yassin won the top positions uncontested. Ahmad Zahid Hamidi, Shafie Apdal and Hishammuddin Hussein won the three posts of vice-president.

However in 2016, Muhyiddin was sacked from Umno while Shafie quit the party. Both are now opposition leaders and will be contesting in Johor and Sabah, respectively, in the general election.

KUALA LUMPUR, May 7 — A massive event dubbed “Konsert Langkawi Hebat 2018” will be held on the Kedah island tomorrow night, coinciding with Tun Dr Mahathir Mohamad’s final push there in the campaign for a closely-fought general election.

The event will star local legend Datuk Ramli Sarip and is scheduled to be held at the island’s Dataran Lang at 8pm tomorrow.

Others featuring in the concert include Datuk DJ Dave, Joe Flizzow, Ruffedge, Ayda Jebat, Syamel, Ernie Zakri, Zahirah Macwilson and Achey Bocey.

“Meet in Langkawi! Join me and fellow artistes tomorrow night in Langkawi. Enjoy the concert, win all sorts of prizes that await you,” Ramli wrote in the Instagram promoting the event.

According to the poster bearing the seal of the Finance Ministry and the Langkawi Development Authority (LADA), the concert is free to all.

The event will clash with Dr Mahathir’s final stop for his election campaign, which his Pakatan Harapan pact also plans to stream live across the Internet for its professed goal of reaching 10 million viewers.

Former prime minister Dr Mahathir is contesting the Langkawi federal seat against Barisan Nasional incumbent Datuk Nawawi Ahmad and PAS candidate Zubir Ahmad in the 14th general election.

For some reason, coincide with the Mahathir and PH last talk in Langkawi tonight. But this concert is free and endorsed by Kementerian Kewangan and LADA.

Documents shared by Cambridge Analytica whistleblower Christopher Wylie spell out how parent company SCL Group tried to influence elections worldwide.

One letter also refers to its support of 15 psychological operations involving the UK's Ministry of Defence as of January 2012.

The Foreign Office is quoted as saying another part of SCL was "a joy to work with" on a counter-terror operation.

The files also refer to work done for Ambassador Bolton on US votes.

This appears to be a reference to John Bolton, the former US ambassador to the UN. He was recently appointed as President Trump's National Security Adviser.

The Guardian had previously reported on his involvement in a Cambridge Analytica experiment to target YouTube videos at profiled US voters.

The political consultancy is in the spotlight after reports that it amassed the data of millions of Facebook users without their consent and used this in political campaigns.

The firm has said that it "destroyed" the information when Facebook demanded, although Channel 4 News has reported that copies of at least part of the trove are still in circulation.

"We take allegations of unethical practices in the past by our former global (non-US) political consultancy very seriously, and they are currently the subject of a full and independent investigation which we have instigated to establish the facts," said Cambridge Analytica in a statement it published on Tuesday.

"Its findings will be made available in due course."
'International experience'

The files were released by the UK's Digital, Culture, Media and Sport Committee.

They detail some of the work undertaken by Cambridge Analytica and companies it has been linked with, including SCL Group, Global Science Research and Aggregate IQ.

Mr Wylie had referred to several of the documents in his appearance before the committee on Monday.

In one document, SCL said that encouraging people "not to vote" might be more effective than trying to motivate swing voters.

Describing its work in a Nigerian election, SCL Global said it had advised that "rather than trying to motivate swing voters to vote for our clients, a more effective strategy might be to persuade opposition voters not to vote at all".

'Ethnic tensions'

It said this had been achieved by "organising anti-election rallies on the day of polling in opposition strongholds" and using "local religious figures to maximise their appeal especially among the spiritual, rural communities".

It boasted of devising a political graffiti campaign to create a youth "movement" in Trinidad and Tobago and of disseminating "campaign messages that, whilst ostensibly coming from the youth, were unattributable to any specific party". It said as a result "a united youth movement was created".

In Latvia, it said it had recognised that "unspoken ethnic tensions" were "at the heart of the election".

"The locals secretly blamed the Russians for stealing their jobs... armed with this knowledge, SCL was able to reflect these real issues in its client's messaging," the document said.

The files spell out how SCL helped the UK's Foreign and Commonwealth Office "in strategic planning to counter violent jihadism" in Pakistan.

"I wouldn't only recommend them, I'd work with them again in an instant," wrote an official, whose name has been redacted.
