KUALA LUMPUR: A three-year-old girl was awarded more than RM5.6 million by the High Court in a medical negligence lawsuit brought against doctors at a public hospital.

The girl, born on May 12, 2020 via a Caesarean section, suffered spinal cord injuries following complications from the surgery, which left her paralysed from the neck down.

The hospital conducted an internal inquiry into the matter shortly after the birth.

The inquiry found that the medical officer on duty had no experience to perform the surgery and that it was done without supervision by an obstetrician and gynaecologist.

The girl, through her father, filed a suit against the government and the doctors involved, claiming they were negligent and failed to act in her best interest.

The government admitted liability, and the court was asked to assess the quantum of damages payable.

In his ruling, Justice Akhtar Tahir said that “no amount of money can lessen the (girl’s) pain and suffering”.

“The court is of the view that the amount of damages awarded must compensate as best as possible for the additional expenses which will be incurred by the caregivers in caring for the plaintiff with the disabilities suffered,” he added.

The judge also said that he had considered evidence from doctors, who testified that the toddler was likely to live up to the age of 23 based on her condition.

“In the era of technology advancement, chances of a longer life expectancy is to be expected,” Akhtar said.

The court ruled the girl is entitled to be sufficiently compensated for the rest of her life.

LONDON, UK - A man who claims that Kevin Spacey sexually assaulted him said the Hollywood actor was an aggressive "predator" uncomfortable with his sexuality, a London court was told on Monday.

The alleged victim, who cannot be identified for legal reasons, claims that the Oscar-winning star began sexually assaulting him more than two decades ago.

But despite him making clear to Spacey that his advances were unwanted, the actor persisted, a jury at Southwark Crown Court in south London heard.

Spacey, 63, has pleaded not guilty to 12 sexual offences, including indecent assault, against four men between 2001 and 2013.

The alleged victim described Spacey, the former artistic director of London's Old Vic theatre, as a "slippery, snaky, difficult person".

Good-looking young men were warned to be on their guard because it was "well known that he was up to no good", he said, likening the actor to his serial killer character in the film "Se7en".

"He's a bit like that, a bit creepy," he said.

The prosecution has described Spacey, who won Oscars for "The Usual Suspects" and "American Beauty", as a "sexual bully", whose preferred method of assault was grabbing other men in the crotch.

His first alleged victim recounted in a videotaped police interview played to the jury that the actor grabbed him on several occasions, and was told to stop.

He told officers that Spacey once grabbed him painfully in a car. He pushed back and told the star: "Don't do that again or I will knock you out." The actor allegedly replied: "That's such a turn-on to me, you're such a man." The witness said Spacey's unwanted sexual overtures made him uncomfortable, ashamed and disgusted, so much so that he could not watch any drama with the actor in it.

"I can't stand watching the man. It makes me feel sick," he told police, describing Spacey as a "predator" who was "aggressive".

"He was obviously very messed up with his sexuality," he added.

Under cross-examination by Spacey's lawyer Patrick Gibbs, the alleged victim denied "100, one million percent" that he had any feelings for the actor, or that what happened led him to question his own sexuality.

He reported the claims to the police after publicity about other allegations against Spacey, he said.

His only motivation was "to tell the truth", he added. - AFP

CHUKAI - Another seven victims in the Jeram Air Putih water surge tragedy were recovered today, making it nine out of the 10 so far who were swept away by raging waters at the recreational spot on Saturday.
Three of the victims were identified as Putri Aryana Umaira Karim, 4, Muhammad Haziq Ziqree Karim, 6, and Putri Nurerina Natasya Karim, 10.

Terengganu police chief Datuk Mazli Mazlan said all seven victims were found in Sectors A and B covering a 25-kilometre radius within the 32-kilometre-wide incident site.

"All the bodies were recovered between 11 am and 1 pm today. They were found between tree branches, floating in the water and by the river bank.

"There were two adult males, one adult female and two boys and two girls. Four of them have yet to be identified,” Mazli told a press conference at the Air Putih police station operations control centre here today.

He said fair weather conditions and slower river currents enabled the search operation to go smoothly, and it will be continued to recover the last missing victim.

The 10 individuals having a picnic at the Jeram Air Putih waterfall were swept away by a water surge phenomenon on Saturday.

The group comprised nine individuals from one family from Felda Lepar Hilir, Kuantan, Pahang and a man from Batu Pahat, Johor, who was believed to be engaged to a family member.

Madonna is said by doctors to have looked “exhausted” and “thin” in photos taken days before she collapsed with a “serious bacterial infection”.

The Queen of Pop, 64, was reportedly intubated in intensive care on Saturday (24.06.23), and medics who have looked at images of her in the lead-up to her hospitalisation have said her appearance indicates she was seriously run-down as she rehearsed for her now-postponed ‘Celebration Tour’.

Images analysed by doctors for Mail Online include a set posted by Madonna last week showing her practising for the shows, and sitting by a piano in one of the snaps.

Dr Thomas Moore, an infectious diseases expert at the University of Kansas, told the outlet about the images: “She doesn’t look much like the Madonna I am used to seeing.

“She looks thin from the photos. She does not look well but it is all relevant.

“She is such a dedicated performer that I wonder if she was not feeling well but then pushed herself too far.”

Another image looked at showed Madonna at a Karl Lagerfeld exhibition in New York City the day before she was rushed to hospital.

It showed her with her hair tied into plaits and wearing a cap and sunglasses to hide her appearance.

Dr Stuart Fischer, who is also a former emergency care doctor in New York City and has more than 40 years’ medical experience, said: “She looks exhausted. Intense rehearsing and the stress associated with large-scale performances are undoubtedly risks for immunosuppression and unwanted health issues.

“It’s the responsibility of the physician to point this out. Just because someone is an international celebrity doesn’t mean they’re invulnerable.”

It has not been revealed what serious bacterial infection Madonna suffered, although rumours suggest it could be sepsis – a life-threatening reaction to an infection that sees the immune system attack the body.

Sepsis is triggered when the bacteria gets into the bloodstream and can enter through cuts, wounds and the digestive system, among other areas.

Dr Fischer believes sepsis is the most likely explanation and said that the star should not have been discharged from the hospital so early.

He added: “This discharge might put her life in jeopardy. No matter how hard (celebrities) push you, you don’t discharge them so quickly.

“They may be a celebrity on the outside, but on the inside, everyone is the same and has the same organs.”

Mum-of-six Madonna was said to have been back home on Thursday (29.06.23), but TMZ has reported she is bedridden and “constantly vomiting” as she recovers.

Kota Bharu council's fine on non-Muslim woman 'unlawful and misguided', says Bersatu

Bersatu today criticised the Kota Bharu City Council for its decision to fine a non-Muslim business owner for wearing "indecent" clothing, calling it both misguided and unlawful as well as liable to creating mistrust among Malaysians.

Sasha Lyna Abdul Latif, the deputy chairman of Bersatu's legal and constitution bureau, said the council's move to penalise the woman for wearing a T-shirt and shorts was void as it exceeded the authority granted under Section 102 of the Local Government Act 1976 to make by-laws.

"Section 102 only permits the council to make by-laws pertaining to 'health, safety and well-being'. No power is granted to regulate clothing or morality," she said.

She added that while shariah enactments could regulate the clothing of Muslims, local authorities had no power to do so.

"Hence, the summons issued to the non-Muslim woman business owner is void and unlawful. The best course for the council would be to cancel the summons and suspend the operation of Section 34(2)(b) (of the Business and Industrial Trade By-Laws 2019) pending review by the state authorities or exco."

In a statement, she added that the standard imposed on Muslim women to cover the "aurat", or parts of the body that must not be revealed according to the Islamic dress code, could not be imposed on non-Muslims.

"The word 'sopan' in Section 34 (2)(b) is vague and open to manifold interpretation," she said.

"It is unfair to subject the woman to a fine when the definition of the offence is unclear."

She also said that whether the woman's clothes were decent or not was a subjective matter.

"To establish that the clothes were 'indecent' would surely require some degree of indecency which is more than just being clad in T-shirt and shorts, such as, for example, partial nudity. This is clearly not the case here."

Calling the fine "unnecessary", she said it could also create mistrust among Malaysians of all races and religions.

"It can also be perceived to be unjust as it appears to be targeting women exclusively," she said.

BOSTON: The former director of marine operations for the US company whose Titanic tourism submersible is missing raised safety concerns before being fired, according to a 2018 lawsuit.

David Lochridge’s misgivings about the safety of the missing submersible, the Titan, are contained in a response he filed to a lawsuit brought against him by its owner, OceanGate.

A massive US and Canadian coast guard search effort is underway in the North Atlantic after the OceanGate submersible carrying five people went missing on Sunday during a dive to the wreck of the Titanic.

Lochridge, a submarine pilot and diver from Scotland, began working for OceanGate in May 2015 as an independent contractor before being promoted to director of marine operations, according to court documents.

In the lawsuit filed in Washington state five years ago, Oceangate accused Lochridge of violating a non-disclosure agreement by divulging confidential and proprietary information.

In a counterclaim, Lochridge said he was fired by OceanGate in January 2018 after he “raised critical safety concerns regarding OceanGate’s experimental and untested design of the Titan.”

“Lochridge first expressed verbal concerns over the safety and quality control issues regarding the Titan to OceanGate executive management,” the document said. “These verbal communications were ignored.”

Lochridge was concerned, the counterclaim said, about “the quality control and safety of the Titan, particularly OceanGate’s refusal to conduct critical, non-destructive testing of the experimental design of the hull.”

Passengers on the Titan could be exposed to danger as the submersible reached extreme depths, Lochridge warned.

In his filing, Lochridge said the viewing port at the forward end of the submersible was built to sustain a certified pressure of 1,300m, although OceanGate planned to take passengers down to depths of some 4,000m.

“OceanGate refused to pay for the manufacturer to build a viewport that would meet the required depth of 4,000m,” the document said.

The Titanic rests on the seabed at a depth of around 3,800m.

‘Unanimous concern’

Lochridge also “strongly encouraged” OceanGate to use a classification agency such as the American Bureau of Shipping to inspect and certify the Titan, the document said.

“Rather than address his concerns or undergo corrective action to rectify and ensure the safety of the experimental Titan, or utilise a standard classification agency to inspect the Titan, OceanGate did the exact opposite – they immediately fired Lochridge,” it said.

According to Insider and the New Republic, which first reported on the lawsuit, the complaint was settled out of court in November 2018.

OceanGate CEO Stockton Rush is one of the five people on board the Titan.

Besides the safety worries put forward by Lochridge, The New York Times on Tuesday published a March 2018 letter from the Marine Technology Society to Rush in which the industry group’s members voiced “unanimous concern” about the Titan.

“Our apprehension is that the current experimental approach adopted by Oceangate could result in negative outcomes (from minor to catastrophic) that would have serious consequences for everyone in the industry,” the letter said.

In 2018 Paul Wang left his home in Beijing to start a new life in Australia, investing US$680,000 (about RM3.1 million) in a food processing business in the hopes of qualifying for permanent residency under the country's investment visa scheme.

Five years on, his hopes for his family of three remain on hold as the government has put the controversial "Golden Visa" programme on the back burner, causing processing times to blow out, leaving wealthy migrants like Wang in limbo.

We were not expecting it would take this long," said Wang, 44. "And our life is a mess because of that. We simply cannot plan ahead with all of the uncertainty."

When Australia introduced the Business Innovation and Investment Programme (BIIP) in 2012, the hope was that wealthy business owners, investors and entrepreneurs would boost the economy by bringing in capital and driving innovation.

The results, though, have been underwhelming. A government review published in March found BIIP migrants contributed less to the economy than the average Australian, as the cohort, despite their wealth, tended to be older and earned lower incomes through capital returns on passive investments.

The review estimated the lifetime economic contribution of BIIP holders at A$600,000, less than half the US$1.6 million of Australians.

After coming to power 13 months ago, Australia's Labor government shifted priority to easing shortages of critical skilled workers. Partly as a result, most BIIP permanent visas are taking nearly three years to process, up from a previous average around 12 months, and in addition to an investment cycle of four to five years.

Wang has been waiting 21 months.

Similar investment visa schemes have been scrapped in Canada, Britain and Singapore as governments conclude they do not create jobs and could be a means to park speculative money.

Every category of Australian visas experienced a backlog during Covid-19. As the pandemic has eased, the government has cut processing times overall, but the wait for more than 3,000 BIIP holders and their families - many Chinese - has only lengthened.

'People won't sympathise'

Some BIIP applicants plan to protest in Sydney on Friday against the government's policy shift, a rarity as Chinese migrants largely avoid public dissent.

Asked about the visa delays, the Department of Home Affairs said in an emailed statement the government would process all visas in line with priority and planning levels, declining to comment on the complaints from BIIP holders.

It said a new migration strategy would be released later this year, which would include "radically reshaping" the BIIP programme.

The delays have raised concern that the government might scrap the BIIP programme, said Tony Le Nevez, managing director at residence and citizenship planners Henley & Partners Australia, whose clients have invested at least A$5 million each in the country.

"I just don't think the investor programme is on their radar at the moment - they might overhaul it down the track. In the meantime, I think they might just keep a small window open.”

The government plans to shrink its BIIP allocation from 5,000 visas last financial year to 1,900 this year - less than 20% of the level of earlier years.

BIIP holders say they are curtailing business investment given the uncertainty, postponing life decisions and in some cases selling properties in Australia. Some say they must hold on to loss-making businesses to keep their visa prospects alive, missing out on investments with greater returns.

"The forever wait means that even if I'm running my business at a loss, I cannot just close shop and move on," said Tan, a Chinese investor who owns a furniture shop in Melbourne and asked to be identified only by his surname due to privacy concerns. He has been waiting for 33 months.

Wang, who gave up on plans last year to buy more land for his factory because of the uncertainty of his visa status, said he was prepared to offload his assets in Australia and move to the US for his daughter's education next year.

"I know a lot of people won't sympathise with us - we're a small group of people," Wang said. "But we're not being treated fairly."

KUALA LUMPUR, June 14 — Former education minister Datuk Mohd Radzi Md Jidin today refuted a claim by Prime Minister Datuk Seri Anwar Ibrahim on the number of absent SPM candidates in last year’s national examinations.

Mohd Radzi noted that local news reports listed a total of 14,858 students absent from the final school leaving exams and not 30,000 as claimed by the prime minister during a dialogue session with undergraduates in Universiti Kebangsaan Malaysia yesterday.

Anwar had blamed Mohd Radzi for the high number of SPM student absenteeism post-pandemic for not taking care of them.

“There were only 14,858 students who were absent. Where did Anwar get 30,000?” the Opposition lawmaker questioned in a news conference at Parliament here.

The Bersatu MP for Putrajaya denied neglecting SPM students during his tenure as minister as claimed.

“I asked SPM parents and candidates whether they make it to the exams like whether they have enough money to go to exam halls. I took care of the students during my time,” he said.

He added that education should not be politicised.

“Education is important for our kids. We should never politicise education. That is why I'm staying away from commenting on any initiatives by the current minister.

“Anwar told everyone that when Fadhila Sidek came into the office, only then this type of issue was exposed to the public whereas I did nothing wrong and there's nothing to be said about during my time as minister.

“The massive 30,000 students sounded like a big thing to the public's ears but it's wrong to give away an incorrect number. Let's only talk about facts,” he said.

KUALA LUMPUR: The government should consider emulating Russia’s anti-LGBTQ propaganda law to protect the nation’s children, the Dewan Rakyat was told.

In welcoming the government’s move to introduce the Child Commission, Wan Ahmad Fayhsal Wan Ahmad Kamal (PN-Machang) said the proposed law would “protect” the children from LGBTQ-related content on both social and mainstream media, as well as “cultural products”.

“What the government did recently in confiscating Swatch watches was a good thing, if such items promote or propagandise LGBTQs,” he said while debating Suhakam’s 2020 report today.

“If we have laws like (that of) Russia, the government does not have to be fearful or apologetic in taking stern action to make sure that our family traditions and religion are preserved in the context of Malaysia’s human rights.”

The Russian law, which was passed last November criminalises any act regarded as an attempt to promote “non-traditional sexual relations” – in film, online, advertising or in public – and expands on a 2013 law that banned “propaganda of non-traditional sexual relations” to minors.

The passing of the law invited global backlash, with rights organisations saying that the law would effectively ban the promotion of LGBTQ rights for sexual and gender minorities in Russia.

Russia admits Ukraine making gains

Russian and Ukrainian forces are reporting intense fighting along the border of Ukraine’s eastern Donetsk and southern Zaporizhzhia regions as Kyiv’s military attempts to break through the front lines and recapture territory in an ongoing counteroffensive.

The new reports came as Russian missiles attacked the central Ukrainian city of Kryvyi Rih early Tuesday, killing at least six people and injuring 25, according to Oleksandr Vilkul, head of the Kryvyi Rih city military administration.

Air defenses shot down three cruise missiles over the city but there were also “incomings” that hit civilian infrastructure, authorities said, adding that a five-story apartment building was on fire.

The latest battle reports came from Moscow-backed officials and military bloggers who detailed clashes south of the town of Velyka Novosilka along both sides of the Mokri Yaly River, where Ukrainian forces have made gains in recent days.

Ukraine on Saturday seized several small villages along the river, according to geolocated video. And on Sunday, Ukraine’s deputy defense minister Hanna Maliar said Kyiv’s advances in the area amount to between 5 and 10 kilometers (3 to 6 miles).

Late Monday, a senior Russia-appointed official, Vladimir Rogov, spoke of heavy fighting in an area known as the Vremivka Ridge, claiming that higher ground remained under Russian control.

Rogov, a member of the Russian-installed Zaporizhzhia administration, said on Telegram that Russian attack helicopters were in action, and that in the vicinity of the village of Urozhaine, “reciprocal shelling and heavy fighting of ultra-high intensity continues.”

Rogov conceded that Ukrainian forces were “holding their positions on the northern and eastern outskirts of the village.”

Russian forces are trying to repel Ukraine’s breakthrough with counterattacks, according to the unofficial Russian Telegram channel, Operatsiya Z.

The channel said Monday that Ukrainian forces were trying to take higher ground to “create conditions for advancing,” and assessed that their aim was to advance toward the Russian-occupied hub of Staromlynivka.

There is no way to verify these unofficial reports, but they are consistent with a pattern in the fighting that has evolved in the last week.

“Our Donetsk” acknowledged that Russian troops had been forced to abandon Neskuchne – just south of Velyka Novosilka – for a second time, “retreating to positions where they would not be encircled.”

It said the Ukrainians were “accumulating forces” in the area, and heavy fighting continued.

Meanwhile, one of the most prominent Russian bloggers, Voenkor Kotenok, said late Monday that a senior Russian officer was killed as troops of Russia’s Fifth Army were forced to leave Makarivka.

Voenkor, who has 423,000 subscribers, said in a Telegram post that “as a result of an enemy missile attack, the Chief of Staff of the 35th Combined Arms Army, Major General Sergei Goryachev, was killed.”

There is no independent verification of the death of Goryachev, a highly experienced commander, and no word from the Russian Defense Ministry.

Another well-known Russian military blogger, WarGonzo, acknowledged Monday that earlier “victorious statements” about the situation in Makarivka were “premature.”

“The settlement is still a place of fierce fighting…The enemy is bringing in infantry in small groups, using light equipment, which makes it difficult to defeat them quickly,” the blogger said on Telegram.

“Despite expectations, we have failed to retake the village by the end of the day. We hope there will be success in this regard tomorrow.”

By contrast, Russian military bloggers are claiming that Ukrainian efforts to advance south of Orikhiv, in another part of the southern front, have been resisted, with several saying the Ukrainians had lost a significant number of demining tanks in an area known to have been heavily fortified by the Russians with minefields and tank traps.

n Ashdod resident was arrested on Tuesday on suspicion of having raped a new immigrant to Israel from Ukraine after he offered to show her around the city.

The investigation began approximately two weeks beforehand, when the 19-year-old new olah filed a report with the police.

According to the police report, the woman met the accused through a mutual friend. He pretended that he was also an oleh and offered to help her familiarize herself with the city of Ashdod.

During their time alone together, the 29-year-old suspect reportedly entered her house and raped her.

His detainment was extended until Thursday, at which point an indictment will likely be brought against him.

India's outsourcing giants cut hiring; disheartening for economy, students

ndia's outsourcing giants are slashing hiring and getting projects done with existing workers, a rare pullback that could weigh on the economy and affect engineering students who have seen information technology as the sector of choice for decades.

The slowdown, triggered by global uncertainty in demand, is unprecedented in an industry that is one of the biggest hirers in India's services sector since the 1990s and provides an assured career path and prosperity to hundreds of thousands of students each year.

"Weak IT hiring could be for two different reasons: short-term negative demand shock or a long-term displacement resulting from labour-saving technologies," said Rohit Azad, an economics professor at New Delhi's Jawaharlal Nehru University.

"The impact of weak hiring would depend on which is the primary cause driving it. A negative multiplier effect in the immediate would be there nevertheless," Azad added.

The IT sector accounts for about 8% of India's GDP versus less than 1% about 30 years back, according to Rishad Premji, the chairman of Wipro, one of the country's IT giants.

Overall, the Indian tech sector employs over 5.4 million people, according to trade group Nasscom, although the number is dominated by the IT sector. About 290,000 new jobs in the tech sector were created in the financial year that ended in March, but Nasscom warned of "global headwinds" in the current year.

With IT employees seen as big spenders on everything from cars, durables and second homes to travel and entertainment, they are likely to have had some effect on the sluggish 0.5% sequential growth in private consumption in January-March.

"Some slowdown in IT hiring intentions could contribute to the flat-lining in consumption that is already underway," said HDFC Bank Principal Economist Sakshi Gupta.

There are pockets of optimism elsewhere in the services sector - especially in accounting, where there is a surge in hiring. But the numbers are still dwarfed by the IT industry.

Recession fears

IT firms, which count global heavyweights such as Apple, Citigroup and American Express among its clients, went on a hiring binge during the pandemic that fuelled a digital services boom.

However, things changed this year as recession fears gripped the world and the collapse of three US regional banks and the forced sale of Europe's Credit Suisse to UBS left the global financial industry shaken, making IT clients across sectors cut spending.

"The post-pandemic phase saw companies ramping up production to meet new demands in the market, leading to a growth in hiring across IT companies. This boom, however, soon fizzled out in the face of the global economic crisis and a looming recession," said Sachin Alug, the CEO of staffing firm NLB Services.

NLB sees a 20-25% drop in IT employee additions in the first half of the current financial year, while TeamLease Digital expects a 40% decrease for the entire year.

Jobs portal Naukri.com's parent Info Edge flagged in May that its recruitment business was seeing "cautious" spending by IT customers.

IT bellwether Tata Consultancy Services said this month it had "recalibrated" its hiring after a drop in attrition. It added 22,600 people in the last financial year, taking its overall headcount to 614,795.

Infosys, another IT giant, warned in April its annual revenue growth would hit a six-year low and refrained from its usual practice of setting a target of fresh hires at the start of the financial year.

"We have a lot of bench with us. They are ready to move into production projects," Infosys CFO Nilanjan Roy said at the time.

Nasscom declined comment on the hiring slowdown.

Doom and gloom

The dismal outlook is worrying many students as the IT sector typically absorbs 20-25% of the 1.5 million engineers who graduate every year in India and was a rare bright spot during the pandemic, when most other industries put hiring on ice.

"Normally, on-campus hiring is easier than off-campus. This year, that kind of flipped," said Gautam, an engineering student in Punjab state, who declined to be identified further. "Some people had their internship revoked or full-time (job offers) revoked too due to cost-cutting."

He said some of his classmates have decided to study further as they have lost hope of finding a job.

IT firms such as LTIMindtree and Wipro have been accused by an employee's union of trying to cut costs by deferring joining dates and slashing starting salaries.

That has "surely left applicants concerned about future prospects", said staffing firm Xpheno's co-founder Kamal Karanth, who highlighted how current hiring activity was "under a third of what was recorded in the buoyant peak".

LTIMindtree did not respond to a request for comment.

Wipro did not directly address the accusations but said the environment was different from a year ago.

"The race to hire ahead of demand has been replaced by a more measured approach in light of the declining attrition rates and the ongoing economic uncertainty," it said.

No plan B

India's engineers might find it hard to find jobs even beyond the IT sector as startups too have been laying off employees in recent months due to a funding squeeze.

"Even if a few startups do absorb freshers, they would skim the cream off the top, and not match the high volume intakes that the IT services and product enterprises do," Karanth said.

Some industry veterans said Indian students may be better off looking at other industries.

"We have significantly different opportunities that are better sustainable as career paths" than two decades back, venture capital firm Siana Capital's founder Siddharth Pai said.

Pai highlighted sectors such as financial services, consumer goods, specialised manufacturing, medicine, law, chartered accounting and other services as more viable options.
