Najib's 1MDB trial to begin on May 14

KUALA LUMPUR (Bernama): The trial of former prime minister Datuk Seri Najib Razak, who faces 25 corruption and money laundering charges involving RM2.28bil in funds linked to 1Malaysia Development Berhad (1MDB), will take place for 14 days beginning May 14.

Judge Collin Lawrence Sequerah set the dates during case management at the High Court here Friday (April 5) - namely May 14, 15 and 17; May 28, 29, and 31; June 10, 11, 12, 13, 14; as well as June 18, 20 and 21.

The new dates were fixed after Najib's lawyer Harvinderjit Singh, 66, told the court that the original dates of the trial set from April 15 to May 3, would overlap with another case faced by the former premier involving misappropriation of funds from SRC International Sdn Bhd.

Harvinder informed High Court Judge Mohd Nazlan Mohd Ghazali that the hearing for the SRC case had been fixed beginning April 3, and would resume from April 15 to May 10.

“As a result, Justice Nazlan, who had fixed all the trial dates of 1MDB and an addition of a week from the 6th to 10th of May for the SRC International trial, it leaves us with three weeks in May, which is between 13th and 17th and the last week of May, which are the trial dates for Tan Sri Muhammad Shafee Abdullah's case.

"I would personally prefer to start with Shafee's case first as the case is much lighter and was registered earlier,” he said.

Judge Collin however refused, and said the court wished to proceed with the 1MDB case first, and set the trial dates for the 1MDB case on the dates originally set for Muhammad Shafee's case.

The money laundering case faced by Muhammad Shafee was previously set on May 14, 15 and 17; as well as May 28, 29 and 31.

The court then set April 16 for case management to fix the hearing dates of Muhammad Shafee's case.

Prosecution chief Datuk Seri Gopal Sri Ram did not object to the matter.

Najib has been charged with four counts as a public officer, namely prime minister, finance minister and 1MDB chairman, of using his position to attain gratification for himself.

In the first charge, he was alleged to be using his position to receive RM60,629,839.43 in gratification at AmIslamic Bank Berhad, Jalan Raja Chulan here, between Feb 24, 2011, and June 14, 2011.

On the second accusation, Najib was charged with using his position to obtain RM90,899,927.28 in the same place between Oct 31, 2012 and Nov 20, 2012, while in the third and fourth charges, he was alleged to have used his position to attain bribes worth RM2,081,476,926 and RM49,930,985.70.

The Pekan MP also faces 21 allegations of money laundering under the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds from Unlawful Activities Act 2001, involving 1MDB funds amounting to RM2.28bil.

Muhammad Shafee, meanwhile, was charged with two counts of money laundering, namely by receiving two AmIslamic Bank Berhad cheques from Najib amounting to RM4.3mil and RM5.2milrespectively, which were then deposited into two CIMB Bank Berhad accounts belonging to the former.

Muhammad Shafee also pleaded not guilty to two charges of money laundering by filing false income tax statements to the Internal Revenue Board, in contravention of Paragraph 113(1)(a) of the Income Tax Act 1967 for the financial years ending Dec 31, 2013, and Dec 31, 2014. - Bernama

Foreign donations, income reviewed on case-by case

KUALA LUMPUR, April 3 — The tax on foreign donations or income is reviewed on a case-by-case basis before any decision is made, said Inland Revenue Board (IRB) chief executive officer, Datuk Seri Sabin Samitah.

However, he declined to elaborate further, saying he was bound by the secrecy provision.

“We are not allowed to discuss tax matters with the public. However, I cannot generalise and it will be looked at on a case-by-case basis,” he told reporters after officiating the “Malaysia Baru Tax Reform Agenda – What’s Next” conference, here today.

He was answering questions on former prime minister Datuk Seri Najib Tun Razak’s reportedly RM1.5 billion tax bill, which includes the alleged RM2.6 billion donation from Saudi Arabia.

Meanwhile, Sabin said the IRB was confident of achieving its tax collection target of RM147 billion this year despite global economic challenges.

“We are on track so far. The amount collected will be used for government operations,” he said.

Sabin added that under the new government, the IRB would continue its commitment to strengthen the tax system by reforming it to ensure everyone pays their fair share.

“Tax reform is not all about new taxes. There are issues that need to be tackled such as under declaring income, falsifying documents and where taxpayers do not pay the right amount,” he said.

Earlier in his speech, Sabin urged Malaysians wishing to voluntarily declare their taxes to do so under the Special Voluntary Disclosure Programme (SVDP) before it ends on June 30, 2019, to be eligible for the reduction in penalty, after which the penalty would rise to 300 per cent.

“SVDP provides an opportunity for you to clear any outstanding tax issues, especially unreported or under declared, in the past,” he said.

418 civil servants arrested for graft last year

KUALA LUMPUR: A total of 418 government servants were arrested by the Malaysian-Anti Corruption Commission (MACC) last year, it was revealed at the Dewan Rakyat today.

Deputy Minister in the Prime Minister’s Department Mohamed Hanipa Maidin said 140 of them have been brought to court to face charges.

He was responding to a question from Datuk Seri Ikmal Hisham Abdul Aziz (PH-Tanah Merah) on the number of civil servants who have been arrested and charged for involvement in graft through the whole of 2018.

On a supplementary question on whether the government intends to limit the number of years a civil servant is allowed in a particular position or state to avoid corruption, Mohamed Hanipa said there was currently no such plan.

He said the current placement process based on time suitability and vacancy would remain, and that any moves otherwise would only take place if the situation called for it.

“At the moment, there are no plans (to reshuffle government staff). Although we admit that there is justification for such a move, we still feel that the situation now is under control.

“The current procedure will go on, unless the situation becomes desperate,” he said.

Mohamed Hanipa added that the government would continue with efforts introduced by the previous administration to fight graft as long as they bring positive changes.

This included the setting of an Integrity Unit in each government ministry and agency as had been previously introduced by Barisan Nasional (BN).

“Whatever good policies that were introduced by the previous government, we have no problem to continue with it. But I’m just curious, how come so many efforts were taken then but yet corruption was rampant,” he said, referring to the various graft charges that have been slapped on several BN leaders.

“So if we introduce the special court for corruption, the appeal will still go to the Appeal Court and then to the Federal Court.

“That means that corruption cases may not get the attention of the ordinary court,“ he said.

Mahathir said the judges for the special court must be appointed by the Yang di-Pertuan Agong, while the power of prosecution would come from the Attorney-General.

The Prime Minister said the meeting also decided that the song “Malaysia Bersih” (Clean Malaysia) will be sung in government functions after the singing of the national anthem “Negara Ku”.

“We want to instil in the minds of the government servants the importance of cleaning our nation of corruption so that we will no longer be known as kleptocratic (nation) and return to become a democracy,“he said.

Asked whether JKKMAR discussed the case involving 14 persons including seven civil servants who were protecting and receiving protection money from reflexology centre operators, Mahathir said it was not discussed in the meeting, however the committee was aware about the case.

“We will request the police and MACC (Malaysian Anti-Corruption Commission) to investigate,“ he said.

KUALA TERENGGANU: Apparently being proclaimed as a 'crown prince' by the djinn government some two months ago is not enough to keep this man away from the laws of the human government.

The 34-year-old is set to be charged at the Kuala Terengganu Syariah High Court this July 28.

He was arrested on suspicion of engaging in odd rituals that went against the teachings of Islam at the Bukit Bauk forest recently.

Pending his day in the human court, the man has been set free on the Terengganu Religious Affairs Department's (JHEAT) chief enforcement officer's bond.

The man from Dungun was nabbed at about 4.15pm last Sunday by a group of policemen.

The arrest was made after police received a report on the man allegedly acting suspiciously.

It is learned that the man had been using a surau in the Bukit Bauk area as his place of meditation. He then claimed that the djinn government proclaimed him as a crown prince (raja muda) two months ago.

Police seized a sofa, mimbar stick, two headstones and an umbrella that were found in the surau.

His odd behaviour resulted in Muslims there feeling a bit worried to utilise the surau for prayers.

Meanwhile, the man said he has no intentions of "abdicating his throne" despite getting arrested.

When met at the JHEAT office here, the man claimed he was a representative of the djinns in this universe and would discuss with the top leaders amongst the djinss before making a decision to "step down".

JHEAT deputy chief commissioner Nik Zulhaiza Ismail said the man would be charged under Section 6(b) of the Syariah Criminal Offences (Takzir) (Terengganu) Enactment 2001.

Nik Zulhaiza said the suspect's statement has been recorded under the provision of Section 23.

"We are in the midst of compiling all related information before presenting it to the public prosecutor," Nik Zulhaiza said today.

Under the Enactment, the suspect could face a fine of RM5,000 or jail of not more than three years or both, upon conviction.

It is unclear though if the man will be engaging a lawyer from the alleged djinn government or one who is not ethereal in nature.

All RM30b from Petronas will b used for tax refund

PARLIAMENT | The Dewan Rakyat was today told that the federal government will honour its commitment to disburse around RM37 billion in backlogged tax refunds this year.

So far, 54,603 registrants have received the refunds amounting to RM3.994 billion, said Deputy Finance Minister Amiruddin Hamzah (Harapan-Kubang Pasu).

This was in response to a question by Noraini Ahmad (BN-Parit Sulong) who sought an update on the refund process.

Putrajaya is financing the refunds through a RM30 billion special dividend payout by Petronas.

Noraini also sought an explanation on how Putrajaya would spend the RM10 billion "balance," claiming the backlogged GST refunds amounted to RM19.47 billion.

To this, Amiruddin (above) said the total refunds owed amounted to RM37 billion and therefore Noraini's suggestion that there would be a RM10 billion balance was invalid.
In August last year, Finance Minister Lim Guan Eng had revealed that Putrajaya owed RM19.397 billion in outstanding GST refunds since 2015.

As for the income tax and real property gains tax refunds, the amount was RM16.046 billion.

The Public Accounts Committee is investigating allegations that the previous administration had problems paying tax refunds. Its report is expected to be tabled in early April.

Sarawak parties see no future in Umno-PAS alliance

KUALA LUMPUR, March 8 ― Umno risks alienating its former allies in Sarawak and a key political bloc by entering into a pact with PAS as the ultra Malay political alliance will be seen as a liability to the ruling coalition's multiracial base.

The Coalition of Sarawak Parties (GPS) has already criticised the Umno-PAS alignment as a threat to progress, saying a single-race coalition would tear into the country’s multiracial fabric.

“Malaysia is a multiracial country hence no single race is able to dominate political control,” PBB vice-president Datuk Seri Stephen Rundi Utom said in a text reply to Malay Mail.

“To govern this country effectively we have to form coalitions...therefore Umno-PAS merge as a single race party, our future will be jeopardised.”

Rundi’s response underscores the growing divide between Borneo-based political parties and its former peninsula ally, which they feel have become too Malay-centric for Sarawak’s polity of highly diverse communities.

On Wednesday evening, Umno and PAS formally declared their alliance to mark the start of a political co-operation that would go on until the 15th general election.

The announcement in effect signalled the end of the Barisan Nasional coalition, according to its secretary-general Datuk Seri Nazri Aziz.

Some analysts warned a Malay-only political bloc could heighten communal tension, as the tussle for Malay votes intensifies.

This came after MCA and MIC said they would seek a “new” political platform, although Umno acting president, Datuk Seri Mohamad Hasan, played down the fissure, saying yesterday that the two parties will likely remain with BN.

Sarawak’s political leaders have watched closely as chaos engulf its former allies.

With BN erupting and Umno drifting further to the right, aligning with moderate Pakatan Harapan will seem more practical for a coalition with a predominantly non-Malay base like GPS, said Jeniri Amiri, political analyst with Unimas, Sarawak.

“You have to remember in Sarawak, non-Malays are the majority,” he said.

“It would be in their (GPS) interest to stay away from working with Umno and PAS...it’s for their political own survival.”

Rundi reaffirmed the view.

When asked if GPS saw itself with Umno and PAS in the future, he said the coalition will maintain a “multiracial stance”.

“We maintain our multiracial stance through coalitions,” he told Malay Mail.

PBB, Sarawak’s ruling party, forms the largest faction in GPS, followed by the Sarawak United People’s Party, the Sarawak People’s Party and the Progressive Democratic Party.

The four were the first to quit BN after its ouster last year. It is now an independent political bloc that has cordial ties with PH.

Sarawak has 31 parliamentary seats and was until its departure a powerful “vote bank” for BN.

Together with Sabah, also governed by a PH-friendly independent bloc, the two states provide a fourth of the 222 parliamentary seats.

Clare challenges Hadi to reveal confidential Doc

Sarawak Report editor Clare Rewcastle-Brown has challenged PAS president Abdul Hadi Awang to reveal his version of the confidential terms to their out-of-court settlement in January.

This is after Hadi denied paying RM1.4 million to the Briton in order to settle his defamation suit against her.

"If he says those weren't the confidential terms of agreement that were cited by the court order, then he really needs to come out and say what were the confidential terms of settlement.

"He can’t just deny it. If there were confidential terms, and it wasn’t my payment, what does he think it was?" Rewcastle-Brown told Malaysiakini last night.

She added that she had documents to prove that she had been paid RM1.4 million, and was confident it was paid on behalf of Hadi and PAS.

Hadi yesterday said that neither he nor PAS had paid off Rewcastle-Brown, as they did not have the financial means to make the payment.

According to Berita Harian, he also claimed that "certain quarters" had approached him prior to the 14th general election to settle the suit, but he refused to do so at the time because of the polls.

The Sarawak Report editor had previously said the payment was made by an intermediary, and confirmed to Malaysiakini that it was KTMB chairperson Rameli Musa (photo).

She said she had no doubt that Rameli was acting on behalf of Hadi and PAS.

This, she said, is because Rameli had to keep going back for approval from PAS and Hadi after she rejected the party president's initial offer to pay her GB£100,000 (RM536,064) to drop the suit.

"He had to go back to ask them, and so it went on until eventually we arrived at the sum which I found to be sufficient to pay my lawyers without losing too much money over this case.

"It was clear that Hadi was being consulted at every turn and the people around him," she said.

She added that Hadi's lawyers in London were also privy to the confidential payment as they had to draw up the terms of the settlement for the court.

'Was it a loan or donation?'

Meanwhile, Rewcastle-Brown also questioned PAS' financial status.

Berita Harian had quoted Hadi as saying yesterday that PAS was so poor that it had to take up loans to pay for its deposits in the last general election.

However, Rewcastle-Brown cited remarks by PAS central committee member Mohd Zuhdi Marzuki (photo) last April, claiming the party had received RM2.5 million as a donation from an individual.

"So which was it? Was it a loan that they had to pay back or was it a donation from a party well-wisher?

"What we do know is that the money went to the seat deposits and a lot of that money would have now come back in," she said.

Sarawak Report had claimed that the RM2.5 million used for seat deposits had actually come from Umno, which PAS denies.

Hadi had sued Rewcastle-Brown in London over a 2016 Sarawak Report article claiming that then prime minister Najib Abdul Razak channelled RM90 million to top PAS leaders in a bid for support ahead of the 14th general election.

On Feb 1, the PAS president subsequently agreed to settle the suit with Sarawak Report and keep the conditions confidential.

Najib has denied the allegation by the whistleblower site, while the MACC is currently investigating the matter.

The statement comes a day after PAS chief Abdul Hadi Awang said his party wants to unite all Malay parties, including Dr Mahathir Mohamad’s PPBM, which is part of the ruling Pakatan Harapan.

PPBM chief strategist Rais Hussin said his party was committed to PH’s cause and believed in “less politicking and more delivering”.

“PAS is more into politicking. They use religion as a trade. They are merchant traders of Islam and they will do whatever they need to survive,” he told FMT.

After announcing his party’s alliance with Umno, Hadi had said: “We need to unite the Malay parties – PAS, Umno and PPBM. PKR is not a Malay party, Amanah is not a Malay party.”

Rais said PAS had unfortunately turned into a “cult” and working with it would not benefit anyone.

He added that the same PAS leaders, who announced an alliance with Umno today, had approached PPBM in 2015.

“PAS has never been consistent. The only thing consistent about them is being inconsistent with their principles.

“They just trade using Islam. They use Arabic terminologies and quote the Quran to hoodwink followers,” Rais said, stressing PPBM had no intentions of working with PAS.

PAS asks for Putrajaya's help

The PAS-led Kelantan government has requested for Putrajaya to restart the "Lebuhraya Rakyat" (people's highway) project which the state government had previously tried to build with the help of public donations but later scrapped the plan.

Economic Affairs Minister Azmin Ali, who is on a two-day visit to Kelantan, said a formal request had been made to the federal government.

"We were informed today that the Kelantan government had submitted an official request to the federal government to take over the Lebuhraya Rakyat project which was previously shelved by the state government.

"This was due to the company, which received the contract, being unable to continue with the construction of the 10km highway which would have cost RM200 million," he told a press conference in Kota Bharu today.

Earlier, Azmin had chaired the Kelantan Action Council meeting.

In 2017, the state government announced that the Lebuhraya Rakyat trust fund had collected a total of RM3.2 million over a period of five years to help fund the highway.

However, the highway project, which was supposed to be completed in March 2018, was terminated in a mutual agreement between Jabatan Kedua Sdn Bhd and the state government.

Azmin said he will ask the Works Department to look at the Kelantan government's request, stating that the highway was an important link for the Central Spine Road.

"We don't want a disconnect as the Lebuhraya Rakyat sits in the middle of the Central Spine Road. It would be unreasonable for us to complete the Central Spine Road without considering the Lebuhraya Rakyat which was abandoned by the Kelantan government," he said.

Azmin added that the PAS-led Kelantan government should also be open to development initiatives by the Pakatan Harapan-led federal government.

"Our wish is to set aside political ideologies and for the state and federal government to develop the state together in the interest of the people of Kelantan," he said.

The Lebuhraya Rakyat is meant to connect Kota Bharu with Kuala Krai while the Central Spine Road connects Kuala Krai to Kuala Pilah.

Rahman said there was nothing to be ashamed about being in the opposition as it was an important responsibility in a democracy.

"If there is no opposition, then the government can do whatever it wishes," he said.

The former minister also dismissed justifications that the representatives were defecting so that their constituencies will continue to see development.

In reality, he claimed, it was for position and power.

Rahman, who was defeated in the Sepanggar parliamentary seat in the last general election, questioned why the elected representatives were defecting to the government which has cut or reduced various subsidies to the people.

He said the defectors should resign to allow a by-election and also urged the people to reject them if they stayed on until the next general election.

KUALA LUMPUR, March 7 — Datuk Seri Hadi Awang alleged he was directed by unnamed parties to abandon his defamation lawsuit in the UK against Sarawak Report (SR) that accused his party leaders of taking RM90 million from Umno.

He purported that he was approached before the general election by a person he did not identify, who supposedly asked him to withdraw the lawsuit against SR editor Clare Rewcastle-Brown.

Hadi claimed he had been reluctant then due to the looming 14th general election but changed his mind after its result.

“When we found out we won Kelantan and Terengganu, did well in Kedah and gained more seats in Pahang, it was a political victory for us.

“Considering the lawsuit was a political case, and because we managed to win (in the elections), so we retracted the case,” he said after attending the monthly religious assembly at the Terengganu state secretariat building today.

Hadi denied that either he or the party paid Rewcastle-Brown RM1.4 million in legal costs to withdraw his lawsuit against her.

The payment is now believed to have come from the chairman of a government-linked corporation thought to be close to Hadi. The Malaysian Anti-Corruption Commission (MACC) had called in the person for questioning over the payment.

Today, Hadi said PAS was a “poor party” that depended on contributions.

“Some even had given us loans during the elections to cover our deposits,” he said when claiming his party was being singled out with the allegation that it received the RM90 million in return for backing Umno.

The two Opposition parties have now combined in a “marriage” announced by acting Umno president Datuk Mohamad Hasan.

The MACC is still investigating PAS over the RM90 million allegation.

Hadi had sued Rewcastle-Brown in 2017 over a report the previous year alleging PAS leaders took RM90 million to support Umno and Barisan Nasional ahead of the 14th general election.

He inexplicably withdrew the lawsuit filed in London, UK, this year, prompting views that he was no longer disputing the accuracy of the report that remains on the Sarawak Report website.

PKR president Datuk Seri Anwar Ibrahim subsequently divulged that Hadi had to pay Rewcastle-Brown RM1.4 million to terminate the suit, which she has since confirmed.

Today, Hadi claimed he is not interested in accepting Anwar’s challenge for the former to sue him over the disclosure.

“We don’t want to spend too much time with summons and suits, it takes a lot of time and costs a lot of money.

“We will only ask for the prayers from all over the country, maybe they can have a sembahyang hajat tonight,” he said.

PAS Youth chief questioned by MACC in 90m probe

PAS Youth chief Muhammad Khalil Abdul Hadi had his statement recorded at the MACC headquarters in Putrajaya today in relation to the RM90 million his party allegedly received from Umno.

The matter was revealed by PAS Youth assistant secretary for diplomatic and external affairs Muhd Khidir Izaidin.

According to Khidir, Khalil was questioned for over an hour by the commission.

"He cooperated well by providing sincere answers to the questions posed," he said in a statement.

Khalil, the son of PAS president Abdul Hadi Awang, was alleged to be the owner of a high-powered motorcycle purchased with the funds in question, which he has denied.

According to Khidir, the motorcycle belongs instead to PAS Youth secretary Afnan Hamimi Taib Azamudden, an independent preacher and a petrol station operator for the past 12 years.

Afnan Hamimi had proclaimed himself the owner of the motorcycle on his Facebook page yesterday.

The MACC launched its investigation into the funds after Hadi withdrew his defamation suit against Sarawak Report editor Clare Rewcastle-Brown.
A 2016 article on the whistleblower site alleged that then-premier Najib Abdul Razak channelled RM90 million to top PAS leaders in a bid to secure their support ahead of the 14th general election.

Najib has denied the allegation.

Several PAS leaders have thus far been called for questioning by the MACC, including spiritual leader Hashim Jasin, secretary-general Takiyuddin Hassan, central committee member Nik Abduh Nik Abdul Aziz, and former party deputy president Nasharudin Mat Isa.

The wife of KTMB chairperson Rameli Musa has claimed that those who received help from her husband are now keeping their distance.

In a Facebook post yesterday, Norlella Md Akram said those who her husband assisted are not even expressing sympathy, now that her husband is facing MACC investigations.

"Does Islam teach us to ignore those who helped us when we get into trouble for helping them?

"There is no (show of) sympathy or even a courtesy call from those who we helped. The truth will prevail," she wrote.

Norlella had accompanied Rameli to the MACC headquarters in Putrajaya for questioning yesterday.

Rameli is widely believed to have paid RM1.4 million to Sarawak Report editor Clare Rewcastle-Brown on behalf of PAS president Abdul Hadi Awang.

The payment, according to Rewcastle-Brown, was part of their settlement following Hadi's decision to withdraw a defamation suit against her.
The MACC has frozen a number of assets, bank accounts and cars belonging to PAS leaders as part of investigations into the party’s source of funding.

Hadi had sued Rewcastle-Brown for publishing an article on Sarawak Report which, among others, suggested that PAS was paid RM90 million by Umno several years ago.

The PAS president has not explained why the suit was withdrawn, or whether the settlement meant that he now accepted Rewcastle-Brown's claim.
